So, looking to capitalize on their good work, I allege that Haynes violated Florida Statute (F.S.) 101.045, Electors must be registered in precinct; provisions for change of residence or name. Violation of 101.045 is a third degree felony. From the OIG report, Ms. Hall and Ms. Nesbit both opined that Commissioner Haynes failure to change his address with the SOE prior to voting in the November election may be a violation of Florida Statute (F.S.) 101.045, and they suggested the OIG contact the Florida Department of State, Division of Elections, regarding this issue. On July 10, 2013, the OIG telephonically contacted Gary Holland, Assistant Director of the Florida Department of State, Division of Elections, regarding whether Commissioner Haynes may have violated Florida law when he voted in the November, 2012 general election using an old address. Mr. Holland opined that Haynes may have violated F.S. 101.045 by failing to change his address through the proper registration method prior to voting and casting his ballot. Additionally, the OIG states, On May 23, 2013, the SOE provided the OIG with the early voting certificate for Commissioner Haynes. The certificate, also known as the voting pass, was signed by Commissioner Haynes and dated November 3, 2012 at 7:47:50 a.m. The certificate had his date of birth and address printed on it, and the address listed on the certificate was 4701 NW 41st Court, Lauderdale Lakes, Florida 33319. The certificate contained the following oath statement: I, Eric L. Haynes, am a qualified elector in this election and a registered voter of Broward County Florida. I do solemnly swear (or affirm) that I am the person so listed on the voter registration rolls of Broward County and that I reside at the listed address. I understand that if I commit or attempt to commit fraud in connection with voting, vote a fraudulent ballot, or vote more than once in an election I could be convicted of a felony of the third degree and both fined up to $5,000 and imprisoned for up to 5 years. I understand that my failure to sign this certificate invalidates my ballot.

The investigation was initiated following receipt of allegations that Lauderdale Lakes Commissioner Eric Haynes moved his principle place of residence to a location outside the city limits in violation of the City of Lauderdale Lakes (City) Charter. Additionally, during the course of the investigation the OIG uncovered information indicating that Commissioner Haynes may have violated Florida law when he voted in the November 2012 general election. The findings of the investigation are summarized below: Allegation One Residing Outside the City Limits Information was provided to the OIG in support of the allegation that Commissioner Haynes had moved his principal place of residence to a location outside the city limits in violation of the Citys Charter. Specifically, Section 3.10 (2) of the Charter states, in part, that A mayor or a city commissioner shall forfeit his office if that person: (f) Has moved his principal place of residence from the City of Lauderdale Lakes. However, it further states that In all circumstances arising under this article, the city commission shall be the judge of the applicability of its provisions. The Broward County Property Appraisers Office public records web site showed that on August 22, 2012 Commissioner Haynes and his wife sold the property where they were residing, 4701 N.W. 41st Court, Lauderdale Lakes, Florida, 33319. A copy of the warranty deed was signed by both Commissioner Haynes and his wife. Further investigation confirmed that Commissioner Haynes did not live at the 4701 property after he and his wife sold it, and that he had not purchased any other properties in Broward County as of July 15, 2013. In an attempt to locate where Commissioner Haynes was living, the OIG ran several record searches. Information was obtained from these searches which indicated that Commissioner Haynes may be residing at 10821 N.W. 73rd Court, Parkland, Florida 33076. This information showed that cable services for the Parkland property were in the name of Commissioner Haynes and his wife and that one of the addresses his cell phone account came back to was the Parkland property. A listing from a credit report agency also showed Commissioner Haynes name to be associated with the Parkland property.

The OIG also ran State of Florida Driver and Vehicle Information Database (DAVID) reports for both Eric and Wanda Haynes to determine drivers license and vehicle registration information. The initial DAVID showed Commissioner Haynes driver license as address as 4701 N.W. 41st Court, Lauderdale Lakes, Florida. His wifes drivers license showed an address of 10821 N.W. 73rd Court, Parkland, Florida. A March 13, 2013 DAVID report indicated that the address on Commissioner Haynes drivers license was changed on January 2, 2013, from the 4701 N.W. 41st Court address to 10821 N.W. 73rd Court, Parkland, Florida address.1 On April 30, 2013, the OIG contacted Commissioner Haynes to request an interview, which was scheduled for May 7, 2013. Another DAVID report was run on May 7th and it showed that the address on Commissioner Haynes drivers license was changed on April 30, 2013 from the Parkland address to 3880 N.W. 39th Street, Lauderdale Lakes 33309.2 A February 6, 2013 DAVID report showed two cars registered to Commissioner Haynes and his wife, a 2004 Nissan and a 2005 Cadillac. The owner information section of the report listed Commissioner Haynes address as P.O. Box 8223, Coral Springs, Florida 33076. Wanda Haynes address was listed as the Parkland address. The OIG researched the Broward County Property Appraisers Office public records web site which indicated the Parkland property was owned by Change Hung Cheng and his wife Le Fan Cheng. The OIG confirmed the Chengs owned the property and spoke to the individual the Chengs hired to manage the property. The property manager told the OIG that the Parkland property was leased to Eric and Wanda Haynes. The lease was from June 1, 2012 to May 30, 2013. The lease agreement was signed by both Eric and Wanda Haynes and the monthly rent was $2,400. The lease contained Commissioner Haynes email address and telephone numbers. The property manager further told the OIG that he mainly dealt with Commissioner Haynes, who was the person he contacted regarding the rent payments. On a few occasions when the rent was late, the property manager traveled to the Parkland property to pick up the payment and Commissioner Haynes was there. The property manager stated that Commissioner Haynes would walk out of the home and pay him in the drive way. In June 2013, the OIG contacted the property management company for the Parkland property and was advised that the Eric and Wanda Haynes were no longer renting the property. The OIG also conducted a neighborhood canvass of residences in the immediate vicinity of the Parkland property. Eight of the ten individuals interviewed by the OIG recalled seeing Commissioner Haynes black Cadillac STS parked outside the Parkland property. Some of the individuals recalled seeing Commissioner Haynes entering and leaving the property and several recalled speaking to him, or to him and his wife, outside of the Parkland property. Some of the individuals believed Commissioner Haynes resided at the property, but most stated they did not know if he lived there.

Florida law requires that driver license holders must notify the Department of Motor Vehicles, Driver License Division, of a change of address within 10 days of moving. 2 The DAVID report also shows that Commissioner Haynes mailing address was changed from P.O. Box 8223, Coral Springs, Florida 33076 to 3880 N.W. 39th Street, Lauderdale Lakes, Florida 33309. The report also indicated that the same address changes were made on May 1, 2013. On May 7, 2013, the OIG interviewed Commissioner Haynes, who stated that he sold the 4701 property in August of 2012. He further stated that he moved his family to the Parkland property and signed a monthly lease to keep his family together. Commissioner Haynes advised that he and his wife have a strained marriage, so he does not live with his wife and two children at the Parkland property. He further advised that he visits his children at the Parkland property and has occasionally slept there. Commissioner Haynes stated that his wife is responsible for providing the financing to pay for the rent, but that he may have signed a few of the rent checks. He noted that he and his wife have a joint banking account. Commissioner Haynes told the OIG that his permanent residence is 3880 N.W. 39th Street, Lauderdale Lakes, and that he had resided there since August 2012. He advised that the 3880 property is owned by Paula Artwell, who he described as a family friend. He stated that Ms. Artwell allows him to live rent free and she also does not charge him for utilities. During his interview, Commissioner Haynes showed his drivers license and pointed out that the address on the license, 4701 N.W. 41st Court, Lauderdale Lakes, Florida 33319, was not correct. He stated that in the week before the interview he had contacted the Department of Motor Vehicles and changed his address to the 3880 address. On May 14, 2013, the OIG interviewed Paula Artwell. Ms. Artwell stated that she is the owner of the 3880 property and has allowed Commissioner Haynes to live there rent free since August 2012. Ms. Artwell stated that Commissioner Haynes is at the home six days a week, usually from around 9:00 p.m. to 6:00 a.m, and that when he first started sleeping there, he slept in the garage, but he eventually moved into one of her bedrooms. During the course of its investigation, OIG Special Agents drove by the 3880 property on several occasions at various times and never saw Haynes black Cadillac STS parked there. An agent also drove by the Parkland property on a few occasions and only once was Haynes Cadillac observed at that location. In addition, the OIG contacted Wanda Haynes for an interview and she responded that she would get back with the OIG with an answer. Thereafter, after having been re-contacted by the OIG, she declined to appear for an interview. On June 10, 2013, during a public workshop, the issue of Commissioner Haynes residency was discussed by the City Commission. Commissioner Haynes represented to the Commissioners that he had been residing at 3880 N.W. 39th Street, Lauderdale Lakes 33309 since August, 2012. Based on the information he provided, and pursuant to its authority set forth in Section 3.10 (2), the City Commission decided not to remove Mr. Haynes as a Commissioner. Allegation Two Possible Violation of Florida Election Laws During his May 7, 2013 interview, Commissioner Haynes told the OIG that in February, 2013 he changed his voter registration address from his old residence, 4701 N.W. 41st Court, Lauderdale Lakes, Florida, 33319, to his new residence, 3880 N.W. 39th Street, Lauderdale Lakes 33309. To verify this information, the OIG contacted the Broward County Supervisor of Elections (SOE). On May 22, 2013 the OIG met with personnel from the SOE and they provided the following information: From 2006 to February 26, 2013, the address Commissioner Haynes had on file with the SOE was the 4701 N.W. 41st Court address. On February 26, 2013, Commissioner

Haynes mailed a change of address form to the SOE requesting that his address be changed from the 4701 address to the 3880 N.W. 39th Street address. The change of address form was signed by Commissioner Haynes and date stamped February 26, 2013 by the SOE. The SOE personnel advised the OIG that Commissioner Haynes voted in the general election on November 3, 2012, utilizing the early voting process, and that he cast his vote from the Downtown Main Library location. They further advised that voters are allowed to vote early at specific early voting designated locations outside of their normal precinct locations. The SOE personnel further told the OIG that Commissioner Haynes may have violated Florida election laws if he voted in the general election using the 4701 address, since he was no longer residing at that location. On May 23, 2013, the SOE provided the OIG with the early voting certificate for Commissioner Haynes. On July 9, 2013, the OIG interviewed Mary Hall, Director of Voter Operations with SOE, and Patricia Nesbit, the Elections Day Operations Director of the SOE. Ms. Hall and Ms. Nesbit were advised that Commissioner Haynes had told the OIG, Lauderdale Lakes City Commissioners, and others that as of August 2012 his permanent residence was 3880 N.W. 39th Street, Lauderdale Lakes, Florida. They were further advised that Commissioner Haynes had failed to provide notification to the SOE of his new address or to properly change his address by submitting a voters registration application with the SOE until February 2013 approximately four months after the November election. Ms. Hall and Ms. Nesbit stated that its the responsibility of the voter to update the information on his voter registration profile as the SOE does not verify every voters personal identification information. They advised that the SOE will only use the information provided by the voter and that it is up to the voter to comply with the voting laws as they relate to voter registration. They also advised that Commissioner Haynes could have made an address change prior to voting by calling, emailing, or filling out a new voters registration application prior to or on the same day he voted in the early voting process. Ms. Hall and Ms. Nesbit both opined that Commissioner Haynes failure to change his address with the SOE prior to voting in the November election may be a violation of Florida Statute (F.S.) 101.045, and they suggested the OIG contact the Florida Department of State, Division of Elections, regarding this issue.
