Nr.: 2010/08/10-A-006 Abortion prohibited in the Quran Allah says in the Holy Quran Chapter 6 Surah Anaam verse 140: Most surely they became losers, who, in their folly and ignorance killed their own children; and made unlawful what Allah had provided them as sustenance, falsely ascribing prohibitions to Allah. Surely, they went astray and were not at all rightly guided. Allah says in the Holy Quran Chapter 6 Surah Anaam verse 151 (part): You should not kill your children for fear of poverty; for We provide sustenance for you and will provide sustenance for them also. Allah says in the Holy Quran Chapter 17 Surah Israa verse 31: Do not kill your children for fear of want; for it is We Who provide for them, and for you as well. Indeed, their killing is a heinous crime!

Surah Ash-Shura (Council, Consultation)42:49-50: To Allah belongs the dominion of the heavens and the earth. what He wills (and plans). He bestows (children) male according to His will (and Plan), 42:50 Or He bestows both females, and He leaves barren whom He will: for He is full of and power.

WHAT ARE THE ISLAMIC RULES ON ABORTION? Answer: In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers. The issues regarding abortion matters are prescribed according to Quran and authentic Hadiths in addition to the Fatwaa made by the distinguished scholars of Islam based on present context and may required further consultation based on the conditions applied, the fatwa varied from time to time and place to place and it is based on the condition that applies to understand the general rule of Islam, I tried to present the views of abortion in Islam based on the general application and not particular; What is abortion: Abortion is a medical process of killing an infant before its birth most knowingly inside the womb of the mother, or by removing the fetus by surgical operation and kill the infant. Why is it necessary: Islam allows abortion for possible following reasons as prescribed by the scholars: Speaking today Scientifically the doctors who want to abort, etc.why does Quran not give permission to abort, if it is danger to the life of the mother?. Quran speaks about abortion in Surah Anam, Ch. 6, Verse No. 151: as well as in Surah Isra, Ch. 17, Verse No. 31: , it says Kill not your children for want of sustenance, for it is Allah that will provide sustenance to you and your children, for killing of infants is a major sin. So abortion is haram under normal circumstances - Example, pork is haram, alcohol is haram, having dead meat is haram. But same time the Quran says in four different places, in Surah Baqarah, Ch. 2, Verse No.

173, in Surah Maidah, Ch. 5, Verse No. 3, in Surah Anam, Ch. 6, Verse No. 145, and Surah Nahl, Ch. 16, verse No. 115: , it says that if unwillingly if you disobey Allah (SWT) Allah is Rehman O Rahim. If under compulsion, if you disobey Allah (SWT) Allah is Rehman O Rahim. Logical reasons: If you are dying of hunger pork is the only dish that you can have, pork becomes halal for you - It is perfectly allowed - but do not have so much, and keep on having after you do not require it. If you are in a jungle if pork is the only thing that you can find to eat or in a desertpork becomes allowed for you only for that time. When you come back to the city it becomes haram - So same way abortion. Just because you do not want a child is haram - In Islam it is a major sin. But if it is a danger to the life of the mother, it is totally allowed - because in Islam the life of the mother is more precious than the life of the child which has not come in being on its own. I do know there are certain people, who say after 40 days its not allowed - before 40 it is allowed.

Quran is very clear cut on that If it is a danger to your life unwillingly if you disobey Allah (SWT), it is totally allowed. So if the doctor says that if you have certain heart problems, and the labour pain will cause a strain on your heart the mother will die - You have to abort. You have to go ahead with it, became in Islam you cannot sacrifice a greater loss, to save a small loss. The life of the mother who adult is more important than the child who cannot live on its own. In these cases if it is danger to the life of the mother, it is totally allowed in Islam - if it is not a danger, it is haram. Hope that answer to the question. : Maternal mortality in Bangladesh is 3.9/1000 live birth .One fourth of these deaths are due to complication of induced abortion. About 3.9 million pregnancies occur in Bangladesh annually out of which 1.3 million is unwanted. Due to this high-unwanted pregnancy rate 0.8 million women terminate their pregnancy either by MR or abortion. RFSU has partnerships with six organisations in Bangladesh: The Family Planning Association of Bangladesh (FPAB) which works with issues such as family planning, youth friendly clinics, and sexuality education; The Population Services and Training Center (PSTC) which works to spread information concerning sexual and reproductive health for young women in the textile industry and for young women in rural areas; and Steps Towards Development (Steps) which works towards increased equality, and improved conditions for girls and women through the prevention and reduction of sexual and gender based violence. Also, Steps strives to raise womens participation in decision-making bodies at all levels. The Reproductive Health Services Training and Education Program (RHSTEP) and Bangladesh Association for Prevention of Septic Abortion (BAPSA) have worked together for more than twenty years with issues such as the right to safe abortion and maternal mortality. Part of their operations include providing services for women and the education of healthcare professionals with the aim of decreasing maternal mortality rates and providing safe abortions for women wishing to terminate their pregnancy. Both organisations have operations in many parts of Bangladesh and offer services to poverty-stricken persons living in areas with little access to reproductive healthcare. RFSU also works together with Bandhu (Social Welfare Society) with the program Health and Rights of LGBT-people. Bandhu is an organization that works for human rights and equal access to healthcare regardless of gender and sexual orientation. Bandhu is a national NGO in Bangladesh that was founded in 1997 and has worked with, among other issues, HIV and AIDS prevention. RFSU has, for the last couple of years, collaborated with Bandhu through the Sida backed LGBT network, Alliance in South Asia. Bandhu works to support the rights of LGBT-persons and has provided healthcare services for men who have sex with men (MSM) for many years. RFSUs collaboration with Bandhu mainly consists of strengthening and developing Bandhus capacity to identify and reach new groups in the LGBT community.

The Incidence of Abortion Worldwide

Henshaw, Susheela Singh and Taylor Haas Results: Approximately 26 million legal and 20 million illegal abortions were performed worldwide in 1995, resulting in a worldwide abortion rate of 35 per 1,000 women aged 1544. Among the subregions of the world, Eastern Europe had the highest abortion rate (90 per 1,000) and Western Europe the lowest rate (11 per 1,000). Among countries where abortion is legal without restriction as to reason, the highest abortion rate, 83 per 1,000, was reported for Vietnam and the lowest, seven per 1,000, for Belgium and the Netherlands. Abortion rates are no lower overall in areas where abortion is generally restricted by law (and where many abortions are performed under unsafe conditions) than in areas where abortion is legally permitted. http://www.alanguttmacher.org/pubs/journals/25s3099.html

The Alan Guttmacher Institute (AGI) along with the World Health Organization (WHO) provides data on induced abortion worldwide. WORLDWIDE INCIDENCE AND TRENDS

The number of induced abortions declined worldwide between 1995 and


2003, from nearly 46 million to approximately 42 million. About one in five pregnancies worldwide end in abortion.

For every 1,000 women of childbearing age (1544) worldwide, 29 were


estimated to have had an induced abortion in 2003, compared with 35 in 1995.

The decline in abortion incidence was greater in developed countries,


where nearly all abortions are safe and legal (from 39 to 26 abortions per 1,000 women aged 15-44), than in developing countries, where more than half are unsafe and illegal (from 34 to 29).

Most abortions occur in developing countries35 million annually,


compared with seven million in developed countries a disparity that largely reflects the relative population distribution.

On the other hand, a womans likelihood of having an abortion is similar


whether she lives in a developed or developing region; in 2003, there were 26 abortions per 1,000 women aged 1544 in developed countries compared with 29 per 1,000 in developing countries.

More than one-third of the approximately 205 million pregnancies that


occur worldwide annually are unintended, and about 20% of all pregnancies end in induced abortion.

Of the 23 million pregnancies that occur in developed countries, more than


40% are unintended, and 28% end in induced abortion.

Of the 182 million pregnancies that occur in developing countries, more


than one-third are unintended, and 19% end in induced abortion (8% are safe procedures and 11% are unsafe).

Worldwide, medication abortion has gained broad acceptance. At least 39


countries have registered mifepristone, 35 in the last 10 years.

REGIONAL INCIDENCE AND TRENDS The most dramatic decline in abortion incidence occurred in
Eastern Europe, a region where abortion is, for the most part, legal and safe: the rate fell from 90 to 44. The decrease coincided with substantial increases in contraceptive use in the region.

Although abortion rates and ratios (the number of abortions for


every 100 births) in Eastern Europe have fallen significantly in recent years, they remain higher than in any other region. In 2003, there were more abortions than births in that region (105 abortions for every 100 births).

The estimated number of induced abortions in Africa has increased


since 1995; however, the regions abortion rate has declined because of an increase in the number of reproductive-age women.

Induced abortion rates and numbers in Asia and Latin America


show modest declines since 1995.

The lowest abortion rate in the world is in Western Europe (12 per
1,000 women aged 1544). The rate is 17 in Northern Europe and 21 in Northern America (Canada and the United States of America).

Because the worlds population is concentrated in Asia, most


abortions occur there (26 million yearly); nine million of these take place in China.

Between 1998 and 2007, the grounds on which abortion may be


legally performed were broadened in 16 countries: Benin, Bhutan, Chad, Colombia, Ethiopia, Guinea, Iran, Mali, Nepal, Niger, Portugal, Saint Lucia, Swaziland, Switzerland, Thailand and Togo. Two territories and one state in Australia and six states in Mexico also liberalized their laws. In contrast, El Salvador and Nicaragua changed their already restrictive laws to prohibit abortion entirely. The following chart is also taking from the AGI/WHO report:

CONCLUSIONS: The need and the possibilities for better future perspectives are outlined in the conclusions of The Szeged Declaration. The major problems identified were the low level or lack of training of professionals, deficiencies in the knowledge of current family planning methods among professionals, consumers, policy makers and media representatives, the lack of supplies of modern contraceptives to meet the needs of the population, the lack of sex education in schools and the high level of induced abortions. In the majority of the countries in the Eastern European region, there is a need for the establishment of a system for the delivery of high-quality family planning services. This imposes a requirement for the establishment of a system for the continuous supply of contraceptives, through national family planning programs, by governmental and/or nongovernmental organizations. To increase contraceptive use, countries in this region should consider the establishment of extensive educational programs on current family planning methods and other aspects of reproductive health for their health professionals, consumers and representatives of the media. Sex education in schools should be promoted. Governments should be encouraged to invest more in setting up and running family planning services and programs.

Percentage of abortions by gestational age in 2004. Post 1967 there was a rapid increase in the annual number of legal abortions. The rate of increase fell from the early 1970s and actually dipped from 1991-95 before rising again. The age group with the highest number of abortions per 1000 is amongst those aged 2024. 2006 statistics for England & Wales revealed that 48% of abortions occurred to women over the age of 25, 29% were aged 2024; 21% aged under 20 and 2% under 16.[11] In 2004, there were 185,415 abortions in England and Wales. 87% of abortions were performed at 12 weeks or less and 1.6% (or 2,914 abortions) occurred after 20 weeks. 82% of abortions were carried out by the National Health Service.[12] The overwhelming majority of abortions (95% in 2004 for England and Wales) were certified under the statutory ground of risk of injury to the mental or physical health of the pregnant woman.[12] Five years on to 2009, and the number of abortions has risen to 189,100. If one is living in a muslim country, then as a believer, who truly fears Allah and the Last Day, he must vote and support the party whose mandate is to establish the Laws of Allah in the land. If a believer living in a muslim country votes and supports a people whose mandate is secular and against the guidance of Allah and His Messenger (saws), it would indeed be a sin. But if a believer is living in a non-muslim country like Sweden, US, England, etc., where all the candidates are non-muslims, then he may vote for the candidate whose mandate is closest to the mandate of Islam. For example, if one candidates mandate is to abolish abortion, or to reduce indecency in society, or to uplift family values, etc.; then he is more deserving of your vote than the candidate who is propagating gay marriages, or who is hostile to muslims, muslim countries, and Islam. Muslims should organize and unite in their voting, especially in non-muslim countries, so that their collective voices and numbers can be heard for the upliftment of society.

Q-2: If I vote to one of these democratic parties, does that mean that I implicitly or explicitly accepted the democratic constitution as definit law? When the muslims live as a minority in any country, it is only natural that they will live under the prevalent system of governance of the majority; but that does not mean that they will allow the Constitution of the country to supercede the Divine Laws of Allah Subhanah in their lives. The first and foremost duty of every believer, who believes in Allah and the Last Day, is to implement the Shariah upon himself and his family; and it is the collective duty of the believers to strive to establish Shariah as the law of the land. Allah says in the Holy Quran Chapter 66 Surah Tahreem verse 6: O you who have believed, save yourselves and your families from a Fire whose fuel shall be men and stones; over which shall be appointed fierce and stern Angels, who never disobey Allahs Command, and they only do as they are commanded! Thus, wherever a believer lives, his first obligation as a believer is to implement the Shariah upon himself and his family. If one is living in a country, where it is forbidden by the constitution or law of the country that one cannot practice the religion of his choice, then it becomes obligatory on the believers to migrate from such a land and go to a place where he may practice Islam as his religion. If they dont, they will have a severe accounting in the Just Court of Allah Subhanah on an Inevitable Day. If a couple under proper medical advice are absolutely convinced that all their future children will be born with a fatal or incurable disease (eg. Aids, handicap, etc.); there is absolutely no harm if they practice birth control. But once the baby is conceived in the womb of the mother, no matter how handicapped or retarded the doctors fear the baby would be, it would be absolutely forbidden in Islam to have an abortion! The only situation where abortion would be a legal option is when one has to chose between saving the life of the mother or the life of the un-born baby in a complication; in such cases the life of the mother will be preferred to the birth of the un-born baby. It would be considered a grave sin and crime in the sight of Allah Subhanah if one aborted a conceived baby in the womb of the mother, just because the baby was diagnosed with a handicap. To keep the situation in perspective, would it be right to kill or intentionally end the life of one who is suffering from an incurable desease like Aids, etc? Or would it be right to kill or intentionally end the life of one who is suffering from a severe handicap or is retarded? Just as the indiscriminate killing of people with Aids and severe handicap is considered a grave sin in the sight of the law in this world and in the sight of Shariah; so would the abortion of an un-born baby who has already been conceived in the womb of the mother be considered a grave sin in the sight of Shariah. The conditions or way to seek sincere Taubah or Repentance from the Merciful Lord is: One is aware that he has sinned, and feels sorry and ashamed at his sin. Makes a solemn covenant and promise with Allah that he will not repeat his sin again. Turns to Allah and seeks forgiveness, before he has met with his appointment of death. Is a believer and does righteous good deeds thereafter. Allah says in the Holy Quran Chapter 39 Surah Zumur verses 53-54: (O Prophet) say: O My servants who have wronged their own souls.Do not despair of Allahs Mercy! Surely, Allah forgives all sins. He indeed is the All Forgiving, All Merciful. Return to your Lord and submit to Him before the scourge overtakes you; for then you may get no help from anywhere. Allah says in the Holy Quran Chapter 3 Surah Ale Imraan verse 135-136: Allah likes such good people very much, who, if ever they commit a base deed or wrong their own soul by the commission of a sin, remember Allah instantly, and ask for forgiveness from Him for their shortcomings. In graphic terminology, Allah and His Messenger (saws) draw and make known the boundary lines of how to live ones life. Those who live within the boundaries are in submission and approval of their Lord and Creator; and those who transgress these boundaries are in disobedience and transgression. Allah Says in the Holy Quran Chapter 4 Surah Nisaa verses 13-14: 13 Those are boundary limits set by Allah: those who obey Allah and His Messenger will be admitted to Gardens with rivers flowing beneath to abide therein (for ever) and that will be the Supreme achievement. 14 But those who disobey Allah and His Messenger and transgress His limits will be admitted to a fire to abide therein: and they shall have a humiliating punishment. There are many facets or parts of a human life; character, manners, wealth, education, work, marriage, children, parents, relatives, neighbors, employees, employers, government, entertainment, rites and rituals in worship, etc. What Islam as a way of approved life provides, is the principles or the usools stating which acts and deeds would fall within the boundaries set by Allah, and which acts and deeds when done would transgress these set limits and boundaries. Thus no matter what part of ones life one lives, as a believer, he must first and foremost respect and honor the boundaries set by Allah and His Messenger (saws); and thus his whole life will be deemed an act of worship and in obedience of his Creator. Your Question: does islam has nothing to do with medicine, or astronomy, or agriculture, or chemistry, or architecture, economy, etc Islam prescribes a complete way of life approved by the Creator; thus no matter what aspect or part of the life of the believer, it will first be determined whether it is within the boundaries of Allah or not. For example: In the field of medicine Allah and His Messenger (saws) have approved the learning and applying of this and all other sciences which help humanity. Thus in its principle the education and application of the science of medicine would fall within the boundaries of Islam.

But if one uses the same science of medicine to perform abortion, or clone human beings, or change the nature of man and transform him medically in a female, etc.; these would fall outside the boundaries set by Allah and would be deemed transgression and disobedience of the principles of Islam. Another example: in the field of economy Allah and His Messenger (saws) have approved the halaal and legal ways of earning money through mutual trade, services, production, manufacturing, hard work, honesty, etc. But Allah and His Messenger (saws) have declared it haraam to deal in usury, dishonesty, or the trade or services of any haraam objects (like drugs, gambling, swine, prostitution, etc.). Thus no matter what part of life one wishes to live as a believer, he must first and foremost determine whether the act is within the boundaries set by Allah and His Messenger (saws) or not. If the act is within the boundaries, it will be absolutely halaal and legal; and if it transgresses the boundaries, it will be deemed illegal and haraam. Thus no matter where one is, and no matter what one does; if he bases his decision in accordance with the Guidance of Allah and His Messenger (saws) he is guided aright. And if he bases his decision against the Guidance of Allah and His Messenger (saws) he is on a path that would lead him astray. The Messenger of Allah (saws) demonstrated the whole scenario of how to live a life in submission in Islam through this beautiful and wise analogy: Al-Tirmidhi Hadith 184 Narrated by Mu'adh ibn Jabal Allah's Messenger (saws) said: Verily Satan is the wolf (enemy) of man, just as the wolf is (the enemy) of a flock. He seizes the solitary sheep going astray from the flock, or going aside from the flock. So avoid the branching paths; it is essential for you to remain along with the community. Allah Says in the Holy Quran Chapter 2 Surah Baqarah verse 187 (part): Those are limits (set by) Allah; do not even go near them! Thus doth Allah make clear His signs to men that they may learn self-restraint. Allah guides mankind to submit to Him and live deep within the boundaries set by Him; and the avowed enemy of man, the Shaytaan, tries to seduce man to break and transgress these boundaries so that they too would become disobedient to Allah Subhanah. In the above hadith, the Messenger of Allah (saws) guides the believers to remain united in the community and Ummah of Muslims within the boundaries of Islam, and never to approach the branching parts or wander near the boundaries and set limits of Allah Subhanah, lest the Shaytaan would seduce man in crossing over the boundaries into the transgression of the limits set by Allah Subhanah. The Shariah allows that in certain circumstances, when one has absolutely no choice but to chose between saving the life of the mother or the unborn baby; the life of the one who is living will be preferred to the life of the unborn. In such a situation, there will be no sin upon the parents. In the situation you have described, it is absolutely imperative the doctor who gave the advice to abort the baby is a pious and God-fearing person; and not some governmental doctor who is more interested in controlling the population than saving the life of the unborn baby! If one is absolutely convinced that the life of the mother would be put at severe risk if she were to deliver her baby, and there is absolutely no way both the mother and the baby would survive, then there is no sin upon the parents if they choose to abort the unborn baby in such a situation. One should fear Allah Subhanah before making such a big decision, and never ever use this or any other excuse to circumvent any of the laws of Allah and His Messenger (saws); for Allah Subhanah is indeed the All-Seeing, All-Knowing, and Knows even the conditions of ones hearts and its intentions. But if she does marry the other man during the pregnancy, the marriage will still be regarded as valid in the sight of Shariah; but it would indeed be a grave and heinous

sin upon her if she did not inform the man she was marrying that she was pregnant with someone elses child. In both the above cases, the nikaah will be considered valid in Shariah, but regardless of who she marries, the baby will be an illegal child. The baby will not be recognized by the name of his father, but will be called by the name of his mother. He will neither inherit from his biological father, nor will his biological father inherit from him. But if a woman was married to one man and became pregnant, and subsequently during her pregnancy her husband divorces her; it is not permissible for her in Shariah to marry someone else until after the time she has delivered the baby. Examples: Prophet Moses (a.s.) is mentioned at least 80 times in the Quran by name, whereas the Last and Final Messenger and the Leader of all the Prophets, Mohamed ar-Rasool Allah (saws) is mentioned only five times by name in the Glorious Quran! The term Shaytaan is mentioned by name at least ten times more than the Angels!

There are numerous other examples of where one term is mentioned several times more in the Glorious Quran than another term; but that repetition of a term in no way signifies its importance over another term simply by the number of times it is mentioned in the Quran! Your Question: so when this newly born girl is born why is only one goat sacrificed why not two? One should also understand that one sacrifice for the new-born girl and two for the new-born boy is the minimum one may offer as a sign of his being grateful to the Lord Most Gracious; but if one is so joyous at the birth of ones child, regardless of whether it is a boy or a girl, and wills to offer more than the minimum number he may offer as many sacrifices as he wishes as a sign of his being grateful to his Lord Most Gracious. If one is so happy and joyous at the birth of a baby-girl which the Lord Willed to provide them, there is absolutely no harm if one shows ones gratefulness for the Mercy and Grace of their Lord and celebrates the birth by sacrificing a hundred or a thousand camels or even more, if one so wishes!

Abortion Act of 1975


The law passed in 1975 gives a pregnant woman the right to decide about abortion until pregnancy week 18. She need not state the reasons and can not be denied an abortion, within the statutory time limits. One effect is that more abortions are performed early in pregnancy, 93 percent of abortions are done before 12 weeks and 76 percent before week 9 (2008). Our criticism of the abortion law can be summarized in two hypotheses. The first theory is that people with liberal values have reason to question the abortion law. Just because we recognize the right of women to control their own body needs it as a liberal does not consider abortion as a right superior to others. Abortion issue is a conflict between the contemporary and future interests of individuals to have their legitimate needs met. Let us illustrate this hypothesis in a comparison with the climate debate. Just as the living generations' interests are important and should be given consideration, there is broad agreement that the interests of future generations also have some weight. Just the fact that our grandchildren's children not yet born is no indication that we have the right to completely disregard their interests in climate. The current generation has the responsibility for future generations and must sometimes make sacrifices for the benefit of future individuals. It is therefore concluded that the future, potentially existing individuals assigned the moral weight of the climate discussions, they should also be attributed to the weight of the abortion debate. If we do trade-offs between present and future generations of climate's sake, we should strike a balance between the interests of the pregnant woman and fetus. The woman's interests are not always, under all circumstances, superior fetus. Our second thesis is about how society should manage the balance between the pregnant woman and fetus's interests. In a research project funded by the Research Council, we examine the idea that fundamental moral judgments about right and wrong are not always binary, contrary to what thinkers such as Kant, Mill and Rawls argued. Our hypothesis is that abortion in many cases are entitled to a certain degree while it is also wrong to some degree. It is simply naive to think that one can describe all the possible trade-offs between the woman and the fetus's interests in black and white. A reasonable moral analysis requires the use of shades of gray. In the sense that an act benefits an individual, this tends to make the document legal, and in so far as the opposite is the case, it helps to make the act wrong. Under certain circumstances, for example, if the pregnant woman is young, but

pregnancy is detected relatively late (eg week 16), can it be right to abortion from one aspect but wrong from another, but these two aspects can not be aggregated to a binary discretion. All one can say is that the act is both right and wrong, and depending on the circumstances, the degree of accuracy and inaccuracy vary. This realization, that abortion is not a binary moral terms, requires us to nuance our moral and legal standpoints. But how? A common misconception is to claim that society, for practical reasons, have put a sharp limit on when something is permitted or prohibited. Even if we accept that many cases of abortion are in a moral gray area there, according to this thinking, no way to formulate laws that reflect such moral ambiguity. But this binary view of the law are unfounded. Our proposal is that the abortion law be revised so that instead of dividing the abortions in two categories, "forbidden" and "allowed", should divide the abortions in three categories: First we have, just like today, where abortion is prohibited. It seems reasonable to insist that there should always be forbidden to have abortions, "if there is reason to assume that the fetus is viable". The second category are cases when abortion is not only permissible, but society also has an obligation to assist women wishing to terminate their pregnancy. This category includes cases in which abortion is not wrong to some degree. Apart from situations where a woman's health is at stake or the pregnancy is the result of a crime, many would probably agree that even enough early pregnancies may be terminated on the grounds that a woman's interest clearly outweighs the fetus. Finally, we have a new, third category. This corresponds to cases where there are reasonable grounds to argue that abortion is both right and wrong to some degree. In these cases, it should not be society's responsibility to actively assist women seeking an abortion, just as it should be society's responsibility to prevent their execution. We are simply suggesting that the law should be revised so that it does not rule on these cases. Instead of trying to bring a sharp distinction in cases where no such sharp distinction exists, it is better that the law refrains from dealing with these cases. In practice, our proposal that the power and responsibility is transferred from the community to the individual woman. If her situation falls under the third category, she acted, how she wants to act, without prompting healthcare or the National Board for permission, but it is not health care obligation to provide personnel and resources to end the pregnancy in these cases. If the pregnant woman is in the third category and choose to terminate her pregnancy is her own responsibility, not something that society is obliged to assist her with. In order to prevent abortions are performed illegally or become a class issue, it may be appropriate to establish special abortion clinics to ensure that abortions are performed in a medically safe manner but that charge for their services in relation to the client's ability to pay. Some women who find themselves in the third type of situation would probably perceive it as unpleasant to no longer have the full support of society and thus be able to fall back on a clear vindication of their conduct in the law. The woman had decided to terminate the pregnancy and underwent an abortion at Frlunda hospital in Gothenburg in the ninth week. When she continued to feel off-colour and pile on the pounds she returned to the hospital and was told that the symptoms could by psychosomatic, according to a report in the Expressen daily. But her insistence ensured that she was ultimately given an appointment with a gynaecologist at stra hospital, almost three months after she had undergone an abortion. The new examination determined that she was still pregnant, now in the 19th week. "It came as a complete shock to me and all of my family," the woman told the newspaper.

Doctors were able to conclude that the the baby was healthy, but discovered a cyst that had gone undetected during her initial examinations. The pregnant woman has now reported the matter to the National Board of Health & Welfare (Socialstyrelsen) on the advice of the gynaecologist.
