Petitioners, by undersigned representatives, respectfiilly state that:

Section 11. Indirect Initiative. Any duly accredited people's orgarizaiofl, as defined by law, may file a petition fot inditect initiati-re with the House of Representatives, and other legislative bodies. The petition shall contain a sunmary of the chief purposes and contents of the bill that the organtzaion ptoposes to be enacted into law by the legislature.
The procedure to be followed on the initiative bill shall be the same as the enactmeot of any legislative measure befote the House of Reptesentatives except that the said initiative bill shall have precedence ovet the pending legislative measures on the committee.
The Petition proposes the eriactrnent into law by Congress of an Initiative BiII tided "ANI ACT TO STRENGTI{EN THE PEOPLETS RIGHT TO INFORMATION", also to be known as the "PEOPT F'-'S FREEDOM OF INFORMATION ACT''.

From the plain meaning of ptovisions of RA 6735 there is no question that a, Petition fot Indfuect Initiative may be fiIed with the House of
Representatives. However, there is arrrbiguity as to whether RA 6735 allows the

filing of a similar petition with the Senate. While Section 3 (b) of RA 6735 speaks of "Congress" (which, by Article VI, Section 1 of the Constitution "consists of a Senate and a House of Representatives"), Section 1L speaks of "the House of Representatives, and other legislative bodies". Not only is the Senate not spelled out in conftast to the House of Reptesentatives, the phtase
is also stated in the plural.
Resort to the legislative record on RA 6735 will likewise not be instructive to the resolution of the ambiguity. RA 6735 is a consolidation of Senate Bill No. 17 passed on Thitd Reading on 28 Septembet 1,987, and House Bill No. 27505 passed on Thitd Rearling on 24 Ap.il 1989. The Senate version confined itself to a system of initiative and referendum in local govemrnent units, adopting what the Senate's main sponsor, Senatot Neptali M. Gonzales, descdbed as "a cautious approach". G.ecord of the Senate, Vol. 1, No. 33, p. 871) In contrast, the House vemion coveted national laws (and even the Constitution). It provided for "Indirect Initiative" in Section 7 thereof, from which Section 17 of RA 6735 was adopted verbatim, except N thzt point it still did not include the phtase "and other legislative bodies". The phrase appeared in the Conference Committee Report on the disagteeing provisions of Senate Bill No. 77 ard House Bill No. 27505 approved by the Senate and the House of Representatives on 8 J*. 1989. An exarrination of the transcript of the conference committee meeting, however, does not disclose a discussion specific to the adoption/addition of the phrase "and other legislative bodies".

Given that Congress is the body pti-*ily rnvolved i" g.ri"g course to an exetcise of Indirect Initiative under RA 6735, Petitioners respectfuIly submit that the filing of this Petition calls for the Senate's exercise of its power and prerogative to contemporaneously resolve the ambiguity, ffid to decide whether or not RA 6735 allows the filing of this petition with the Senate.
Petitioner's position, and which we plead to this Honorable Senate, is that the phtase "and other legislative bodies" in Section 71 caurr be given a reasonable, just and legally valid intetpretation as necessarily including the Senate, and that therefore this Petition can be given due course.

10. RA 6735 urith respect to the enactrnent of laws finds its wellspring
from Sections 7 ar'd 32, Artcle Vf, of the Constitution, which provide: Sec. 1. The legislative power shall be vested in the Congress of the Philippines which shall consist of a Senate arnd a, House of Representatives except to the extent reserved to the people by the provisions on initiative and referendum.

11. The Supreme Court has held that "provisions for initiative and referendum are liberally construed to effectuate their pu{poses, to facihtate and not to hampet the exetcise by the voters of the dghts gtanted thereby." In the case of Subic Bay Metopolian Authority vs. COMELEC (G.R. No. 125416,
September 26,7996), the Supreme Court said:
x x x Indeed we recognize that "(p)rovisions for initiative and teferendum liberally construed to etfectuate their ^re puiposes, to facilitate and not to hamper the exercise by the voters of the rights granted thereby." In his authoritative treatise on the Constitution, Fr. Joaquin G. Bernas, S. J. treasures these "instruments which can be used should the legislanrre show itself
indifferent to the needs of the people." Impelled by a sense or ugency, Congtess enacted Republic Act No. 6735 to give life and form to the constitutional mandate. Congress also interphased initiative and tefetendum into the workings of local governments by including a chapter on this subject in the Local Goverrment Code of. 7997. And the Commission on Elections can do no less by seasonably and judiciously promulgating guidelines and rules, for both national and local use, in implementation of these lays. For its paft, this Court early on expressly recognized the revolutionary import of resenring people powet in the process of law-making.
Iike elections, initiative and referendum are powerful and valuable modes of expressing popular sovereignty. And this Court as a matter of policy and doctrine will exert every effort to nurture, protect and promote their legitimate exercise. For it is but sound pubiic policy to enable the electotute to express their free and untrarnmeled will, not only in the election of theit anointed lawmakers and executives, but also in the formulation of the very rules and laws by which our society shall be governed
and managed.

The purposes of initiative as provided in the Constitution and the meaning and intention of authots of RA 6735 would be best effectuated if the phrase "and other legislative bodies" is interpreted to cover the Senate for pu{poses of the filirg and consideration of a Petition for Inditect Initiative. Under the Constitution and the Rules of the House of Representatives and of the Senate, fot a bill to become law it must be passed by both Houses on three readings. The exercise by peoplers organizatons of the Inditect Initiative would be rendered futile if no cor:ntelpart petition is allowed to be filed in the Senate, and thete is no sirnilar bill filed by members of the Senate. Even if the House of Representatives pass a bill on third reading, and the Senate takes it up as a bill ftom the House of Representatives, the loss of material time compated to if the measute is taken up simultaneously by both Houses, gready teduces the prospects of enactrnent specially in the case of contentious bills.

4.16. Petitioner Arg I(apatiran Party, also known as the Alliance for the Common Good, is a registered national political puffy that stands on a platfotm and specific policy objectives aimed ^t enhancing the common good, promoting the politics of virtue and the politics of duty.
4.17. Petitioner Action for Economic Reforms is an association of concerned citizens organized as a non-stock, non-proEt corporation under Philippine law, doing research and advocacy work on economic development ard govemaflce $sues.
4.18. Petitioner Philippine Centet for Investigative Jorrnalism CI) is an independent, nonprofit medi^ agelacy of journalists that specializes in investigative reporting. The PCIJ believes that the media play crucial role in scrutinizing and sttengthening democratic
^ institutions, defending and asserting press freedom, fteedom of information, and fteedom of expression. T'he PCIJ contributes to this end by ptomoting investigative reporting on current issues in Philippine
society and on matters of large public interest.
4.79. The Center for Migtant Advocacy - Philippines (CMA) is an advocacy group, drrly otganized and existing under Philippine law, that promotes the rights of overseas Filipinos - land- or sea-based migmnt wotkers and Ffipino immigrants - and their families. The

Center works to heh improve the economic, social and political conditions of migrant Filipino families through policy advocacy, information dissemination, networking, capability-building, and direct
assistance.
4.20.The Freedom from Debt Coalition (FDC) is a nationwide multi-sectoral non-sectaiafl and plutalist coalition, duly orgarrized and existing undet Philippine law, conducting policy advocacy work and campaigns to rcilize a common ftamewo* and agenda, for economic development. FDC's mandate is to formulate and campaign for comprehensive alternatives in public finance, essential services, and climate sectors, and to fight for specific changes in policies, processes and structures with the end view of making economic justice a, rcalrty4.21. WomanHealth Philippines is a national otgtnizanon that promotes, advances and defends women's rights to health, reproductive and sexuality towards .u/omen's empowerment in
self-determination society. 4.22. Pafiao ng Mangagaura is a sector il puq that is pushing for an agenda of: defending the workers' right to orgafl1ze, unionize, collectively bargain, and to sttike; abolishing the cheap labor policy and implementing the constitutional provision on the living wage; protectiflg the employment and secutity of tenute of all wotkers - public and pdvate; instituting labor protection policies against globalization; and implementing upgraded labor standards and benefits for workers.
4.23. Barrrtay Kita is a coalition of mote than fifty (50) otganzatons, registered as a non-stoch non-profit otgantzatton under Philippine law, advocating for uansparency and accountability in the
extractive industry.
4.24. The Philippine Alliance of Human Rights Advocates (PAHRA) is a non-stock, non-ptofit alliance duly registered under the Iaws of the Philippines. It is a campaign and advocacy center with a membership of more than thirty (30) NGOs and peoples' orgarizzt:lons nationwide, involved in advocating the rights of vadous groups and sectors including peasants, workers, urban poor, women, childten, indigenous peoples, and victi:rrs of hu:rran dghts violations. 20. The United Nations Human Rghtr Committee, in its General Cornment No. 34 issued at its 702nd session on 77-29 Juily 2011 in Geneva,
expounded on the right to information aspect of Article (19) 2 of ICCPR:
Article L9, pxagraph 2 embraces a dght of access to infornation held by public bodies. Such information includes tecords held by a public body, tegatdless of the form in which the information is stored, its source and the date of ptoduction.

To give effect to the right of access to informad.on, States parties should proactively put in the public domain Government infonnation of public interesl States parties should make every effort to ensute easy, prompq effective and ptactical access to such information. Sates parties should also enact the necessary procedutes, whereby one mly gllrt access to information, such as by means of freedom of information legislation. The procedutes should provide for the timely processing of requests fc,r information according to clear rules that are compatible with the Covenant. Complementing the Bill of Rights provision on FOI is the state policy of full disclosure of all state transactions involving public interest. Article II (Declaration of Pdnciples and State Policies), Section 28 teads: Subject to reasonable conditions prescribed by Iaw, the State adopts and implements a policy'of full public disclosue of all its traflsactions involving public interest.

While the Supreme Court has consistently held that the right to inforrnation under the Bill of Rights is self-executorf, it lacks the substantive and procedural details necessary fot its effective and predictable
implementation.

Thus, the Initiative Bill has the following chief specific pu{poses:
25. First, it seeks to address the lack of definite scope and limitations to the right to information. The constitutional provision states that access to
inforrration shall be afforded our citizens "subiect to such limitations as may be provided by l^\r/'. Congress has yet to fulfill this mandate. While the Supreme Court has stepped in by enumerating a number of exceptions thtough jurisprudence, the expected lack of exactness in the absence of legislation opens the enumeration to wide intelpretation. In Chavez vs. PCGG (G.R. No. 1,30716, December 9, 1998), the Supreme Court noted that "there are no specific laws ptescdbing the exact limitations within which the right may be exercised or the correlative state duty may be obliged." Given this, it has been easy for govefnment agencies to set up discretionary exceptions, and citizens have to deal with a litigious process to challenge a denial of access.

In practice, goveflrment has evaded the application of this plnin provision by applyrng instead letter (a) of the same section: "Act ptomptly on letters and requests. All public officials and employees shalf within fifteen (15) working days ftom teceipt thereof, respond to letterc, telegrams or other means of communications sent by the public. The reply must contain the action taken on the request." Thus, a response within fifteen days (such as mere acknowledgement of the request with indication of the steps being taken) without Santing access is deemed substantive compliance.

27. Third, it seeks to addtess the absence of sanctions for unlawful or delay of access to infotnation. Because of the lack of definite
procedure as well as the absence of definite scope and limitations, it is difficult to enfotce the general administtative ot penal sanctions provided irr RA 6713. Putting in place effective sancdons will work as a detertent against violation of the right to information, or alternatively, as a mechanism for accountability when the right is violated.
28. Beyond the above specific pulposes, the Initiative Bill will
also
promote the genetal pqposes that the ftamers of the Constitution sought to achieve with the express recognition of the tight to information and the adoption of full disclosure of ttansactions as a state policy. The twin constitutional provisions of the dght to infonnation and the policy of full public disclosure of govemment transacdons are intended to promote the fundamental precepts of democracy, peoplers participation, public office being a public trust, governmeflt accountability, prevention of corruption, and
responsive decision-making.
These precepts ate emphaically expounded by the Supreme Court in its decisions relating to the dght to infonnation. In Legaspi vs Civil Service Comrnission (G.R. No. 72179,May 29,7987), the Supreme Court said:

The postulate of public office as a public trust, institutiontliz.ed in the Constitution (in Art. XI, Sec. 1) to protect the people from abuse of governmental Power, would certainly be were empty words if access to such nfotmaion'of public concefn is denied, except
under limitations presctibed by implementing legislation adopted pursuant to the Constitution.
x x x It is in the interest of the State that the channels for free political discussion be maintained to the end that the govefirment may perceive and be responsive to the people's willYet, this open dialogue can be effectiv'e only to the extent that the citizenry is inforrned and thus able to formulate its will intelligendy. O"ly when the participants in the discussion are arwate of the issues and have access to informadon relating thereto can such beat fruit.
The right to infoonation is an essential premise of a meaningful tight to speech and expression. But this is not to say that the right to information is merely at:- adjunct of and

The right to information goes hand-in-hand with the constitutional policies of full public disclosute and honesty in the public service. Second, it seeks to address the absence of a uniform and effective ptocedure for access to information. Third, it seeks to address the absence of sanctions fot unlawfirl denial or delay of access to information. Fourth, it introduces mechanisms to facilitate better citrzer, access to rnformation, such as providing standatds for recotd keeping and mandating the pro-active disclosure of classes of information imbued with high public interest.
Beyond the above specific pu{poses, the Initiative Bill wiII also promote the general purposes that the framers of the Constitution sought to achieve with the e{press recognition of the right to information and the adoption of fiill disclosure of tansaclions as state policy. Each 2 government agerlcy shall establish'a system to trace the status of all tequests 3 for infonnation received by it. 4 (d) The tequest may indicate the requesting parry's preferred mode and 5 means of teceiving the information requested, ptovided that the mode and 6 means are reasoflable, taking into consideration equipment normally avulable 7 to the concerned govefiiment agency.
