And, heres a case to prove the point: RCMP officer Adam Jonathan Clarke received one day in jail and three years probation after he pleaded guilty to attempting to lure a 12-year-old Langley girl, and a 15-year-old Richmond girl through the website Nexopia while on duty. What one day in jail?? And, with the help of the new RCMP Commissioner Robert Paulson another RCMP officer charged was kept from the public: Court documents show that Const. Andrew Ugrica was charged on Aug. 10 with one count of possession of child pornography. Since then he has made two court appearances, but the Mounties had not publicly announced the charges. Hello, hello!! Something screwy there - Canadian Prime Minister Stephen Harper?? Something screwy there - RCMP Commissioner Robert Paulson?? And to give some idea what RCMP Commissioner Robert Paulson is like - the first thing he did as the RCMP commissioner was to cheat the Canadian people by using on-duty RCMP officers for his wedding??

As cited in the Globe and Mail, published Thursday, Aug. 29 2013, in an article entitled Harper unveils plans for tougher laws against child sex offenders: Prime Minister Stephen Harper is proposing new legislation that would increase penalties for those convicted of sexually exploiting children. We must create a justice system that is more responsive to victims, and especially more responsive to children and to the families of children who have been victimized by sexual predators, Mr. Harper told a room full of cabinet ministers, senators, police officers and journalists during a visit to Toronto. Among the proposals is a move to ensure offenders convicted of exploiting multiple children will serve their sentences consecutively one after another instead of at the same time. As well, the Prime Minister hopes to increase maximum and minimum penalties for child sexual offenders, and ensure that spouses of those charged with child pornography will have to testify in court. Mr. Harper declined to say what he hopes the new penalties will be, saying the details will be decided upon in parliament. More than 3,900 sexual assaults against children were reported to Canadian police in 2012, according to a news release from the Prime Ministers Office. This is an increase of three per cent from 2011. Mr. Harper criticized the justice system as having become progressively unbalanced and skewed in favour of offenders. Indeed, the system has become profoundly centered on the welfare of the criminal, he said. He brought up the example of Gordon Stuckless who pleaded guilty to sexually assaulting 24 boys and was sentenced to two years less a day in 1997. The sentence was appealed and extended to five years. Mr. Stuckless got parole after serving twothirds of his five year term. A very worthwhile cause and suggestion by Canadian Prime Minister Stephen Harper!! He deserves a pat on the back for that idea!! 6

Langley RCMP officer Adam Jonathan Clarke was charged in June with two counts of child luring for allegedly using a community police office computer to convince a 12- and 15-year-old girl to produce child pornography for him.1 What happened to these charges against RCMP officer Adam Jonathan Clarke? In April, Adam Jonathan Clarke, a former Langley RCMP officer, received one day in jail and three years probation after he pleaded guilty to attempting to lure a 12year-old Langley girl, and a 15-year-old Richmond girl through the website Nexopia while on duty.2 What, one day in jail for luring TWO children, one age 12 and one age 15?? Justin Harris was suspended with pay in September 2004 and accused under the RCMP Act of behaving in a "disgraceful manner, accused of having sex with underage prostitutes.2 RCMP Const. Justin Harris was one of nine officers in Prince George named in investigative reports alleging links to underage prostitutes.3 One of the women said she was between the ages of 13 and 15 when she had sex with Harris, who is now in his early 30s.4 That woman, who can be publicly identified only as C.C., told investigators Harris once paid her $60 for oral sex and struck her in the face when she refused to perform the act.5 Incredibly, but quite typical of the RCMP, Const. Justin Harris had the disciplinary charges against him thrown out because the Mounties took too long to bring their case against him.6 Deputy RCMP Commissioner Gary Bass lifted the suspension in April and ordered Harris reinstated as a full-time RCMP officer.7 Harris lawyer Reginald Harris argued the Mounties failed to meet that standard in his clients case because senior members of the force including assistant commissioner Gary Bass were aware of the allegations as early as July 2002.8 In other words, the RCMP purposefully dragged their feet so the accusations against Const. As reported, RCMP officer Khomphet (Kam) Khamphoune, a Richmond RCMP member who was charged with six counts in June after what police described as a lengthy child-pornography investigation.1 However, what was RCMP officer Khomphet Khamphoune actually chatged with? Khamphoune was charged with tampering with evidence, breach of trust, and various firearms-related offences -- but no child-pornography charges.2 As further reported: Khamphoune isnt the only RCMP officer charged with possessing child porn!3 These RCMP officers were: RCMP Paul Richer, RCMP Tristan Johnson, RCMP Stephen Hugget, RCMP Patrick Francis.4 As further note, those are only examples through a simple Google search not a forensicsearch. If we are to have any confidence in child protection laws and the willingness of judges and police to abide by them, the recent acquittal of Seth Paine must be appealed. In 2006, Paine advertised himself on an "adult-only" website as "one hot cop." His profile included a photo of the constable in his RCMP uniform. The phone number he later gave the girl was his RCMP-issued cellphone. All through his seduction of this child, Paine used the fact that he was a police officer as part of his appeal. Knowing the girl was 14 didn't dissuade Paine. He set up a date in the middle of her school day to have sex. They showered together before the girl went back to class. After that, the girl said that he gave her the "brush-off." She was suffering from a schoolgirl crush. Yet the man, old enough to be her father, was done with her.1 And who was the arse-hole judge that accuited RCMP officer Seth Paine? None other than British Columbia Judge Michael Hubbard. Carson was arrested last year after his DNA from a coffee cup matched stains on the womens underwear. A subsequent search of his home computer also found more than 32,000 pictures and videos of pornography, including 24 videos involving children.1 Notice how the possession of child pornography was glossed over by the courts in this case? As cited in Perverts, Sexual Deviants Occupy Top RCMP Ranks1, allegations Say Some Top Officers Constantly Harassed Women Officers For Sex, Blackmailed Some Trainees Into Sexual Submission Their Punishment A Slap On The Wrist If Caught!2 The LINK did its own investigation and found one case of a recent Indo-Canadian woman RCMP trainee who was married before she began her training but has filed for divorce since becoming an officer.3 The husband, who did not want his name disclosed, says that his wife most likely had an affair with her superiors or was coerced into sexual submission, which led to his wife becoming cold and distant.4 He said hes devastated. And given the recent shocking allegations of sexual harassment and abuse he blames the RCMP for ruining his life and tearing his family apart.5 Serious allegations of sexual harassment, blackmailing trainees into sexual submission and corruption have come to light against top RCMP officers, some of whom were involved in the expensive Air India investigation, which was dodged by failure on the part of the force, as well as another troubling investigation of sex-killer Robert Willy Pickton.6 More female members of the RCMP in British Columbia have come forward with serious allegations of harassment following CBC Newss shocking revelations of well-known Mountie spokeswoman Cpl. Catherine Galliford s claims she suffered from years of sexual harassment [see Appendix cited below].7 On Monday, CBC News revealed Cpl. Catherine Galliford has filed an internal RCMP complaint alleging repeated sexual harassment from some of her supervisors.8

Galliford said she experienced six to 10 incidents of harassment or sexual harassment, including one occasion in which a superior showed her his genitals and asked if a mole on his penis was cute.9 Earlier, during the Air India investigation, she said she was dragged along on pointless trips to Eastern Canada to meet with victims families. She said there was no news to impart, but her superior used the road trips as an opportunity to try to have sex with her.10 Following Gallifords explosive allegations, Krista Carle contacted CBC News, breaking her own long silence.11 I know for a fact there are at least six women that I know [who] have left the force or are still in that have suffered harassment, Carle said. Im sure there are others who are afraid to come forward for fear of reprisals.12 Carle, who graduated from the RCMPs training academy with Galliford in 1991, says she was harassed and sexually assaulted. She is now off the job and says she has been diagnosed with post-traumatic stress disorder. 13 RCMP management tried to cover up the problems when she complained, Carle told CBC News.14 When I spoke out against the harassment, it wasnt taken seriously and I felt diminished and I felt re-victimized every time I told what happened to me, she said.15 Carle is one of four women officers who have sued the RCMP, saying they were sexually assaulted by undercover Sgt. Robert Blundell in the late 1990s.16 The women worked for Blundell on undercover investigations in Calgary from 1994 to 1997. According to the statement of claim, they were individually and separately sexually assaulted and harassed by Sgt. Blundell.17 The case was eventually settled in 2007 with all parties agreeing to keep the terms of the settlement secret.18 Current authors note: Terry Mallenby has never kept his successful suit of the RCMP secret.

Terry Mallenby has maintained for years there are a lot of lying bastards in the RCMP [and Canadian Government] and incidents like those appearing in this book confirm his sentiments to be absolutely true! Recently an Ottawa RCMP sergeant admitted to internal charges of disgraceful conduct after he had sex with one secretary and made advances toward another.19 Sgt. Daniel F. Marquis, posted to the forces immigration and policing unit, has been docked eight days pay under the RCMP Act. He was docked three days pay for having sex with an underling, and five days pay for trying to kiss another secretary after calling her to a private meeting in a headquarters conference room.20 Current authors note: Another slap on the wrist for another RCMP pervert? The next disgraceful conduct case against Marquis involved another secretary in his unit.21 For his perverted indiscretions, Marquis only received 8 days docked pay. What a disgrace.22 As further noted, Sexual harassment of women thrives in environments that are male dominated, hierarchal and demand strict adherence to codes of silence like the RCMP, said MacDougall, noting female officers are afraid to speak up.23 MacDougall adds that police are not an option for women in this crisis.24 Female police officers are incredible public servants and the general public is only starting to hear about the harassment that we go through, said Galliford, former RCMP spokeswoman for the Missing Women Task Force. It can break you, and then if you need help, its very hard to find.25 The RCMPs employee assistance program was of no help and even leaked her medical files to the RCMP, said Galliford, who now has good medical support.26 In a 115-page statement to RCMP Internal Affairs Insp. Paul Darbyshire, Galliford said she documented the sexual harassment she experienced from top RCMP.27 An RCMP boss insisted she go along on road trips to visit victims families and then hed turn into Octopus-Man in a hotel room at night, she said.28

Galliford named another female officer who had to physically fight off an attempted rape by the same officer. Appendix This a most important article and gives the reader further insight into Canadas disgrace, the RCMP. As such, it too is being cited ver batim1: A sleep-deprived Catherine Galliford is running on adrenalin and ragged nerves after a wild week that saw the RCMP corporal rock her employer with claims that she was sexually harassed and bullied by senior officers, even as she served as the spokesperson for two of the biggest investigations in the forces history. Galliford was calm and competent on camera as the public face of the RCMPs investigations into the Air India bombings that claimed 329 lives, and serial murders committed by Robert Pickton on his Port Coquitlam pig farm. But while Gallifords allegations of harassment reached as far as the House of Commons this week, one of her most explosive claims is only now being made public. Galliford says the rampant sexism within the ranks of the RCMP that ruined her health and career may also have contributed to the mismanagement of the Pickton murder investigation, at a cost of many lives. Galliford said during an internal affairs meeting with RCMP staff this April that a senior officer did nothing with information that could have broken open the Pickton murders more than two years before his arrest, and attributed the flawed investigation to sexist attitudes and misogyny. In two extended interviews with Macleans this week, she said her examination of a le from the Coquitlam RCMP, with information dating as far back as 1997, showed the force had more than enough information by the late 1990s to obtain a warrant to search the Pickton property. Instead, surveillance on the farm was curtailed, indicative, she says, of the indifference that marked the investigation of the disappearance of women from Vancouvers Downtown Eastside, and a misogynist attitude toward women. She said in October 2001 she read an RCMP file dealing with the Pickton farm as she briefed herself on her assignment with the missing womens task force. I had one of those oh, no moments because I saw what was already on the file. There was enough evidence there for another ITO (information to obtain a search warrant), she said. She said the file included evidence of guns on the site of the farm, as well as womens clothing, government identification and an asthma inhaler later tied to one of Picktons victims. Yet, she said there was only a cursory attempt at surveillance, which was cut short because it was impossible to see activity at Picktons trailer, which was set back far from the road. 21

No further action was taken, in what she called an appalling lapse of judgment. And during that time, Pickton went on a killing spree. By some estimates, about 14 women disappeared between that period and February 2002, when a search warrant was executed on Picktons farm, leading to his arrest. Galliford said the information on illegal guns at the Pickton farm that precipitated that 2002 warrant was already in the old Coquitlam RCMP file. They took all the information that was on the original file, the firearms file, and they pretended it was new information, she said of her supervisors. If there was new evidence, as they claimed, she said she was never able to find out what it was. Nor did she get an explanation for the past inaction. Investigators eventually found the DNA of 33 women on the farm. Pickton was convicted of killing just six of the women, though he once bragged of killing 49. Galliford said she expects to testify in the new year at the ongoing inquiry in Vancouver into the ineffectual investigations by the RCMP and Vancouver police into the murders. When I testify at the missing womens [inquiry] its going to be on behalf of the [dead] womens families, she told Macleans. Its not going to be on behalf of the RCMP. She said she was unable to voice her concerns while the Pickton case was before the courts, or later, while she battled both the RCMP internal complaints process and her own stress-related demons. The beauty of it now is I can actually talk about it. Moreover, with her career in tatters, she said she has nothing left to lose. RCMP Sgt. Rob Vermeulen, a spokesman for B.C.s E Division headquarters, said he was not aware of Gallifords claims that the force sat on search warrant information for Pickton. It would be majorly inappropriate to comment about that, Vermeulen said. Theres an inquiry going now, so those questions Im sure will be answered there. Sexism in the RCMP is not a new story, but as Galliford and other women like her speak up in growing numbers, it has become the leading symptom of the forces ongoing dysfunction. Five years ago, after commissioner Giuliano Zaccardelli resigned amid the Maher Arar affair, the government promised sweeping reforms, in part to confront a veritable plague of harassment cases. Task forces were struck, consultants summoned. For the first time in 133 years, the government went outside the organization to find it a leader. Today, the most rudimentary fixes lie unrealized. The Mounties remain under the umbrella of the federal public service, an arrangement that hamstrings their ability to implement reform. The creation of an independent board suggested by a task force to oversee human resources decisions never came to pass. (The head of that panel, David Brown, 22

famously described the RCMPs paramilitary management structure as horribly broken.) Two federal bills that would have created a civilian complaints commission, while strengthening rules and discipline on workplace misconduct, died when Parliament dissolved for last springs election. Were not any further ahead, concludes Cpl. Tori Cliffe, one of four sexual harassment complainants who took the force to court in 2003. People are still defining their actions as appropriate when they certainly were not. Nothing has changed. Certainly the stream of lurid tales emanating from RCMP station houses shows no sign of abating. Last December, a constable in Parksville, B.C., admitted to having sex in a police van with a young woman who had joined him for a ride-along. Another officer, in Hamilton, Ont., admitted around the same time to sending vulgar emails to a mailroom intern, offering the young woman money to strip for him (she refused). Then, two months ago, a staff sergeant in Burnaby, B.C., was accused in a lawsuit of using his authority to coerce a female constable into a four-month sexual relationship. The scandals tarnishing the RCMP are by no means limited to sexual harassment. Footage of a constable kicking a man in the face in Kelowna last January unleashed a wave of public anger in B.C., where nearly a third of the forces officers are stationed. So did the findings of the Braidwood inquiry, that officers gave false testimony during the probe into the death of Polish immigrant Robert Dziekanski. Both incidents arose amid accusations that outgoing commissioner William Elliottthe outsider brought in to clean up the forcehad been bullying and intimidating his own deputies. (This week the Conservative government was set to name Bob Paulson, a veteran RCMP officer and deputy commissioner, to the top job.) Now, Gallifords allegations have raised the stakes even higher. Within weeks, a woman who once personified progress within the organization the firm-yet-sympathetic image of police authoritymay well be describing from a witness box her belief that her bosses were laying bets on who would have sex with her. Or how the antediluvian attitudes of her superiors toward women compromise public safety. All of which calls into doubt the RCMPs ability to do its job. If the force cant safeguard the woman who speaks for it, or even protect the integrity of its most prominent criminal investigation, exactly what can it protect? Its not as though the force hasnt had time to evolve. The first troop of female members graduated 36 years ago, in standard-issue high heels and pillbox hats instead of high-browns and Stetsons. Gender-related harassment was part of working life for women back then, says Bonnie Reilly Schmidt, who joined the force three years later and served for a 23

decade. In the RCMP, she says, there was everything from mild sexual comments or jokes about your breasts to overt sexual touching. Shaking it off was part of proving you were tough enough to be a cop, adds Schmidt, who has written a dissertation on women Mounties for her Ph.D. at Simon Fraser University. But the taboo on harassment that has prevailed in most workplaces since the late 1980s never took root in the RCMP. Women either endured the jibes and gropes, seeking transfers to get away from offenders, or they left the force for good. Attrition rates of the women who joined between 1975 and 1985 were nearly double those of male officers. Even now, as a brave few take the force to court, the abuses continue. Every woman in the RCMP has experienced some form of harassment in her career, says Schmidt, who has interviewed more than 20 female officers as part of her research. Not all women had such severe experiences they had to go on medical leave. For some, it just rolled off their backs. But it depended on the environment. If you have three or four of five men who are abusive and youre the only woman, thats serious pressure. The psychological effects can be debilitating. Galliford has been off the job on full pay since 2007, after she was diagnosed with post-traumatic stress disorder, the result, she said, of a barrage of advances from some superior officers and colleagues dating from about 2000. I think I became the flavour of the month, she says. I dont know if it was because I was on TV, but it almost felt like I was some kind of a bet. She began to abuse alcohol, became physically ill at the thought of going to work and developed a phobia about stepping outside her Vancouver-area home. Since Galliford first spoke out in a CBC interview, several other current and former RCMP members have come forward to say their working lives were also plagued by sexist behaviour, unwanted advances, or harassment of a non-sexual nature. Mike Webster, a B.C.-based psychologist with 35 years experience in police-related counselling, said he has been contacted by more than a dozen other RCMP members facing harassment issues since Galliford, an occasional client, went public. He blames the RCMPs bizarre policy of unlimited sick time for contributing to the problem. The RCMPs formal complaints process, the Division Staff Relations Representative Program, is a toothless tiger in the hip pocket of management, he says. Too often, contentious issues are left unresolved for years, driving disaffected members onto fully paid, indefinite sick leave, a move Webster calls fiscally unsound and organizationally perplexing. No surprise, then, that filing a harassment complaint in the RCMP can mean career death. Barbara Dixon, a former homicide and major crimes 24

investigator who worked out of several B.C. detachments, found that to her detriment. She endured constant comments from her direct superior and another team member with the intention to discredit, demean and humiliate her. I think it was just scared little boys who didnt like a female in their midst, she says. In just one example, Dixon says her boss labelled a murder file she was working onthat of a mother in the sex trade who had a nine-year-old sonProject E-Erectile. She went over his head to change it, horrified that she would have had to carry that file name into the court case, and complained to a senior officer. My life changed from that moment on, she says in an interview from her home outside Calgary. Once you file a complaint, you are forever tainted. Instantly, she was given a poor performance review, after years of being considered a high flyer. Eventually, she transferred to E Division headquarters, where a supervisor was willing to take a chance on her. Still, the complaint flatlined her career prospects. She quit the force in May, ground down not by the murders and crimes she once investigated, but by some of the people she worked for. Such accounts have left an indelible stain on the Mounties image. And even those with a grasp of its sprawling complexity shake their heads at the RCMPs failure to get ahead of the damaging allegations. There seems to be almost a regular diet of issues surfacing in the organization, says David Brown, head of the 2007 task force on governance and culture within the RCMP. With the proper management structure and focus, much of this would not have happened. Theyre needless issues that can and should be rectified. Four years ago, Brown thought he had some answers. His task force recommended a board of management for the RCMP that would have liberated it from the interfering bureaucrats and politicians when it came to human resources matters. It also suggested a civilian oversight body to handle complaints against the Mountiesnot just from the public but also from RCMP members. Potentially, that kind of system could help to alleviate some of these [recent] problems, he says. The Harper government greeted the suggestions warmly, then left them to wither on the vine. A more modest bill to create a civilian commission to handle external complaints died on the Order Paper, and Mike Patton, a spokesman for Public Safety Minister Vic Toews, says the government has not yet decided whether to reintroduce it. Another bill to strengthen the forces policies on workplace conflict, grievances and discipline will be reintroduced, Patton says, but he doesnt know when. As for that horribly broken management structure, it too remains unchanged, to the dismay of would-be reformers. Last December, a panel struck to implement Browns recommendations cited the apparent office 25

feud between commissioner Elliott and his deputies as proof of the need for independent oversight. Now is the right time for the government to initiate legislative action, the group urged in a report to Toews. But a year passed with no action, leaving critics like Robert Gordon, director of the school of criminology at Simon Fraser University, with little hope for the RCMPs future. The bottom line is: the organization is sick, says Gordon, a former cop, and it doesnt seem capable of healing itself. Theres got to be some kind of major change take place, if for no other reason than for the sake of the people who work for the RCMP. But the organization sails on, impervious. Critics, especially in B.C.the scene of so many of the Mounties debacles and disasters, from the Dziekanski Taser death to a cascade of harassment allegationsare astounded that the RCMP survives in its current form. Even its most egregious self-inflicted errors have failed to scuttle negotiations to renew the 20-year provincial, territorial and municipal policing contracts the RCMP has in all regions but Ontario and Quebec. Alberta and Saskatchewan broke ranks and signed renewal agreements earlier this year, and few doubt that the RCMP will lock up the rest of the provinces and territories, possibly within weeks. The federal government, which is playing hardball on the Mounties behalf, has imposed a Nov.30 deadline on contract negotiations and has threatened to pull the RCMP out of British Columbia by 2014 if it fails to reach a deal by the deadline. That would give B.C. just two years to cobble together a provincial police service, saddling it with massive start-up costs and leaving such major communities as Surrey, Burnaby and Richmond scrambling to form city police forces. The RCMP serves as the town cop in most communities outside of Vancouver, Victoria and a handful of other cities with local police departments. That might explain why both B.C. and its municipalities are so forgiving of the RCMP. In September, B.C. Solicitor General Shirley Bond warned she would consider forming a provincial police force if the province and municipalities arent given greater say in containing the spiralling $900million annual cost of RCMP service. But she soon toned down the rhetoric. Last week Bond said she doesnt expect claims of sexual harassment to impact negotiations. I have been reassured that there is a process in place to investigate any allegations, she said of Gallifords complaints, which have lingered without resolution for four years. Peter Fassbender, the mayor of the city of Langley and the municipal representative at the contract table, said RCMP harassment issues need to be dealt with . . . but Im not prepared to say the RCMP isnt worth keeping.

Truth is, says SFUs Gordon, B.C. has missed an opportunity for a discussion on replacing the RCMP with more accountable policing alternatives. Kash Heed, a provincial Liberal MLA who served briefly as provincial solicitor general before leaving cabinet due to election campaign financing irregularities, is troubled that harassment complaints drag on without resolution. Yet he continues to receive anguished emails from women in the RCMP who are victims of bullying. These harassment complaints are not from the 70s, says Heed, the former chief of West Vancouvers police force. These are recent complaints. These are complaints in the 21st century. So will the Mounties drag themselves into the 21st century? Or can Canadians look forward to a couple more decades of embarrassing revelations from their storied police service? When contacted by Macleans, an RCMP spokesman stressed the forces zero tolerance policy toward sexual harassment, and noted an online awareness tutorial on the issue that members are required to complete. Last year the force appointed a professional integrity officer, to whom harassed officers can go if they are worried about trying to go through the chain of command. Curiously, some of the harassment complainants voice similar notes of optimism, offering hope that their criticism leads to positive changeeven if it costs them their careers. Krista Carle, who sued the force in 2003, alleging sexual assault by an undercover officer based in Calgary, enjoyed a surge of unaccustomed confidence last week watching Galliford challenge the old boys club on prime-time television. The following night on CBC, she did the same. Unless you step up, theres not going to be any change, she says. I dont want anyone else to go through what I did. Galliford has less faith in RCMP brass. But she did take heart when Toews rose this week in the Commons, pledging for RCMP members a workplace free of harassment and calling on Mounties to carry out their duties with integrity and professionalism. More than an acknowledgment of Gallifords suffering, it was a commitment to change from the only authority with the power to make it happen. It might not come in time to salvage her career, and its certainly too late to remedy the mistakes of the Pickton investigation. But theres still time to save the iconic institution whose uniform Galliford once proudly wore.2 Footnotes 1 - 2. As cited, the Mounties want you to believe they take sexual harassment allegations seriously.1 But when you listen to Janet Merlos story, the RCMPs oft-repeated declaration rings hollow.2 In September, 2007, Constable Merlo wrote to then-RCMP commissioner William Elliott concerning plans under way to transfer her out of the B.C. detachment in which she was serving.3 In the note, she talked about a run-in she had with a supervisor because I did not think his sexual advances were funny.4 She didnt think the sex toys he was leaving on her desk were funny either.5 Yet I put up and shut up with the sexual harassment for the sake of the RCMP, but kept all the notes, dates and times in case the problem escalated, she wrote to the commissioner.6 That year, my assessment reflected his feeling about me not accepting his jokes and presents.7 How silly I was not to launch one of the biggest sexual harassment lawsuits the RCMP has ever seen in this province.8 Provocative allegations.9 Certainly ones you would think might have prompted the recipient to launch an immediate investigation.10 At the very least, a diligent and sensitive CEO would have quickly assured his employee that he was taking her claims seriously and that someone would be in touch to discuss them further.11 Ms. Merlo waited for a reply. And waited. Until one day it finally arrived more than two years later.12

In November, 2009, she received a letter from deputy commissioner Peter Martin, writing on behalf of his boss. It began by thanking Ms. Merlo for your correspondence of Aug. 19, 2007, and referenced her allegations of harassment.13 As you are aware the RCMP does not take these allegations lightly and, in fact, has an obligation to provide a harassment free environment for all of our employees, he wrote.14 Janet Merlo didnt know whether to laugh or cry.15 I couldnt believe it, said Ms. Merlo, who retired from the force last year.16 I couldnt believe the gall of them writing back to me more than two years after the fact.17 And then saying they took my claims seriously.18 As far as Im concerned, that told me everything you need to know about how serious the RCMP takes harassment on the job and what kind of priority it is.19 Two years to respond to an officers complaint of harassment?20 That is appalling.21 And perhaps tells us everything we need to know about why and how this is ugly workplace phenomenon has apparently been allowed to thrive for decades in the force.22 Something screwy there - Canadian Prime Minister Stephen Harper?? Chapter 11 Perhaps among the most disturbing revelations about the RCMP is the sexual abuse of children? In this incident, the RCMP did little about allegations of sexual assault at the Kingsclear Training School by one of its own officers, a CBC news investigation has learned.1 The culprit, Staff Sgt. Clifford McCann, apparently abused seven teenage boys at the reform school in 1991, was considered a father figure and a male mentor to the troubled teens and could take them on outings whenever he wanted.2 Carl Schneider said that during one visit to McCann's house, McCann asked to see Schneider's penis.3 Other assault victims have accused McCann of similar actions. A mother of one of the victims claims to have seen her son having sex with McCann in the back seat of a car.4 In addition, prior to the Kingsclear case, CBC uncovered that McCann faced allegations of sexually assaulting a young hockey player in a washroom and of appearing in photos with naked teenage boys.5 What did the RCMP do? The news investigation found that RCMP Commissioner Giuliano Zaccardelli, in charge then of the RCMP in New Brunswick, had been briefed on the allegations against McCann but nothing was done.6 You remember RCMP Commissioner Giuliano Zaccardelli, he was the guy at the centre of the pension scandal. Incredibly too, after a 12-year investigation into the allegations the RCMP said they couldnt find enough evidence to press charges.7 Sexually abused Carl Schneider said he was outraged the investigation has been closed.8 "It's damaged me inside and out. One way I could possibly explain is I feel like a ghost in my own body," he said.9 34

What police force takes 12 years to do an investigation? Either an incompetent one! Or a corrupt one! In another incident, in September 2006, a female passerby witnessed an RCMP constable openly masturbating in his unmarked police vehicle.1 The RCMP constable was supposed to be conducting surveillance in a counterfeiting investigation.2 The RCMP constable simply smiled at the passerby and kept on masturbating.3 What did the RCMP do, they docked him 10 days pay.4 He remains on active duty in Montreal.5 In another situation, Mounties say they will not comment on unconfirmed media reports that officers did not intervene in a potentially dangerous sexual encounter between two detainees at the Kamloops RCMP detachment earlier this month.6 Police announced on Friday that four officers and three municipal staff were under investigation in connection with an undisclosed incident that occurred in the jail cell block on Aug. 18.7 A little more digging, and this was the undisclosed incident: what exactly happened inside a Kamloops cellblock on a steamy mid-August night?8 Seven people including four RCMP officers allegedly watched the incident on video but theyre now under investigation and are saying nothing.9 City council wants to know, the mayor is promising to get to the bottom of it and the central British Columbia town is abuzz over reports of what happened.10 Its not often the story includes two women one allegedly HIVpositive engaging in sex for as long as an hour while RCMP officers and prison employees gathered around to watch the show on closed circuit cameras, doing nothing to stop the duo.11 36

A justice official in Kamloops Monday told the Toronto Star on the condition of anonymity that there is also the possibility of a charge of aggravated assault against the inmate who is reportedly HIV-positive.12 The cellblock incident investigation is being undertaken by the detachment and the RCMP headquarters in B.C., an issue that creates concerns over independence, according to William Sundhu, a former provincial court judge and now a defense lawyer in Kamloops.13 Sundhu said ever since Robert Dziekanski, the Polish man who died at Vancouver airport after getting shot by RCMP officers with a Taser gun in 2007, the public has become wary of the RCMP investigating itself.14 The public has over the last two to three years become very aware of the problems that arise when police investigate police, he said Monday. Theres been a loss of confidence in the RCMP.15 There is a feeling among many people on the streets that theyre justified in not trusting the RCMP and that evidence is starting to come out.16 She said the four RCMP members and three city workers who allegedly watched for several minutes before intervening failed to protect her while she was in the cell.17 Such incidents obviously open the door to lawsuits, said Victoria lawyer Erik Magraken, who is representing the woman. "What you're left with is a sexual assault or an aggravated assault, exposing the person with HIV to criminal consequences, but also civil consequences," Magraken said.18 As one commenter mentioned: Is there ever an end to the problems with the RCMP? Possibly they are taught they are above the law as apparently they are taught in training that they are the best police force in the world. Holy mackerel that is laughable. The stupidity of the members of this organization never ends, if you dont believe me find the story that was reported yesterday from Kamloops of the investigation started over jailers and members of the RCMP watching two females engaging in a sex act in a cell and one apparently is HIV positive.

In this case, as cited a Kamloops RCMP constable is suing top-ranking members of his own police force, prosecutors and several cabinet ministers for $1 million in damages.1 As noted, in a writ filed in B.C. Supreme Court, Const. Joseph Dale Kohut seeks damages for a "malicious" investigation by the RCMP, who were looking into allegations that some Prince George police officers were complicitous or involved in abuse of prostitutes.2 David Ramsay, a former provincial court judge, was sentenced in 2004 to seven years in jail after he was charged with preying on young aboriginal women, ranging in age from 12 to 17, over an eight-year period beginning in 1992. Ramsay pleaded guilty to one count of sexual assault causing bodily harm, three counts of obtaining sexual services from someone under 18 and breach of trust by a public officer.3 After his conviction, B.C. aboriginal leaders demanded an inquiry into allegations that surfaced at Ramsay's trial that at least 10 police officers knew about Ramsay's conduct and either looked the other way or got involved. The RCMP created a special task force called Project E Prevails to look into the stories about its officers.4 Kohut was stationed in Prince George from April 1991 to June 2004 and had to "deal with, and reveal his identity to, individuals involved in prostitution and the drug trade," the writ states. It says Kohut was told Jan. 31, 2005, that he was the subject of a criminal and internal investigation.5 In March 2005, RCMP went to the home of Kohut's ex-wife Sandi Quayle and told her "he had engaged in violent sexual relations with child 39

prostitutes," the writ says. The investigators knew Kohut and Quayle were separated and "engaged in a spirited custody battle" over their daughter. "As a result . . . Const. Kohut lost custody of his daughter," the writ claims.6 It also alleges that RCMP investigators then went to Kohut's current wife Lisa, told her Kohut "had engaged in violent sexual relations with child prostitutes . . . and inquired as to whether Lisa Kohut was infected with a sexually transmitted disease."7 Bob Sandbach of Prince George, whose late daughter Celynn was just 13 when she was attacked by Ramsay, was outraged to hear of Kohut's lawsuit against the RCMP. "This is why we're demanding a public inquiry into how a prominent and well-known judge could have openly picked up and abused all these underage girls, like my daughter, without the police knowing," said Sandbach.8 "My daughter told me by name about several police officers who abused her or were regular dates paying for sex." Sandbach said the allegations in Kohut's writ, which he read yesterday, "prove this whole thing just stinks."9 He said he is "outraged" that Kohut considers himself a victim. His daughter, Celynn, 22, who had been battling drugs died in hospital April 1.10 On Oct. 3, 2006, Kohut's writ alleges, RCMP internal investigator Sgt. Armin Teitz disclosed Kohut's "identity to the mass media" and said Kohut had been "suspended on the basis of reliable evidence that he had engaged in sexual relations with minors involved in prostitution."11 Kohut says he suffered "pain and suffering, loss of enjoyment of life, embarrassment and loss of reputation, loss of opportunity for advancement, loss of the opportunity to earn income and extensive legal expenses."12 As further cited, for an eight-year period in Prince George starting in 1992, former provincial court judge David Ramsay openly preyed on young, often underage aboriginal girls. Ramsay was charged with several sex-abuse counts in 2003.13 Ramsay was charged and, after a lengthy trial, sentenced June 1, 2004, to seven years in jail. In September of this year, he was denied early day parole.14 In 2004, the RCMP launched its own internal investigation, Project E 40

Prevails, after allegations surfaced during and after the Ramsay case that approximately 12 of the complainants alleged they had engaged in paid sexual encounters with members of the RCMP."15 What? Then-assistant RCMP commissioner Gary Bass, who is also named in Kohut's suit, said police didn't do anything about it at the time because so many officers in a small town like Prince George had been named by prostitutes.16 What? The RCMP decided to proceed against Const. Justin Harris in 2005. The RCMP eventually alleged that Harris, who was at one time Const. Joseph Kohut's partner, behaved in disgraceful manner while he worked in Prince George, sexually touched an underage prostitute during an improper search, and on another occasion paid her for sex.17 But the force lost its internal case due to the delay in proceeding with the case.18 What? Kohut, who Prince George Const. Gary Godwin described as a very fine, fit constable when I worked with him briefly several years ago is still working in Kamloops.19 Was it another example of RCMP justice for none? Incredibly, one RCMP was found guilty of severe misconduct -- rape -according to documents obtained by The Vancouver Sun.1 On May 30, 2005, an RCMP constable from Fort St. John was guilty of having sexual intercourse without consent.2 In addition to the officer from Fort St. John, eight other B.C. officers were subject to milder forms of discipline over the past year for a variety of offences, including sexual harassment, having sex in a marked police car and looking at Internet porn while on duty.3 On Oct. 27, 2005, RCMP Const. Norman Lapointe of Fort St. John was reprimanded and docked 13 days pay after the board found him guilty of having sex several times in his marked police car -- while on duty and in uniform.4 The RCMP rationalization, "at all times" during the sexual encounters, Lapointe "continued to monitor for duty-related calls and telephone calls."5 What? Isnt that the stupidest comment you have ever heard? On Aug. 24, 2005, RCMP Sgt. Glen William Anderson of Surrey was docked four days pay and ordered to receive harassment training after he had sexually harassed two female colleagues and insulted several male co-workers.6 RCMP Andersons comments: "So, I just want you to know that I really like your tits," Anderson said, according to Johnston a female member. "In fact, it's the nicest set of tits I've ever seen."7 Another female member said, "on a few occasions he made her feel uncomfortable," a summary of Falk's testimony states. "He asked her a number of times, in a joking tone, whether she wore a push-up bra.... On one other occasion RCMP Sgt. Anderson made comments about her 45

breasts. She then put on a sweatshirt and he made further comments about why she would wear a sweatshirt because her breasts looked nice."8 Again, on June 9, 2005, RCMP Const. Bob Archer of Prince George was reprimanded and docked three days pay after the board found him guilty of harassing his ex-girlfriend ... no criminal charges have been laid against him9 Once again, on July 11, 2005, RCMP Const. Myrl Stus of Princeton was docked four days pay after the board found him guilty of viewing more than 40 pornographic websites during four successive shifts in August 2003.10 In December, in an unrelated case, Stus pleaded guilty in court to assault with a weapon for ordering another Mountie to Taser an unconscious prisoner.11 Why do provinces put up with this police force, it would be less disastrous and more economically feasible to have their own provincial police forces -- more control? As cited, Duncan Canvin, a former mayor of Fort Simpson, was arrested Thursday night and charged with sexual assault and sexual exploitation in connection with offences that allegedly took place while he was a member of the RCMP's Fort Simpson detachment.1 Canvin, now a 52-year-old liquor store owner, has since been released on several conditions, including one that he not be around the complainant or anyone under the age of 17, police said in a release Friday.2 Oh, oh? Not another case of an RCMP officer sexually assaulting young women, is it? He is scheduled to appear in territorial court on Dec. 7 in Fort Simpson, a village of about 1,200 located about 400 kilometres west of Yellowknife.3 The authors mistake, as further cited, police also said they could not release the male complainant's name because he was a young person at the time of the alleged offences, even though he is an adult now.4 Oh, oh not another case of diddling little boys -- is it, as the saying goes? As indicated, the complainant told CBC News on Friday that he and other teenage boys in Fort Simpson came under Canvin's influence in the early 1990s, when Canvin was an RCMP officer and a minor hockey coach in the community.5 According to the complainant, Canvin had allegedly turned his home into a fraternity house of sorts, where alcohol was readily available and pornographic movies were shown regularly.6 The author must ask again, are these RCMP officers properly psychologically tested? 47

In another incident, RCMP officer James Douglas Macleod was charged with sexual assault after allegedly raping a woman at a Super Bowl party in Maple Ridge in February 2005.7 In yet another incident, RCMP officer Gary Stevens is sentenced to 18 months in jail for sexually assaulting two teenage girls Mr. Stevens pleaded guilty to attacking a girl in Vancouver in the early 1990s, and a girl in Terrace in 2004.8 Again, two RCMP officers based in Watson Lake, Yukon, have been charged with sexual assault following an attack on a woman earlier this week A woman told police she was sexually assaulted.9 "It's obvious people are going to be very concerned," said Kevin Brosseau, the commission's senior director of operations.10 No kidding Brosseau! Court documents obtained Thursday by CBC News show the two RCMP officers to be Graham Belak, 29, and Shawn McLaughlin, 32.11 And on July 11, 2005, Sgt. Dean Meikle of Richmond was docked two days pay and urged to attend harassment training after inappropriately touching several female colleagues at staff parties.12 In another incident, in February 2005, an RCMP constable attended a Super Bowl party at a suburban Vancouver residence where at the constable had sexual intercourse with an unconscious adult woman who had been drugged at the party.13 His decision to take advantage of a woman in this state demonstrates a fundamental flaw in his character that renders him unfit to perform the duties of a police officer.14 In yet another incident, Saskatchewan RCMP Constable Thierry Jacques was sentenced to three years in jail for sexually assaulting a female prisoner while she was in custody.15 A judge found him guilty of taking the 26-year-old woman from her cell and sexually assaulting her in the garage at the La Ronge RCMP detachment on Sept. 4, 2004.16 As cited, RCMP Const. Thierry Jacques left court Thursday in leg shackles after being sentenced to three years in a penitentiary for sexually assaulting a female prisoner in the garage of a northern police detachment.17 48

Jacques, 32, will have his name on the national sex offender registry for 20 years and has also been ordered to provide a DNA sample for the national databank.18 Justice Duane Koch found Jacques took the 24-year-old aboriginal woman from her detention cell at the La Ronge RCMP detachment on the pretext of having a cigarette in the adjoining garage.19 When they were alone, he told the woman to lift her shirt so he could touch her breasts, which she did while he masturbated and ejaculated on her. A white shirt belonging to the victim and stained with semen matching Jacques's DNA was entered into court as evidence during the trial.20 "He (Jacques) has managed to destroy some of the bridges built between police and aboriginal people. He has created a rift and mistrust," said Crown prosecutor Inez Cardinal.21 The sentence is exactly what Cardinal requested, saying it "sends the appropriate message to the public" that police misconduct is a serious offence to be dealt with harshly.22 What about all the RCMP officers who get off with a slap on the wrist, loss of pay? "This was a serious, serious breach of trust," she said. "He was on duty, dressed in full uniform complete with gun in his holster. She was a young woman in custody, vulnerable, with nowhere to go and no ability to defend herself against his advances."23 Portions of a victim impact statement, read into the record by Cardinal, spoke of flashbacks that have left the woman "tormented and ashamed."24 In yet another case, as reported, a former Manitoba RCMP officer is facing up to six years in prison after pleading guilty to trying to sexually assault a teen girl on a First Nation community north of Winnipeg.25 Benjamin Neufeldt, 26, pleaded guilty to two sex-related charges at a hearing in Winnipeg on Tuesday. He admitted to asking a 17-year-old girl to touch him sexually while he was in a position of trust over her and forcible confinement.26 The charges stemmed from an incident on the reserve 200 kilometers north of Winnipeg in August 2008. The Crown is seeking a six-year prison term for Neufeldt, while his own lawyer is seeking about 2 1/2 years 49

behind bars.27 An agreed statement of facts tendered in court showed that a knife seized from Neufeldt as part of the investigation contained DNA belonging to the victim.28 Incredibly, although this disturbing sexual assault story broke on 12 September, the newspaper had already closed reader comments.29 Something screwy there - Canadian Prime Minister Stephen Harper?? In this incident, a Manitoba RCMP officer was drunk and forced his way into a Winnipeg home, spooking the female resident, and falling asleep.1 The 30-year-old RCMP officer supposedly thought he was entering a house be it his own or one belonging to a friend or relative in River Heights where he was welcome and would spend the night, but that wasnt the case.2 The man was allegedly unaware of this due to his intoxicated state.3 How drunk do you have to be? How did he get there - did he drive that drunk? The RCMP officer gained entry by breaking through a door or window, causing some damage. This awakened a woman, who was the homes lone occupant.4 She encountered the man and fled to a neighboring residence, where she called police.5 The RCMP officer wasnt charged with break and enter.6 One person commenting on this story said, why is it only a boo boo for a cop yet drunk driving charges for a civilian? The double standard lives on!7 Heres another example of a double standard when it comes to RCMP boo boos. Incredibly, two Ridge Meadows RCMP officers, Pat Hughson and Steve Frazer, were only docked 10 days' pay after they got very drunk and then rode around Maple Ridge assaulting innocent people, described as "intentional, serial abuse of innocent passersby, without reason."8 Just incredible, docked a few days pay for "disgraceful" conduct, because 52

they were "highly intoxicated" as they drove downtown around 3 a.m., the two off-duty officers spotted a man, Colin Frederick, walking down the street Hughson and Frazer stepped out of the pickup truck and started fighting with Mr. Frederick."9 Hughson to hide his deplorable behavior, wrongly identified himself as a "PoCo [Port Coquitlam] cop. Even the other wonder did the same. As a security guard came to investigate the raucous, Frazer flashed his police badge and said he and Hughson were with the "PoCo Police."10 The security guard believing the badge to be a fake one asked RCMP Const. Frazer if he could see his badge again, to which RCMP Const. A Manitoba RCMP officer is suing her employer for what she calls an intentional and reckless campaign of sexual and emotional harassment and discrimination that allegedly spanned 15 years and two provinces.1 Sherry-Lee Benson-Podolchuk is seeking unspecified financial damages from the Mounties in a statement of claim obtained Monday by the Winnipeg Free Press2 [see Appendix cited below]. Benson-Podolchuk, 44, claims the alleged abuse forced her to go on disability from stress and has caused other ailments including clinical depression, anxiety and loss of self-esteem.3 Benson-Podolchuk, a resident of Winnipeg Beach, Man., says her problems began while she was posted at the RCMP detachment in Tisdale in 1991 to start what she thought would be a promising career in law enforcement.4 She was repeatedly subjected to sexual harassment and other harassment by male members of the RCMP, her lawsuit claims.5 Benson-Podolchuk cites specific alleged incidents including hearing improper sexual comments from fellow officers in public, at the police station and even over the RCMP radio.6 She said a dead chicken was placed in her private gun locker, with blood dripping down into her personal belongings.7 What kind of swine are these RCMP to do this? the womens washroom, she claims.8 Benson-Podolchuk said she filed a complaint with the Canadian Human Rights Commission in 1992, which resulted in her being transferred to a new posting in Selkirk, Man.9 Her lawyer claims the human-rights complaint essentially blackballed her in the eyes of her superiors and co-workers.10 Benson-Podolchuk has also accused RCMP of trying to obtain confidential medical information from her doctor, pulling her over during a highway traffic stop for no reason and threatening consequences if she didnt quit.11 She says the abuse left her afraid to go to work, embarrassed, intimidated and afraid for her personal safety.12 Nancy Sulz, a former RCMP constable in B.C. who was harassed by her supervising officer, successfully fought a decade-long battle against the federal government and the RCMP and won $950,000 damages last year.13 The harassment award is the largest-ever imposed against the RCMP.14 A B.C. On another occasion, she opened her locker to discover a dead prairie chicken dripping blood all over her belongings. And on it went throughout much of her career. When she permanently injured her shoulder during a shotgun training exercise in 1994, the force started a medical discharge process. Even though the Mounties accommodated officers who suffered debilitating injuries playing recreational hockey, they werent prepared to make room for a woman whod seriously hurt herself on the job. In 2005, Ms. Benson-Podolchuk wrote to then-RCMP commissioner Giuliano Zaccardelli about her harassment issues and the efforts to push her out of the force. She received no reply. She filed a complaint with the Canadian Human Rights Commission and followed it up with a lawsuit, claiming the Mounties had failed to accommodate her job-related injury and provide a harassment-free environment. 56

The RCMP settled out of court in 2009. Ms. Benson-Podolchuk officially called it quits a year later. Last year, she published a revised edition of a book she wrote in 2007 about her experiences. Women Not Wanted initially received little attention but is now particularly apt in light of the latest harassment controversy that has engulfed the force. Sexual harassment has been a problem in the RCMP for decades. While the subject has occasionally created headlines, little seems to have been done inside the organization to eradicate this ugly workplace phenomenon. Lawyers representing a growing number of officers are readying a harassment-related class-action lawsuit against the Mounties. And a number of female members, past and present, have recently spoken out about their ordeals. Ms. Benson-Podolchuk sympathizes with anyone experiencing what she went through. Im on the other side of despair now and I know how hard it was to get here, she says. The fact is, the organization is terribly broken. Women feel isolated. I have two letters from RCMP headquarters one in 1992 and another in 2009, both apologizing for the harassment I suffered and saying how the Mounties dont tolerate it. Did anything change over that time? No, absolutely nothing. Its still a terrible work environment for most females. Even though Im mostly recovered, I still have nightmares about my experience, says Ms. Benson-Podolchuk. Its simply a devastating thing to go through. MORE POLICE FACE PERJURY CHARGES Mon, January 21, 2009 By Tamara King, CP http://www.canlaw.com/rights/police.htm WINNIPEG -- A growing number of Canadian police officers are facing charges of perjury -- the serious and usually rare crime of giving false testimony. At least eight officers, either active or recently retired, will head to courts in Toronto, Winnipeg and Regina over the next two months accused of an offence that carries a maximum penalty of 14 years in prison. "I have not seen this many examples of perjury charges brought against police officers," says James Morton, a Toronto lawyer and adjunct professor at York University's Osgoode Hall Law School. "I don't think this means that police are lying more than they used to," Morton said.. "It used to be that people just didn't believe policemen would lie. That sort of restriction has disappeared now." Perjury is viewed as dangerous enough to the justice system that it's actually enshrined in Canada's Constitution, Morton said. "It is the only crime that is expressly referred to in the Charter of Rights (and Freedoms)." Most serious when the accusation is levelled against a member of the justice system, perjury is extremely difficult to prove. Prosecutors have to show the evidence was intentionally false. In the most recent case, two Winnipeg police officers were accused last week of lying under oath about how they obtained a search warrant in a drug investigation. Also last week, a British Columbia RCMP officer was temporarily taken off the job because of allegations he gave misleading testimony at an inquest into the 2004 death of Kevin St. Arnaud, who was shot after a drugstore burglary. Although the force did not use the term perjury, Const. Ryan Sheremetta was suspended under the RCMP Act over allegations that he conducted himself "in a disgraceful manner that could bring discredit on the force by knowingly making false, 67

misleading or inaccurate statement(s) while testifying," Assistant Commissioner Al Macintyre said at a news conference. In Saskatchewan, a Regina police officer is going to trial, likely in the fall, on a perjury charge that stems from testimony given at a January 2006 traffic-court case involving a seatbelt violation. Five members of an elite Toronto police drug squad that is facing allegations of extortion and assault are also charged with perjury.
