CA 01 (41) IMPERIAL HOUSE CONDOMINIUM, INC., Plaintiff, vs. STEVEN SHIEKMAN, etc., et al Defendant(s). ________________________________/ SUMMARY FINAL JUDGMENT OF FORECLOSURE This cause came before the court on October 10, 2012 on Plaintiffs Motion for Summary Judgment. The Court having reviewed the motions, affidavits, and the file and finding that the Defendant Steven Shiekman has not provided proof that he is not indebted to Plaintiff Association, it is ORDERED AND ADJUDGED that:

1. With regard to Count I of Plaintiffs Amended Complaint, Plaintiff IMPERIAL HOUSE CONDOMINIUM, INC. is due the sum of $93,422.59 representing unpaid maintenance, special assessments, interest and late fees as of May 01, 2012. 2. The court retains jurisdiction to assess costs and attorney fees due to counsel for the Plaintiff by the Defendant Steven Shiekman in connection with Count I upon proper notice. 3. Plaintiff holds a lien for the total sum superior in dignity to all claims or estates of Defendants Steven Shiekman, Last Chance Glass, Inc., A Florida Corporation, Edd Helms Group, Inc., A Florida Corporation d/b/a Edd Helms Electric, Miami Country Day School, Inc., Deference Corp., Philip J. Schecter, Cynthia J. Dienstag, P.A., John Shiekman, The Estate of 1

Lila Shiekman, and Suzanne A. Shiekman, The Estate of Lila Shiekman, and John Shiekman, and Suzanne Shiekman, as trustees of the Lila Shiekman Trust any right, title, interest or claim of said Defendants and all persons, corporations or other entity claiming by, through or under the said Defendants on the following described property located in Miami Dade County:
Condominium Unit No. 10(C) IMPERIAL HOUSE CONDOMINIUM, according to the Declaration of Condominium thereof, as recorded in Official Records Book 8297, Page 303, of the Public Records of Miami-Dade County, Florida; A/K/A: 5255 Collins Avenue, Unit 10(c) Miami Beach, Florida 33140; Property ID# 02-3214-007-0840.

4. The Plaintiffs claims against the Defendant Estate of Lila Shiekman and the Lila Shiekman Trust remain pending. Plaintiffs Motion for Summary Judgment as to Counts 2, 3, and 4 of the Complaint is denied, without prejudice. 5. If the total sum together with interest described in paragraph 1 and all costs accrued subsequent to this judgment are not paid, the Clerk of the Court shall sell the subject property at public sale by on ______________ to the highest bidder for cash, except as prescribed in paragraph 6 in accordance with section 45.031, Florida Statutes using electronic sale beginning at 9:00 a.m. on the prescribed date at www.miamidade.realforeclose.com after having first giving notice as required by Section 45.031 Florida Statutes. 6. Plaintiff shall advance all subsequent costs of this action and shall be reimbursed for them by the Clerk if Plaintiff is not the purchaser of the property for sale, provided, however, that the purchaser of the property at the sale shall be responsible for the documentary stamps, payable upon the Certificate of Title. If Plaintiff is the purchaser then the Clerk shall credit Plaintiffs bid with the total sum with interest and cost accruing subsequent to this judgment, or such part of it, as is necessary to pay the bid in full. The Clerk shall receive the service charge imposed in Sec. 45.031 Florida Statutes for services in making, recording and certifying the sale 2

and title that shall be assessed as costs. 7. If Plaintiff incurs additional expenses, unpaid assessments and attorneys fees and costs subsequent to the entry of this final judgment prior to the sale date specified above, Plaintiff may, by written motion served on all parties, seek to amend this final judgment to include said additional expenses. Fees and costs taxed as per paragraph 2 above may also be included in any amended judgment. 8. Upon filing the Certificate of Sale the Clerk shall distribute the proceeds of sale, so far as they are sufficient, by paying: first, all of Plaintiffs costs; second, documentary stamps affixed to the Certificate; third, Plaintiffs attorneys fees; fourth, the total sum due Plaintiff, less the items paid, plus interest at the rate prescribed in paragraph 1 from this date to date of sale; and the remainder to be held by the Clerk pending further order of this Court. 9. On filing the Certificate of Sale, Defendants Steven Sheikman, Last Chance Glass, Inc., A Florida Corporation, Edd Helms Group, Inc., A Florida Corporation d/b/a Edd Helms Electric, Miami Country Day School, Inc., Deference Corp., Philip J. Schecter, Cynthia J. Dienstag, P.A., John Shiekman, The Estate of Lila Shiekman, and Suzanne A. Shiekman, The Estate of Lila Shiekman, and John Shiekman, and Suzanne Shiekman, as trustees of the Lila Shiekman Trust and all persons claiming under or against said Defendants, since the filing of the notice of Lis Pendens shall be foreclosed of all estate or claim in the property including right of redemption as prescribed by Florida Statute Section 45.031(5) shall be terminated, except as to claims or rights under chapter 718 or chapter 720, Florida Statutes, if any. 10. Upon the filing of the Certificate of Title, the person named on the Certificate of Title shall be let into possession of the property. If any Defendant remains in possession of the 3

property, the Clerk shall without further order of the Court issue forthwith a Writ of Possession upon request of the person named on the Certificate of Title. 11. NOTICE PURSUANT TO AMENDMENT TO SECTION 45.031, FLORIDA STATUTE (2006); IF THIS PROPERTY IS SOLD AT PUBLIC AUCTION, THERE MAY BE ADDITIONAL MONEY FROM THE STATE AFTER PAYMENT OF PERSONS WHO ARE ENTITLED TO BE PAID FROM THE SALE PROCEEDS PURSUANT TO THIS FINAL JUDGMENT. IF YOU ARE A SUBORDINATE LIENHOLDER CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN SIXTY (60) DAYS AFTER THE SALE. IF YOU FAIL TO FILE CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. IF YOU ARE THE PROPERTY OWNER, YOU MAY CLAIM THESE FUNDS YOURSELF. YOU ARE NOT REQUIRED TO HAVE A LAWYER OR ANY OTHER REPRESENTATION AND YOU DO NOT HAVE TO ASSIGN YOUR RIGHTS TO ANYONE ELSE IN ORDER TO CLAIM ANY MONEY TO WHICH YOU ARE ENTITLED. 11. The Court retains jurisdiction of this action to enter such further orders as are proper, including without limitation, a deficiency judgment.
