Biker's Rules for Transportation

America has moved from a democracy to a monarchy. Unfortunately without a official house of commons (like the British Empire), royalty strips away the the effect of a house of commons by holding up a banner of a Constitution, while the stacked pyramid of peers fighting for the position of future dictators; who now are above law - by force of status instead of logic. Both American parties are in support this monarchy type of empire; thus only closure is the prime interest with legal actions; instead of fairness or justice. Acceptance of the situation means that those of us that are bikers must be faithful to our important Ruler's intent, and not the minor executioner peer dictator's method of leadership. American cities have been incorporated into anarchy; so we cannot allow ignorant attorneys write laws for bike transportation, i.e. color of law - that abridges international and American civil law; especially when they know nothing about the mechanics of the bicycle. So we are the ones responsible to write the rules for traveling via our experiences, and through engineering guidance. Using a bike for local neighborhood traveling is different than Racing for a century ride; and the bike should be properly suited to the rider for the occasion. When one is into racing, he desires performance through efficiency; however the sporty traveler is out for comfort, traction, and reliability; a somewhat different universe and speed range to accommodate goals. One wants quick stopping power, so skinny high pressure tires are not recommended. Fat tires are better with air pressure less than 60 psi to grip the road better. The 1.375 international standard in 26 inch or 24 inch diameter is the best sizing for average size adults. 24 inch tires should be the minimum size for road transportation functions, unless one is very diminutive or only need a short range utility bike, and then the 16 inch folders become the 'road bike' of choice. Yes, as a compromise, the 16 inch folder, or European Moulton, works well enough for me to do a couple of metric centuries to solve curiosity; but believe me, I would choose less abuse by using a teenager's 24 incher. Center pull brakes are better then side pull for ease of tire servicing; i.e. for those that wish to crowd the street curbs to enhance nail seduction(!). The gutter usually has trash, tacks and nails swept into them by vehicle motion, so contrary to popular belief, they should be avoided. Also, dodging in and out between parked cars may have been acceptable in the past when the majority of vehicles were smaller, and less in number, but now it has become a vary dangerous practice because of poor visibility, and the higher speeds of more efficient bicycles. One must command his lane of traffic if no marking for bike travel exists; and a local band of bikers must support this view! And not accept the 'legal' criminal inversion of liability that converts the victim into the criminal. The dawdler riding the bike did not get out of my way, so I am justified to run him down! This currently is the view of our dedicatory system that supports the abusers of society i.e. those of more status. Instead of protecting weaker pedestrians that cannot afford to compete with automobiles (that are sold for race-car performance instead of reality, conservative convenience). Let us look at Bike speed of travel as a factor to determine suggested range a rider should select to 'rule'; as his neighborhood. A 60+ year old in good shape can hold a steady 8 mph, so environmental range is about 4 miles. Yielding a set* of about 1 hour of duration; whereas, a 20-40 year old will hit about 12 mph, so range is expanded to 12 miles for 2 hours of duration. Hold this thought for the arrival of the ebike; the answer for a very safe transporter for bikers, especially aging ones. This will give the weaker sex (old males?) the ability to keep up with the sexy physically fit young ladies, when

joining in with weekend rides of about 30 miles, while at the same time apportioning a realistic exercise agenda. In the English language, the ebike is the true NEV, whereas the American courts have converted NEV into a slang expression for an electric 4 wheel automobile designed for limited travel, in spite of the fact that the majority of the world (everywhere except America) NEVs are 3 wheelers? This attitude truly makes the DMV into a rich man's toy, basically useless to replace an automobile! This fiasco of ignorance of language, and basic engineering creates, the ridiculous fiascos of attempting to transfer equity law onto bicycles, including ebikes (as defined by civil law), through ignorance that truly has no justification, or legality. DMV has created a huge program for the acceptance of only their equity tied NEVs - that excludes ebikes and trikes, [the true compact individual NEV.] to force abuse onto those that can ill afford attacks of injustice. Conspiracy? No. Stupidity? Absolutely. This attitude forces us bikers to write logical rules of travel, and stimulate acceptance by DOT, and DPS - giving these organizations more support for them to enforce their Civil law jurisdiction onto resistive municipalities that accept funds to improve the superstructure of a city, but misapply them for prestige and status, the most important goal for wealthy politicians! Looking at 2 cities, Richardson and Carrollton. that both received John Barton's letter of 2011. Richardson welcomes the new travelers by bike, by making Belt line road (a 45mph traffic loop circumnavigating Dallas Texas, available to bikers); whereas Carrollton precinct #3 sets up the street of drive-in traffic for municipal deliveries to city hall, a shopping center, the post office, at a 35 mph speed limit for one block i.e. centered upon this main intersection (that causes a multitude of accidents). It then fortifies police officers with the BS that if the sign says 35 mph, you must do 35! And not in kilometers. This becomes probable cause to stop the bike for a legality and safety inspection, so as to be able to write a kiddie violation converting a bike into roller skates, in conformity to a vague ordinance that is in violation to DOT Civil law. On Belt line road in Richardson, traffic signs proclaim bikes have the right of way, and cars must yield, whereas in Carrollton it is the other way around. God help you if you have a unusual bike, trike, electric assist, or hybrid electric motor scooter, because a policeman on a CHIPs motorcycle will take you on a ha ha high speed chase, because it takes a bit of time to pull into a safe zone, and you can be thankful he doesn't charge you for evading him. [He has a bunch of voluntary witnesses that the etrike was speeding, doing wheelies, turning on two wheels while victim was noise polluting i.e. with a hearty HI HO Silver...Away!] So what does the Carrollton DA do to shore up some of the problem? He writes a new ordinance that is titled Illegal use of Roadway. This is another attempt to go after the elderly bikers that cannot do more then 8 mph in the flat?? And those that cannot hold 20 mph up a 5% grade? This demonstrates the ignorance of bike mechanics, while passing rules against them. DMV regulations only concern those with a driver license, driving DMV recognized vehicles; the safety contract with the State. The prime contract for equity law? Is the Driver's license - that is unavailable from the DMV to a biker... Using Carrollton as the Crime Center, traveling West on Jackson we come to Josey. We have 3 available lanes of traffic, center for left turns, middle for straight travel, and right for right turns only. When I group ride with the CCC, we choose to go straight on Jackson (a DOT published bike route) and use the middle lane to cross Josey for a 13 second trip to go past a fire station. Jackson ahead is a 40 mph zone at this point (that the municipal court has a 1/16 inch torrence on its boarder). Jackson is a

street that has no usable sidewalks; that would be dangerous for the group, so Jackson (a rough street for vehicles smaller then pickup trucks, and vehicles with tires smaller than 14 inches in diameter) is truly not a street of choice. But be a Lone Ranger is asking for a world of hurt that is far greater then the risk the uncombable street has to offer, for transportation. Keller Springs is an alternate East West street but has been made dangerous because of lazy officers refusing to hold down the 50 mph speeders (as high as 100 mph) that pervade that area as owners; that can afford tickets - as trivia trophies. Obviously police prefer to disturb the peace of little old men driving down almost vacant streets on bikes and stubbornly refuse to follow state law! Believing the mayor will protect their indiscretion. Chief of police wants bikers to use the crosswalk to cross Josey now, putting School Children in harms way i.e. if you ride across. By DPS rules I have to dismount and push my trike across, while being crippled means that I can get halfway, making me and my trike stationary while cars swirl about me. According to the officer; this is done for my safety, and is the reason for the DA manufacturing law of Illegal use of Roadway, illegally! The right hand curbside on Jackson to cross Josey via motorcycle or bike has a bad reputation for hit and run accidents. Knocking down a school kid on the side walk is dismissed, because the victim could crawl away, and is usually terrified of police. If I report the incident, I will be criminalized, so I have to follow the other successful hit and run criminals, and hope the victim doesn't broadcast the crime? Due to lack of reporting, and low injury level, these accidents are just written off, Auto drivers believing they have right away, side swipe and just ignore damage done. Since liability is transferable by status in Carrollton (and other communistic municipalities like it), creating extra risks for the cyclists, especially those of us that are gullible, law abiding and honorable. Beware of the one factor the US is now famous for. USA now stands for 'Unlimited Stress Aggravated!' Everything is now hi tech, that is used to cover-up stupidity. Safe passage for example means to drive through the meanest district in St Louis; without a firearm. Heavens, we just don't want the criminal element to become extinct! Expect a ride to the corner store to become a dangerous trek that requires food, water, tools and weapons to complete i.e. miles and miles of safe travel as viewed by peace officers. My situation is unique as a retired engineer whose life savings were stolen by Attorneys. I have marked my jurisdiction of ridding by a 7.5 mile radius about my house (47 square miles) of territory that truly is identified as my domain (jurisdiction). I follow DMV, DOT and DOT regulations, but I am now being held to higher illicit standards because my potential damage to others is minimal?? Since I am retired, I use time share traffic as my system of travel. I use a system coined with Carrollton's mayor Pro Tem as Road Vampires for the time index i.e. With 9:30 AM to 4:00 PM the window I use for riding, and that is about the time the 'hound dogs can safely lay in the street' here in Carrollton. Just avoiding the lunch hour is about the closest thing to any traffic excitement that I deal with. If held up at the Library after 5:00 PM, I use the only safe sidewalk that I have found in Carrollton, that is not a twisty wild ride for a bike, nor a danger to my broken back, along with very little school kid traffic. Since my trike is set up for road travel that Carrollton ignores, the lighting system is excellent for scooting a couple of blocks to visit friends at night, or go to a park display or activity. I am an extreme conservative, with 50 years of 70,000 miles of biking experience. Rush hour is not a problem for me, as long as I follow Road Vampire rules as an addition to DPS Rules of the Road.

My trike is the only street legal machine (by specifications) in Carrollton that is safe in rain, snow, power outage (at least for 40 miles of traveling in failure). In fact solar recharging for my ebikes have been curtailed by Carrollton's creepy attitude, again defeating progress by protecting status quo, that is now very obsolete!
