PLEASE TAKE NOTICE, that upon the annexed Verified Petition, duly verified on April 27, 2013, and the exhibits annexed thereto; and upon the Affidavit of Lucy Drotning of Columbia University dated August 24, 2012; the undersigned will move the Court at the New York County Courthouse, located at 60 Centre Street, New York, New York 10007, on May 24, 2013, at 9:30 a.m., or as soon thereafter as counsel can be heard for an Order (a) removing the requirement that a fellowship recipient must be a person of the Caucasian race; (b) modifying the Trust instrument to require that a fellowship recipient must have been a resident of the State of Iowa rather than having been born in said state, and that such recipient may either be a resident of said state or a graduate of a college or university in located in the State of Iowa prior to attending Columbia University; (c) modifying the restriction that all fellowship recipients must accept the award in writing within 30 days so that the procedure for acceptance is the same as Columbia Universitys general policy for accepting fellowship awards;

(d) removing the restriction that fellowship recipients must state their intention to return to Iowa upon completing his or her studies at the University or upon the expiration of his or her fellowship; (e) modifying the Trust instrument to allow a fellowship recipient to obtain financial assistance in addition to the fellowship award; (f) modifying the Trust instrument to provide that a fellowship recipient has until the end of Columbia Universitys add/drop period to register for courses; (g) removing the restriction that a fellowship recipient is prohibited from teaching or receiving remunerative employment without the permission of the President of Columbia University; (h) removing the investment restrictions contained in Article Second, second paragraph, of the Trust and replacing said restrictions with modern trustee investment standards consistent with New York law; (i) modifying the non-substantive administrative provisions of the Trust to conform to those of all other fellowships administered by the University; and (j) granting such other or further relief as may be just and proper.

PLEASE TAKE FURTHER NOTICE that, pursuant to CPLR 401(b), an answer and supporting affidavits, if any, must be served upon the undersigned at least two (2) days prior to the return date of the within motion.
