Present were: Mayor W. J. Walker, Treasurer Chris Hopkins, Water & Sewer Maint. Supt. Mike Lewis, Animal Control Officer Randy Poindexter, Chief David Taylor, Sgt. Karl Cuschieri, Attorney Jim Kelly and City Clerk Ruth M. Haskins.

Citizens and guests present were: Casey Chastain with Connell Ins.; Andy Simmons and Jeff Ceperley with Simmons Engineering; David Rauch, Reba Hale and Brady Brite of Headliner News.

Mayor Walker asked everyone to stand for the Pledge of Allegiance to open the meeting. Mayor Walker then welcomed everyone to the Meeting. PUBLIC PARTICATION. Mayor asked if anyone wanted to speak that was not on the agenda. Casey Chastain of Connell Insurance asked for a few minutes of the Boards time to explain some of the advantages of his company could provide for the City of Billings. Casey says they have access to 14 carriers; all companies do not have access to all carriers. Clever was changed to his company last year and it saved the City of Clever about 40o/o. Cowrcll would provide human resources to redo all of your handbook and policy's. Quarterly training for employees. They would also update all of your buildings
and

equipment.

Review of Minutes for the August 28,20t2 Special Called Meeting and Public Hearing for the Tax Levy. Motion made to accept the Minutes made by Pierce seconded by Monroe. voting'oAye" Monroe, Rufer, Pierce andYanzandt. voting "Nay" None.

OLD BUSINESS: a. Table this item.

NEW BUSINESS, MEMOzuALS, PROCLAMATIONS and ORDINANCES. a. David Rauch appreciate the opportunity to be here tonight, want to introduce Reba Hall, Leon Rauch is her brother-in-law and my grandson Elliott. For nineteen (19) years this sign was posted on Hwy 60 commentating Leon Rauch who was the voice of Western Swing Country and it should have been the voice of Western Swing music. Last year about this time they disappeared. Rauch called the Highway Department and they said it could be put back up. However, the City would have to request that and a contract would have to be signed. Rauch stated that the Highway Department does not want the responsible for the maintenance for the sign. Rauch stated that he and Reba have raised the money to pay for the sign. Rauch also stated that any maintenance would be taken care of by Mr. Rauch or some of his family. Mayor Walker asked Mr. Rauch if this could be put off until the next meeting to give Mr. Kelty to look over the contract. Mr. Rauch agreed to have the answer at the next meeting. b. Mayor to discuss alleys and trees. The map shows a line of trees and brush. Mr. Bill Smith lives next to the trees. Mr. Smith is afraid that the tree is going to fall on his garage and if that does happen the city will have to pay for the damages. Rufer stated that both of them need to come out. Mayor Walker got three quotes one company wanted a $1,000.00, the other also wanted $1,000.00, Vaught from Crane quoted $300.00. If Vaught takes out two trees it would be $1,200.00. Motion made by Pierce to have Vaught take out two trees not to exceed $1,500.00 seconded byYatrZandt. Voting "Aye" Monroe, Rufer, Pierce andYanZandt. Voting "Nay" None. c. Mayor to discuss the widening of Purdy St., Mr. Simmons states that if the City wants to widening the Street it will cost anywhere from $60,000.00 to $70,000.00. It appears that we have a 30 ft right of way road measured 13 ft. Monroe asked why this street. Stated only one car at a time can travel on the road. This price would include ditches, mailboxes and other. Pierce stated need to readdress next month. Motion to postpone this item until next month made by Pierce seconded by Rufer. None. Mayor to discuss Softball field at the Park, in order to have tournaments the fence will have be moved. Mrs. Bryant will have the labor to do this, and the City would provide a tractor and a man. Yanzandt stated the fence had a gate for the tractor pull. Motion made to contact the School and give them the go ahead made by Rufer seconded by Monroe. Voting "Aye" Monroe, Rufer, pierce and YanZandt. Voting o'Nay" None. Hopkins asked how the Board wanted this done this year. Pierce stated just do like they did last year.

Mayor Walker made a recommendation to appoint Jason Baker to Planning and Zoning Commission to fill Andy Dickinson term, which expires on December 31, 2013. Motion to approve Mayors recommendation of Jason Baker to the Planning and Zoning Commission made by Pierce seconded byYanZandt. Voting "Aye" Monroe, Rufer, Pierce andYanZandt. Voting "Nay' None. Mayor to present the Planning and Zoningletter of Recommendation and Finding of Fact of the lot split for Driscoll Manufacturing, LLC. Motion to accept Planning andZoning Recommendation for the Minor Subdivision on September 6, 2012 made by Rufer seconded by Monroe. Voting "Aye" Monroe, Rufer, Pierce andYanZandt. Voting o'Nay" None. Commercial insurance is due November 6,2012; Mayor asked the Board how will this be handled this year. Mr. Kelly stated probably put it out for bid. Motion to put this out for bid for insurance made by YmZandt seconded by Pierce. Voting "Aye" Monroe, Rufer, Pierce andYanZandt. Voting "Nay" None. Mayor read a Proclamation honoring Constitution Week, September 17 through 23,2012. BILL NO. 12-05. An Ordinance of the City of Billings, Missouri to Adopt the Procedure for Disclosing Potential Conflicts of Interest and Substantial Interests for Certain Officials. Motion made by Pierce seconded by Rufer to have the first reading of Bill No. 12-05 by Title Only. Voting "Aye" Monroe, Rufer, Pierce and YanZandt. Voting "Nay" None. Mayor Walker asked the City Clerk to read Bill No. 12-05 by Title Only. Haskins read Bill No. 12-05 by Title Only. Motion made byYanZandt seconded by Monroe to accept the first reading by Title Only. Voting "Aye" Monroe, Rufer, Pierce andYanZandt. Voting "Nay" None. Motion made by Pierce seconded by Rufer to have the second reading of Bill No. 12-05 by Title Only. Voting "Aye" Monroe, Rufer, Pierce andYanZandt. Voting "Nay" None. Mayor Walker asked the City Clerk to read Bill No. 12-05 by Title Only. Haskins read Bill No. 12-05 by Title Only. Motion made by Rufer seconded by YarrZandt to accept the second reading and for final passage thereof. Voting 'oAye" Monroe, Rufer, Pierce andYanZandt. Voting "Nay" None. Motion made by Monroe seconded by Rufer that Bill No. 12-05 be accepted as Ordinance 12-05. Voting "Aye" Monroe, Rufer, Pierce andYanZandt. Voting "Nay" None. Bill No. 12-05 is now Ordinance 12-05. Police Report by Taylor. Chief says have a grant for $2,000.00. Officer Hicks made a stop of drug courier, waiting on Federal Court to make decision, probably a couple thousand dollars. Motion to accept the Police Report made by Pierce seconded by Rufer. Voting o'Aye" Monroe, Rufer, Pierce andYattZartdt. Voting "Nay" None. Water & Sewer Maint Report by Lewis. Mayor asked for a Motion to go into Closed Session Pursuant to Section 610.02I(3&13) RSMo to consider hiring, firing disciplining or promoting an employee. ROLL CALL VOTE
