Can we be able to solve our problems before clearly describing the problems and the sources of the problems? When we clearly describe our problems and may be it appears directing a finger on you, should you accuse us of hate speech or accept that you have wronged us and you have to sincerely repent? If we are spiritually guarded by the philosophy Of What Use are We the Strong, If We Cant Use Our Strengths to Strengthen the Weak amongst Our Brothers & Sisters Before We or Our Strengths are No More does it mean we are psychologically misplaced in the society or we are Godly beings? Didnt God commanded us to see for our blind brothers, to hear for our deaf brothers, to speak for our dump brothers and to take care of the least of our brothers? If we have given our lives as a living sacrifice to serve Gods will as stated above, should you blame us for being hate speakers? Didnt God say he will humble the proud & arrogant while uplifting the humble? Similarly, increased social equity results in decreased spending on prison services, security enforcement services, welfare services as well as social services. Martin Luther King observed where there is injustice for one, there is injustice for all. Thus, if anyone of us has been done injustice, all of us have been done the injustice. 1.0. How does (did) the Exploitative-rich-business-elites Network deprive, exploit, impoverish, oppress, scorn and made us frustrated & hurting? 1.1. Whats up Kenyans? We are impoverished and hurting as consequences of processes which concentrate wealth and power to a few individualistic people (members of the Exploitative-rich-business-elites Network). This process operate at three levels, i.e. internationally, the richer countries have made and keep the poorer countries relatively poor through colonial exploitation

and post-colonial unequal exchange, and at the same time benefit from investment of capital & the repatriation of profits; internally, within our poorer country Kenya, urban middle class (members of the Exploitative-rich-business-elites Network) gain at the cost of rural interests, through skewed & exploitative rural-urban terms of trade (brokers buying farm produce cheaply, shopkeepers selling goods/services to the rural/urban poor expensively), and through investment in urban industries and services, which sell their products/services to the rural/urban poor at extorting/exploitative prices/fees; and within urban/rural poor areas themselves, our local business elite (members of the Exploitative-rich-business-elites Network) shopkeepers, brokers, moneylenders, and bureaucrats, consolidate their power and wealth by exploiting us-their poor neighbours. For our part, we the deprived & impoverished rural/urban poor, we stand to lose relatively and often absolutely through all these among other processes. These means there is a dominant network of self-centered extortionist elite businesspersons working in synergy/tandem/together to all-out exploit & oppress us the impoverished; The Dominant Self-centered All-out Extortionist Business Elites Network (The Exploitative-rich-business-elites Network). The character traits of the Exploitative-rich-business-elites Network are exemplified by their thinking that everything that is worthy in Kenya should naturally belong to them or otherwise be vested on their absolute control, and in their thinking, all the non-Exploitative-rich-business-elites Network members are lazy, non-innovative, non-talented in entrepreneurship, and thus are not worthy of anything valuable in Kenya. The Exploitative-rich-business-elites Network is only pre-occupied in accumulation/concentration of wealth on hands of the few Exploitative-rich-business-elites Network members while extorting/exploiting everybody else. The Exploitative-richbusiness-elites Network does us all the above in total disregard of legal frame work, social norms/ethical code conducts/morals, and Gods commands. It has to be noted that the individual members of the Exploitative-rich-business-elites Network are members of all the ethnic groups in Kenya and they reside in all the localities in Kenya, both in rural areas and urban areas. And that the Exploitative-rich-business-elites Network does not consist of all the relatively financially endowed persons in Kenya at both local and national level. population of Kenya; meaning that we are the one to decide who will be vested with state power/political power at all levels after the forth coming general elections. 1.2. How does (did) the Exploitative-rich-business-elites Network deprive us of our natural resources, business & employment opportunities and thus impoverish us and made us frustrated & hurting? The Exploitative-rich-business-elites Network either directly or indirectly used political power to effect self-centered and grossly-skewed amendment to the independence Lancaster constitution, hence depriving us of any say on the subdivision and allocation of our ancestral lands during the immediate post-independence period, directly opposite the scenario envisaged by the un-amended version of the independence Lancaster constitution. Upon skewed amendment of the independence constitution, the Exploitative-rich-businesselites Network indirectly using political power, allocated to themselves most of our most arable ancestral lands, including the one that they eventually developed into a capital city, which they even want to expand as they call metropolitan area, to include all of our remaining ancestral lands in Machakos and Kajiado Counties. All these were done in total disregard of the aboriginal title doctrine, indigenous peoples land rights, convention on conservation of natural heritage, other international laws and conventions, and our current constitution that recognize that community land consists of ancestral lands and other lands and is vested on persons recognized according to ethnic groups, common culture & common interests. The said historical land injustices are recognized by newly enacted current constitution. The Exploitative-rich-business-elites Network have either directly or indirectly using political power deprived us of benefit from our local heritage/resources e.g. forest, coal, cement raw materials, water & water based resources (like geothermal steam, fish), fluorspar, magadi soda, tourist attracting natural resources, and possible oil reserves within our locality as exemplified by our deprivation of licensing fee of over 700 million. The allocation of license and lease to exploit these local resources have always been skewed in favour of the Exploitative-rich-business-elites Network and their international associates, in fact the Exploitative-rich-businesselites Network uses locally owned but abroad registered (using foreign names e.g. Fing-Hu Bao coal mining company)
exploitative companies. All these are in total disregard of the constitutional provision on article 66(2) that requires any development on land or land based resources to benefit local communities and their economies. Think of a situation where by our local ethnic-based political party leader aka presidential candidate is made a deputy president in exchange with transfer of our political power to the Exploitative-rich-business-elites Network. Does that mean our natural resources (e.g. coal reserves) will be deprived of us without any political power still remaining for use to defend our economic interests? Will we gain anything from the Deputy Presidents office given that the constitution never vested any responsibility on the position? Doesnt the position depend on state power donations from the president, who rarely donate meaningful power at all? The Exploitative-rich-business-elites Network has either directly or indirectly deprived us of our local investment/business opportunities. This is by using political power to allocate themselves of government tenders within our locality, in disregard of the constitutional provision article 227(2b). Using political power obtained through blackmail and corrupt practices, they have allocated to themselves our local urban centres residential, industrial and commercial plots, hence depriving us of our local market place. They have also established consumer goods/services distribution channels and local farm produces marketing and sales channels that are exclusive and discriminatory of everybody else including the farm producers themselves, but ensure all the business proprietors are only the Exploitative-rich-business-elites Network members. In this model of deprivation, the Exploitative-rich-business-elites Network members use corrupt practices, and business opponents blackmail, intimidations and assassination (and misleadingly accusing car hijackers and robbery with violence gags as the culprits behind the killings) and blocking of all the urban markets from access by our local farmers as direct marketers of their farm produces, if you proof smart enough you face the assassination. It is pure truth, the Exploitative-rich-business-elites Network who act as brokers of our farm produce buy our produces at exploitative prices (throw away prices) and subsequently sell in wholesale-retail modes at the urban centers at exorbitantly multiple price which is up-to 300 times the price they bought us with i.e. equally deprive us the farmers and our fellows in the
urban centres as exploited customers, thus the Exploitativerich-business-elites Network accumulate all our local and urban areas incomes. For example, our locally produced tea, fish, coffee, vegetables, potatoes, beef, milk, maize, barley, wheat, bananas, nuts, mutton, chicken, forests/trees, charcoal, among others pass whose hands before reaching the consumer markets? Is it not the hands of the Exploitative-rich-businesselites Network? Are we able to reach the market without their sabotage/blocks? Who makes the greatest profit isnt the Exploitative-rich-business-elites Network? Who is exploited? Is it not us the farmers/mineral producers/primary producers and our fellow impoverished consumers? Who is hurting? Is it not the producer and consumer who are us the deprived and impoverished & who are the majority voters? The Exploitative-rich-business-elites Network has directly or indirectly using political power deprived us of financial loan instruments. It is an economics fact, you cant start a profitable business without having good capital base, and good source of capital is financial loan instruments. The banks owned, controlled and operated by the Exploitative-rich-business-elites Network in an environment devoid of interest rates controls charge prohibitive loans interest rates, which are not affordable to us the impoverished, in addition to demand for guarantees that do not include title deed to agricultural land that we have. Because we are deprived of the financial loans instruments we cant establish a viable business venture that can fairly complete with the Exploitative-rich-business-elites Networks businesses/companies. The Exploitative-rich-business-elites Network has indirectly using political power sabotaged full-state Corporations into collapsed state, subsequently they use the created business opportunity to establish their corresponding companies, which are used to further deprive us by accessing our local farm produce at exploitative prices e.g. our cereals, coffee, beef, coconut, fish and milk produce. Similarly, indirectly using political power the Exploitative-rich-business-elites Network has acquired controlling shareholding stakes or totally acquired state corporations (parastatals) and subsequently used the acquired corporations to further deprive us of our daily income via exorbitantly increased service charges bills or prices of goods. What do you think is behind the exorbitant hiking of electricity tariff in the country X? Is it just to hike tariff of electricity or any other service charges of any almost totally
private investment (49.9% privatized State Corporation) with the objective of extorting the helpless customers (49.9% privatized monopoly State Corporation) to raise funds to service that almost fully private companys debt obligations? Are we right to say, in the country X political power is used to forcefully accumulate/concentrate all that countrys citizens income on to the hands of the few more equal citizens? Why did the World Bank refused to extend loans to fund the Turkana Wind Power station development? Is it not to protect us from forcefully indirectly servicing the loans via extortionist hiked electricity charges? Indirectly through political power, the Exploitative-richbusiness-elites Network knows a lot about the hidden natural resources available within our locality including those minerals in our own ancestral lands. But they do not tell us, but instead they secretly strategize on how to come and deprive of us using either local companies or locally owned but foreign named and registered companies. Have they told us about the worth of natural gas in Mbawa 1 well & natural gas/oil reserves estimates in our Coastal basin, coal reserves in South Eastern basin, oil reserves in North Rift, underground water reserves in semi-arid North Rift and North Eastern, Gold reserves in Nyanza and Western Kenya, Rare earth minerals in Taita/Taveta e.t.c.? Havent they being secretly strategizing on how to deprive us of the same, including our hosting ancestral lands? Unfortunately, it is a pure fact, in terms of appointment to employment opportunities in Exploitative-rich-business-elites Networks controlled private sector (private companies/firms/plantations/family businesses e.t.c), the Exploitative-rich-business-elites Network gives first priority to members of their families, second priority to their Exploitativerich-business-elites Network network members, third priority to the members of their clan & ethnic groups and finally to us the others will there remain any position for us other than the indecent & un-gainful dangerous positions. The painful question is what is now the hope, the future and everything of the youth/children/yet to be born & next generations of us the members of ethnic groups with none or with the least members of the Exploitative-rich-business-elites Network? Are we and our future generations of any use in Kenya out of this vicious cycle of poverty/deprivation trap? Or we are just to remain deprived, impoverished, exploited, oppressed and hurting for the rest of our generations until God comes to take us home to
rest forever? It is a fact, for the approximately 500,000 job opportunities created in Kenya in the financial year 2011/2012, over 95% of the jobs (475,000) were created by the private sector owned and controlled by the Exploitativerich-business-elites Network - meaning that these job opportunities were mainly given to the family members of the Exploitative-rich-business-elites Network, Exploitative-richbusiness-elites Networks networks and members of the ethnic groups of the Exploitative-rich-business-elites Network members and to negligible percentage to the rest of us i.e. we are discriminated against in the appointments to positions of service in our current private sector in Kenya and that is why we are highly educated but unemployed/underemployed. Even the private sector operating within our very locality (using the limited local natural resources & business opportunities) do not employ us but instead ferry people of the specific operating Exploitative-rich-business-elites Network members ethnic group from a far distance to be employed by the sector within our own very locality, isnt that hurting? We are only employed in indecent least gainful positions like as night watchman and house girls/boys. When we complain about the private sector, the Exploitative-richbusiness-elites Network says we are anti-private sector, should we keep quiet and yet we are hurting from our discrimination by the same? It is heart breaking to note, that the Exploitative-rich-businesselites Network deprives us and accumulate wealth and subsequently use the accumulated wealth to establish structures/traps/networks and organizations to be used to further deprive us and our next generations of anything worthy i.e. to block us and our next generations from ever getting out of our vicious cycle of poverty/deprivation trap that they have subjected us to. Their actions are totally immoral and un-Godly, but it is the bitter truth hidden in Kenya our dear country. 1.3. How does (did) the Exploitative-rich-business-elites Network isolate, marginalize, oppress, scorn and made us frustrated & hurting? The Exploitative-rich-business-elites Network either directly or indirectly using political power deprived use of benefit from government infrastructural expenditure; our locality was discriminated against in the government establishment of communication infrastructures that includes: superhighways, modern commuter rail networks, tarmac roads, landline
telecommunication networks, e.t.c. Directly or indirectly, the Exploitative-rich-business-elites Network ensured the government used large percentage of national infrastructural expenditure in building tarmac roads to intensely interconnect their area of property concentrations/accumulations and neighboring regions i.e. the business hub/capital city & environs, these is in total disregard of equity in national expenditure allocations. As a result we are isolated, marginalized and hurting. Directly or indirectly, the Exploitative-rich-business-elites Network has deprived us of our freedom of expression and opinion. Whenever we speak out on out frustrations e.g. on our deprived ancestral lands and the need for timely resolution of historical land injustices, they say we are preaching hate speech subsequently they take us or our honorable leaders to court to face hate speech charges. Thank God, our courts differentiate between hate speech and genuine expression of historical grievances. You will see they will call regional development authorities (RDAs) e.g. RVDA & SEDA as hate speech, and they will threaten to take us the RDAs campaigners to court. By the way, they even wanted to give spy authorities powers to arrest and put us in detention for any period they deem necessary & even powers to shoot-to-kill with pretention (which is not based on facts/truth) that we resisted arrests while armed, thank God, the ideology never succeeded, God our Lord is great HALELUYA AMEN. The Exploitative-rich-business-elites Network either directly or indirectly via use of political power used the so called provincial administration and security service to intimidate, blackmail, oppress, silence and to isolate us the more. When we develop mental disorders because of our deprivation, exploitation & impoverishment, and more so, our mental disorder that manifest in irritability, lack of sleep, lack of concentrations and general disorderliness, then they call us the outlawed Mungiki sect members and subsequently they disassociate us and one by one they dismember us by prematurely sending our fellow impoverished member to our father in heaven. Since we are mentally sick, should we be sent to heaven or should we be provided with medical care and the source of our sickness be amicably fixed? The source of our sickness is our deprivation of our Mau Mau fathers/forefathers ancestral lands which should be restituted to us, and our exploitation should be stopped in addition to our economic empowerment via social
entrepreneurship. Some of our fellow mentally heal brothers are now being called members of the outlawed (though legal) MRC, should out members be isolated, marginalized, called bad names, oppressed, threaten with dire consequence or should they be equally served with justice by promptly solving their historical land injustices among other injustices. Due to the competitive manner (lacking affirmative action to safeguard the impoverished) of admission of bachelors degree students in public universities, we the members of impoverished families who always studies in cheap but poor academic quality local secondary schools; we are further isolated because we have got no option other than to accept less competitive courses which once we graduate cannot enable us to secure any employment opportunity. The competitive government sponsored courses are only benefiting the members of the Exploitative-rich-business-elites Network who afford the prohibitively expensive skewed-located national schools. So almost all of us have/are studied/studying for less competitive/vague degree course which have got no future and thus we are frustrated & hurting; we cannot afford self sponsored/parallel degree programs that are exclusively designed to benefit the moneyed members of the Exploitativerich-business-elites Network. Directly or indirectly, the Exploitative-rich-business-elites Network regularly feed us with misplaced/wrong information on our rights, entitlements and obligations e.g. that we do not have rights to file court proceedings to litigate for all our ancestral lands including the lands in the said capital city, and that any speech on ancestral lands litigations is hate speech and incitement ( is it hate speech to talk about ancestral lands litigation/injustice or is it hate action to deprive other peoples of their ancestral lands in total disregard of the basic right to own communal property as was/is indicated by aboriginal title doctrine which binds all common wealth countries & the constitutional provision on community lands who should be prosecuted, the victim or the perpetrator & the beneficiary of the perpetration; or is it an incitement to talk about the litigation of the ancestral lands, to say the plain painful truth is it incitement for the complainant to complain or is it not pure incitement of descendants by dismembering the descendants from their ancestral lands bearing remains of their ancestors in addition to being their blood-connected-to natural & cultural heritage, what do ancestors feel when they
see their descendants being dismembered from what they left them with & thus being forced into vicious circle of poverty/deprivation trap so who should be prosecuted of incitement, the victim or the planter of incitement & hurt feelings in victims heart? Do you think the forefathers never bindingly-ordered the descendants to never ever think of stopping litigations on even the tiniest of the ancestral lands? All these are meant to further isolate, marginalize, stigmatize and make us hurting the more. Dont we know our rights as stipulated in the constitutional bill of rights and chapter on community land? Are we to remain fools who are taken advantage of forever? 1.4. How does (did) the Exploitative-rich-business-elites Network made us physically weak, frustrated & hurting? We the impoverished and deprived we are physically & psychologically weak as a result of isolation, stigmatization, trauma and psychologically stress among other evils inflicted upon us by the Exploitative-rich-business-elites Network. As a consequence of our isolation, stigmatization, traumatizing and psychological stress our bodies develop complications that include psychological disorders and immune system suppression (our body produce biological chemicals that destroy cells of our bodys defense system immune system, i.e. psychosomatic disorders) that eventually manifest as infections from opportunistic infections/diseases, and noncommunicable diseases that includes various cancers, diabetes and cardiovascular disorders (stroke, heart attack, heart failure e.t.c.), in addition to chronic mental disorders that portray us as non-mentally healthy people who engage in risky behaviours that may/have lead to our infection with HIV/AIDS and other communicable diseases. When we are sick from HIV/AIDS they the Exploitative-rich-business-elites Network members say we are immoral people without knowing that they are the one who indirectly inflicted us with our sicknesses. Also when we behave arrogantly and somehow rude/rough the Exploitative-rich-business-elites Network members call us bad people, are we bad or mentally sick out of their inflicting us with inhumane conditions. Medical experts, isnt this the pure truth? We have to note, that because we the impoverished we cant afford decent entertainments, we use unsafe modes of entertainment to relief ourselves of our daily stresses, hence we are vulnerable to infections from HIV/AIDS and illicit liquor associated disorders and other disorders. Why do the

Directly or indirectly, the Exploitative-rich-business-elites Network ensures bare minimum government expenditure goes to fund public hospitals in our locality. Thus, public hospitals are not well equipped and with inadequate qualified medical personnel and to large extend no specialized equipments and personnel. How is our healthcare to be assured? The well equipped private hospitals owned and operated by the members of the Exploitative-rich-business-elites Network are very expensive and literary unaffordable to us the impoverished. Do you think if one of us the impoverished suddenly suffers cardiovascular attacks e.g. stroke or heart attack/failure, will he/she access emergency cardiovascular medication offered by the well equipped private hospitals or he/she will just die or be permanently incapacitated? Do you understand that that impoverished person who will just die or be permanently incapacitated any time now is you or me or both of us? Should we wait until we just die or be permanently incapacitated so that we can do something to save our dear lives? The Exploitative-rich-business-elites Network directly or indirectly via use of political power has ensured skewed regional-distribution of established highly equipped & staffed affordable public medical institutions and learning institutions e.g. referral hospitals, highly equipped universities & colleges, and highly equipped & staffed national high schools. Doesnt the level of education directly influence the level of ones physical & mental weakness? Without medical and academic amenities in your locality will you be weak and vulnerable to incapacitation & death? Until when are the Exploitative-rich-business-elites Network to make us to be just there to make the lives of micro-organisms such as fungus, bacteria and viruses successful, and having the microbes send us prematurely to spiritual world? 1.5. How does (did) the Exploitative-rich-business-elites Network discriminate us and made us to be in trauma, vulnerable, stigmatized, frustrated and hurting? Because state power/political power was used to deprive of us of our ancestral lands and the lands were given to extremely rich multinational companies, then we became landless. Out of
our landlessness we were helped by good Samaritans to get shelter as squatters in forests including Mau forest. But the spirit crushing question is, why use us the deprived & impoverished forest squatters to plan and execute your personal political opponent character assassination schemes? Why participate in secret planning for our suffering and subsequent dismembering via one-by-one deaths through pneumonia, trauma, stigma, isolation & psychological stress. For your subsequent use to character assassinate your private personal political opponent? Why deny us our right to seek court injunction of our eviction with your promise of use of your political powers & high connections to save us? Did you fulfilled your promise or is your quite successful character assassination schemes the fulfillment of the promise? You knew quite clearly that if we sought the injunction with the claim that the forest was our ancestral land, the claim would have aroused substantial constitutional human rights questions which would have lead to injunction, may be the case could be pending in supreme court today and non of use would have suffered or be prematurely forced to start his/her journey to our eternal home in heaven. Now, the spirit of our dead fellows blames & haunts who among the secret planners and the nave implementer of cabinet decision? Morire nakoboro arire nikiengeeto. Why dont we see the political solution after our persecution & deaths have been successfully used for character assassination of private-personal political opponents is it mission accomplished? Are we the deprived & impoverished forest squatters just there to be used to secretly set political traps, and our persecution & deaths used to character assassinate private & personal political opponents? Until when will we be not equal with the more equal political brokers? The Exploitative-rich-business-elites Network indirectly misleads (using simsim financial support) our children into being beach boys/illicit entertainment tools & beach girls/illicit entertainment tools (homo-sexual/hetero-sexual workers) in local/international tourist hotels; thus our poor children does not access education and are exposed to sexually transmitted diseases e.g. HIV/AIDS. It is heart breaking, our school boys/girls are also hidden victims of the same and this is because we are trapped in our vicious circle of poverty! What is our future now? The Exploitative-rich-business-elites Network have financially dominated us, humiliated us, and deprived us of virtually
everything good until we are stigmatized to an extent of submission and avoiding any conflicts with the Exploitative-richbusiness-elites Network my friend, get into conflicts with the Exploitative-rich-business-elites Network members and you will be in for spirit crushing consequences I have been there before and I know. The only one lead tribal political broker is given the responsibility to package all the political power of his ethnic group in the form of all the our-ethnic-groups elected political leaders being nominated by the single tribal political party, and by the single lead tribal political broker being able to singly order his/her ourethnic-group to vote for presidential candidate X and not & absolutely never to vote for presidential candidate Y. The sad question is that arent the Exploitative-rich-business-elites Network taking us through the back door to one party state situation? Are the Exploitative-rich-business-elites Network indirectly buying our political power for their use in depriving us of all our natural resources, business opportunities and employment opportunities in terms of our local legislative leaders being used to support legislative provisions and policies that empower the Exploitative-rich-business-elites Network, and the elected presidents executive preserving the deprivation traps established by the Exploitative-rich-businesselites Network, not forgetting, the timely use of our local elected political leaders to block enactment of any constitution that we ourselves the impoverished & deprived people drafted ingeniously in a manner that it liberate us from the deprivation traps? It is clear now; the political parties nomination process is purely rigging into political power the Exploitative-richbusiness-elites Networks sycophant candidates. We have to note, according to the law, for one to participate in a given political partys nomination exercise, one has to be
registered as a member of that party and should have membership card. The deadline submission of political party membership lists is 60 day to the day of the general elections. Each political party will nominate her own elective candidates using her own party nomination rules and electoral board; the deadline for the nominations is 45 days to the day of general elections. When you consider the above 3 facts, it is very clear that each political party owners can easily rig in their entire preferred candidates line-up without rising any legal litigations. Which methods will political parties owners use to force us to elect the personal loyal sycophant? 1. Members of each ethnic group will be coerced/bullied into voting for elective candidates from only one our-ethnic-groups political party, those who will refuse will be character assassinated and called traitors. 2. Because political party registered members list will be submitted to IEBC just 15 days before the nomination exercise, meaning front-runners nomination candidates and their strongholds will be very clear. Thus, the political party owners will delete most of the registered members from the strong holds of unwanted candidates from the list and their membership numbers given out. To extreme situations, the name of unwanted candidate can be removed from the political partys membership list before submission to IEBC Registrar of political parties. Do not forget that registration of members will be done secretly by the preferred candidates themselves, meaning all the preferred candidates in a given ward will register members that they are sure will vote for the secretly preferred candidates line-up only. 3. The nomination exercise will be conducted by clerks who will be hired by the political partys owners, meaning the owners will only hire persons who they are sure will follow their instructions in both letter & spirit, hence will use all the available strategies to ensure the political party owners preferred candidates are voted in, do you still remember the scenario during the previous by-election political parties nomination exercises was the winner predictable depending on who was close to the party owners. The sponsored political brokers subsequently use the sponsors money to mislead use via well oiled campaign programs, well coined rhetoric and by feeding us with plenty of illicit liquor/local brews & cheap illegal deathly brews, ultimately making us unable to judge well on their suitability for election. As expected, upon their election they repay the campaign money by being absolutely loyal to the Exploitative-rich-business-elites Network and blind to our cry for help in breaking our vicious circle of poverty and other requests. Please refer to Volume III for the provisions in The Constitution of Kenya, 2010 that were referred to during the proposal of the establishment of regional development authorities and in the drafting of The Proposed Rift Valley Development Authority RVDA: The United Counties of Rift Valley Economic Revolution 2013 2023. On reading and deeply reflecting on The Constitution of Kenya, 2010 article 189 i.e. Cooperation between national and county governments 189. (1) Government at either level shall (a) Perform its functions, and exercise its powers, in a manner that respects the functional and institutional integrity of government at the other level, and respects the constitutional status and institutions of government at the other level and, in the case of county government, within the county level; (b) Assist, support and consult and, as appropriate, implement the legislation of the other level of government; and (c) Liaise with government at the other level for the purpose of exchanging information, coordinating policies and administration and enhancing capacity.
(2) Government at each level, and different governments at the county level, shall co-operate in the performance of functions and exercise of powers and, for that purpose, may set up joint committees and joint authorities. (3) In any dispute between governments, the governments shall make every reasonable effort to settle the dispute, including by means of procedures provided under national legislation. The regional government level had being mandated to spearhead functions that cut-cross various county boundaries e.g. provision of water and sanitation services according to the current provincial water service boards like Rift Valley water service board which was realistic because water bodies can be in on county but other counties also need to source and operate water infrastructure based in other county,s borders. consider Chepkoilel town (Uasin Gishu County) and Chebara dam (Keiyo/Marakwet County). Because parliamentarians removed the provision for the regional government the CoE had to hide the regional government in the constitutional provision above. The hidden regional governments are herein revealed through the establishment of regional development authorities e.g. Rift Valley Development Authority (RVDA) to serve in behalf of the Rift Valley Regional Government that the parliamentarians on their wisdom abolished. 3.0. What are the General Objectives of Regional Development Authorities e.g. RVDA? 1. To promote national values & principles of governances as indicated in the constitution article 10; 2. To promote national unity, love, peace & stability by recognizing & respecting national diversity, and by timely resolution of historical land injustices & other historical and current injustices; 3. To promote the policy of doing what you can, in where you are, with what you have;
4. To facilitate the conservation of natural & cultural heritage 5. To promote realization of cultural rights (e.g. right to practice, preserve and hold intellectual property rights of ones cultural heritage), social rights (e.g. right to have water, health, education, decent housing) and economic rights (e.g. right to have incomes, employment, investment, savings, profits, trade, livelihoods, equity); 6. To safeguard future generations via immediate establishment of firm inclusive socio-economic foundations; 7. To totally eliminate corrupt practices via elimination of government procurement & disposal tendering process; this is by having all government tenders directly serviced by host regions RDAs P-P-P companies according to pre-agreed just & standard terms and conditions of service; 8. To promote equity in Kenyas wealth ownership & economic power distribution and utilizations: 9. to socio-economically empower the Rift Valley Community and beyond, and improve their livelihood ensuring all the people lead a dignified live devoid of exploitation and discrimination; 10. to provide an opportunity to harness and promote local talents, skills and abilities for community advancement; 11. to provide quality and affordable goods/services to Rift Valley Community and beyond; 12. to enable Rift Valley Community members to participate in all development initiatives and decision making processes with regard to sustainable use of their natural resources, marketing of their farm produce, and manufacture & supply of their consumer goods promote community responsibility rather than waiting for someone else to do it for them; 13. to provide internship placement for school leavers and college graduates, hence promoting mentorship linkages, therefore, facilitating their development into responsible citizens, at the same time protecting them from job market exploitation, financial exploitation, sexual exploitation (HIV/AIDS) and idleness; 14. to provide investment opportunities at subsidized operational cost to Rift Valley Community and beyond and in turn generate employment opportunities; 15. to facilitate cluster settlement for easier provision of infrastructure and social amenities and hence mitigate uncontrolled subdivision of agricultural land;

What, how and which political leaders should lead us in the establishment of the proposed Regional Development Authorities? 4.1. Whats up Kenyans? All of us Kenyans, at least wake-up at 7am and sleep at 8pm. During the day each one of us use his/her brain as maximum as possible and also use his/her physical energy as maximum as possible. But it is funny, over 95% of us are still trapped in vicious circle of poverty/deprivation trap while 5% of our citizens (the Exploitative-rich-business-elites Network members) are growing rich & super-rich each and every day flying everywhere while we do not afford to own even a bike or in the extreme cases a pair of shoe. We the impoverished we only struggle to meet our basic needs i.e. food, water, shelter, toilet-needs, while tap water and electricity is what we only hear about i.e. we fully struggle but we have nothing to show for it! Does it mean we are idiots & our brains are vague? But we are the professors teaching & researching in the university! Or we are physically weak, lazy, fatalists and procrastinators? But we are the one diligently serving in the disciplined forces authorities! Then, does it mean there is some supreme powers that the Exploitative-rich-businesselites Network access & utilize to make themselves to grow rich and super-rich each and every day while at the same time use the power to trap us & all our generations in vicious circle of poverty/deprivation trap? If that is true, can that power be political power/sovereign power/state power/power of the government of the day? If it is the political power/state power, are we able to lawfully capture this supreme - everything determining power for our use to break our vicious circle of
poverty/deprivation trap? What is lawfully needed to capture this supreme - everything determining power? Can it be the famous power to vote for political leaders? If so, we the impoverished & deprived, do we have adequate enough power to vote that will enable us to capture the supreme thing? Are we misplaced in concluding that, given that state power/political power was used to deprive of us of everything valuable and subsequently trapped us in our vicious circle of poverty; being learned like a university professor or being physically strong like tiger power or being a big thinker and philosopher like Aristotle will never stop you and your future generations from being impoverished if no political power/state power is used to correct the current trap/snare that traps all of us & all our future generations in the vicious circle of poverty? Recognizing that all sovereign power/state power/political power belongs to the people of Kenya and that we the people may exercise the power either directly or via our democratically elected political representatives (ref: the constitution article 1), we the people will only and only entrust our sovereign power/state power/political power on political leaders who through their experiences have demonstrated loyalty to our interests us the people and are committed to faithfully exercise the powers according to our wishes as exemplified in the proposed RVDA economic blueprint & summarized in the doorto-door civil education campaigns handouts here-are. In the spirit of national unity, we shall never recognize ethnicbased political parties and their owner political brokers who are there to package our political power (in terms of our ethnic group political power) in the ethnic-based political parties for their subsequent sell to the highest bidder, and the highest bidder is always ready to use the purchased power to deprive us & impoverish us the more. Everyone has got to clearly understand; public interest outweighs individual interests. We the people we encourage ourselves to contribute generously towards the campaigns of our vetted & preferred candidates, which will be implemented in the form of the proposed doorto-door civil education campaigns. We have to make sure the Exploitative-rich-business-elites Network will not get a chance to fund election campaigns of our vetted & preferred candidates, so that upon their successful election they will be loyal to us and never at all to the Exploitative-rich-business-elites Network.
4.2. What political leaders should we elect? The political leaders to be elected are the one who are naturally Intelligently-Brave-Stubborn-Just-Revolutionary persons. A naturally Intelligently-Brave-Stubborn-Just-Revolutionary leader is a leader who openly supports, advocates and pushes for fundamental change in power or organizational structures, changes that takes place in a relatively short period of time e.g. via complete change from one constitution to another and prompt full implementation of the new constitution. In this regard, the complete change from one constitution to another has already been effected; the remaining is full implementation of the constitution in both the letter and spirit. Thus, we need to elect political leaders who first of all beliefs in the letter and spirit of the constitution and in the proposed Regional Development Authorities (RDAs) as exemplified in the proposed RVDA economic blueprint. We all accept our new constitution as compared to the former constitution is Revolutionary in nature, and can only be faithfully implemented by naturally Intelligently-Brave-Stubborn-Just-Revolutionary leaders. The political experience of the leader should clearly demonstrate incidences of manifestation of IntelligentlyBravery, Stubbornness and Just Revolutionary nature. The political leader to be elected and his/her strong supporters should not have any know or perceived vested interests against the revolutionary constitution and the proposed RVDA or any provision indicated in the proposed RVDA economic blueprint i.e. should not be member of the Exploitative-rich-businesselites Network or financially or otherwise supported by the Exploitative-rich-business-elites Network. Each of the naturally Intelligently-Brave-Stubborn-JustRevolutionary leader to be elected can be compared with a very huge earth moving machine (Caterpillar - Tinga Tinga) that cannot be blocked on its way by huge rocks or huge tree stumps or huge craters (Exploitative-rich-business-elites Networks sabotage) because the machine will clear & smoothen its way as it moves. We, the least of our brothers & sisters can then walk bear footed on the cleared-smoothen highway.
Can we afford to risk giving our political power to the Exploitative-rich-business-elites Network or to any of their members hirelings, or anyone who can be arm-twisted by the same, for them to use the same power to kill our hope, our future, our very everything - the proposed RDAs i.e. RVDA & SEDA. 5.0. How would the next elect well-educated naturally Intelligently-Brave-Stubborn-Just-Revolutionary leaders use political power to break our vicious circle of poverty/deprivation trap? Elected naturally Intelligently-Brave-Stubborn-JustRevolutionary leaders to use political power to among others: To use political power to facilitate county government County Development Plan Constitution enactment via county th referendum to be held on June 15 2013, the enactment of all the requisite constitutional amendments and legislations, and adopt requisite national government and county governments policy papers and subsequently faithfully and promptly implement them, which include the following: 1. Political power will be used to enforce equity in nationwide economic resource ownership by effecting re-orientation of Kenyan Vision 2030 milestones for delivery by the proposed RDAs in behalf of member County governments, so that Vision 2030 will be about doing what you can where you are with what you have (adopted from Nike and Roosevelt former president of USA). In this regard, the following regional development authorities (RDAs) will be formed immediately after the next general elections: a) Rift Valley Development Authority (RVDA): To spearhead national developmental agenda in Turkana, West Pokot, Trans Nzoia, Uasin Gishu, Elgeyo Marakwet, Baringo, Samburu, Nandi, Kericho, Bomet, Nakuru, Laikipia, Narok and Kajiado Counties: The United Counties of Rift Valley (UCRV); b) Western Kenya Development Authority (WKDA): To spearhead national developmental agenda in Bungoma, Kakamega, Vihiga and Busia Counties: The United Counties of Western Kenya (UCWK); c) Nyanza Development Authority (NDA): To spearhead national developmental agenda in Siaya, Kisumu, Homa Bay and Migori Counties: The United Counties of Nyanza (UCN); d) Gusii Development Authority (GDA): To spearhead national developmental agenda in Kisii and Nyamira Counties: The United Counties of Abagusii (UCA); e) North Eastern Development Authority (NEDA): To spearhead national
developmental agenda in Moyale, Isiolo, Wajir, Mandera and Garisa Counties: The United Counties of North Eastern Kenya (UCNEK); f) Mount Kenya Development Authority (MKDA): To spearhead national developmental agenda in Nyeri, Kirinyaga, Muranga, Kiambu and Nyandarua Counties: The United Counties of Mt. Kenya (UCMK); g) Meru-Embu Development Authority (MEDA): To spearhead national developmental agenda in Meru, Tharaka-Nithi and Embu Counties: The United Counties of Meru & Embu (UCME); h) South Eastern Development Authority (SEDA): To spearhead national developmental agenda in Machakos, Kitui and Makueni Counties: The United Counties of South Eastern Kenya (UCSEK); i) Pwani Development Authority (PDA): To spearhead national developmental agenda in Lamu, Kilifi, Tana River, Mombasa and Taita/Taveta Counties: The United Counties of Pwani Kenya (UCPK); j) Nairobi Development Authority (NDA): To spearhead national developmental agenda in Nairobi County: The United County of Nairobi City (UCNC). Each RDA is to operate in the same framework as the Chinese governments China Investment Corporation (CIC) by hosting a fund i.e. regional development fund that all the member County governments will pool all their sourced international loan proceeds together into one joint regional fund (e.g. Rift Valley Development Fund RVDF). After which, the RDA will use the fund to establish all the necessary public-private-partnership (PP-P) companies to be hosted in newly established cities, towns and local resource centres (1 each at county and constituency Hq, and 3 equitably distributed per ward). Each P-P-P company to be share owned by RDA in behalf of member County governments, residents of the member Counties and strategic investor foreign company/state corporation in the ratio 30:35:35 (for the initial 10 years after which it will be 30:51:19 permanently) . The RDAs 30% shareholding will be subsidy attracting no profits, and useful as incentive for attracting residents and strategic investors investments, also serving as social justice. All the P-P-P companies are to be managed like any other state capitalism investment, with RDA Executive Committee (e.g. RVDA Executive Committee) regulating shareholding (who to buy shares), product/service quality standards, quantity of goods on sell/production, prices, service fees, hiring/firing policy (who to hire/fire), business policy, investment policy, profit margins and social responsibility allowances among other business variables i.e. the way state corporations are regulated by Chinese state capitalist government. In other words, turn-around of our Kenyan
economic system from Western model of Capitalism to Chinese model of State Capitalism mixed with Nilotic model of Social Capitalism and the Corporate Capitalism model in the ratio of let say 30:51:19 or something like that. We belief, this new model that we can call Rift Valley model of Capitalism will amicably resolve our deprivation and impoverishment i.e. the ultimate breaking stroke of our vicious cycle of poverty/deprivation trap. 2. To use the political power to effect constitutional amendment, increasing the minimum amount of national revenue to be equitably shared to county level of governments from 15% to 50%. The constitutional responsibilities of national government is mainly in implementations in only security sector, national truck roads, national referral hospitals, education sector, judiciary, and just policy formulations & regulations for all the other sectors, while county level of governments are to implement almost everything at the grass root level and to spearhead execution of equitable national development economic blueprints at County and Regional level. If it is so, which level of government should justly & equitably get more revenue than the other? 3. To adopt national policy on public debt that provide maximum ceiling of public debt to GDP ratio of 12020%, meaning with a projected 2013/2014 financial years GDP of KSH 4.383 trillion, that financial years public debt maximum ceiling will be KSH 4.383 6.1362 trillion. The international loan borrowing sovereign power will be shared equitably between national government and county level of governments. Such that county level of governments will deserve to borrow USD denominated international loans that will contribute 50% of the total public debt i.e. KSH 2.1915 3.0681 trillion. The County level equitable worth of international loans borrowing sovereign (state) power will be equitably shared amongst county governments according to instantaneous (that times) county governments revenue sharing formulae adopted by parliament. The county level of government loans is to be allocated to and used by the proposed RDAs in establishing public-private partnership companies that will spearhead the breaking of our vicious cycle of poverty/deprivation trap. The loans will be serviced over a 30 years period with 3 years grace period using 30% of annual revenue share of each county government respectively e.g. Turkana County will source over KSH 73.8 billion (30% x KSH 8.2 billion x 30 years) and service
the same using 30% of her annual revenue .i.e. 30% x KSH 8.2 billion = at least KSH.46 billion per year. Will Turkana County feel any birch given that currently the County gets almost nothing of our national revenue? But 2how many of us the impoverished will be up-lifted from our vicious circle of poverty by the KSH 246 billion worth of investments (KSH 73.8 billion x 100/30)? It is important to note, Kenya has over KSH 55 trillion wealth reserves that include the over KSH 7 trillion coal reserves in Kitui and the over KSH 48 trillion oil reserves in North Rift (Turkana, West Pokot, Baringo and Elgeyo Marakwet counties), the over KSH 30 trillion natural gas reserves in Kenya Coastal basin hydrocarbon system, among other multi-trillion KSH worth of mineral reserves. In addition to increase in national and county government tax revenue that will accrue as a result of the investment of the KSH trillions of international loans i.e. new tax from taxing of incomes & expenditures of over 30 million new employees and from taxing of new multi-trillion investors investments incomes & expenditures, in addition to multi-trillion industrial productions/services taxing. Kenya will have no problem in repaying the USD denominated long term international loans. Furthermore, the economies of the wealthiest developed countries are fueled by loans e.g. in 2011 the public debt to GDP ratio of Japan was 229.77%, Italy (120.11), Singapore (118.20%), U.S.A. (103%), Canada (87.40%), France (86.50%), UK (86.30%), Germany (82%), Israel (74.34%), while in our Kenya where we are impoverished & unemployed it was only 49%, while in the still life & kicking Zimbabwe and Sudan it was 230.8% and 100.8% respectively. Significantly important to note, our neighbors countries where poverty is more vicious than ours in Tanzania and Uganda it was 36.9% and 25% respectively. It is only Greece which used her long term loans to service luxurious consumptions that is having problems in the repayment of her debts but we will invest in capital projects & other pro-profit projects the whole of our loans and non will be used for servicing recurrent expenditures nor on any luxuries. It is important to understand clearly that, the higher the public debt to GDP ratio in a country, the higher the GDP of that country consider the public debt to GDP ratio of the top twenty wealthiest countries worldwide i.e. according to IMF the top twenty wealthiest countries worldwide from the wealthiest is as follows [their 2011 GDP (nominal) in USD trillion & the public debt to GDP ratio is in bracket in that order]: [USA (15.0, 103% ), China (7.2, 25%), Japan (5.9, 230%), Germany (3.6, 82%), France (2.8, 86%), Brazil (2.5, 66%), UK (2.4, 82%),
Italy (2.2, 120%), Russia (1.9, 9.6%), India (1.8, 68%), Canada (1.7, 85%), Australia (1.487, 23%), Spain (1.480, 68%), Mexico (1.2, 43%), South Korea (1.1, 34%), Indonesia (0.846, 25%), Netherlands (0.838, 66%), Turkey (0.7, 39%), Switzerland (0.66, 49%), Saudi Arabia (0.59, 9.4%). The economy of China and Russia are not dependent to public debt because they are highly endowed with natural resources including large land mass, had they had high public debt (like USA), each of their economy would be almost the same as USAs, you know their international economic policy & their policy on international security issues & stands in UN permanent security committee and the consequence of that and the economic cold war with others. In the above analysis consider the public debt of Kenya, Tanzania and Uganda and their respective poverty levels]. We have to note, that the booming Chinese economy was started & fueled using loans sourced by the Chinese government and vested in China Investment Corporation (CIC which is moreless similar to our proposed RDAs e.g. RVDA & SEDA), which subsequently used the loans to establish and manage lots of state corporations that in-turn powers the Chinese state capitalist economy. China also used state resources to establish the all-powerful China Development Bank (CDB - which is more-less similar to our proposed RVDB) that heavily finances the state corporations some of them are the one that build our roads here e.g. Thika superhighway was built by Chinese State Corporation Chinese Roads & Bridges Construction Company and others. Is there anyone who can mislead us that our strategy of solving financial capital deprivation is uneconomical or unrealistic? Maybe only the Exploitative-richbusiness-elites Network who always want to take advantage of our lacking cash capital to come and deprive of us our natural resources, business opportunities & subsequently our decent gainful employment opportunities and thus impoverish us & make us to be more hurting. 4. Political power will be used to waive property appreciation tax to Regional Development Authorities (RDAs) entities and PP-P companies properties; 5. To ensure approximately 70% of each governments annual expenditure is used to fund development projects and communication infrastructural development, political power will be used to make all the governments and all their institutions to be very lean, with only skeleton of key policy makers and administrators as permanent & pensionable
employees, while outsourcing from host Regional Development Authoritys (RDAs) P-P-P companies all other services & utilities e,g. transport, cleaning, photocopy, office tea making, constructions & all other public works, IT services, accounting, auditing, marketing, data collection & analysis, water & sanitation services, veterinary services, agricultural extension services, medical services, registration services, surveillance services, warehousing services, gardening services, electrical services, fire-fighting, security services complimenting national police service, human resource service, events planning & management, documentation & data storage, public relations, procurement service, revenue/tax collection, auctioneering, call services, policy advisory services and many more; 6. Political power will be used to ensure the national government promptly source for adequate long term USD denominated concessional loans for her use to develop the proposed 12-lane superhighway national trunk roads that transverse the proposed specialized cities and modern towns. In the same way the government has build the multi-billion shilling 12-lane Thika superhighway, Northern by-pass highway, Eastern by-pass highway, Southern by-pass highway and the Nairobi double-decker superhighway flying over Uhuru & Waiyaki highways. The national government will be requested through bills to be introduced in parliament to priorities and develop/up-grade a number of transport infrastructure that includes: Up-grade and electrification of Kenya-Uganda railway and extension to Southern Sudan via Lodwar Town, Development of 8 to 12 lane superhighway linking Nairobi cityKonza Technology City and from Athi River through Kajiado CBD to Konza Technology City, Extension of oil pipeline to Southern Sudan via Kitale-Lodwar route, Extension of Kisumu-KakamegaBungoma highway to Southern Sudan via Kitale-Lodwar route and construction of Greater Southern By-pass connecting Naivasha-Suswa-Ngong-Kitengela-Lukenya. The public debt increase share (accruing loans) is to be allocated to national government, is the one to be utilized here; 7. To ensure fairness and national government incentive to new cities/towns/resource centers developers. Political power will be used to waive tax obligations of companies based on newly established cities where by the developers established social infrastructure that include road infrastructural networks, airports, optic fibers, railroads and water & sanitation
infrastructures. The waivers will be there until each respective company recovers the excess funds the company had paid during the city/town/resource centers plot purchasing/leasing that was meant to cater for the infrastructural development (used to refund the developers money used in the infrastructural development because it was governments responsibility to develop the infrastructure. 8. To bring equity in national resource/wealth ownership and efficiency in provision of service and goods, and to comply with constitutional provision (constitution of Kenya, 2010 article 66) that directs that investment in property is to benefit the local communities and their economies. Political power will be used to effect privatization and takeover of all Kenyan commercialized state corporations local assets directly to host RDA relevant P-P-P companies. Which include the following state corporations: Kenya Electricity Generating Co. (KenGen), Kenya Power, Kenya Ports Authority (KPA), Kenya Airports Authority (KAA), Kenya Railways (KR), Geothermal Development Corporation (GDC), East African Portland Cement Ltd., Agricultural Development Corporation (ADC), Kenya Seed, New Kenya Cooperative Creameries (New KCC), Kenya Tea Development Agency (KTDA), Pyrethrum Board of Kenya (PBK), Posta Corporation of Kenya, Kenya Meat Commission (KMC), National Hospital Insurance Fund (NHIF), National Social Security Fund (NSSF), Uchumi Supermarket Ltd, Kenyatta International Conference Centre (KICC), Agricultural Finance Corporation (AFC), Nyayo Tea Zones Development Corporation (NTZDC), All state sugar millers, Kenya Wines Agencies Limited (KWAL) and many other commercialized state corporations. In this case, assets of the state corporations in a given region are isolated, valued and directly sold to host regions RDA relevant P-P-P company which will implement national development plan in the local region e.g. all KenGens geothermal power assets in Rift Valley to be privatized to RVDA managed proposed P-P-P company Valley Geothermal Power Ltd, while the Port of Mombasa to the privatized to the proposed PDA managed P-P-P company Pwani Seaports Co. Ltd, while Kenya Railways will be privatized to a consortium of P-P-P companies managed by different RDAs. In this respect, all shares owned by the National Government in any company as a minority shareholder will be sold out, until the National Government has absolute no shares in any commercial sector or enterprise. In addition to promotion of equity in wealth ownership, this provision will
prevent state assets from becoming obsolete & unsellable upon establishment of the proposed P-P-P companies; 9. Political power will be used to totally liberalize importation, refinery, and retail distribution/refilling of petroleum products; 10. Political power will be used to timely facilitate RDAs e.g. RVDA & SEDA in their acquisition of adequate investment lands, for example, RVDAs (via RVILB) acquisition of the 225,000 hectares investment lands to host the proposed Nakuru Commercial City (NCC). 11. Political power will be used to transfer Universities, tertiary educational institutions, primary schools, special education, secondary schools and special education institutions infrastructural development responsibility from national government level to county government level. This is to ensure regional equity in educational institutions infrastructural development and to prevent indirect deprivation of others of their right to education. Other non-infrastructural functions will remain with the national government. 12. To comply with: C169 Indigenous and Tribal Peoples Convention, 1989 and 61/295 United Nations Declaration on the Rights of Indigenous Peoples, 2007, which demands recognition & vesting of ancestral land on members of the Indigenous peoples i.e. descendants of the initial owner ancestors; Constitutional provisions on community land which clearly state that community land consists of land that is ancestral lands and other specified lands, and should be vested in and be held by communities identified on the bases of ethnicity, culture or similar community of interests; aboriginal title doctrine which is a common law doctrine that expects commonwealth courts to made court decisions that respects Indigenous peoples right to hold ownership of their ancestral lands without being deprived of using force or deceit; National Land Policy (NLP) and Constitution article 67 (2e), which recognize the presence of historical land injustices in Kenya and the need for their resolution. We have to acknowledge that all titles to land that were awarded via political power patronage & according to statutes (acts of parliament) that were/are in conflict with aboriginal title doctrine or otherwise in contravention to constitutional provisions on ancestral lands, null & void. Thus, private land rights based on such titles to land (e.g. private land rights to some lands in coastal Kenya & Rift
Valley) are not protected by right to property as provided for by the constitution of Kenya, 2010 i.e. the constitution article 40 (3a) & 40 (6) as read together with the constitution chapter 5. In this case, ancestral lands are rightfully owned by the community as a whole or by individual members of the community. Therefore, political power will be used to enact legislations (Historical Land Injustices Resolution Act, 2013) that will enable the courts to make timely decisions with the effect of directing the national executive, the registrar of lands, National Land Commission (NLC) and national security institutions to (within a given period e.g. 2 years) restitute deprived ancestral lands to the true owner indigenous peoples clans or family lineages, while the litigants are to be paid compensation commensurate with current/that days market price for extensively developed unconstitutionally deprived lands in Nairobi city. Interpreting the provisions of the constitution article 40 on protection of right to property together with the provisions in the constitution article 60 on community land, article 67 on National Land Commission, article 68 on legislation on land and article 69 on obligations in respect of the environment, it is clear the constitution envisages restoration of deprived ancestral lands to the aborigines (descendants of original land owner ancestors), which is in conformation with customary land rights (which has being made to be part of the constitution via ancestral lands provision), aboriginal title doctrine and the international land conventions & declarations stated above. [You know, before we unjustly lost the said ancestral lands, constitution of Kenya (the Lancaster constitution) was amended in a skewed manner to kill regional governments and thus deprive us (take away from us) of any say on the immediate post-independence allocation of our ancestral lands, and for that reason large portions of our most arable ancestral lands were unjustly deprived of us without extinguishing our ancestral land rights (aboriginal land title/native land title, because in the first place our ancestor acquired the land directly as a gift from God and via justified/righteous traditional means, subsequently, the ancestor/forefathers never sold the land to the white colonialist and no one in our lineage also sold the said lands to the current unconstitutionally land rights holders; in fact, the unconstitutional land holders were unjustly given Settlement Trustee Fund STF sourced by immediate post-independence government form Britain, STF was not used to buy our ancestral soils from the white settlers but was only used to compensate the departing white settlers for development that they had done on the land e.g. for the developed roads, housing, tractors/vehicles,
boreholes & water pipelines, fences & fencing, clearing of bush & tilling of land and livestock that were left behind), that is why we now want to litigate in the courts after enactment of historical land injustices resolution act 2013] The aborigines are to promptly and indirectly via their RDAs (Agricultural Land Consolidation Fund under Rift Valley Investment Lands Board) compensate everybody else who will lose right to the affected land; refer to the proposed RVDA economic blueprint chapter on investment land acquisition. The recovered ancestral land shall never be subdivided, but will be agriculturally developed by the host Countys agricultural or livestock development subsidiary company or the proposed Valley Agricultural Development (VAD) Group, under land use agreement with the aborigines who will own the lands. In this regard, aggrieved aborigines are strongly advised to immediately work in conjunction with local legal experts & other local professionals to prepare litigation documents indicating their ancestral administration, occupation & use of the lands and their loss of the lands via force/political power patronage or deceit (not by informed consented willing selling). Therefore, indicating that the aboriginal title was not extinguished; meaning according to the constitution the aggrieved aborigines still hold the right to the land while all other said owners affected by the same, own the land unconstitutionally else are not under protection by the constitutional Protection of right to property (constitution article 40). Political power will be used to ensure absolute (up to a square inch) litigation success of all the deprived ancestral lands including all the ancestral lands in Mombasa City and Nairobi City in inclusion of in Kayole. Legislation will be enacted to provide for judicial resolution of all ancestral land st litigations by July 1 , 2016. Please refer to www.. who owns the land 13. Political power will be used to render null & void all land leases to all the lands that were allocated in total disregard of aboriginal title doctrine & indigenous peoples land rights that include the constitutional ancestral land rights. These leases include leases to agricultural lands (not include cities/towns commercial & industrial plots to which equivalent to current land market value compensation will be sought) allocated to multinational companies, private companies and to individual persons or families. Subsequently the agricultural lands will be restituted back to the indigenous peoples who hold aboriginal title to the ancestral lands.
14. Political power will be used to ensure indigenous communities and other land owners are not deceived into disposing off their natural heritage i.e. Agricultural Lands Consolidation Fund under Rift Valley Investment Lands Board will be adequately facilitated to solely acquire any agricultural land on sale in Rift Valley Community and Nairobi County for subsequent leasing to RVDAs Agricultural/Livestock Development Companies for appropriate land use. 15. To comply with Convention on Biological Diversity - 1992, that is an internationally binding legal treaty, and constitutional article 69 on environment and natural resources. Political power will be used to enact legislation that will ensure lands hosting endangered biological diversity and other fragile ecosystems, and lands that are migratory routes of endangered species are all vested only on national government/county government as public lands or to local communities as community land that shall never be subdivided or internally fenced. Count governments in Rift Valley shall mandate Rift Valley Investment Lands Board (RVILB under RVDA) to acquire all such lands in Rift Valley and hold in their behalf. 16. To comply with constitution article 66 (2), that provides that investment on property should benefit local communities and their economies. In this context, property including anything vested in land, while land including natural resources contained on or under the surface of the land. Political power will be used to enact legislations that will provide for immediate review of all grant of right or concession by any person including national government to any person for exploitation of any natural resource in Kenya that includes coal reserves, oil reserves and natural gas reserves. The objective of the review is to ensure any natural resource in Kenya is exploited by P-P-P companies operating under host Countys RDA and any foreign company previously exploiting the natural resource is considered as strategic investor holding 35% or 19% (within 10 years and afterwards respectively) shareholding in the P-P-P company. In that respect also, political power will be used to ensure 5% and 20% of revenue that accrue from exploitation of natural resources are equitably shared out to local community and host County government respectively. 17. To facilitate Regional Development Authoritys (RDAs) proposed Agroforestry Development Companies to manage
government forestry for efficient agro-forestry & forestry development e.g. The management of all the government forests in Rift Valley Community (RVC) by the proposed Valley Agroforestry Development Co. Ltd. In addition, to facilitate the leasing for 99 years of deforested & illegally settled on government forests directly to host County RDAs Agroforestry Development Co. Ltd. e.g. leasing for 99 years of all the illegally settled on portions of government forests that include portions of Mau forest, Embobut forest & Marmanet forest to Valley Agroforestry Development Co. Ltd. The leased land to be used according to strict terms of use that include growing only agreed upon commercial tree/scrub species that have high carbon sequestration capacity and hence conserve water catchment area/water towers the most e.g. commercial bamboo, macadamia nut trees and tea bush. The illegal forest settlers are to be compensated by the government using the lease fee, they are to use the compensations to acquire shares in the Agroforestry Development Co. Ltd and subsequently settle on cluster settlement centres within the forest as they work with the company. In this way, both water towers and humanity will be conserved. 18. Political power will be used to ensure national government introduces unit costing in University students government partial sponsorship program, once enacted it will enable National government partially sponsored university studentship candidates to joint any Kenyan Public University or P-P-P University of their choice using the partial sponsorship vouchers. The above provision will be tailored to apply across the academic levels i.e. from pre-schools through primary schools, secondary schools & tertiary institutions to university level. 19. Political power will be used to ensure national government subsidize healthcare offered to her citizen by all the public and P-P-P hospitals (to a given maximum level for a given health condition) i.e. for services offered by both public and P-P-P hospitals, these legal requirement may be implemented through government sponsored/facilitated health insurance cover for all citizens. 20. Political power will be used to establish Commission on Conservation of Water Towers which is to be allocated 0.5% of annual national government budget. Its mandate will be to restore and conserve the 5 national water towers.
21. Political power will be used in support of compensation of the Mau Mau veterans, in the same aspects of past injustices compensations, political power will be used to ensure indigenous communities who loosed their ancestral lands, livelihoods including livestock genetic resources, the traditional economic activity of nomadic pastoralist way of livelihood security, among others via government controlled post independence skewed land adjudications. This is because the post independence government being a member of the common wealth, she was legally bound to respect common law doctrine of aboriginal land title which the government totally disregarded leading to the loss of the ancestral lands through the well know historical land injustices, the government senior most officials did the injustice knowingly with impunity & scorn (madharau) the compensation is in addition to restoration of ancestral lands to the aborigines as provided for below; 22. Political power will be used to subsidize for referral healthcare offered to her citizen by all the referral hospitals (to a given maximum level for a given health condition) i.e. for services offered by both public and private hospitals, these request can be implemented through government sponsored/facilitated health insurance cover for all citizens. 23. The national government will be requested through a bill in parliament to allow duty free importation of essential industrial raw materials not adequately available in Kenya e.g. iron ore. 24. Political power will be used to constitute a special boundaries commission to investigate need for and recommend transfer of Mt. Elgon constituency from Bungoma County to Trans Nzoia County. Subsequently, the same power will be used to approve the transfer recommendation. 25. Political power will be used to restructure the so called Provincial Administration in such a manner that the administrators in the administration reports directly and be under the direct supervision of the respective County governments. This is to prevent their uses to intimidate us and to participate in our deprivation of natural resources that include our ancestral lands do you still remember how our only very lucrative seashore ancestral lands was lost through delegated higher political patronage;
26. Political power will be used directly & indirectly via Judiciary to order relevant authorities to retrace the remains or portions of the remains of our hero/heroine-fellows who were persecuted during the period of the resistance of colonial rule or during the struggle for independence. So that their remains may be given the last respect by being given decent order of habeas corpus (decent last respect - at ancestral lands) as provided for in the constitution for their spirit to rest in eternal peace, and that our motherland may be truly peaceful, truly stable & truly prosperous. Do you think our motherland can enjoy true peace, true stability & true prosperity when the spirit of our hero/heroine-fellows are still silently crying for recognition & respect by their remains being given the last respect of decent order of habeas corpus (burial). 27. Political power will be used to ensure immediate return of over 1,000 Nandi artifacts kept in the Oxford Pitt Rivers Museum in UK and in elsewhere. The returned Nandi artifacts will be permanently kept in the proposed Koitalel arap Somoei Memorial Park, Nandi Hills. 28. Political power will be used to enact legislations with provisions that ensure any court case against or incidental to the timely implementation of any provision herein proposed (provided for in the proposed RVDA economic blueprint) is resolved by judiciary within 3 months of its filling, legislation amendments or constitutional amendment or new legislations enactment will be done to ensure any court case against any of the provision provided by the proposed RVDA is resolved favorably for RVDA economic blueprint faithful implementation. 6.0. Who are the vetted & preferred well-educated naturally Intelligently-Brave-Stubborn-Just-Revolutionary candidates for 2013-election? 7.0. Sustainable Post-election Socio-politico-economic Stability 1. To offer sustainable post-election socio-economic stability, all the pre-election political coalitions will be reviewed via amendment of Elections Act, 2011. Upon the review, realistic post-election political coalitions of all political parties whose elected political leaders were elected based on the current economic revolution i.e. all pro-RDAs political parties. The coalition political parties will share political positions based on mutual respect & recognition, but of important will be putting the last first peoples interests first. 2. The proposed name of the post-election political parties coalition is: Federal Socioeconomic Equity Movement (FSEM). We expect Anti-RDAs political parties also to form AntiRDAs political parties coalition, whose name may-probably-be: The National Capitalists Coalition for Conservation of Statusquo (TC3S); though they may adopt a name which hides their stands on national economic policy. TC3S will try all their best to sabotage the proposed Economic Revolution but since no one can sabotage Gods promise they shall never succeed. 3. We expect to have only two main parties out of the two coalitions ever after in Kenya, as it is in USA where there are two main political parties, a pro-equity in resource distribution and a pro-capitalists interests party. 4. 8.0. Should those who will directly or indirectly try to sabotage the establishment of the proposed Regional Development Authorities benefit from their fruits? Considering that the members of the Exploitative-rich-businesselites Network are self-centered and dominant people who consider us the deprived & impoverished as not worthy for anything good, it is logical to conclude that the Exploitativerich-business-elites Network will do all within their powers under the sun to sabotage our liberation from our vicious circle of poverty/deprivation trap that they inflicted upon us. In this respect, the Exploitative-rich-business-elites Network will do all to try to block our electing of naturally Intelligently-BraveStubborn-Just-Revolutionary Leaders. Which means, they will immensely finance well oiled election campaigns for naturallyUnwittingly-Coward-Puppet-Conservative Leaders or some of their loyal members, to whom they will have entered preelection binding agreement (via binding oath associated with devastating consequences in case of its violation) to conserve status-quo i.e. sabotage the establishment of the proposed RDAs and all the associated proposals as indicated in the proposed RVDA economic blueprint. Indirectly trying to sabotage the establishment of the proposed RDAs (e.g. RVDA & SEDA) is by either financing
campaigns for the real saboteurs, campaigning for the real saboteurs, voting for the real saboteurs or voting for hirelings of the Exploitative-rich-business-elites Networks who are hired to divide votes of slum dwellers in Nairobi/Mombasa/Nakuru and elsewhere we all know - via voting for Exploitative-rich-business-elites Network funded our-ethnic-based-party line-up of our-ethnic-members nominated by our-ethnic-based-political party lead by ourethnic-member presidential candidate who is propped & financed by the Exploitative-rich-business-elites Network to divide votes of the deprived & improvised masses living under undignified live in slum of Nairobi/Mombasa/Nakuru or living as disrespected cooks/shamba-boys/house-girls/watchmen in somewhere we all know, to divide the votes so that the Exploitative-rich-business-elites Network members may elect their own so that he/she will surely sabotage revolutionary legislations enactment in parliament and any presidential assenting to, or otherwise doing anything that can lead to sabotage of the implementation of the proposed RDAs. Logically speaking, do anyone who will participate directly or indirectly in trying to sabotage the establishment of the RDAs deserve to get any fruit/gain that will come-out as a result of the establishment of the RDAs. As to whether the establishment of the proposed RVDA will be sabotaged or not is not a question, because the establishment of the proposed RVDA is fulfillment of Gods promise to his chosen people, and as it were, no one can sabotage Gods will the colonialists never succeeded to prevent the withering and fall of the 15 feet diameter mugumo tree that was in Thika, despite their building of iron/concrete support all-round the tree. According to the logical arguments above, the employment opportunities created by the establishment of the proposed RVDA will be shared out as per the following formulae: 50% of all the positions at all the cadres will be equitably (according to shareholding in RVDF) allocated to residents of the member counties, 20% of all the positions at all the cadres will be equitably (according to percentage of votes over total votes to the vetted ) allocated to residents of the counties which will have majorly (majority) voted for the vetted-preferred lead naturally Intelligently-Brave-Stubborn-Just-Revolutionary leader as next president- elect, 20% of all the positions at all the cadres will be equitably (according to number of elected leaders) allocated to residents of the counties/constituencies whose elected legislative house members will support
constitutional amendments, enactment of requisite bills & government policy papers in senate or parliament accordingly, the remaining 10% will be allocated to expatriates seconded by strategic investor(s) or otherwise internationally recruited expatriates. 9.0. The Continues Monitoring & Evaluation of the Economic Revolution What can we do to ensure the next elected naturally Intelligently-Brave-Stubborn-Just-Revolutionary political leaders will efficiently and timely diligently deliver peoples interests as depicted in The Proposed Rift Valley Development Authority RVDA economic blueprint? To ensure the next elected political leaders deliver the peoples interests/goods within the set timeframes, we the people will be ready to participate in a sustained peaceful & unarmed mass demonstrations, picketing and petitions country wide or region wide as appropriate (i.e. region wide e.g. residents of Mt. Elgon constituency and Trans Nzoia County will participate in a sustained peaceful & unarmed mass demonstrations, picketing and petitions - pushing for the proposed timely legal transfer of Mt. Elgon constituency from Bungoma County to Trans Nzoia County). The peaceful unarmed demonstrations, picketing and petitions will be lead by University students, College students, workers and urban areas based youth for urban areas level, and farmers, rural areas-based youth, primary school students & their teachers and secondary school students & their teachers at rural areas levels. Appropriate legally-sound slogans will be adopted and pronounced during the peaceful demonstrations i.e.:1. If a given County government fails to implement specified milestones according to the specified timelines, all the people in the County will participate in the sustained peaceful & unarmed mass demonstrations, picketing and petitions until the County government is suspended by the next president according to the constitution article 192 (1) [which states that The President may suspend a county government (1) (a) in an emergency arising out of internal conflict or war; or (b) in any other exceptional circumstances; (6) On the expiry of the period provided for under clause (5), elections for the relevant county government shall be held]. Subsequently, we the people will install via by-election a new County government which will automatically implement Putting The Last First; Peoples Interests First policy;
2. If parliamentarians fail to enact specified requisite laws or amendments within specified timelines, proposals 1 will be promptly implemented with relevant modifications; 3. If the next president fails to faithfully implement specified milestones according to the specified timelines, the parliament will immediately initiate the process of his/her removal from state power according to the law. Starting with vote for noconfidence to the entire presidents appointed state officers that include all the cabinet secretaries, attorney general, secretary to the cabinet, and all the principal secretaries & Diplomatic Representative/Ambassadors representing Kenya abroad. The state officers will have failed confidence of the people for failing to advice their appointing authority (the president) accordingly. As the president is being removed by the parliament, proposals 1 will be promptly implemented with relevant modifications. Subsequently, we the people will install via by-election a new president who will automatically faithfully implement Putting The Last First; Peoples Interests First policy; 4. To facilitate monitoring and evaluation of the faithful implementation of the Economic Revolution, we the people will form and register numerous students associations, youth groups, farmers groups, women groups, professionals groups, civil society groups, community based organizations (CBOs), non-governmental organizations (NGOs), facebook groups, tweeter groups, Google groups, among others to facilitate the same. 5. To ensure the next elected political leaders deliver the peoples interests/goods within the set timeframes, we the people will regularly participate in a sustained peaceful & unarmed mass demonstrations in support of the Economic Revolution as indicated by The Proposed RVDA. The peaceful unarmed demonstrations, picketing and petitions in support of the Economic Revolution will be lead by University students, College students, workers and urban areas based youth for urban areas level, and farmers, rural areas-based youth, primary school students & their teachers and secondary school students & their teachers at rural areas levels. Appropriate legally-sound slogans supporting the Economic Revolution will be adopted and pronounced during the peaceful demonstrations 10.0. Conclusion
Had it not been for the self-centered & skewed amendment of the independence Lancaster constitution; had we not being hurting; had it not been any need for the Economic Revolution; had it not being the Economic Revolution. If political power was unjustly used to concentrate good things in somewhere/somebody, why not use the same political power to return good things into where/whom God had knowingly put? When the place/whom good things were unjustly concentrated become obsolete, to whom should blame be directed? Then, what reason do we have for us not to support the Economic Revolution which is well inspired to return good things into where/whom God had knowingly put - Thus fulfilling Gods promise to his chosen people.
