2. On 05 May 2010, I attended the assembly of the ________ political party in our plaza.

3. During said assembly, _______________, a chief of the Philippine national police-crime Investigation and detention Group (PNP-CIDG) regional office in ________, went up the stage, raised the hands of ____________, a mayoralty candidate in our municipality, and urged the crowd to vote for said candidate.

4. I was able to record said incident using my own video camera. The video footage in support of this complaint in hereto attached and made integral part hereof as Annex ________

5. I attest that ________ s act of going up the stage during said assembly, raising the hand of _________ and urging the crowd to vote for said candidate is what is exactly recorded in my own video camera .

6. Said act of ____________ constituted intervention of public officers and employees which is a prohibited act under Section 261 (i) of the Omnibus Election Code, which provides as follow:

Sec. 261 (i) Intervention of public officers and employees. Any officers or employee in the civil service, except those holding political offices; any officer, employee, or member of the armed forces of the Philippines, or any police force, special forced, home defense forces, barangay self-defense units and all other Para-military units that now exist or which may hereafter may be organized who directly or indirectly, intervenes, in an election campaign or engages in any partisan political activity, except to vote or to preserve public order, if he is a peace officer.

2. I am a barangay secretary of barangay ______________.

3. During the campaign period, specifically on 10 April 2010, I attend the meeting of all the barangay officials of our barangay.During said meeting _________ who is mayoralty candidate was present therein.

4. During said meeting, ______________, our punong barangay, informed _________________ that he and all seven (7) members of his sanguniang barangay have agreed to vote for him/her if he/she will give his/her commitment to undertake renovation of the barangay hall, to which ________________ acceded.

5. To corroborate said fact is picture taken during the meeting showing _______________, our punong barangay shaking the hands of __________________, as a gesture of agreement. Attached hereto and made integral part hereof as AnnexA, is a copy of said picture which was secretly taken by me in the guise of reading text messages in my cellular phone.

6. Said act of _________________ violates Section 261 (a) (2) of the Omnibus Election Code which provides follows: Sec.261 Prohibited Acts.- the following shall be guilty of an election offense: xxx (a) Vote- Buying and Vote- Selling-

(1) Any person who gives, offers or promises money or anything of value, gives or promises any office or employment x x x in order to induce anyone or the public in general to vote for or against any candidate or withhold his vote in the election x x x

(2) Any person, association, corporation group, or community who solicits or receives, directly, and indirectly, and expenditure or promise of any office or employment, public or private, for any of the foregoing consideration.

3. __________, after handing me the leaflet, tried to convince me to vote for _________. A copy of the leaflet that was handed to me by __________ is hereto attached and made integral part hereto as Annex _____.

4. Said incident which took place just near the polling place and within thirty (30) meter radius thereof, was witnessed by __________ who was with me when I was approached by _______________. The testimony of _________, in support of this complaint is hereto attached and made integral part hereto as Annex _____.

5. Said act of _________constituted unlawful electioneering which is a prohibited under Section 261 (k) of the Omnibus Election code, which provides as follows:

Sec.261 (k) Unlawful Electioneering. it is unlawful to solicit votes or undertake any propaganda on the day of registration before the board of election inspectors and on the day of election, for or against any candidate or any political activity within the polling place and with a radius of thirty meters thereof.

2. On 05 May 2010, _________, a mayoralty candidate together with a group of armed men went to my residence. _________ informed me that he was able to gather information that I, my family and most of the workers of the factory that I own were voting for _________, his competitor for the mayoralty position in or municipality.

3. ________ told me that I should just refrain from voting on 10 May 2010 if I will vote for _________. He also told me that I should convince my family and my workers to do the same. Otherwise, a fire from an unknown origin will burn down my factory.

4. Said incident was witnessed by my wife _____________ who was present during my conversation with _____________. The testimony of my wife in support of the complaint is hereto attached and made integral part hereto as Annex _____.

5. In support of said visit by _________, my son _______________ was able to take picture of the above incident with _________ together with his armed men seated in our living room and talking to me and my wife. A copy of said picture taken by my son is hereto attached and made integral part hereof as Annex_____ and his testimony in support of said pictures as Annex______.

5. Said act of _______________ constituted threats and intimidation, terrorism, use of fraudulent device or other forms of coercion which is a prohibited act under Section 261 (k) of the Omnibus Election Code, which provides as follow:

Sec. 261 (e) threats, intimidation terrorism, use of fraudulent device or other forms of coercion.- any person who, directly or indirectly, threatens, intimidates or actually causes, inflicts or produces any violence, injury, punishment, damage, loss or disadvantage upon any person or persons or that of the

immediate members of his family, his honor or property, or uses any fraudulent device or scheme to compel or induce the registration or refraining from registration of any voters, or the participation in a campaign or refraining or desistance from any campaign, or the casting of any vote or omission to vote, or any promise of such registration, campaign, vote or omission there from.
