TEMPORARY RESTRAINING ORDER
This day came on to be heard the request of Defendant and Counter-Plaintiff Domingo Garcia
("Garcia" or "Defendant") for a temporary restraining order.
The Court, having examined Defendant's Answer, Counterclaim, and Application for Injunctive Relief
finds that Defendant is entitled to a temporary restraining order. The Court further finds that Defendant has a
probable right to recovery, probable immediate injury in the interim, and that if Plaintiff is not restrained
Defendant will have no adequate remedy at Jaw. Specifically, the Court finds that unless a temporary
restraining order is granted, and Plaintiff is restrained from preventing Domingo Garcia from running for the
office ofNational President of the League ofUnited Latin American Citizens (:LULAC") atthe 2013 National
Convention, Defendant will suffer irreparable damage. If unrestrained, Plaintiff will deprive Defendant ofhis
rights to run for the office of National President ofLULAC in 2013. The Court further finds that Defendant's
pleading accurately sets forth the facts, and incorporates the same as its findings herein.
IT IS THEREFORE ORDERED that the Clerk of this Court issue a temporary restraining order
immediately restraining Plaintiff, its officers, agents, representatives and employees, and servants and all

persons and entities in active concert or participation with it from preventing Domingo Garcia from running for
National President of LULAC as described in Defendant's Answer, Counterclaim, and Application for
Injunctive Relief and restraining Plaintiff from preventing Domingo Garcia's name from being on the ballot

This Order shall be binding on Plaintiff, its officers, agents, representatives and employees, and
servants and all persons and entities in active concert or participation with it who receive actual notice of this
order by personal service or otherwise.
IT JS FURTHER ORDERED that Plaintiff appear and show cause before the Judge of the above-

temporary injunction should not be issued as requested by Defendant. The Clerk of the Court is hereby
directed to issue a show cause notice to Plaintiff to appear at the temporary injunction hearing. On filing by
Defendant ofthe bond, or cash deposit in lieu thereof, hereinafter required, and on approving the bond, if one
is filed, according to the law, the Clerk of the above-entitled Court shall forthwith issue a Temporary
Restraining Order in conformity with the law and the terms of this Order.
