The Circuit Attorney of the City of St. Louis, State of Missouri, upon information and belief, charges that Count 1: BURGLARY 1ST DEG (Class B FELONY) RSMo 569.160 3:00 AM TO 1/1/2013 at 7:30 AM Place: 52XX HOLLY HILLS AVE FROM 1/1/2013 at (SCC 14010)

The defendant, in violation of Section 569.160, RSMo, committed the class B felony of burglary in the first degree, punishable upon conviction under Section 558.011, RSMo, in that on or between January 1, 2013 at 3:00 AM and January 1, 2013 at 7:30 AM, in the City of St. Louis, State of Missouri, the defendant, acting with another, knowingly entered unlawfully in a building, located at 52XX HOLLY HILLS AVE and possessed by XXXXXXXXXX, for the purpose of committing stealing therein, and while in such building there was present in such building XXXXXXXXXXX, a person who was not a participant in the crime.

Count 2: Theft/stealing (value Of Property/services Is Less Than $500) - 1st Offense (Class A MISDEMEANOR) RSMo 570.030 FROM 1/1/2013 at 3:00 AM TO 1/1/2013 at 7:30 AM Place: 52XX HOLLY HILLS AVE (SCC 15000) The defendant, in violation of Section 570.030, RSMo, committed the class A misdemeanor of stealing, punishable upon conviction under Sections 558.011 and 560.016, RSMo, in that on or between January 1, 2013 at 3:00 AM and January 1, 2013 at 7:30 AM, in the City of St. Louis, State of Missouri, the defendant appropriated jewelry, which property was in the possession of XXXXXXXXX, and the

DATE: January 10, 2013 I, Ramiro Martinez, a law enforcement officer for the City of St. Louis, State of Missouri, knowing that false statements on this form are punishable by law, state that the facts contained herein are true. 1. I have probable cause to believe that Timothy Gilbert, a White Male DOB: XX/XX/94 Age: 18, committed one or more criminal offense(s). Count 1: BURGLARY 1ST DEG (Class B FELONY) RSMo 569.160 FROM 1/1/2013 at 3:00 AM TO 1/1/2013 at 7:30 AM Place: 52XX HOLLY HILLS AVE Count 2: Theft/stealing (value Of Property/services Is Less Than $500) - 1st Offense (Class A MISDEMEANOR) RSMo 570.030 FROM 1/1/2013 at 3:00 AM TO 1/1/2013 at 7:30 AM Place: 52XX HOLLY HILLS AVE 2. The facts supporting this belief are as follows: A.H. told me that she and her husband woke up on January 1st, 2013 to find their home vandalized and their wedding bands and her engagement ring missing from where they were left the night before. On January 2 nd, 2013, the defendant, as recorded by surveillance cameras, sold one of the rings, later identified by Harris as her engagement ring, to M.G.B.
