MEDICAL BOARD AND CISCO SYSTEMS (San Jose) Medical Board denied Dr.

. Sheikhs application for Physicians License because her husband filed a lawsuit against Cisco Systems. Dr. Sheikh successfully completed Family Practice Residency training and received a certificate of Residency Completion from U.C. Davis. Dr. Sheikh has recommendations from University of Texas and Stanford School of Medicine. Board accused Dr. Sheikh of incompetence then Board changed its story. Board falsely accused Dr. Sheikh of incorrectly submitting application form. On July 27, 2009 Administrative Law Judge signed orders for Board to release a copy of Application forms. The Board has denied compliance with Judges orders (because Boards story is a fiction). Members of the Board initiated an investigation on Business Practices of the Board. Can the Board stand against Corporate Power and let Dr. Sheikh to practice her profession??? COMPOSITION OF THE BOARD IS A PROBLEM Current Chief of Licensing of Medical Board was a licensing expert for used Auto vehicles. Now he is an authority to license physicians. Ex President of Board has correctly suggested in his speech that the Board Members should be appointed on merit. LICENSING LAWS ARE UNFAVORABLE TO PHYSICIANS The Board Members are not allowed to review records before proposing a disciplinary decision. (B&P Code 2335). That violates Constitutional Right to Due Process (Fourteenth Amendment). Currently Board can propose any punishment to any physician (B&P Code 2227). That law violates Eight Amendment of the Constitution. With such logic, a person guilty of traffic violation can be punished to capital sentence. Dr. Sheikh has filed a Brief (Legal Arguments) with the Ninth Circuit Court of Appeals to Invalidate both laws unfavorable to Physicians. We the Physicians must speak with one voice before the Esteemed Court if we want to protect our rights. Please convey Dr. Sheikhs request for support to every organization representing physicians.

STANFORD & SAN JOAQUIN GENERAL HOSPITAL How those hospital treat their Physician Staff? STANFORD Medical Board of California denied a Resident physicians license who was working at Stanford. Stanford called their attorneys to help the Resident physician. Stanford requested help from their Representative in the United States Congress so that the resident physician be licensed. That Resident Physician at Stanford was licensed without any delay. SJGH Medical Board of California denied a Resident physicians license who was working at SJGH. SJGH denied Resident Physicians Request for a copy of her own Residency Records. SJGH, then, denied compliance with an Administrative Law Judges orders for a copy of Residents Records allegedly on the instructions of their attorneys. When Resident Requested compliance with the Judges orders, SJGH sent Security personnel at the Residents cottage demanding that Resident leave the premises within five days. SHGH, then, sent locksmith, fire engine along with multiple security & police cars and possessed the cottage by force without a Court order. The Residents family lived at a nearby Hotel for two months. SJGH has withheld the Residents paychecks until today (SJGH Claims that there was no mail box at the residents cottage). These are a few of the least uncivilized actions taken against the Resident Physician.

Im requesting your support against the unlawful actions of San Joaquin General Hospital (County Hospital) and Medical Board of California against my wife (Dr. Sheikh) (Because I filed a lawsuit against Cisco System Inc.) As a result of the retaliatory and unlawful actions of the hospital and the Board, Dr. Sheikh cannot practice her profession. Dr. Sheikh is a compassionate physician with Excellent Recommendations from University of California, University of Texas Medical Branch and from Stanford School of Medicine. Both the County Hospital and the Board have improperly denied compliance with Judges order to release a copy of Dr. Sheikhs personal file. (Web update June 15, 2012 or earlier) Hospital has withheld Dr. Sheikhs pay check(s) since 2008 claiming that Dr. Sheikh does not have a Mailbox. Ref: Medical Board orders investigation into Business Practices of the Medical Board TO San Joaquin Medical Society Physicians Residency Programs with University of California at Davis

The respectable members of the Medical Board of California have taken an unprecedented action and ordered an investigation (first of its kind in history) against the Business Practices of the Medical Board see News letter of the medical Board (January 2010). The Investigation was in response to indication of major unjustified and mindless actions against physicians. The Executive Director of the Medical Board has resigned since early this year. SUPPORT FOR LOCAL PHYSICIAN Dr. Sheikh Dr. Sheikh completed Family Practice Residency training from San Joaquin General Hospital in mid 2008. She has provided patient care at the San Joaquin County Hospital for over two years. Dr. Sheikh has recommendations from University of California at Davis, University of Texas Medical Branch and Stanford Medical School. Dr. Sheikh cannot provide patient care because Medical Board will not send her a piece of paper that is generally referred as license. Patient population of County of San Joaquin declared as underserved for acute shortage of primary care physicians is improperly deprived of access to Healthcare. During November 2007, the Medical Board assured in writing that Dr. Sheikh will be licensed in mid 2008 (by completion of her residency training). My office has reasons to believe that former Interim Program Director of Family Medicine Residency Program falsified application forms and other documents. Later Interim Program Director wrote to the Medical board that he did not see the forms that he signed. On July 27, 2009 Administrative Law Judge Hon. Karen Brandt singed orders for the County of San Joaquin and for the Medical Board of California to deliver a copy of Dr. Sheikhs records to Dr. Sheikh. Both San Joaquin General Hospital and the Medical Board of California have denied compliance with the Judges orders in defiance of Court procedures. The Family Practice Residency Program at San Joaquin General Hospital claims that the Residency Program is instructed by the County of San Joaquin not to comply with the Judges order. The Office of State Attorney General represents the Medical Board of California. PHYSICIANS CAN BE DISCIPLINED FOR SUCH OFFENSE The State has laws that sanction physicians one thousand dollars a day ($1000 per day) for not timely giving patient records to the Medical Board. Imagine; if a physician is guilty of not complying with a Judges order How long will that take for the Medical Board to take disciplinary action against that physician?

PHYSICIANS LICENSE IS THEIR CONSTITUTIONAL RIGHT Physicians have a legal right to enter in a profession for which they trained a good part of their life. This is not a matter of States grace (to issue license to a physician whom it pleases). A Physicians license is his/her vested property and is protected under Fourteenth Amendment of the Constitution of the United States. STANDARD FOR PHYSICAINS LICENSE The Enforcement Monitors Report, presented to the California state Senate, clearly states: The law views [physicians] license as a property right which may not be taken by the state absent substantive and procedural due process. All segments of society need competent and qualified physicians to assist in preventing, detecting, and treating disease and other medical conditions. Thus, trained physicians should not be barred from the marketplace for insignificant reason. In this era of managed care, the impact of MBC investigative and disciplinary activity can have momentous ramifications for a physicians ability to practice medicine. Thus, the fairness, consistency, and quality of MBC disciplinary decision making are of significant [importance] to Californias physician population. WHY ANY PHYSICIAN SHOULD PAY ATTENTION; In Germany they first came for the Communists, and I didn't speak up because I wasn't a Communist. Then they came for the Jews, and I didn't speak up because I wasn't a Jew. Then they came for the Catholics, and I didn't speak up because I was a Protestant. Then they came for me and by that time no one was left to speak up. Pastor Martin Niemller (German anti-Nazi activist) WHAT SHOULD BE DONE I believe that in a Democratic Society with the rule of law, all of us need to follow the rules; Not only as individuals but also as a Government agency. WHAT CAN WE DO TO HELP? I seek help from professional organizations (Medical societies, County Bar Associations), Community organizations (churches, mosques, synagogues) and from Residency Programs at University of California at Davis. All we need is to tell those two publics offices, County of San Joaquin and Medical Board of California to comply with the Judges order and not to violate physicians Constitutional Rights. Office of State Attorney General (Mr. Edmunds Brown now Candidate for Governor) is responsible for ensuring that the laws of the State are uniformly enforced. Residents of County of San Joaquin need Patient Care not a Political Slogan of Protection of Public by the State of California. I request every ones generous support.
