On Sunday December 11, 2011 the group, Occupy Palm Beach, was granted permission by Mayor Muoio to move to city-owned property located at 200 2nd Street, the former City Hall site. Early in February a meeting was held between representatives of Occupy Palm Beach and City Administration to include; Mayor Muoio, City Administrator Ed Mitchell, members of the City`s Attorney`s Office, the Police Department, and Occupy Palm Beach representatives to include; Greg Weiss and Allen Mergaman. During the meeting, Mayor Muoio informed the representatives that the Occupy Palm Beach group would have until March 1, 2012 to vacate the 200 2nd Street site. During conversations with the city and local media, members of the group Occupy Palm Beach have made multiple claims that they do not indend to leave the 200 2nd Street location despite the formal order of City staff to vacate or be charged with trespass. Since the arrival of the Occupy Palm Beach group on city property, police calls for service have increased slightly to include calls for disturbances at the site, battery, and criminal mischief. The actions of some members of the Occupy Palm Beach group have been in clear violation of earlier agreements with city representatives regarding their expected behavior at the 200 2nd Street location. On March 1, 2012 employees of the Public Works Department responded to 200 2nd Street at the direction of the police and legal department to post the property with "No Trespass" signs around the perimeter of the property in accordance with state statute. These signs were recorded on video and photographed. On March 2, 2012 occupants at the location were formally given notice to vacate the location in the form of a "Notice of Closing Occupy Site" letter that was signed by West Palm Beach City Administrator Ed Mitchell. Additionally, a dispersal order was verbalized by police officers to the occupants informing them of the possibility of being of arrested if the order was not followed. The occupants were told that they would be given a "reasonable amount of time" with which to comply with the order. The dispersal has continued to be read at the site location approximately every six (6) hours since the initial reading. Since this order was given, several protestors were observed moving onto a roof overhang on the former city hall building. They erected tents and signage from this location. There has been damage to the building and the grounds that can be directly attributed to the people staying on the site. On Monday, March 5, 2012 at approximately 0500 hrs. Officers from the West Palm Beach Police Department and the Palm Beach County Sheriffs Office Field Force teams planned an operation to ensure the safe arrest of parties that refused to comply with the dispersal order. The entire operation was video taped by Deputy Korb ID #3477 and Deputy Rothell ID #6497. The final dispersal order was read by Officer Fernando Palacios, ID #1833 at all four corners of the property between 0500-0510 hrs. At that time five (5) persons decided to vacate. A female voice coming from the building said, "Hey Palm Beach Police, we`d like to know where`s our alternate area?" and "Where`s our alternate area?" It appeared this female, later identified as Jacqueline Bryant used a bull horn to amplify her voice. Between 0510 hrs and 0515 hrs. members of the Emergency Field Force team moved in to begin to arrest protestors who refused to comply with our lawful order. Three persons on the roof appeared to move up against the building securing themselves in while officers were on the ground clearing the tents and other areas. A white female asked to be allowed to collect her belongings from inside a tent before she left, but she was more than willing to leave. She was allowed to do so without police interference. A white male, later identified as, Peter Loegovich 04/13/1964 was arrested for trespass under case number 12-3676 by Officer Banks ID#1661, Archer ID#1679, Barr ID#1694 and Evrley #1648. He was escorted to the transport van by Officer Evrley and Banks.

West Palm Beach Fire Rescue assisted members of the West Palm Beach Police Department and Palm Beach County Sheriff`s Office Field Force Units to get on to the overhang roof where the three individuals resisting arrest were located. It was approximately 0520 hrs. when WPBFD utilized an aerial platform to access the overhang roof. There was also a ladder placed up against the building to allow additional officers to get to the roof. As officers made it to the roof, they observed the protestors secured themselves in a large pieces of PVC piping with a chain device and attached it to the frame of an airconditioning unit. Jacqueline Bryant was attached to the northwest corner of the a/c frame, Frazier Williams was attached to the northeast corner of the frame and John Pope was attached at the southeast corner of the frame. These devices are known as "sleeping dragons". They were cut free from the airconditioning units by PBSO`s cut team. Sgt. James Hightower ID #4515, Detective John Wikse ID#6933, and D/S David Chasteen ID#4956 responded to assist in removing the protestors. This is covered under their case number 2012-046025. At approximately 0533 hrs. Sgt. Hightower reiterated to the protestors that they were under arrest and asked them to voluntarily release themselves from the protestor device, however, they each individually refused. The metal air conditioner frame was cut and each protestor was released individually. The first individual, Jacqueline Bryant, W/F, 08/17/1974 was transported to the safety of the ground by Officer Bales in the fire bucket. Her restraints were removed by PBSO`s cut team, Detective Wikse, and she was arrested and charged by Officer Morton #1761 under case #12-3678. She was placed into flex cuffs and walked to the transport van. She had no signs of injury from the removal process and required no medical attention. The second individual, Frazer Williams, B/M, 08/29/1959 was transported to the safety of the ground by Officer Bales in the fire bucket. His restraints were removed by PBSO`s cut team, D/S Chasteen, and he was arrested and charged by Officer Bales #1601 under case #12-3677. He was placed into flex cuffs and walked to the transport van. Williams had no signs of injury from the removal process and required no medical attention. The third individual, John E. Pope, B/M, 12/12/1965 was transported to the safety of the ground by Officer Bales in the fire bucket. Upon the aerial transport reaching the ground, Pope advised he was going to passively resist and his body was going to go limp. Officers Evrley, Nagel ID#1769, Campbell ID#1823, and Bales carried him to the cut area. His restraints were removed by PBSO`s cut team, D/S Scott Levey ID#9415 and he was arrested and charged by Officer Archer #1679 under case #12-3675. He was placed into flex cuffs and walked to the transport van. Pope had no signs of injury from the removal process and did not require medical attention. All three protestors were offered water and blankets to ensure their comfort during the device removal procedure. All evidence as it related to the cut team was taken by Palm Beach County Sheriff`s Deputies and placed into their evidence. All three were photographed and inteviewed on tape about their property. The only one to claim any property was John E. Pope, who stated a wooden cot on the roof belonged to him. The rest was stated to be "community property". The arrestees were transported to the West Palm Beach Police Department booking facility. After the arrest paperwork was completed, they were transported to Palm Beach County Jail. While the above arrests were being completed, other members of the WPB Field Force team with the assistance of City Attorney Lisa Conforti, began bagging and tagging the property that needed to be stored. This was coordinated by Officer Yermanos ID #1813 under case numbers 12-3669, 3670, 3671, 3672, 3673, 3674. Property that could not be attributed to a specific site, but was "community" property was tagged under case #12-3668 to include all the signage recovered. This was video taped by deputies and CSI Emily Afandor. Prior to transporting this evidence to the police department several former occupants were allowed to return and collect their belongings. This was video taped. The unclaimed property was transported to the West Palm Beach Police Department by Sgt. Johnson ID#1560 and placed into evidence. There were several crates of food seized and donated to the Vicker`s house as it was not

possible to store in the WPB PD evidence locker. The video tapes, letter from City Administrator Ed Mitchell, and Dispersal Order were also placed into evidence by me. Several media stations were on site and did extensive photographing and video taping. PIO Allen Ortman was advised of the operation. City staff was onsite to secure the facility upon the departure of the police. Upon completion of the operation, there were no injuries reported by either the arrestees or any of the personnel involved.

On Monday the 5th of March 2012 at approximately 0430 hours, I responded to the police station to assist in an emergency field force (EFF) operation to arrest and remove occupy protesters from the old city hall building, located at 200 2nd Street. My role was to support the Officers involved from a bomb squad prospective, in the event that there were any potential threats during the operation. I responded with the EFF team and PBSO to the scene. Upon my arrival, I cleared the area for any obvious threats and collected several propane cylinders from the site for disposal. None of the protesters lay claim to the cylinders as their personal property, so they were disposed of by recycling them at the solid waste authority site on Jog Rd for disposal. This was done as a result of the cylinders being partially full or nearly empty and the evidence section not being able to store the materials safely as found property. I had no other involvement in the operation and left the scene at approximately 0700 hours.
