To start with, as frustrated Auckland buyers are certainly aware, prices quickly move up, making this a great time to sell. The other side of the equation is the pressure on buyers in a heated market to act quickly or risk yet again missing out. As open homes and auctions draw big crowds, Anne Duncan Real Estate consultants are noticing that some buyers are choosing to bypass the homework to sign a deal before someone beats them to it. For agents, its something of a balancing act because Real Estate Agents Authority rules require them to advise would-be buyers to seek the counsel of lawyers before signing a deal. But in todays market some people feel it chews up too much time, potentially allowing another buyer to step in and make an unconditional offer. Rather than run that risk, they are choosing to sign a contract without first checking with lawyers. While only a few people consider signing without legal advice, Anne Duncan is worried about the trend. She says the issue can arise when multiple offers are on the table and a buyer wants to make an offer that is as clean as possible.
HOW do you grab the attention of a mob of enthusiastic youngsters? Easy you leave it to Cornflake the Clown. Cornflake was a star turn at the great annual Easter Hunt on the mountain on Easter Sunday, organised and sponsored by Anne Duncan Real Estate. It was a great family day, drawing 250 children (and the Easter Bunny) for a morning of good fun, healthy exercise and chocolate! Her consultants will always urge buyers to talk to lawyers before committing themselves. Its right and proper that we do that, she says. We act for the vendor, but it is in no ones interests for unforeseen issues to arise after a sale has gone ahead. Buyers are fearful of missing out and I understand the pressures on them if offers they have made are being overtaken. But we are talking here about major events in peoples lives and it is just so important to get good legal advice. Anne points to just one local example - on the day a house was listed for sale by auction, a party made a cash unconditional offer attractive to the vendor, insisting he wanted to sign the contract without legal advice. He didnt want to run the risk of missing out, even though he had spent just a few minutes looking around the property. I do realise the frustration and stress felt by buyers who are missing out and are watching prices rise, she says. But buying a house is a serious business. People who spend $5000 on a car will get an AA check and take their time to make sure its okay, yet some people are prepared to sign a contract for a $700,000 or $800,000 house without checking with their lawyer. I think thats really ill-advised. Meanwhile, the local market continues to fire and the company has had a strong start to the year, with auctions bringing terrific results. The buyer interest is enormous, says Anne. This is a brilliant time to sell and I think most people would be pleasantly surprised at the prices their properties would fetch.

Have your say on masterplan that will change the future shape of our city
UCKLAND is on the verge of the biggest planning change in its history aimed at creating a compact city that stops spreading out and starts going up and its not too late to have your say. The Auckland Unitary Plan introduces a new planning rulebook to cope with the extra million people who will be drawn to the city in the next 30 years. It will bring in new housing zones across the supercity, changing the present status of more than half Aucklands residential land. The council has set a deadline of May 31 for feedback on the draft plan; the deadline for the formal notification of the new process is September this year. The plan affects all Auckland suburbs and will have a strong influence on the future shape of Mt Albert, Pt Chevalier, Waterview, New Windsor, Avondale, Owairaka, Western Springs, Sandringham, St Lukes and Kingsland. It creates a series of new zones, like: Terrace housing and apartments where buildings of four to sixstoreys will be allowed. Pockets of these developments will be spread through the city fringe in areas, for example, like the western side of Mt Albert village and down the edge of Carrington Rd; a patch in the east of Western Springs; and a circle around the intersection of Sandringham Rd and St Lukes Rd, and north down the edge of Sandringham Rd. Mixed housing the most widespread zone, which enables the building of two-storey houses (detached, semi-detached, town houses and terrace housing). Most of the area from New Lynn and Avondale to Mt Albert and Sandringham carries this zoning. Local centre a mix of small-scale commercial businesses, offices and retailers in buildings that can reach from four to eight storeys, with apartments on upper floors. Typically, this zone covers small town centres, like Mt Albert village (where the limit will be four storeys). Large pockets of single house zones remain (in Mt Alberts Golden Triangle and around the mountain, for example, and also through Kingsland), but otherwise the Unitary Plan will in time bring huge change across Auckland. ANNE Duncan has a hectic business life, starting work most days at 7am and getting home at 8pm and later, but she always finds plenty of time for family. And that family has just expanded with the arrival of first grandson, Darragh, who was born on February 15 and weighed in at 8lbs 12oz. Darraghs the first off-spring of Annes daughter Helen and her husband, Owen, and joins 10-year-old Kayla (daughter of Emma Duncan, who works alongside Anne at the agency) in the family fold.

(learned award) and Property Manager Hazel Craw. new lease agreement between the ASB Bank and the Mt Albert Grammar School board of trustees has secured the future of the school farm. The ASB will continue to lease the land to the school for an effective 99-year term with a nominal annual rent of one dollar. The farm was originally established in 1932, and needed special legislation to allow the Auckland Savings Bank to buy the land from the Kerr-Taylor sisters and then lease it back to the school. The bank made a grant of 2000: 1600 to enable 20 acres of the Alberton estate to be bought outright, with the balance to provide equipment for the farm.
