) A F F I D A V I T I, Rosa Carnalna Belicario, 71 years old, single and a resident of 324 B. Aranas Extension, Barangay Duljo Fatima, Cebu City, after having duly sworn to in accordance with law states that; That, I know Mr. NARIO SERNA personally being my neighbour for a long time who stayed at the vicinity four (4) houses away from our residence. Lately, the house of Narios sister-in-law, namely, Josefina Martinez was demolished by the City Government of Cebu the day before the hereunder incident happened. The respondent took the blame on the affiant, being the president of C. Padilla, B. Aranas Ext. Urban Poor Home owner Association, Incorporated; That, at around 7:00 oclock in the morning on January 24, 2013, I was at the ground floor of our two (2) stories house sitting in one of the corner of our house which is not visible outside of the residence, while watching an early television show, I heard a commotion outside which I did not mind at first, however, when I heard my name, I pip at the window and saw the respondent looking at the window of the second floor without noticing that I was at the ground floor; That, he angrily shouted a defamatory and threatening words against me by saying maam rose, gawas diha ongo! Ako gol-golon imo ubol-ubol Maam rose, come out you witch, I will slit your throat; That, I avoided altercation. I sit down again and hide for fear that he might hurt me and the other members of the family; That, such an incident for me is a defamatory and threat to my life which causes me emotional pain, embarrassment, fear for loss of life, and sleepless night; That, on February 28, 2013. I decided to have the incident reported at the Barangay with the purpose of resolving the same at the barangay level but since, we did come out in terms, the Lupon has issued a certificate to file action; and That, I am executing this affidavit in order to file a civil and criminal case against the respondent for oral defamation, grave threat, and violation of R.A. no. 9994 against MR. NARIO SERNA of legal age, married and a resident of sitio Carbarex, B. Aranas Ext., Barangay Duljo-Fatima, Cebu City.
