Neal, internal affairs investigator for the police department. Lieutenant sir, could you

please read the affidavit into the record? THE WITNESS: Yeah. I, Roger Ramirez,

being first duly sworn hereby state my name is Roger Ramirez. I work for Miami-Dade County My date of

Public Schools Police Department. birth is 12-1-71. 305-219-1284.

statement to Sergeant Edward Torrens who has identified himself as internal affairs investigator for the Miami-Dade Schools Police Department, State of Florida, in connection with case number IA 12-001, 002, 003, 005 -- I was about the say four but -- 006. I am of

drugs or alcohol at this time.

Lieutenant sir, are you appearing here today without any promises and without any threats or duress to provide information in an investigation being conducted by the Miami-Dade Schools Police Department? THE WITNESS: MR. TORRENS: Yes, I am. Sir, are you aware that your

you say may or may not be used at a departmental here or in the court of law? THE WITNESS: I'm aware.

DIRECT EXAMINATION Q (By Mr. Torrens) Thank you sir. So the

reason why you're here today regarding -- actually two reports pertaining to T.M. information that you were contacted, what do you know about T.M. as far as the young man, I mean outside the media. I mean

as far as for the department, were you contacted by anyone or to gather information, anything about T.M.? A case. Q A Q A Only on one case? Yeah. Okay, then let's explore that. The case that I was contacted on, I don't Both cases or -- I was contacted on one

remember the date but Major Kitchell contacted me and called me after the incident and the media happened with T.M. and asked me to research that to contact the officer and find out what happened with the case. I believe the case was a found property

far as you can recollect? A Yeah from what I recollect, I'm sure you

got the report there but from what I recollect he told me that there was a case where T.M. was found by the school administration with a clear baggy with possibly suspect marijuana residue in it, and also a pipe, tobacco smoking pipe, that he alleged was not his. So at that time I was not made aware of that

case at that time because it was a found property but to my recollection Officer Dunn and administration came to an accord that the best way to handle that was to label it found property and I believe the school suspended T.M. for 10 days and recommendation for expulsion. I really don't know

what they did but I know that was the minimum they did. Q -A Q Yes I did. -- to the major. Any other further Any other direction by the Okay and you communicated your findings to

Major after that as far as you can recollect? A No I think the question was, was why was

it handled in that way and like I told him I was not made aware of -- I'm usually not made aware of lost

property cases directly, you know, mostly every arrest, but this does not result in an arrest. Q A Q A Q Right. So I was not made aware at the time -Okay. -- of the particulars of the case. Okay sir, have you had any contact with

any members outside of our agency about any other law enforcement agency contact you about any case involving T.M.? A Q No I believe -- no. Directly, no.

Okay, have you had any contact or has the

media attempted to contact? A Q Me directly, no. Okay, you said you didn't have any

knowledge of the particulars in this other case. Did you have a need to print out this case? A Q A No. Never did? No because the major didn't ask me to I mean obviously he read it, he knew I mean, I guess he wanted to know

print it out. what was there.
