CONTRACTUAL AGREEMENT FOR ARCHITCTURAL DESING

This Agreement is made and entered into on the ____ th day of Jan. 2006 by and between _______________________________ whose address is _____ K/Ketema Kebele ___ ( here in after referred to as the Project Owner) on one hand. AND Professional __________________________ whose address is ________ Kifle Ketema, Kebele ____ House No _____ (Here in after referred to as the Architect) on the other hand, where As the Project owner has invited the Architect for the preparation and approval architectural design of G+2 buildings by concerned government authority and finally submit in acceptable condition to the Project owner ARTICLE 1 OBJECT OF THE CONTRACT The Architect Shall prepare architectural, structural, electrical , sanitary designs with their bills of quantities that satisfy acceptable standards of a professional work and the stated designs below. Architect in accordance with terms and condition of the contract. ARTICLE 2 OBLIGATION OF THE ARCHITECT 1. The Architect Shall:A) Prepare Architectural Design, B) Prepare Structural Design, C) Prepare Electrical Design D) Prepare Sanitary Design and E) Prepare bills of quantities. The project owner on its part shall pay the agreed remuneration to the

Also have the architectural design approved by the concerned government organs and to the effect arrange, fix complete processes required for obtaining permission for the construction of the buildings.

Deliver the approved design and the other works to the Project owner on or before _______ 2006 (within 30 calendar days).

4. Make improvements, adjustments and modifications if required by the approving Authority. 5. Shall pay about 30% of the total amount of the remuneration paid to him as a penalty for delay in submission of the approved designs and drawings with work permit. ARTICLE 3 OBLIGATION OF THE PROJECT OWNER The Project owner shall:1. Provide the Architect with basic necessary documents such as planning information format, approved title deed (ownership certificate) and / or any data relevant for the agreed design works. 2. Follow up the progress of the project (design works) through representative (s) and designate one or more persons with whom the Architect discusses details of the design works and / amendments, modifications adjustments, alterations and other as may be required. 3. Effect payment due to the Architect in accordance with terms and conditions stipulated in Article 4 of this contract. ARTICLE 4 PAYMENT TERMS 1. The Project owner shall pay remuneration to the Architect Birr _______________ (______________________) Birr for the entire project. 2. Such payment shall be effected in two payments. shall be paid in cash upon the signing of this contract by the parties. the remaining balance shall be paid upon submission of the approved complete architectural designs and drawings and work permit issued by the concerned government authority by the Architect to the project Owner 3. The Project Owner shall pay about 20% of the total amount of the remuneration payable to the Architect as a penalty for default in effecting the last and final payment. ARTICLE 5 ENTRY IN TO FORCE This contract shall become effective on the date it is signed by both parties and remain valid until its completion. The parties here to have given their consent freely before witnesses whose names are mentioned here in below and have affixed their respective seals on to this contract on this ___ th day of Jan. 2006 here in Addis Ababa.
