Rental Agreement

The terms and conditions outlined in this agreement are to be upheld by the individual with whom tenancy is granted, hereby referred to as the Guest, and HotelAmnesty LLC., hereby referred to as the Company. The conditions outlined in this agreement are subject to change without notice; please refer to all documents that have been sent to you, the Guest, by the Company. This agreement shall become valid and binding once initial payment is received by the Company for the requested reservation.

1. ARRIVAL AND DEPARTURE TIMESThe successful completion of a reservation will result in a confirmation email that outlines arrival and departure information and will be sent to the Guests email address that was provided during the reservation process. Please keep a copy of this agreement with you at all times for reference purposes. 1.1 Check in procedures and guidelines- The Guests reservation begins at 3:00 p.m. on the first day of the reservation as outlined in the arrival information. The Guest is not permitted to check in to the unit before the outlined time frame as set by the Company. 1.2 Early check in requests and availability- In the event early check-in is needed; the Guest is required to notify the Company as soon as possible and no later than 48 hours prior to reservation. Early check in cannot be guaranteed by the Company. Early check in that is granted by the Company is from the hours of 12:00 p.m. to 3:00 p.m. on the first day of the reservation only and will incur an additional $65 charge which will be applied to the credit card on file. Checking in before 12:00 p.m. on the first day of the reservation, as granted by the Company and as needed by the Guest, will incur a fee equal to and including half the nightly rate of the night prior to the arrival day plus any additional administrative fees. 1.3 Checkout procedures and guidelines- The Guest is required to check out of the unit at 11:00 a.m. on the last day of the reservation as outlined in the arrival information. The Guest may check out of the unit at any time prior to the scheduled check out time. There will be no proration of money or days for time not spent in the unit. 1.4 Late checkout requests and availability- In the event that late checkout is needed, the Guest is required to notify the Company as soon as possible and no later than 48 hours prior to checkout. Late checkout cannot be guaranteed by the Company. Late checkout that is granted by the Company is from the hours of 11:00

a.m. to 2:00 p.m. on the last day of the reservation only and will incur an additional $65 charge that will be applied to the credit card on file. Checking out after 2:00 p.m. on the last day of the reservation, as granted by the Company and as needed by the Guest, will incur a fee equal to and including half the nightly rate of the next concurrent night plus any additional administrative fees. Failure to notify the Company within the stated time frames as set forth by the Company will incur any applicable fees associated with any late checkout requests plus an additional rate of $115 an hour per hour that the Guest remains in the unit. The fees will be applied to the credit card on file. 1.5 Reservation extensions- Reservation extensions cannot be guaranteed by the Company for any existing and/or current reservation(s). If an extension of a reservation is needed prior to the last day of the existing reservation, the Guest must contact the Company as soon as possible. The Company will exhaust, at its discretion, all possible alternatives to accommodate the Guests request. The Company reserves the right to move the Guest to a similar unit with similar amenities that the Company operates, to accommodate the extension. If the Company is unable to relocate the Guest, the Guest will be required to leave the unit at the specified checkout time as outlined in the arrival information. 1.6 Departure procedures and guidelines- The Company is in no way liable and will not make any exceptions for anything left behind by the Guest at the unit during their stay. Remove any and all refuse or trash from the unit and place it in the designated trash receptacles throughout. Place any soiled dishes or cookware items in the dishwasher. There is no need to operate the dishwasher; the cleaning staff will operate it as part of the cleaning and sanitation procedures performed by the Company. In the event that the unit is left in an excessively soiled condition, as determined by the Company not the Guest, the Guest will incur an additional cleaning fee at a rate of $115 an hour for each additional hour of cleaning. Upon departure of the unit, ensure that any keys, parking permits, access codes or other items provided by the Company for the use of the Guest during their reservation must be returned so as to not incur additional fees for lost items. Fees will be assessed based on value but not to exceed the following costs: $55 for lost or missing key(s), $135 for parking or access code cards, and any other items will be assessed based on value. Any items above found to be missing will be charged to the credit card on file at the rates listed. Initial____________ 2. PARKINGParking permissions vary from unit to unit; the Guest must contact the Company with their intentions of needing parking. The Guest is required to inform the Company with

the year, make, model and license plate of the vehicle. In no way is parking guaranteed by the Company for the Guest. Unless otherwise stated or notified, parking is on the street located outside of the complex. There may be additional charges and policies for parking, please refer to them as applicable. The Company assumes no responsibility or liability of any kind and including but not limited to: infractions incurred due to nonpayment, illegal use of parking space and/or damaged occurred at any time. If any required material(s) is missing, call the Company. Not all properties have parking available nor is parking guaranteed in any way. If parking is needed, please contact the Company to discuss availability. All requests must be made at time of reservation. 3. PETSNot all units accept pets. Pet stays are subject to breed and weight restrictions. The Guest is required to notify the Company of their intentions to bring a pet at the time of reservation. Additional charges for pets, that are agreed to by the Company, will be applied at the time of reservation at a rate predetermined by the Company and made known to the Guest prior to the successful completion of a reservation. Permission to have a pet is only valid if stated in the arrival information sent to the Guest by the Company. It is the responsibility of the Guest to notify the Company of pet allergies; the Company will verify if pets have been present and notify the Guest of what type and when they were there last. If the Company determines that the Guest willfully broke the pet policy either stated by the Company or the units complex itself, the Guest will be responsible for all damages including but not limited to any and all methods required to remove all traces of the pet. The Guest will also be assessed an additional $600 administrative fee for time spent remedying the issue(s). Any fees incurred for failure to comply will be charged to the credit card on file. 4. MAINTENANCEThe Guest is required to notify the Company immediately of any maintenance issues related to the unit. Maintenance issues include and are not limited to: non-working light bulbs, appliances not operating, leaks and other maintenance items. The Guest is not permitted to contact any personnel that may work for the unit. Personnel that work for the units where the Company does business are not employed by the Company and in no way affiliated with the Guests reservation rights. In the event that a maintenance item interferes substantially with the Guests reservation, the Company reserves the right to relocate or refund the Guest at the Companys discretion. 5. HOUSEKEEPINGPrior to the Guests arrival to the unit, the unit has been cleaned and sanitized accordingly. The Guest is required to leave the unit in the same general condition that it was received. Housekeeping services are not part of the contract; they can be purchased by the Guest at a rate of $65 per cleaning. Housekeeping services include and are not limited to: turn down service of bedding in all bedrooms, general dusting and vacuuming of floors, general cleaning of bathrooms and other services not

specifically outlined. The Company is in no way liable for any items that the Guest requested cleaned that are not part of the Companys provided items. Excessively soiled units will incur a cleaning fee of $115 an hour per hour as stated above. All units are equipped similarly and vary slightly in decorative manner. As noted above, the unit has been cleaned and sanitized accordingly prior to the Guests arrival. All units are equipped with provisions for up to and including four guests. Sleeping arrangements may outnumber the four guest provisions. The unit will provide prior to the Guests arrival, initial one-time only, basic necessities: toilet paper, paper towels, hand soap and other items not specifically outlined. The Company will not provide toiletries or other like type items and it is the responsibility of the Guest to provide for them. Each unit is equipped with amenities such as but not limited to: bath towels, face/hand towels, washcloths, bedding, linens and other items not specifically listed. 6. SMOKINGSmoking is never permitted in the units. If the Company has determined that the Guest has been smoking in the unit in any way at all, the Guest will incur any and all charges associated with remedying the issue(s). The Guest will be assessed an additional $250 administrative fee in addition to the costs associated with the removal of the presence of tobacco. The Guests credit card on file will be charged for all associated fees. 7. DAMAGEThe Guest is responsible for any and all activity that goes on within the unit. In the event of damages to the unit, or items in the unit, the Guest will be charged the full amount to repair or replace the damaged item, plus any additional fees associated with getting the unit back into working condition within a time-frame set forth by the Company. There will be an additional administrative fee associated with getting the unit back in working order and will be assessed at a rate of twenty-five percent of the costs. The Guests credit card on file will be charged for any and all damages found to be the liability of the Guest. 8. GUEST CONDUCTThe Guest shall act in a manner that is lawful and legal. The reservation and use of the unit by the Guest shall be for its intended use; the Guest is not permitted to use the unit for any other uses. The Guest is not permitted to alter the unit in any way. The Guest shall abide by all rules set forth by the complex where the unit resides. Unless otherwise noted, quiet time is from 9:00 p.m. to 8:00 a.m. Any Guest found to be in violation of the any rules, either posted or otherwise, will be subject to removal from the unit; the termination of any remaining days of the reservation will not be refunded for days or time not used. The Company acts in a manner that is professional, courteous and responsible; the Guest is to act in like manner. In the event that any services or amenities provided by the units complex for the use of the Guest during their stay, that

are inoperative or no longer provided, in no way, voids any portion of this agreement or the reservation itself and are, in no way, subject to refund. 9. PAYMENTS AND CANCELLATIONSThe Guests reservation will be considered complete and binding upon issuance of a successful transaction completion and an invoice number issued. There is a nonrefundable twenty percent deposit which will be collected at the time of reservation. Reservation payments can be made by credit or debit card, over the phone or online at the Companys website. The Guest is permitted to cancel their reservation anytime within twenty-four hours of making the reservation without penalty, at which time a full refund of the deposit will be made. After the twenty-four hour time frame from which the reservation was made, the Guest is responsible for the monetary fulfillment of the entire contract. The Guest is responsible to have the contract paid in full prior to their reservation date(s) but no later than thirty days prior to the reservation start date. Contracts not fulfilled within this time frame will be considered forfeit by the Guest and the Guest will lose their deposit. Lost deposits due to nonpayment cannot be recouped or used for other dates. The contract will be considered cancelled and closed. If for any reason the Guest needs to cancel their reservation within 8-30 days of their stay the Guest will be charged for 50% of the entire reservation charge; not including any and all applicable Administrative charges that will be charged above and beyond the 50% reservation charge and no refunds or credits will be applied. If for any reason the Guest needs to cancel their reservation within seven days of their stay, the Guest will be charged for the entire amount of the stay and no refunds or credits will be applied. It is recommended that when traveling one should be reminded that issues may arise; buying travelers insurance may help in certain situations. Reservation changes; such as but not limited to: changes in dates, cancellations; can be requested up to thirty days prior to the first day of the reservation and may incur a $75 administrative fee at the Companys discretion. In the event that the Guests reservation falls under the thirty day reservation payment policy, the Guest is required to pay the full amount at the time of booking the reservation, at which point the Guests card will be charged the full amount of the reservation, plus all fees. For Guests that will be using the unit on a month-to-month basis and wish to pay as such, the Company will work with the Guest with regard to payment schedules but reserves the right to set forth payment schedules in accordance with the Companys guidelines.

10. COMPANY REMEDIESIn the event that the Guest violates any part of this Rental Agreement including nonpayment of the reservation, the Guest is in default of the Rental Agreement. In the event of a default, the Company may initiate legal proceedings in accordance with local

and state regulations to evict or have the Guest removed from the unit as well as seek judgment against the Guest for any monies owed to the Company as a result of the Guests default. 10.1 The Guest agrees that any expenses and/or damages incurred as a result of a breach of the Rental Agreement including attorneys fees and costs will be paid to the Company or the prevailing party. 10.2 The Guest agrees that any court costs and/or fees incurred as a result of a breach of the Rental Agreement will be paid to the Company or prevailing third party. 10.3 All payments for the balance of the term of this Rental Agreement is immediately due to the Company and the Company may sue for the entire balance as well as any damages, expenses, legal fees, and costs. 10.4 The Guest understands and agrees that if the Guest files a petition of bankruptcy, it will not release the Guest from the fulfillment of the terms and conditions of the Rental Agreement. 10.5 The Guest agrees to be solely responsible for any damage to or loss of the Guests personal property. Accordingly, the Guest is strongly encouraged to obtain property/renters insurance with an insurance company properly licensed to do business in the State. This policy must become effective on or before the beginning date of the reservation. NOTICEThis is an important legal document. You are giving up certain important rights and may want an attorney to review the Rental Agreement. Time is of the essence in this Rental Agreement. By signing this Rental Agreement, the Guest certifies that he/she has read, understood and agrees to comply with all of the terms, conditions, Rules and Regulations, Special Terms and Conditions and Applications.
