Examples of Green Buildings in the Greater MSA W. M. Jordan Company recently celebrated the expansion of its Richmond office with an open house at their Manchester District location. The new 9,508-square-foot office expansion and 4,500-square-foot maintenance shop with related site work will achieve a Leadership in Energy and Environmental Design (LEED) Silver Certification. Green building design elements include bioswales and drought tolerant native plants around the site, oak flooring extracted from another building, low VOC finishes, lighting controls and a high performance building shell and mechanical system. The exterior fa~ade was designed to be reflective of the traditional "Richmond Warehouse." As part of the company's commitment to support the art community, W. M. Jordan will showcase local, original art in its facility.
Liberty Property Trust announced that it is nearing completion on its 77, 708-square-foot Class A office development located in the Westerre Business Park in Henrico County. To be known as the Westerre IV building, the project marks Liberty's second development in the park and the company's first sustainable development project in Richmond. Liberty broke ground on the project at the end of August 2007 and anticipates the building's opening in mid-May. The three story multi-tenant Class A building features an elegant lobby, state-of-the-art telecommunications and fiber optics and a high-tech energy management and security system. To achieve LEED certification, Liberty has registered the project with the U.S. Green Building
Council. Westerre IV has already received pre-certified LEED "silver" status, and Liberty is currently seeking the LEED "silver" certification. The architect for the Westerre IV project is Freeman & Morgan, the general contractor is ARGO Development and Dana Dame, vice president of development is Liberty's project manager. Upon completion, Northwestern Mutual will be the first tenant to move into the building. The company has leased 46,500 square feet of office space on the first floor of the building. David Wilkins, Trib Sutton and Scott Durham of CB Richard Ellis represented Northwestern Mutual in the transaction.
Weinstein Hall, University of Richmond Social Sciences Building was named one of the most environmentally friendly buildings in the world. Expansion and renovation of an existing 15,000-sq. ft. structure on campus enlarged the building to 53,000 sq. ft. Architects and contractors followed the council's guidelines throughout construction and included many environmentally friendly features, including a system that monitors and adjusts fresh air entering the building to improve comfort and save energy. Other features include special parking for carpool and alternative fuel vehicles, with plug-ins for recharging electric motors; special mats at major entrances to remove particles from shoes; and use of recycled steel and other recycled contents. All materials, such as paint and carpeting, were selected for their low "volatile organic compounds," which reduce allergyrelated problems for faculty, staff and students. "LEED certification is a great honor because it proves that the building is sustainable," said Andrew McBride, university architect. "Institutional builders like the University of Richmond are appropriate leaders of this movement because they build for the long term and influence future leaders."

WATER
Fed by the James and Appomattox Rivers, Virginia's Gateway Region has an abundant supply of water and surplus wastewater treatment capacity for increased industrial demand. Most of the region is served by the Appomattox River Water Authority, a public authority supplying potable water to the cities of Petersburg and Colonial Heights, Fort Lee and suburban areas in the counties of Dinwiddie, Chesterfield and Prince George. The raw water is obtained from lake Chesdin, a 3,000-acre reservoir located six miles west of Petersburg on the Appomattox River. lake Chesdin has a safe yield of 77 million gallons per day (mgd), The Water Authority treatment plant has a current capacity of 46 mgd, The Authority makes an average withdrawal of 21.5 mgd from Lake Chesdin. With over 40,000 connections to the system, the Appomattox River Water Authority serves approximately 200,000 people,
The Virginia-American Water Company in Hopewell supplies water to Hopewell, Fort Lee, and suburban areas in Prince George County. The Company withdraws itswater from the Appomattox River near the confiuence with the James River. The treatment plant has a current capacity of 33 mgd and the average total water production is 21 mgd. Eighty-five percent of the water processed is consumed by the industries of Hopewell. Currently the system contains over 8,500 connections. The incorporated towns located in Sussex and Surry Counties operate their own public water systems.

Virginia's Gateway Region is served by two major, regional public wastewater treatment systems, operated by the South Central Wastewater Authority and the City of Hopewell.
The South Central Wastewater Authority operates a 20 mgd capacity secondary wastewater treatment plant that provides service to the cities of Petersburg and Colonial Heights and to suburban areas in the counties of Dinwiddie, Chesterfield, and Prince George. A major expansion of the plant was recently completed, ensuring the accommodation of increased industrial demand in the Gateway Region. The City of Hopewell operates a 50 mgd capacity secondary wastewater treatment plant that serves the City of Hopewell, Fort Lee, and suburban areas of Prince George County. At present, the treatment plant is operating at 32 mgd. Existing industries are the major users of the system, as the plant was designed as a regional treatment facility to treat industrial waste for the City of Hopewell. Sewer systems are also available in several of the incorporated towns located in the counties of Sussex and Surry.
COGENERATION
Cogeneration is the use of a heat engine or a power station to simultaneously generate both electricity and useful heat. In separate production of electricity some energy must be rejected as waste heat, but in cogeneration this thermal energy is put to good use. Renewable energy is energy generated from natural resources-such as sunlight1 wind, rain 1 tides, and geothermal heat In 2008, the United States became the leader in new capacity investment with 20 percent global total investment. In addition, the U.S. surpassed long-time wind power leader Germany to become the top country in total wind power capacity.
Dominion Virginia Power, located in Richmond, VA, is committed to doing its part to reach the Commonwealth of Virginia's goal of 15% electricity from renewable sources by 2025. The company is expanding its renewable generation portiolio to help achieve this goal through wind power, hydro power and biomass stations. Dominion also offers Green Power program designed for customers who want to make their own investment in renewable energy in addition to Dominion's investment that will go above and beyond the renewable generation that they provide. Other such companies invested in renewable energy in and around the region include:
Osage Bio Energy: Operates as a sustainable, environmentally responsible company and will differentiate itself from traditional corn-based ethanol production companies through producing ethanol from regionally grown barley, and exclusive use of KATZEN technology capable of producing ethanol from barley within a 200-mile radius of each plant site. Alstom Power: Alstom is the world leader in integrated power plants for the production of electricity and air quality control systems.
Areva: A world leader in providing reliable, efficient and environmentally friendly transmission and distribution solutions to improve network stability and make electricity available everywhere. Chesapeake Renewable Energy: Helps residents, farmers and business owners select and install renewable energy systems. lntrinergy: Use advanced gasification and combustion technology to convert biomass and otherwise unused hydrocarbons (such as wood residues, industrial scrap, fiber residues, and alternative feedstock) into usable energy. lntrinergy helps its clients reduce their greenhouse gas emissions as well as landfill contributions, and lowers their demand for non-renewable fossil fuels.

Virginia 1s Gateway Region is wired to accommodate virtually all telecommunications needs. local, long distance and cellular telephone service is provided by a number of national companies, including AT&T, Cavalier, Cox Communications, NTelos, SunCom, Sprint, Nextel and Verizon. There are also a number of Hfgh Speed Broadband Internet providers, which include Earthlink, Cavalier, Cox Communications, Comcast and Verizon.

Ace Waste, located in Chester, VA, is a collector and processor specializing in construction and demolition debris {C&D) recy~ cling. They process sorted or unsorted C&D and recycle most of it. The most common materials include cardboard and paper, carpet, concrete, dirt, metal, plastics, wallboard and wood. The center is designed to process 75 tons of construction and demolition debris per hour.

career potential. Professional development courses can be used for teacher recertification 1 skill enhancement and professional growth. Diverse offerings are available including courses in emergency medical technology/ classroom management,
first aid and CPR, educational computer applications and many others.
CONVENTIONAL SOURCES
Large industrial and commercial loans are available to qualified firms through banking
institutions in Virginia 1s Gateway Region and their affiliate holding companies in Richmond. Within the Gateway Region 1 19 commercial banks, which provide 117 offices, serve the area1 along with 5 savings banks providing 19 convenient offices. The overall climate and expertise
of the area's financial sector is excellent and quite conducive to the attraction of new and
expanding enterprises.

GOVERNMENT STRUCTURE
The state and local taxes here are some of the most competitive in the country. Virginia has one of the fairest and most stable tax structures of the 50
states. The Commonwealth has not raised its income tax rate since 1972. Virginia's local governments function according to the independent city concept. When an area is incorporated as a city, it ceases to be part of a county. Citfes levy and collect their own taxes, and county taxes are not imposed within a city's boundaries. Over 10,000 acres of local, state, and national parks throughout Virginia's Gateway Region provide a range of cultural and
recreational opportunities for citizens of all ages. The prime location of the region, with access to the James, Appomattox, and Nottoway rivers, and lake Chesdin, makes all water-related activities very popular.
Virginia was the birthplace of colonial America and eight U.S. Presidents, and the site of many historical battles. The 10-month siege of Petersburg during the Civil War is well documented through museums, battlefields, and other historical parks. A full day can be spent exploring the area's unprecedented history, which includes battlefields and beautiful colonial homes, leaving
plenty mOre to do for future visits.
In addition to the Gateway Region's landmarks and parks, the City of Richmond and Colonial Williamsburg, the capital of the
South and top resource for colonial America, respectively, and many other attractions are located within a day's trip of the region.
The majes~c Blue Ridge Mountains to the west, hundreds of miles of pristine beaches to the east, and our nation's capital Washington, D.C., to the north are all within a 2-hour drive of the Gateway Region.
The Gateway Region's entertainment, historical, and recreational facilities are supplemented by a plethera of arts, science and cultural attractions. Over 20 area museums cover the topics of the arts (Virginia Museum of Fine Arts), science (Science
Museum of Virginia), aviation (Virginia Aviation Museum), horticulture (Lewis Ginter Botanical Gardens) and more. The
extended region's diverse historical attractions include revolutionary sites- St. John's Church (where Patrick Henry made his

The rest of us see the obvious need for a meeting. I am going to put out an agenda shortly, to include Roy's participation and update of whatever he discussed yesterday with David Lu. Could really use your help at that point by replying to everyone that a team discussion and consensus approach to this issue is required today, especially given the political sensitivity of the issue and the importance the company is putting on it as an essential source of funding for this project. My thought is to have Sandi work directly with David Lu and Debra Dowd from LeCiairRyan on this, rather than having International, BD and/or Research in the middle. The reason Paul & Roy went to you while we were out of the office is that they are more concerned about proving their worth on large projects than being part of team - standard operating procedure for the past few years, especially in high profile situations. Went well. Need to get you involved in strategic discussion of next steps. David Luis going to provide us with a draft application for a statewide regional center. His law firm in NOVA can operate it if we choose to accept that offer, which we really don't want to do for obvious reasons. Not sure what you missed but interesting to hear what Lu had to say about qualifying areas within the Commonwealth for $500,000 investment threshold (to be competitive with the one established in MS). The idea is to utilize his expertise but feel out LeCiairRyan for their interest to help us keep things in perspective. Hopefully they may also have interest in operating it.

That is the only regional center through which we can bring in investors. This is also the reason why time is of essence to get a regional center in Virginia. Once an EB-5 investor invested in this project through one regional center, it is unlikely the same investor will invest through another regional center in the same project again. Rob, Just a quick follow up to the whole EB-5 visa issue, which might be useful to you as you prepare a white paper. By way of background, this issue has been monitored for several years by International staff. Roy, Hailey and Secretary Gottschalk were given a presentation on this EB-5 program in Beijing China on March 31st 2007 by 2 representatives from USA Advisors. Pat's comments were that while Jeff would make the final decision, he did not see any value or opportunity for Virginia in the program. When Roy returned from that Asia trip, he and I briefed Jeff on the presentation Pat and Roy received. The answer from Jeff was the same as Pat had indicated. All four of us are skeptical of the potential investment that EB-5 designation represents. And, given the costs of establishing an EB-5 center and on-going costs, it becomes even more dubious. We have had a small number of inquiries from China in the past couple of years inquiring of Virginia's participation in this program which we have handled. I believe Roy has had several discussions with Jay about this issue. Should you wish to add data in the white paper as to what other states' experiences have been, I would be happy to query my counterparts. Jeff, I called you a few minutes ago to discuss the Greentech project. I don't know if you are aware of all the details or not. In short, it involves Terry McCauliffe, Bill Clinton and of course Gov. Kaine. A key driver is whether Virginia will pursue the EB-5 visa designation. We have great doubts that it is a legitimate project, but because of the players involved are being responsive. In short, Gov. Kaine has asked for a briefing on Monday afternoon. We are not sure whether he wants a briefing related to the EB-5 visa process or related to the project specifics. My strong inclination is that he is more interested in the EB-5 process since that is how the project originated and on which the capital investment hinges. At this time, Mike L. is scheduled to provide that briefing. I am not sure if that request came from Pat or through you. I would recommend that Roy provide that briefing instead. Roy is ful ly familiar with the EB-5 issue, had briefings given to him in China (with Pat in attendance) and understands the Chinese drivers behind these kinds of projects. Of course, he is fully familiar with the project parameters as well. Frankly, Roy will represent VEDP in the best possible light for any question the Governor might have. The EB-5 visa for Immigrant Investors is a United States visa created by the Immigration Act of 1990. This visa provides a method of obtaining a green card for foreign nationals who invest money in the United States.[ll To obtain the visa, individuals must invest $1,000,000 (or at least $500,000 in a "Targeted Employment Area" high unemployment or mral area), creating or preserving at least 10 jobs for U.S. workers excluding the investor and their immediate fami!y_lll Initially, under the first EB-5 program, the foreign investor was required to create an entirely new commercial enterprise;l2l however, under the Pilot Program investments can be made directly in a job-generating conunercial enterprise (new, or existing "Troubled Business"l31), or into a "Regional Center". a 3rd party-managed investment vehicle (private or public), which assumes the responsibility of creating the requisite jobs. Regional Centers may charge an administration fee for managing the investor's investment. The Regional Center provision of the program was scheduled to end on September 30, 2012.l4l At the end of September 2012, President Obama signed into lawS. 3245 extending the EB-5 Regional Center Pilot Program for an additional three-year period. The program was reauthorized by the House of Representatives on September l3 in a vote of 412-3 and passed by the Senate in August 2012. If the foreign national investor's petition is approved, the investor and their dependents will be granted conditional permanent residence valid for two years.31 Within the 90 day period before the conditional permanent residence expires, the investor must submit evidence documenting that the full required investment has been made and that 10 jobs have been maintained, or 10 jobs have been created or will be created within a reasonable time period.l31 In 1992, Congress created a temporary pilot program designed to stimulate economic activity and job growth, while allowing eligible aliens the opportunity to become lawful permanent residents. l41 Under this pilot program, foreign nationals may invest in a pre-approved regional center, or "economic unit, public or private, which is involved with the promotion of economic growth, including increased export sales, improved regional productivity, job creation, or increased domestic capital investment". Investments within a regional center provide foreign nationals the added benefit of allowing them to count jobs created both directly and indirectly for purposes of meeting 10 job creation requirement.l41 Foreign investors' use of the EB-5 program has been far less than originally anticipated by Congress.l 51 In 2005, a Government Accountability Office repmt found that investors were not utilizing the program because of "an onerous application process; lengthy adjudication periods; and the suspension of processing on over 900 EB-5 cases-some of which date to 1995-precipitated by a change in USC!S's interpretation of regulations regarding financial qualifications."l61However, in 2011, USCIS began making a number of changes to the program in hopes of increasing the number of applicants. If you wondered how it may have come in through the Policy Office of the Governor, this is now a bit less surprising. Hang on to your wallets! Exercise caution. Nevertheless, I think having a briefing to get more acquainted with the EB-5 program is appropriate. I did note on Immigrations website that a number of states have been approved for these Regional Centers.

Roy Dahlquist and I met with a couple of people at least a year ago who proposed this type of scenario (man and woman). Trying to figure out who they were because I have a feeling it's related. This approach makes no sense. Highly inefficient assembly concept but based on the company's experience in China. Similar to a railroad town concept in the 1800's. Gives new meaning to the phrase "it takes a village". As I recall , it is a totally integrated approach, meaning everything that goes into the vehicle is produced locally by the village. Also seem to recall that they had never built a vehicle before. This was based on some other manufacturing the company did in China. In any case, to quote one of the analysts- "It's ridiculous on the face of it".

Do you know anything about Chinese vehicle manufacturers in Mississippi? There is a potential project opportunity for Virginia floating to the Policy office related to a Chinese company manufacturing vehicles in Mississippi. I've pasted an internet article below that may be relevant. This project would be tied to EB-5 Visas, and I've spoken with Roy about the visa issue, and about Pat's thoughts on those visas. JACKSON, Miss. --Two dueling Chinese businessmen have settled a federal lawsuit over a proposed $6.5 billion car plant in Mississippi, with both sides saying they can pursue the massive project on their own. An attorney said a company owned by one of the men will unveil four prototypes in August and break ground on the plant this fall. He said the company already has a site plan ready. "Our project is the original project that is going to go forward under a new name," said Bill Brabec, an attorney for Xiaolin "Charles" Wang. "Getting rid of this litigation was pivotal to getting this project going again." The other man, Yung "Benjamin" Yeung, also said he platmed to move forward with his plans for the plant. Analysts, meanwhile, wonder about the viability of a project with the ambitious goal of producing 1 million cars a year and employing 25,000 people in notih Mississippi's Tunica County, just south of Memphis, Tetm. Secret discussions about the proposal were first revealed in June when a federal judge unsealed a nasty lawsuit involving Yeung and Wang. Court documents said Mississippi Gov. Haley Barbour and other state officials were involved in the talks. Yeung and Wang had disagreements over the terms of their "handshake" business deal and whether they were partners or Wang worked for Yeung, according to filings in U.S. District Comi in Northern Mississippi. Each man accused the other of dubious business practices. A settlement was reached Friday in the lawsuit, which was complicated by two dozen third patiies and the fact that the name of Yeung's company, Hybrid Kinetic Automotive Holdings, closely resembled one controlled by Wang, Hybrid Kinetic Automotive Corp. Yeung's companies said Tuesday in a statement to The Associated Press that they have the right to the "hybrid kinetic" name and "to pursue the hybrid automotive project in Mississippi without any interference fiom Xiaolin Wang." The governor's office had no comment. A spokesman for Tunica County said he couldn't discuss economic development projects.

Lyn Arnold, president and CEO of the Tunica Chamber and Economic Development Foundation, said the lawsuit settlement allows Wang and Yeung to compete over projects in Mississippi. "There's still a lot of details, because of confidentiality agreements, that I can't discuss," she said. It's not clear what, if any, incentives Mississippi or Tunica County officials have offered. Brabec said Tunica County already has secured land and has been looking for a big industry, such as a car plant, to come to the area. Haig Stoddard, an auto analyst with the consulting firm IHS-Global Insight, said Tuesday the plan sounds "risky" and it "would be unprecedented to say the least" for a single plant to build 1 million cars a year. "A typical car assembly plant in North America builds 200,000 to 250,000 vehicles per year, with 2,500 to 3,000 employees," Stoddard said. The plan before Yeung and Wang split was to raise some money through a visa program that provides foreign investors "with both a great investment opportunity and a possibility of becoming a U.S. resident," according to Hybrid Automotive's Web site. The Web site will be shut down in August as part of the settlement agreement in the lawsuit. Other terms of the settlement were not disclosed. Laurie Harbour-Fe lax, another automotive consultant, said "there's just a ton of unknowns." And, she said, the hybrid market in general has been slow to take off because the vehicles usually cost more than those with traditional engines.
