Re: (U//FOUO) Potentially Responsive CIA Documents

Forwarded to Mr. Dan Levin for Handling by the
Executive Office of the President Staff

Dear Mr. Marcus:

(U//FOUO) The purpose of this letter is to memorialize a

process about which the Commission is familiar, but which has
not yet been reduced to writing. As you know, consistent with
longstanding practice, when the Central Intelligence Agency
(CIA) reviews documents located in response to the Commission's
document requests, the CIA identifies those documents that
require coordination with the Executive Office of the President
(EOP) because they are addressed, sent to, or received from the
EOP or because they record communications with or coordinated by
the EOP. This coordination process is affected through the
Executive Branch's point of contact for the Commission, Mr. Dan
Levin.

(U//FOUO) The attached list identifies the various bates-

stamp page numbers of documents that Mr. Levin has advised have
been handled by the EOP staff. With respect to these documents,
Mr. Levin has informed CIA that the documents corresponding to
the Agency's sequential bates-stamp numbers on the attached
lists have been handled by the EOP Staff pursuant to
arrangements established between the EOP and the Commission.

Dear Mr. Marcus:

(U) This responds to Item No. 33 of DCI Document Request

No. 8 (DR #8), issued by The National Commission on Terrorist
Attacks Upon the United States (the Commission) on 3 July 2003.

(U) This production includes document Nos. 0801543 through

0801728, all of which are responsive to Item No. 33 of DR #8
pertaining to materials given by the Counterterrorism Center to
the DCI. All of these documents are, by prior agreement, being
retained by the Agency and are available for your inspection at

produced in the following categories of restricted access:

1. Document Nos. 0801543 through 0801620 are

available for review in the Commission's reading room at

2. Document Nos. 0801621 through 0801624 are

documents to which, by prior agreement, only the Honorable
Thomas Kean, the Honorable Lee Hamilton, Mr. Philip

4. Document Nos. 0801701 through 0801706 bear

have access. These documents have been placed in a file

5. Document Nos. 0801707 through 0801728 include

information relating to a subject matter to which only the
Commission's teams headed by Mr. Doug MacEachin,

| 9/11 closed by statute |of f ice at CIA headquarters.

(U) For documents described in the above paragraph No. 2,

it is our understanding that the "Hurley Team," in its review of
documents falling into the subject compartmented category, will
identify those documents for which other Commission teams
require access. This understanding is important, as without
this review, some Commission teams may not learn of important
responsive documents.

(U) In a number of cases, Mr. Dan Levin, the Executive

Branch focal point for Commission matters, has requested that we
remove certain documents appearing in a package of documents
being produced with this response. In such cases, we have
replaced the document with a placeholder indicating that the
document(s) have been removed. Please contact Mr. Levin
regarding the handling of removed documents.

(U) Please note that materials being produced with this

letter include a variety of talking points, briefing slides, and
other materials that we have located through a variety of
electronic and physical searches. In the absence of routing
information or some indication regarding the use to which a
particular document was put, the inclusion of these materials
does not necessarily mean that they were used as talking points
or briefing materials. Likewise, the absence of talking points,
briefing slides, or other materials concerning a particular
subject does not establish that a particular topic was not
discussed between officials, but only that no materials were
likely drafted for that particular topic.

(U) CIA has attempted to mark all documents that contain

information about Zacarias Moussaoui in the upper right-hand
corner with the letters "Mous." Due to the volume of this
production, there may be some documents relating to Moussaoui
included in this production that we inadvertently failed to
appropriately mark as "Mous" documents. The Commission should
take particular care with the Moussaoui documents as they are
not only classified, but are also subject to the Moussaoui Non-
