1. This Act may be cited as the Constitutional Review (Amendment) Act, 2013 and shall be read as one with the Constitutional Review Act, hereinafter referred to as the principal Act.

Amendment of section 3

2. The principal Act is amended in section 3, by inserting in the appropriate alphabetical order the following new definitions: Draft Constitution means the draft constitution prepared by the Commission under this Act; Standing Orders means the Standing Orders of the Constituent Assembly made under this Act. 3. The principal Act is amended in section 20 by deleting subsection (4) and substituting for it the following: (4) Notwithstanding the dissolution of the Commission under section 37(1), the Clerk of the Constituent Assembly may, upon consultation with the Chairman of the Constituent Assembly, invite the Chairman, Vice Chairman or any other member of the dissolved Commission to give clarification which may be required during the debates of the Constituent Assembly.

4. Section 22 of the principal Act is amended(a) by deleting the opening phrase of paragraph (c) appearing in subsection (1) and substituting for it the following: (c) one hundred and sixty six members appointed by the President in agreement with the President of Zanzibar from the following:

(b) deleting paragraph (vi) and substituting for it the following: (vi) the Trade Union Organisations; (c) by inserting the following provisions after subsection (2): (2A) The President shall invite each group specified under subsection (1) (c) to submit to him a list of not more than nine names of persons for appointment of three persons from the list as members: Provided that, the list shall, for every name proposed, indicate the age, gender, experience, qualifications and place of abode of such person. (2B) In appointing members of the Constituent Assembly under subsection (1)(c), the President shall have regard to: (a) qualifications and experience of persons nominated; and (b) gender balance.
Addition of section 22A

5. The principal Act is amended by(a) adding immediately after section 22 the following new section: Interim 22A.-(1) Without prejudice to the Chairman provisions of section 23, after the convening of the Constituent Assembly, the Clerk of the National Assembly and the Clerk of the House of Representatives shall manage and supervise the process of electing the Interim Chairman of the Constituent Assembly who shall preside

over the proceedings of the Assembly for the purposes of: (a) developing and adopting the Standing Orders of the Constituent Assembly; and (b) conducting the election of the Chairman and Vice Chairman of the Constituent Assembly. (2) The Interim Chairman elected by the Constituent Assembly under subsection (1) shall not be eligible to contest for the chairmanship of the Constituent Assembly.
Amendment of section 23

6. The principal Act is amended in section 23 by(a) adding immediately after subsection (3) the following: (4) A member shall not be eligible for nomination or election as a Chairman or Vice Chairman unless that member(a) possesses a degree from a recognized university; (b) possesses proven experience and competence in chairing public assemblies or fora; (c) has not been convicted by any court in the United Republic and sentenced to a term of imprisonment exceeding six months for any offence involving dishonesty and moral turpitude.

(5) Procedure for application, nomination and election of Chairman and Vice Chairman shall be as may be prescribed in the Standing Orders. (b) renumbering subsections (4), (5) and (6) as subsections (6), (7) and (8) respectively;
Amendment of section 24

7. The principal Act is amended in section 24 by(a) deleting subsection (4) and substituting for it the following: (4) The Clerk of the Constituent Assembly shall, upon consultation with the Deputy Clerk, select such number of staff from the National Assembly, the House of Representatives, Offices of the Attorney General of the United Republic and Zanzibar and from other public institutions, as may be necessary for better performance of the functions of the Constituent Assembly. (5) The staff selected under subsection (4) shall be under secondment for the prescribed period of the Constituent Assembly. (b) renumbering subsection (5) as subsection (6). 8. The principal Act is amended in section 26 by adding immediately after subsection (2) the following: (3) Where the support of two third majority of the total number of members is not attained as required under subsection (2), the Chairman of the Constituent Assembly shall identify issue or issues in controversy for the purpose of voting for the second time in respect of such issue or issues.

(4) The issue or issues as identified under subsection (3) shall be passed by the Constituent Assembly based on the support of two third majority of the total number of members hailing from Mainland Tanzania and two third majority of the total number of members hailing from Tanzania Zanzibar. (5) Where the support of two third majority is not attained as required under subsection (4), the Constituent Assembly shall vote for the third time, and the issue or issues shall be determined by simple majority of the total number of members hailing from Mainland Tanzania and simple majority of the total number of members hailing from Tanzania Zanzibar. (6) Upon completion of voting under subsection (5), the proposed Constitution shall be deemed to have been passed by the Constituent Assembly and the provisions of the Referendum Act shall apply. (7) Procedures for voting under this section shall be as prescribed in the Standing Orders.
Amendment of section 27

9. The principal Act is amended in section 27 by deleting subsection (2) and substituting for it the following: (2) There shall be freedom of opinion in the debates of the Constituent Assembly and such opinion of the members shall not be questioned in any court or place outside the Constituent Assembly. (3) The procedure of debates in the Constituent Assembly shall be prescribed in the Standing Orders.

10. The principal Act is amended in section 28 by adding immediately after subsection (2) the following provision: (3) Without prejudice to subsections (1) and (2), the Constituent Assembly shall deliberate on the Draft Constitution within a period not exceeding seventy days from the date on which the Constituent Assembly convened. (4) The Chairman of the Constituent Assembly, after consultation with the Vice Chairman may, upon approval by the President in agreement with the President of Zanzibar, extend the period under subsection (3) for such period as may be appropriate to accomplish the functions of the Constituent Assembly. 11. The principal Act is amended in section 37 by deleting subsection (1) and substituting for it the following:
Dissolution of Commission

Amendment of section 37

37.-(1) Upon submission of the Draft Constitution to the Constituent Assembly under section 20(3), the President shall, by Order published in the Gazette, dissolve the Commission.

1. Muswada huu utaitwa Muswada wa Sheria ya Marekebisho ya Sheria ya Mabadiliko ya Katiba, mwaka 2013 utasomwa pamoja na Sheria ya Mabadiliko ya Katiba, ambayo itajulikana katika Sheria hii kama Sheria mama.

Marekebisho ya kifungu cha 3

2. Sheria mama inafanyiwa marekebisho katika kifungu cha 3 kwa kuingiza katika mtiririko wa kialfabetiki tafsiri mpya zifuatazo:Rasimu ya Katiba maana yake ni Rasimu ya Katiba ambayo imetayarishwa na Tume chini ya Sheria hii; Kanuni maana yake ni Kanuni za Bunge Maalum la Katiba zilizotungwa chini ya Sheria hii. 3. Sheria mama inafanyiwa marekebisho katika kifungu cha 20 kwa kufuta kifungu kidogo cha (4) na kuweka badala yake kifungu kifuatacho: (4) Bila kujali kuvunjwa kwa Tume chini ya kifungu cha 37(1), Katibu wa Bunge Maalum anaweza, kwa kushauriana na Mwenyekiti wa Bunge Maalum, kumwalika Mwenyekiti, Makamu Mwenyekiti au Mjumbe yeyote wa Tume ilivyovunjwa ili kutoa ufafanuzi unaoweza kuhitajika wakati wa mjadala wa Bunge Maalum. 4. Sheria mama inafanyiwa marekebisho katika kifungu cha 22 kwa: (a) kufuta maneno ya utangulizi kwenye aya (c) yanayojitokeza katika kifungu kidogo cha (1) na badala yake kuweka aya ifuatayo: (c) wajumbe mia moja sitini na sita watakaoteuliwa na Rais kwa kukubaliana na Rais wa Zanzibar kutokana na wafuatao;

(b) kufuta aya (vi) na badala yake kuweka aya ifuatayo: (vi) Shirikisho la Wafanyakazi; (c) kuongeza baada ya kifungu kidogo cha (2), vifungu vifuatavyo: (2A) Rais ataalika kila kundi lililoainishwa katika kifungu kidogo cha (1)(c) kuwasilisha kwake orodha ya majina ya watu wasiozidi tisa kwa madhumuni ya uteuzi wa watu watatu kutoka kwenye orodha kuwa Wajumbe wa Bunge Maalum: Isipokuwa kwamba, orodha hiyo itaonesha, kwa kila jina linalopendekezwa, umri, jinsi, uzoefu, sifa na mahali anapotoka mtu huyo. (2B) Katika kuteua wajumbe wa Bunge Maalum chini ya kifungu kidogo cha (1)(c), Rais atazingatia: (a) sifa na uzoefu wa watu waliopendekezwa; na (b) usawa wa kijinsia.

Sheria Mama inarekebishwa kwa(a) kuongeza baada ya Kifungu cha 22 Kifungu kipya kama ifuatavyo: Mwenyekiti 22A.-(1) Bila kuathiri masharti ya wa muda kifungu cha 23, baada ya kuitishwa kwa Bunge Maalum, Katibu wa Bunge la Jamhuri ya Muungano wa Tanzania na Katibu wa Baraza la Mapinduzi watasimamia mchakato wa kumchagua Mwenyekiti wa muda wa Bunge Maalum

atasimamia na kuongoza Bunge Maalum kwa madhumuni ya(a) kusimamia uandaaji na kupitishwa kwa Kanuni za Bunge Maalum; na (b) kuendesha uchaguzi wa Mwenyekiti na Makamu Mwenyekiti wa Bunge Maalum, (2) Mwenyekiti wa muda aliyechaguliwa na Bunge Maalum chini ya kifungu kidogo cha (1) hatakuwa na sifa ya kugombea nafasi ya uenyekiti wa Bunge Maalum.

6. Sheria Mama inarekebishwa katika kifungu cha 23 kwa(a) kuongeza baada ya kifungu kidogo cha (3) kifungu kifuatacho: (4) Mjumbe wa Bunge Maalum hatastahili kuteuliwa au kugombea nafasi ya kuwa Mwenyekiti au Makamu Mwenyekiti isipokuwa kama Mjumbe huyo(a) amehitimu shahada kutoka katika Chuo Kikuu kinachotambulika; (b) amethibitika kuwa na uzoefu na ujuzi wa kuongoza mihadhara au mabaraza; (5) Utaratibu wa maombi, uteuzi na uchaguzi wa Mwenyekiti na Makamu wa Mwenyekiti utakuwa kama utakavyoainishwa kwenye Kanuni.

(b) kubadilisha kifungu kidogo cha (4),(5) na (6) kuwa kifungu kidogo cha (6), (7) na (8) ipasavyo. (c) hajawahi kutiwa hatiani na Mahakama yoyote katika Jamhuri ya Muungano na kuhukumiwa kifungo kisichozidi miezi sita kwa kosa lolote linalohusu uvunjifu wa Uaminifu wa Maadili.

7. Sheria Mama inafanyiwa marekebisho katika kifungu cha 24 kwa(a) kufuta kifungu kidogo cha (4) na kuweka badala yake kifungu kifuatacho:(4) Katibu wa Bunge Maalum baada ya kushauriana na Naibu Katibu na taasisi za umma, atachagua idadi ya watumishi kutoka miongoni mwa watumishi wa Bunge la Jamhuri ya Muungano, Baraza la Wawakilishi, Ofisi za Wanasheria wa Jamhuri ya Muungano na Zanzibar na taasisi nyingine za umma kwa kadri itakavyohitajika kwa madhumuni ya utekelezaji bora wa shughuli za Bunge Maalum. (5) Watumishi walioteuliwa chini ya ibara ndogo ya (4), wateuliwe kwa masharti ya kuazimwa katika kipindi chote cha Bunge Maalum. (b) kubadilisha kifungu kidogo cha (5) kuwa kifungu kidogo cha (6). 8.-(1) Sheria Mama inarekebishwa katika kifungu cha 26 kwa kuongeza baada ya kifungu kidogo cha (2) vifungu vifuatavyo:(3) Pale ambapo theluthi mbili ya idadi ya jumla ya Wajumbe haijafikiwa kama inavyotakiwa chini ya

kifungu kidogo cha (2), Mwenyekiti wa Bunge Maalum atabainisha suala au masuala yaliyobishaniwa kwa madhumuni ya kupigiwa kura kwa mara ya pili (4) Suala au masuala yaliyobainishwa chini ya kifungu kidogo cha (3) yatapitishwa na Bunge Maalum kwa kuzingatia kuungwa mkono kwa theluthi mbili ya wajumbe wote kutoka Tanzania Bara na theluthi mbili ya wajumbe wote kutoka Tanzania Zanzibar. (5) Pale ambapo kuungwa mkono kwa theluthi mbili hakujafikiwa kama inavyotakiwa chini ya kifungu kidogo cha (4), Bunge Maalum litapiga kura kwa mara ya tatu, na suala au masuala yataamuliwa kwa wingi wa kura za jumla za wajumbe kutoka Tanzania Bara na kwa wingi wa kura za jumla za wajumbe kutoka Tanzania Zanzibar. (6) Baada ya kupiga kura chini ya kifungu kidogo cha (5), Katiba inayopendekezwa itachukuliwa kuwa imepitishwa na Bunge Maalum na masharti ya Sheria ya Kura ya Maoni yatatumika. (7) Utaratibu wa kupiga kura chini ya kifungu hiki utakuwa kama utakavyoelezwa katika Kanuni za Bunge Maalum.

9. Sheria mama inafanyiwa marekebisho katika kifungu cha 27 kwa kufuta kifungu kidogo cha (2) na kuweka badala yake vifungu vidogo vifuatavyo:(2) Kutakuwa na uhuru wa maoni katika mijadala ya Bunge Maalum na maoni ya wajumbe hayatahojiwa mahakamni au sehemu yoyote nje ya Bunge Maalum. (3) Utaratibu wa kuendesha mijadala katika Bunge Maalum utaainishwa katika Kanuni.

Marekebisho ya kifungu cha 28

10. Sheria mama inafanyiwa marekebisho katika kifungu cha 28 kwa kuongeza baada ya kifungu kidogo cha (2) kifungu kidogo kifuatacho: (3) Bila kuathiri masharti ya kifungu kidogo cha (1) na cha (2), muda ambao Bunge Maalum litajadili Rasimu ya Katiba hautazidi siku sabini kuanzia tarehe ambayo Bunge Maalum lilipoitishwa. (4) Mwenyekiti wa Bunge Maalum, baada ya kushauriana na Makamu Mwenyekiti, anaweza, kwa ridhaa ya Rais baada ya kushauriana na Rais wa Zanzibar, kuongeza muda uliotolewa chini ya kifungu kidogo cha (3) kwa kipindi kitakachofaa kukamilisha shughuli za Bunge Maalum. 11. Sheria mama inarekebishwa katika kifungu cha 37 kwa kufuta kifungu kidogo cha (1) na kuweka badala yake kifungu kifuatacho:Kuvunjwa 37.-(1) Baada ya kuwasilishwa kwa kwa Tume Rasimu ya Katiba kwenye Bunge Maalum chini ya kifungu cha 20(3), Rais, kwa amri iliyochapishwa kwenye Gazeti la Serikali, ataivunja Tume.
