Vacation Rental Agreement


Canyonlands Guest Lodging Business Trust Revised Nov. 23, 2012 and effective as of said date. Please read through carefully, sign and date page #4, and return a copy of this Rental Agreement (via email or fax) for your acceptance of the Policies and Terms specified herein. Refusal of these terms and conditions will render your reservation and any payments void. RESERVATION DEPOSIT: Any reservation made more than 30 days prior to your arrival date requires a 50% down payment of the total rental charges. Reservations made within 30 days of your arrival date require 100% payment to confirm your reservation. CANCELLATION/REFUNDS: All cancellations are fully refundable, less a 5% reservation fee, if cancellation notice is received more than 30 days prior to scheduled check-in date. All cancellations must be made in writing (email preferred, fax or letter is acceptable). For cancellations less than 30 days before check-in date, any and all payments are forfeited (unless dates are booked and paid for again by another party). PAYMENTS: Payment in full is due no later than 30 (thirty) days prior to check-in date. Any payments made by credit/debit card are subject to a 1.9% credit card transaction fee. If sufficient time permits, the remaining balance (after down payment) may be paid via check or money order, sent to our po box, thus eliminating any related credit card transaction fee. If you wish to pay via check or money order, you must contact us to request the final balance due, less credit card fee. If payment for remaining balance is not received by the due date, we reserve the right to cancel the reservation, if an attempt to contact the guest is unsuccessful. PETS: Pets are NOT allowed inside any rental unit for any reason, except at the following locations: Moab Guest Cabin, Rock-House Cabin, Bunkhouse Cabin, and Clayborn Cabin. (Pets fees will apply during your booking process). A maximum number of 2 pets are allowed at any of the locations mentioned above, and must be disclosed to us before your arrival. Any and all pets must be kept on a leash while outdoors, and under no circumstances may any pet be left unattended while you occupy the residence. If pets are allowed inside any rental unit, other than those afore mentioned, or if there are more than 2 pets in your party, an immediate $250 fine will be assessed and your party may be asked to vacate the rental unit, thus forfeiting any reservation payments. SMOKING: All our properties are non-smoking. You must not be within 25 feet of any rental unit while smoking. All cigarette butts must be disposed of properly. An immediate $250 fine will be charged if evidence of smoking is found inside the unit, and you may be asked to vacate the property, thus forfeiting any reservation payments.

2 NUMBER OF GUESTS: Some cabins and cottages (large properties excluded) have different rates per number of guests. (Usually $5 - $10 per person after the first 2 people). During the booking process an accurate number of guests must be disclosed. If guest count decreases prior to arrival, please notify us at least 24 hours before check-in, otherwise the original agreed-upon price will be paid. If your party has more guests than are disclosed in the rental agreement which are not disclosed to us prior to arrival, you will be charged double for each additional guest per night, and towels/linens may not be adequate for more guests than were scheduled. We urge you to be honest in disclosing the accurate numbers of guests, as the owner/manager is likely to check-in during your stay. RENTAL TERMS: Canyonlands Guest Lodging Business Trust (CGLBT) reserves the right to change or alter any reservation and issue any related refund for any difference in advertised rental value, in the event a property becomes unavailable for rent. CGLBT agrees to use best efforts to secure an equivalent rental property for the guest(s). If this is not possible, CGLBT reserves the right to cancel the reservation and return all monies to Guest(s). Under no circumstances will any compensation be granted to a guest, beyond the paid reservation amount, due to a cancellation. Guest Agrees to allow property managers/owners and/or assignees the right to enter the rental unit due to the following: a) To make necessary or agreed repairs. b) To supply services/materials requested or necessary. c) If unit is for sale, we will give you 24 hours advance notice to show the unit at reasonable hours. d) In case of an emergency, we reserve the right to enter at any time for the purpose of safe keeping or prevention of further damage. Note: Please notify us if you will be absent from the property for more than 2 days. Managers Responsibility: a) We will give you the right to occupy unit per agreement. b) We will provide and maintain appliances. We will not be liable for interruption of these services that is beyond our control. We will also not be responsible for interruption of electricity, water, gas, internet, TV channels, Etc. beyond our control. Please promptly notify us of any problems, as our goal is to keep you safe and comfortable. You may not end this agreement or request a refund due to these interruptions. Occupants Responsibility: a) Notify us promptly of any defects or problems. b) Use the unit strictly and respectively as a vacation rental; you may not use it for any filmmaking, photo shoots, or any unlawful, improper, or offensive purpose. c) Furniture is not to be moved within or from the unit. d) No one under the age of 18 may be left unattended at any time in the rental unit. e) No animals/pets allowed in the unit or on the property, unless according to the PETS section of this contract. f) No smoking within the unit. g) Please obey all house rules/regulations posted inside the rental unit. Miscellaneous: a) Housekeeping services may be available by request only and will incur additional fees. b) This contract is binding and cannot be modified or terminated by a sudden change of circumstances. c) Changes: The booking manager must be notified of any changes as soon as possible. d) You must leave unit on the date and time designated, unless prearranged. You hereby authorize CGLBT to charge your credit card for any extra time in which you occupy the unit, beyond your scheduled time of departure. e) Abandoned possessions: We are not responsible for any of your personal effects left in the

3 unit. We will be glad, if found, to mail them to you and have the right to collect the postage from your credit card. g) Unit may not be sublet or assigned to another person or party without prior consent of CGLBT. You hereby authorize CGLBT to charge your credit card, without prior notice, for any necessary additional fees, including but not limited to: number of guests exceeding that which is listed on the rental contract, excessive cleaning/laundry or rearranging furniture that has been moved, replacement of missing items from unit (including towels, linens, dcor, kitchen supplies, etc.), excessive soiling of towels, linens and carpets, costs of cleaning beyond the normal, and costs to replace keys and misuse of items belonging to the property. ACCIDENTAL RENTAL DAMAGE INSURANCE: Canyonlands Guest Lodging Business Trust offers you the option of purchasing Accidental Rental Damage Insurance, rather than paying a damage/security deposit when reserving your rental property. Purchasing the Accidental Rental Damage Insurance covers financial burden for losses due to damages that might occur accidentally within the property while you occupy the residence. The Accidental Rental Damage Insurance provides coverage up to $1,000 (less $50 deductible) and is valid for the entire stay. With this Insurance you and your traveling companions will not be obligated to pay for accidental damage to the rental unit you occupy, unless the damages exceed $1,000 in which case you (the renter) are responsible for any and all additional costs of repairs/replacement. Accidental Rental Damage Insurance DOES NOT Cover: 1. 2. 3. 4. 5. 6. Intentional destructive acts of a guest and traveling companions; Gross negligence or willful misconduct; Any loss, if a guest or traveling companions do not take reasonable and prudent measures to protect the residence; Any loss, if the guest does not report the damage to property manager by the time of departure; Theft without forced entry; Damage or loss caused by any pet or other animal not authorized on the premises under the Rental Agreement.

Honesty is the Best Policy. You must notify us of any damage or theft to the unit during your occupancy (before check-out), or this insurance is void and you will be held legally responsible for any and all damage to the rental unit/property. We reserve the right to charge your credit card, without prior notice, for any damages not disclosed to us before your departure. You (the renter) do hereby authorize any such charges to be assessed. Accidental Rental Damage Insurance must be requested before your date of arrival. You cannot purchase said insurance after your arrival and, should any damages occur, you (the renter) will be held solely and entirely responsible for any and all damages to the unit/property. We reserve the right to

4 charge your credit card, without prior notice, for any such damages. You (the renter) do hereby authorize any such charges to be assessed.

DISCLAIMER OF LIABILITY: All liability, whether incidental or consequential, is assumed by you the Renter (Lessee). You hold the owners and/or managers exempt from any and all liability for any injury or death, whether within reason or not, of the use of any and all of the property involved. Inherent dangers exist in the use of any property or building and all liability is accepted by the you, the renter(Lessee), for yourself, your family, your guests, and all minors. Guests for themselves and their respective heirs, personal representatives, successors and assigns, do hereby release the owner(s) of the rental property being used and Canyonlands Guest Lodging Business Trust, and its respective partners, directors, trustees, officers, agents, employees, insurers, attorneys, successors and assigns from all claims, demands, or cause or thing whatsoever resulting from or in connection with the rental property of this contract, including without limitation, any claim, demand or cause of action for personal injury or death and any and all loss, liability, cost and expense resulting from any claim, demand, suit or cause of action which may be asserted.
