I am a 57 year old white female.

I was named as a witness in an EEOC

investigation (420-2012-00251) involving Jamie Ligon, Payroll Manager in the General Accounting Division. Ms. Ligon filed a charge of discrimination on November 8, 2011, alleging age and race discrimination in the workplace. Iwas named in the investigation as a witness because Ihad served as her supervisor for approximately 16 years and was familiar with the discrimination to which she had been subjected. At the time Ms. Ligon's case was being investigated by EEOC, I was contesting my termination from the same employer, the City of Birmingham. I had been charged with hostile environment and racial discrimination. I had served for 18 years as the Chief Accountant in the Department of Finance. I had worked for the City for nearly 24 years. Prior to that, I was never the subject of any disciplinary action. I had anexemplary employment record. 'Thr~&ft'eIs()n County Personnel Board ruled in my favor and ordered my 'f~iijstf~$~ent()n JanuarylQ,20 12. I went back to work on January 23, 'Zo.j2:.'0ii:j:~n~aiy 26, 20.1;2, I was again noticed far termination. I was 'termInated on january 30, 2012. I was forewarned by City attorneys that if J wasreinstat~d by the Board that I would be subject to another termination action. In fact; within days Qlreinstatement, I was terminated again. I claim that my second termination was taken in retaliation for my participation in the Ligon EEOC investigation. I hereby incorporate the Ligon filing with this claim. I also. claim that my recent (second) termination - as with the first termination - was based on racial and age discrimination. The City of Birmingham has engaged in a pattern and practice of race and age discrimination. I stood against these practices as the Chief Accountant and was subjected to retaliation as a result of my stance. At the present time, there remains only one White supervisor in the accounting department. Prior to my first termination in October 20 10, there were 5 whites in supervisory positions. The changes all came about in the last two. years. Many older persons and Whites were forced to. resign or .were discharged'<I under the recent .administrati,on. There rema~ns only ?~e White in the 28 \\ member Accounting Department. Lanelle Dnver. She IS 60 years of age.

Ms. Driver is being subjected to derision daily and an increased workload. She is afraid to file a complaint with the City or EEOC because she needs to work until her retirement date.

Since J~!y 2010, Barbara McGnJe, Di3puty Director of Finance, continually publicly chastised, ridiculed, humiliated me, and verbally insulted me and other White employees creating a racially hostile work environment. Ms McGrue denied White employees opportunities afforded Blacks employees. I e-mailed Tom Barnett, Director of Finance, Peggy Polk, Director of Personnel, and copied Ms. McGrue that I believed that Ms. McGrue was subjecting me to discriminatory treatment because of my race. No action was taken and they did not respond to my email. Subsequent to my complaint Ms. McGrue would not meet with me or keep me informed with what was going on in the section. Ms. McGrue began finding fault in any thing that J did whereas there were never any problems identified with my work. On August 19, 2011, I was forced to resign my employment as a result of no longer being able to tolerate the adverse treatment imposed upon me which caused me great stress and mental anguish. A number of White employees in tHe protected age group have been discharqec or forced to resign and replaced with Blacks. The employer offered no reason for the adverse treatment imposed up me.
