In a motion filed late Friday U.S. time, Apple sought a further $400 million damage award for design infringement by Samsung; $135 million for willful infringement of its utility patents; $121 million in supplemental damages based on Samsung's product sales not covered in the jury's deliberation; and $50 million of prejudgment interest on damages through December 31. The requests together come to $707 million. A single mom, she applied to more than 100 jobs with no success. She borrowed money from friends, babysat, cleaned houses, asked her church for help to pay her mortgage and utilities, went to the local food bank and left thousands of dollars in bills unpaid. She says she was in foreclosure three times since losing her job and has a lien on her condo apartment because she hasn't paid her sewage bill. Last fall, she exhausted her unemployment benefits, which were $600 a week less than what she made when she was working. Depressed and out of options, she turned to The WorkPlace, a program for the long term unemployed, which helped her find a part-time job in January. She went full-time this week, making close to her previous salary. But she says she has a long climb to get back to where she'd been. "It's depressing; here I am, 50, with nothing saved," she says. "They can't just keep cutting

We know there are SaaS solutions that are better and easier to use, but even though its not ideal and we will change eventually for the moment, it works, and upgrading is not a priority for our IT team. For many years to come, a lot of companies will be in a similar situation: Theyre not moving all the way to the cloud

not just yet because it doesnt pay off to do so with every application. Not all cloud solutions are created equal; some have a higher immediate return on investment than others. 3. You need a multiplier of value for cloud adoption. Real change happens when theres a multiplier involved. For a business to take the time and expense to rip out and replace a legacy system with a cloud solution, they need to see that they will be rewarded with a multiplied increase in productivity, not just an incremental increase. Theyve already spent the capital expense on their current system and have an IT guy to manage it. So theyre running along fine until they have an extremely good reason to change. In the backup and recovery market, for example, many SMBs have continued using tape-based backup solutions. While tape backup is as outdated as the VHS tapes you cleaned out of your attic 10 years ago, disk and other backup methods that have appeared over the years werent dramatically better or cheaper, so people stuck with what they had. It is only recently that cloudbased backup and recovery technology has improved to the point that a business can see a

multiplied effect on productivity and revenue over tape. With a cloud-based data and application protection solution like Axcient, businesses can not only restore data, but also recover systems instantly after a failure to ensure continuous business productivity. Compared to waiting the hours or days it takes to recover with tape or traditional disk-based backup, such anywhere/anytime uptime via the cloud delivers an exponential improvement in productivity and revenue. This is whats convincing IT managers to finally switch from tape to cloud backup. When Cloud Makes the Most Sense (and Dollars) The above reasons throw a sobering cup of cold water in the faces of those who think that desktop servers and software are going away in the near future. While my aim is to set this view straight, its not to downplay the impact of the cloud or its rapid growth. The cloud will achieve widespread adoption gradually, as most business technologies do. When a new business starts, it will likely be on all-cloud platforms. When an established business replaces a single system, it will be cloud. The Rise Of The Mobile-Social-Vertical Marketplace

Some current Mayfield Fund investments include Appcelerator, Fab, Marketo, Poshmark, Solarcity, and Zimride. The U.S. e-commerce market is estimated at $200 billion and is still projected to account for only 9 percent of total retail by 2016 (source: Forrester Research Feb. 2012 U.S. Online Retail forecast). We believe there is ample room for growth, and much of it will come from marketplaces. The metaphor of online marketplaces, established by Amazon and eBay starting in 1995, has endured and is flourishing once again but in a different way than in the past. From an investor point of view, four things have changed: The Rise of Vertical: The ecommerce market is large enough to support vertical marketplaces that super-serve consumer needs and are defying the winner take all theory that eBay or Amazon will be the only game in town. These vertical marketplaces have

tuned the user experience to very specific needs by vertical and are easier to achieve liquidity due to their focus. Examples include Homeaway (vacation rentals), Etsy (niche artisan goods), and OpenTable (restaurant reservations). Global? Not As Much: The incumbents have not been able to execute a global playbook strategy across geographies, as local giants have emerged that offer a customized business model depending on the geography (China: Taobao [has more than 65 percent of the market and growing according to CrunchBase] and India: Flipkart) with many more to come. Platform Disruption: New platforms such as mobile are proving to be disruptive for incumbents and require a different approach. Poshmark (a Mayfield investment) is a great example of a vertical womens fashion marketplace where consumers can list fashion items in their closets in just a few clicks, and any customer can purchase simply and directly from the phone. The ease of listing (via your camera on the phone) combined with the simple viewing metaphor (similar to Instagram but for fashion items to purchase) were purpose-built for this platform. Offline/Online Marketplaces: We

are beginning to see offline models disrupted by online marketplaces, which was very difficult before smartphone, Internet ubiquity, and examples of rapid local scaling like Groupon and Yelp. Craigslist reigned here for a while, but now users demand a simpler, more vertical experience and safety/social identity lacking on that marketplace. That said, these are not easy as they are highly local and require operational excellence in addition to a great mobile/ online product. Examples include Uber and Zimrides Lyft in the transportation space (Mayfield is an investor in Zimride), TaskRabbit for personal services, Postmates for delivery, and Airbnb for real estate rentals. As a result, there is still a lot of potential for creating gamechanging companies that use the marketplace as a model. With the rise of the social and mobile web, todays marketplaces demonstrate some unique characteristics that entrepreneurs should think about. Im categorizing six of them under the acronym ACCESS accessibility, curation, community, efficient commerce, simplicity, and symmetry. Successful marketplaces on mobile platforms now provide addictive, anywhere anytime accessibility. The best example of

this is OpenTables mobile app, which easily lets users find and make restaurant reservations (almost 10 percent of its cumulative 350 million reservations or 30 million diners have made reservations using its mobile app). Marketplaces grow their inventory rapidly by crowdsourcing items, such as eBay or now Etsy, but curation matters more than ever and can come from both data/analytics and social signals. A good example of this is the Showrooms metaphor from Poshmark, which lists 4,000 items daily, but where sellers can showcase their fashion items by designer, theme (evening wear), or recently added. This curation is critical when a customer is mobile and just has a few minutes to be satisfied. By adding the social layer, todays marketplaces build community that goes beyond reviews and ratings of 1.0 marketplaces. This social layer brings true identity to the sellers and buyers and enables interactions regarding advice (and of course purchasing) directly from trusted friends. Importantly, the social layer acts as a powerful free marketing channel, as users show off to friends what they bought or are interested in, build up their personal tastemaker

brands, and help friends also interested in the category. (A good example of this is Mayfield investment Fab whose subscribers are proud to show off their design sensibility through the products they have bought. In fact, 50 percent of new Fab users are brought in via social media). Efficient and frictionless commerce is a business model that is well understood by users and, for this, Amazons one-click commerce still reigns supreme. This is now a must-have in mobile marketplaces. A recent example is Cherry, the on-demand mobile car -washing service, which requires three clicks to find, schedule, and pay for your car wash. Using a design-first mentality, todays marketplaces demonstrate stunning simplicity of use. A good example of this is Exec, a mobile TaskRabbit-type app that allows users to enter the task they need completed and pay for it without much data entry. Finally, pioneered by the collaborative-consumption movement, marketplaces are becoming increasingly symmetric, with significant overlap between buyers and sellers, as people rent and share their own belongings instead of historically a few merchants selling new goods to RISE page 22

The lovely thing about a new iPhone is that it brings people together. Whether your Karl is Rove or Marx, whether your Justin is Bieber, Timberlake, or Theroux, somehow the iPhone has always brought so many together in wondrous adoration. And yet the new iPhone 5 ads released yesterday seem to be creating an oddly conflictual atmosphere. The ads, to my eyes and ears, seem to be a rather smooth journey back to the future. Some of Apple's recent ads have tended toward the dull. Can anyone remember even one exciting ad for the iPad? At heart, they've never had to be that interesting, because the brand is so strong, so emotionally powerful, that the best ads have always been the products themselves. Still, the new ads include some rather pleasant turns of humor. Not pleasant enough for some,

however. A quick perusal of some of the comments from CNET readers suggest a discomfort akin to one too many spicy sausages at lunch. Commenter Notalilo offered: Apple must be really proud of the fact that iPhone was the last phone on the market with panorama photo capabilities. The choice of features picked for these commercials really shows that iPhone 5 has nothing on competition (earbuds? really?) Hoss 805 puts on his 20-gallon hat and declaims: ALL Propaganda for APPLE, they can easily add every single feature thats available right now but they know they got you guys where they want, they make a new iphone every year, add 1 little thing and they know people will PEE-PEE there Panties just to go get one. And Nicci_Amber sees red: It's almost as if Apple is trying to justify its tiny screen by saying things like "it's perfect for the hand." Yeah, right. I have tiny hands and love my 4.5" screen. I'd actually prefer it to be even larger.

It makes watching movies, going on the Internet, playing games all the better. It renders a tablet useless. Apple needs to stop justifying the fact that in SEVEN years, all they've done is make the screen a half inch bigger and add LTE. So pathetic. Yet iSheep still fall for it. It's faintly quaint that a company that has "nothing on the competition" manages to still have something on the competition in so many people's hearts. It's perhaps almost amusing that some find it painful that Apple is convinced that people like to use their phones one-handed and makes an ad that says so. For them, it seems a sad justification for changing very little and making it seem like a lot. More Technically Incorrect It's probably true that Apple can't go on making little incremental changes to a beautifully designed core for too much longer. (The excellent, funny new Samsung ad makes fine hay from some truths of the iPhone 5 and its flock.) It's surely true that the company has to find a new category of

gadget in order to expand people's imaginations. But these little ads will serve merely to persuade not those millions who have already lined up and ordered, but those whose contracts might shortly be up, those who are coming into the market, and those who still look at the iPhone as something desirable -- even though it's been around for a while. Yes, it's John Stamos or Heidi Klum. These ads are oddly pleasing, blessedly simple, and very true to the Apple people know. If only the folks behind the excellent Windows Phones, for example, could find as simple a way to people's innards. A war is brewing in the mobile space. No, that war isnt Apple against Samsung or Google versus Microsoft. Those battles have been raging for months, and chances are, they wont end anytime soon. The latest and perhaps most vicious battle is now being waged between Apple fans and Samsung fans. If youve been following the mobile space lately, you know that Apple fans have taken it upon themselves to target Samsung smartphone fans, discounting their choice in product, hammering the Android operating system, and criticizing them in nearly every way imaginable. In some forums across the Web, even Mama jokes arent off the table. The trouble started last week after Samsung released an ad showing the differences between its Samsung Galaxy S III and the iPhone 5. The company claimed that its product comes with all of the bells and whistles Apples alternative doesnt, making it the better choice for consumers. Apple fans, of course, responded

with outrage, taking aim at every Samsung fan they could. They argued that Android is a loser, Samsung copies Apples products, and the only reason any company has been able to make some cash in the mobile market is because of the iPhone makers innovation in 2007. Without Apple, the fans say, there would be no Samsung or Android."Its clear that a real war is on" Of course, the Apple reaction to Samsungs fan charges is nothing

new. For years, Apples fans have been taking anyone to task that would even come close to criticizing their favorite company. What has been most surprising, however, has been the swift and vicious attacks Samsung has leveled against Apple, making clear that a real war is on. But does that war make much sense? Sure, Apples fans believe the iPhone 5 is the best smartphone on the market. And while there are countless Android-

based devices, Samsungs faithful fully believe that the Galaxy S III is tops. Both sides are loyal. And they are flanked by millions. But we are already seeing and will continue to see a number of logical business functions and applications move to the cloud. At some point, there will be a balancing point between onpremises and cloud-based systems, and I suspect that balancing point is not too far in

the distant future. In the meantime, staying grounded in the real benefits and limitations of the cloud will help IT professionals navigate beyond the hype to identify SaaS solutions that bring about the greatest business advantages.

Psst. In case you didn't notice? In iOS 6, Siri is a hoot. Apple has programmed in even more silly, sassy, delightful responses and it's up to all of us to find the Easter Eggs. Asking Siri about itself is one of the more common ways to get a chuckle -- inquire about how old it is, what it's wearing, its birthday, its gender, its favorite color, and whether it has a family. Try pitching it some of the older standard comic routines like, "Who's on first?" Ask it how it feels about you. Most of all, be persistent. Over time, Apple's programmers have added lots of alternate messages for commonlyasked questions and statements. Take " Open the pod bay doors," for example. Siri has quite the repertoire of answers to the classic command from Clarke & Kubrick's 2001. Or how about asking what the meaning of life is, or saying " Klaatu barada nikto."

"What's Next?": Simon Johnson Explains The Doomsday Cycle

Via Simon Johnson and Peter Boone - Originally posted at VoxEU, (Via CentrePiece magazine) There is a common problem underlying the economic troubles of Europe, Japan, and the US: the symbiotic relationship between politicians who heed narrow interests and the growth of a financial sector that has become increasingly opaque ( Igan and Mishra 2011). Bailouts have encouraged reckless behaviour in the financial sector, which builds up further risks and will lead to another round of shocks, collapses, and bailouts. This is what we have called the doomsday cycle (Boone and Johnson 2010). The cycle turned in 2007-8 and was most dramatically manifest in the weeks and months that followed the fall of Lehman Brothers, the collapse of Icelands banks and the botched rescue of the big three Irish financial institutions. The consequences have included sovereign debt restructuring by Greece, as well as continuing problems and lending programmes by the IMF and the EU for Greece, Ireland, and Portugal. Italy, Spain and other parts of the Eurozone remain

In the 1980s and 1990s, deep economic crises occurred primarily in middle- and lowincome countries that were too small to have direct global effects. The crises we should fear today are in relatively rich countries that are big enough to reduce growth around the world. The problem is that the modern financial infrastructure makes it possible to borrow a great deal relative to the size of an economy and far more than is sustainable relative to growth prospects. The expectation of bailouts has become built into the system, in terms of government and central bank support. But this expectation is also faulty because, at times, the claims on the system are more than can ultimately be paid. For politicians, this is a great opportunity. under intense pressure. Yet in some circles, there is a sense that the countries of the Eurozone have put the worst of their problems behind them. Following a string of summits, it is argued, Europe is now more decisively on the path to a unified financial system backed by what will become the substance of a fiscal union. The doomsday cycle is indeed turning and problems are undoubtedly heading towards Japan and the US: the current level of complacency among policymakers in those countries is alarming. But the next turn of the global cycle looks likely to hit Europe again and probably harder than before. The continental European financial system is in big trouble: budgets are unsustainable and It enables them to buy favour and win re-election. exception. For bankers and financiers of all kinds, this is easy money and great fortune literally. The complexity and scale of modern finance make it easy to hide what is going on. The regulated financial sector has little interest in speaking truth to authority; that would just undercut their business. Banks that are too big to fail benefit from giant, hidden and very dangerous government subsidies. Yet despite repeated failures, many top officials pretend that the market or smart regulators can take care of this problem. For the broader public, none of this is clear until it is too late. The issues are abstract and lack the personal drama that grabs headlines. The policy community does not understand the issues or becomes complicit in the schemes of politicians and big banks. The true costs of bailouts are disguised and not broadly understood. Millions of jobs are lost, lives ruined, fiscal balance sheets damaged and for what, exactly? Over the past four centuries, financial development has strongly supported economic development. The market-based creation of new institutions and products encouraged savings by a broad cross-section of society, allowing capital to flow into more productive uses. But in recent decades, parts of our financial development have gone badly offtrack becoming much more a

In the US, the symptoms are different. Figure 2 illustrates the US version of the doomsday cycle: the rise of total credit as a fraction of national income. Major players in the financial system have become too big to be allowed to fail and consequently receive large subsidies. The Congressional Budget Office estimates that the final fiscal impact of the crisis of 2007-8 will end up increasing debt relative to GDP by about 50 percentage points. This is the second largest debt shock in US history; measured in this way, only the Second World War cost more. (For more detail, see Johnson and Kwak 2012.) The alliance that leads to unsustainable finance here is simple: the US financial system earns large rents (excess returns to labour and capital) from the implicit subsidies offered by taxpayers. These rents finance a massive system of lobbyists and campaign donations that ensures pro-bailout politicians win elections regularly. Each time the US has a crisis, politicians and technocrats admit their errors and buttress regulators to ensure that it never happens again. Yet still it happens, again and again. We are now on our third round of the so-called Basel international rules for banks, with the architects of each new reform admonishing the previous

architects for their mistakes. Theres no doubt that the US will someday soon be correcting Basel 3 and moving on to Basel 4, 5, 6 and more. The problem that the country faces is that with each crisis, the financial risks are getting larger. If continued in this manner, bailing out the system will eventually be unaffordable. When the US finally runs out of enough savers to buy the bonds needed to bail out the system, it will suffer the ultimate collapse. (For more detail, see Schularick and Taylor 2012.) Roughly half of all US federal debt is currently held by nonresidents. So US fiscal policy remains viable only as long as the dollar is seen as the ultimate safe haven for investors. But what is the competition? Japan is not appealing today as a haven and it is unlikely to become more appealing in the near term. A great deal of the prospects for the US budget and growth therefore rest on what happens in the Eurozone. There is no sign that the Eurozone will emerge from crisis any time soon. The incentive structure of the Eurozone ensured that each countrys financial sector clamoured to join it. The key feature that made it so attractive was the liquidity window at the ECB. Rather, they are independents whose voting choices are not determined by party affiliation. That one-third of the voters, as

well as independent-thinking Republicans and Democrats, deserve an opportunity to see and hear a credible third party candidate. I understand that there are a great many third party candidates, and that a line must be drawn somewhere. However, the simple reality of our Electoral College system draws that line in a very straightforward and fair way a reality that is reflected in your existing criteria. If a candidate is not on the ballot in a sufficient number of states to be elected by the Electoral College, it is perfectly logical to not include that candidate in a national debate. If, on other hand, a candidate IS on the ballot in enough states to be elected, there i s no logic by which that candidate should be excluded. Nowhere in the Constitution or in law is it written that our President must be a Democrat or a Republican. However, it IS written that a candidate must receive a majority of the votes or at least 50% cast by electors, and that any candidate who does so, and otherwise meets the Constitutions requirements, may be President. As the Libertarian Partys nominees for Vice-President and

President, Judge Jim Gray and I have already qualified to be on the ballot in more than enough states to obtain a majority in the Electoral College, and we are the only candidates other than the Republican and Democrat nominees to have done so, or who are likely to do so. In fact, we fully intend and expect to be on the ballots of all 50 states and the District of Columbia. However, the Commission has chosen to impose yet another requirement for participation: 15% in selected public opinion polls. Unlike your other requirements, this polling performance criterion is entirely arbitrary and based, frankly, on nothing other than an apparent attempt to limit participation to the Democrat and the Republican. Requiring a certain level of approval in the polls has nothing to do with fitness to serve, experience or credibility as a potential President. On The Rise Of ETFs As A Driver Of Bond Returns

The seemingly inexorable rise of corporate bond ETFs(most specifically HYG and JNK is the high-yield market, and LQD in investment grade) have been discussed at length here as both a 'new' factor in the underlying bond market's technicals (flow) as well as their correlated impact on equity and volatility markets. Goldman Sachs' credit team delve deep into the impact of these relatively new (and rapidly growing) structures with their greater transparency but considerably higher sensitivities and conclude that not only are they here to stay but the consequences of ETFinclusion(dramatic outperformance bias relative to non-ETF bonds) are deepening the liquidity divide (and relativevalue) of what is already a somewhat sparsely-traded market. end of 2007. Even when scaled by the overall size of the US corporate bond market, these figures suggest a bigger ownership share of credit mutual funds. Perhaps more impressive is

the growth of corporate bond ETFs, whose size for IG and HY has increased to $105bn and $31bn, respectively, from just $12bn and $288mn at the end 2007. Despite all-time low yields, the appetite for corporate bonds remains firm, with net inflows to IG and HY mutual funds still running at a robust pace. Inflows to the HY market have been steady all year with the exception of a brief episode of outflows from mid-May to midJune, while IG inflows have remained firm, having been positive for all but two weeks this year. As we often point out, the strength of the inflows is by and large a reflection of sluggish growth, which has maintained a friendly outlook for inflation as well as a challenging outlook for growth expectations, trends we expect to persist. In the past we have extensively analyzed the price impact of mutual fund flows, showing that fund flows provided a significant boost to bond returns in the early months that followed the crisis and gradually normalized afterwards. Generally these remain in the

middle part of their 2+ year range. The Refinance Index also rose about +1% for the week. The Federal Reserve Bank's weekly H8 report of real estate loans this week rose 20 to 3534. The YoY comparison rose to +2.2%, which was also the seasonally adjusted bottom. The raw number is an 18 month high, and the percentage gain is the best in 3 years. YoY weekly median asking house prices from 54 metropolitan areas at Housing Tracker were up +2.2% from a year ago. YoY asking prices have been positive for almost 10 months. Money supply remains quite positive: M1 declined -0.6% for the week, but was up +2.3% month over month. Its YoY growth rate continued to rise sharply, to +14.3%. As a result, Real M1 also rose to +12.6%. YoY. M2 increased +0.3% for the week, and was up 0.6% month over month. Its YoY growth rate also rose again to +6.8%, so Real M2 rose to +5.1%. The growth rate for real money supply is still quite positive, despite the summer 2011 incoming tsunami of Euro-cash having disappeared from the comparison. Rail traffic was completely flat YoY due primarily to coal, but 12 of 20 carload types had YoY

negative comparisons: The American Association of Railroads reported that total rail traffic was essentially unchanged YoY, up only +0.1%. Nonintermodal rail carloads were again off a substantial -2.9% YoY or -8,700, once again entirely due to coal hauling which was off 13,100. Negative comparisons expanded from 8 to 12 types of carloads. Intermodal traffic was up 8,400 or +3.9% YoY. Turning now to the high frequency indicators for the global economy: The TED spread declined sharply again to yet another new 52 week low of 0.27. The one month LIBOR also declined sharply to 0.2165, and also set another new 52 week low. Both are well below their 2010 peaks and in the middle (TED) or low end (LIBOR) of tier respective 3 year ranges. The Baltic Dry Index rose sharply from 662, which was a 52 week low, to 774. This is only a one month high and the declining trend in shipping rates for the last 3 years is fully intact. The Harpex Shipping Index fell yet again, down 4 from 390 to 386, and is now only 11 above its February 52 week low. Finally, the JoC ECRI industrial commodities index was SHARP page 33

Rather than spinning straw into gold, the ECB converts unattractive government and bank -issued securities into highly liquid collateral that can be readily swapped for cash from the ECB. This feature instantly made sovereign and bank bonds very attractive debt instruments. Knowing that the borrowers had essentially unlimited access to liquidity from the ECB, investors became willing lenders at low interest rates to all banks in the Eurozone. Given such attractive features, it is easy to understand why 17 countries mastered the political debate to join the Eurozone. It is also easy to understand how the system got abused and why it will be so difficult ever to make it safe. If the Japanese cant control their public finances and if the US cant control its too-big-to -fail banks, the added complexity of merging 17 regulators and 17 national governments into a system where someone else can be made responsible for bailing out the intransigents seems a financial and regulatory nightmare. Such a system is sure to be crisisprone. The Federal Reserve and the US federal governments attempt to provide bailouts when there is trouble in the US. But in Europe, the bailouts are only partial. No country has a lender

of last resort like the Federal Reserve or the Bank of Japan so markets are now learning that large risk premia are needed to reflect default risk in troubled countries. Flexible exchange rates would undoubtedly make it easier to manage these crises. Devaluations instantly reduce wages and raise countries competitiveness. If Greece had managed a large devaluation, it could probably have avoided much of the unemployment and social turmoil we see today. Instead, each troubled country in Europe now suffers when having to force down wages and prices during adjustment. This system poses great dangers to global financial stability. The Eurozone faces myriad problems, including insufficient bank capital, high levels of private and public debt, and the chronic inability of some member countries to grow. It is now common to hear policymakers blackmailing populations: unless the Eurozone survives, tragedy will result. And it is true that tragedy will result; we only need to look at the rise of complex derivatives and the dangers they pose were the Eurozone to dismantle. (For a broader discussion of Europes problems, see Boone and Johnson 2011 and 2012.)

Figure 3 illustrates the growth of euro-denominated interest rate derivatives, the notional value of which now totals more than 10 times the GDP of the Eurozone. Regulators commonly use net figures when they consider ultimate risk for banks and this makes sense under the usual circumstances of bankruptcy. But when a currency area breaks up, the practice of netting off contracts needs to change dramatically and banks will be facing far more risks than regulators and risk officers currently report. Figure 3 For example, if a German bank has a contract with a French bank and an opposite identical contract with a German pension fund, it can net those two contracts and report the ultimate risk as zero. (Of course there is counterparty risk, but under standard agreements, derivatives are cleared instantly at liquidation so the counterparty risks can be netted). But if investors start to believe that there will be new currencies in each country, then the two contracts in this example are no longer offsetting so they must not be netted. It is reasonable to think that after any demise of the euro, the contracts between two German counterparties will be converted into deutsche marks,

while contracts with international partners will be disputed or maintained in a euro proxy. As a result, risk officers at banks should understand that if the Eurozone breaks up, all banks in Europe face enormous and unaccountable currency risk. Each of their euro assets and liabilities needs to be examined to understand into which currency it would be converted. (For more discussion on redenomination issues, see Nordvig and Firoozye 2012.) The tragedy of the Eurozone appears unavoidable, but it reflects far greater risks that will spread to Japan, the US, and other advanced economies. Through our financial systems, we have created enormous, complex financial structures that can inflict tragic consequences with failure and yet are inherently difficult to regulate and control. We are at the behest of our politicians and financial sectors to prevent them from creating dangers. Yet around the world, our political and financial systems have aligned to build these dangers rather than suppress them. The continuing crisis in the Eurozone merely buys time for Japan and the US. Investors are seeking refuge in these two countries only because the dangers are most imminent in the

Eurozone. Will these countries take this time to fix their underlying fiscal and financial problems? That seems unlikely. The lesson from all these troubles is clear: the relatively recent rise of the institutions of complex financial markets, around the world, has permitted the growth of large, unsustainable finance. We rely on our political systems to check these dangers, but instead the politicians naturally develop symbiotic relationships that encourage irresponsible growth. The nature of irresponsible growth is different in each country and region but it is similarly unsustainable and it is still growing. There are more crises to come and they are likely to be worse than the last one. Does Mitt Romney Really "Know Better" Than the Silly Things He Says?

Does Mitt Romney really "Know Better" than the silly things he has said on the campaign trail lately? I ask the question because that subject came up twice recently, once in Time Magazine, and once in the Financial Times. Writing for Time Magazine, writer Joe Klein brought up the subject in The Imaginary Campaign It is the business of a presidential challenger to overstate the dire situation the incumbent has inflicted on a betrayed public. Bill Clinton certainly overstated the extent of the economic recession in 1992. But there are limits. There is reality. In this country, successful politicians have always avoided apocalyptic predictions. This year, however, Republicans have routinely embraced the dark side. If Obama is re-elected, "I don't know that our country really survives four more years of all the regulations," Senator Rand Paul told CNN's Wolf Blitzer during the Republican Convention. Blitzer called him on it, saying, "Wait a second. If President Obama is re-elected, you think the United States of America, in four years, will not be the United

States of America?" Paul beat a hasty retreat. Romney has lived the past six years in his party's overheated shark tank, spending more time pestering plutocrats for cash than meeting with and listening to the general public. I suspect Romney doesn't really believe that 47% of the electorate are moochers; he was just dialing for dollars. But it's becoming increasingly difficult to see how the man who mouthed those words, whether he believes them or not, can be elected President. Foot-in-Mouth Disease I wrote about that set of now infamous statements by Romney in Foot-in-Mouth Disease. Shortly after Romney made that huge gaffe, Tim Pawlenty, a Top Romney Adviser Quit the Campaign. What caught my eye in the Financial Times article was an analysis of some of the statements made by Romney regarding trade with China. Let's take a look. Chris Chocola, president of the influential Club for Growth lobby group, gave the most tepid of endorsements of Mr Romney on Thursday, saying he could not be sure that the former Bain Capital executive would be a progrowth president. I think he has the potential to exceed expectations. But its a

mixed bag with Romney. Thats his problem...you dont really know how hell serve, Mr Chocola told reporters at a briefing organised by the Christian Science Monitor. When you start to threaten a trade war with China, when you start to pander politically on trade issues, youre hurting the economy, youre not helping it, Mr Chocola said. What we need is politicians who stand up and [say] trade with China is good. Yeah, this is why. With his background in business, Mr Romney knows better, Mr Chocola said, but he says what he says. Mr Romney has vowed to label China a currency manipulator on the first day of his presidency, while Mr Obama this week took action against China over its export subsidies for cars and car parts. Does Romney Really Know Better? Chocola says " Romney knows better". Really? Why should anyone believe he does? In fact, it is far more logical to believe Obama "knows better" for the simple reason Obama has resisted huge pressure from trade unions to label China a currency manipulator for the last four years. Understanding Smoot-Hawley One would think that Romney

ought to know something about Smoot-Hawley Yet, off he goes, threatening a no -win trade war with China when instead he out to stand up and explain why trade is good (with China and everyone else). A Fool or A Liar? If Romney does what he says he will do, he is a fool. If he doesn't, he is a blatant liar. Now, we all know candidates lie. However, Romney made a pledge to do something blatantly stupid on day one. Is he going to lie about a " day one" promise? If that is the premise (and several high-placed Republican friends suggest that), I have to ask: why should anyone believe anything he says at all? It is far easier to believe Romney is a complete dunce regarding the benefits of free trade than he is purposely making a pledge of this nature. The only other possibility (and it is a far worse possibility), is Romney knows his position on China is wrong, but he will do what he says anyway, if it helps him get elected. Regardless, of whether he "knows better" or not, Romney certainly "says what he says", frequently flip-flopping in the process (as he does on health-care reform). Those actions have him in extremely hot water. Thus, I side with Joe Klein on

multiple grounds, on several issues: " It's becoming increasingly difficult to see how the man who mouthed those words, whether he believes them or not, can be elected President." Please bear in mind, this is not an endorsement of president Obama. It is simply a statement of political reality regarding hopelessly inept statements by Romney. The fact remains, both Obama and Romney are fatally flawed, and I will not vote for either of them, but I will vote. Despite their recent growth, ETFs remain a relatively small subset of the mutual fund complex, but they are of particular interest to us, for two reasons. First, unlike mutual funds, ETFs generally try to track an existing bond index and are thus more transparent in terms of their composition. Second, unlike institutional investors, ETF managers need to be fully invested, and thus need to put money to work urgently when inflows increase. Intuitively this should make returns on ETF bond constituents more sensitive to flows. The ETF factor: Is it really there? Our primary goal is to determine whether, all else equal, the bid for ETFs has boosted the return on their bond constituents, both in absolute terms and relative to the broad market. More specifically and using the bond constituents of the iBoxx USD domestic index and its subindex the LQD IG index, which is tracked by one the largest IG ETFs, we investigate the following questions: Controlling for maturities, ratings, sectors and liquidity, how do the bond constituents of the LQD ETF perform relative to those bonds that are not part of

In all due respect, it is not the proper role of a non-elected, private and tax-exempt organization to narrow the voters choices to only the two major party candidates which is the net effect of your arbitrary polling requirement. To the contrary, debates are the one element of modern campaigns and elections that should be immune to unfair advantages based upon funding and party structure. Yet, it is clear that the Commissions criteria have both the intent and the effect of limiting voters choices to the candidates of the two major parties who, in fact, created the Commission in the first place.

Eliminating the arbitrary polling requirement would align the Commission and its procedure for deciding who may participate in the critical debates with fairness and true nonpartisanship, which was the purported intent behind the Commissions creation. As of right now, eliminating that requirement would not disrupt the process or make it unmanageable. Rather, it would simply allow the participation of a two-term governor who has more executive experience than Messrs. Obama and Romney combined, who has garnered sufficiently broad support to be on the ballot in more than enough states to achieve a majority in the Electoral College, and who, without the help of party resources and special interests, has attracted enough financial support to qualify for presidential

campaign matching funds. I urge and request you to remove the partisanship from the debates, and allow the voters an opportunity to hear from all of the qualified candidates not just those who happen to be a Democrat or a Republican. Housing sales, prices, and mortgage refinancing are all positive at this point. Consumers are yet again holding up like champions. Money supply remains strongly positive. It looks like Oil and gasoline prices may have temporarily peaked. Remember the Euro crisis? The TED spread and LIBOR say it is back to

simmering on the back burner. At the same time manufacturing and employment indicators continue to falter, as measured by increasing first time jobless claims and a stalled temporary staffing index (although treasury deposits have turned quite positive again). Gasoline usage is negative again. Rail traffic looks poor, with no YoY growth and 12 of 20 carload groups negative. Shipping rates remain poor. So long as housing, cars, and consumer spending hold up I remain very cautiously optimistic. At the same time it is apparent

that the global slowdown or contraction is dragging down US manufacturing, and that plus the Oil choke collar have begun to affect employment. A peaceful person thinks and talks like this: "God, I don't like what I'm going through right now, but I trust You to get me through it. I know You're in control and will work all things out for my good. Give me the grace to be stable in this situation." If you're not careful to think and speak words of faith, worry will creep in, and it will not only steal your peace and joy, it will steal your "today." "I am so proud of Pastor Dino. It hurts to see him leave, but it's wrong to keep a man of God when he has a call on his life," said Chris Hjhh on the church's Facebook wall. But one member who also had only positive things to say about Rizzo expressed a desire to look more into the situation. "I tried to stay positive last week under the circumstances of loosing the greatest Pastor I've ever met! "This decision will allow them to devote their complete and undivided attention to healing their marriage and family and to earnestly seek the Lord's will for their future lives in ministry." Rizzo told the congregation on Sunday, according to The Advocate, that he has "needed a lot of mercy and a lot of grace" over the last couple of months. "To those I have disappointed, I want to say forgive me. I'm sorry if I've ever disappointed you as pastor." Though many in the church were shocked, Chris Hodges, one of Healing Place Church's overseers, indicated to the congregation that no additional details would be given about the Rizzos. "I know you want more than what's being said here today but can you be OK that the seven of

us (overseers) know?" Hodges asked, according to The Advocate. "We're going to take care of them and we're going to take care of you. Trust me." In an update Friday, the church announced that "due to the recent resignation of our Pastors Dino & DeLynn Rizzo, our Presbyters felt that it was best to postpone [the Live the Dream Conference] indefinitely in order for us to have a time of healing as a family." Live the Dream is an event geared toward women. Healing Place Church is a multisite church attended by over 6,000 people. Its vision is to be a healing place for a hurting world. Andrews riposte: Notice how pure the smear is, enabled and not diminished by the first sentence. Notice the key concept of Beltway ideological policemen: there is a mainstream and a non-mainstream. Dabble with the latter at your peril. Since David has perished by the cult of the mainstream, its odd he should deploy it against others. But to throw in Holocaust denial and 9/11 Truthers for good measure! Really. And notice how particularly cheap and easy it is to use such tactics against a libertarian. The traditional left is often based on collective associations, building a movement out of oppressed groups and their grievances, whether it be class or race or even

sexual orientation. Libertarianism is the opposite. Its about dis associating. When you listen to Paul saying he will not turn anyone away from supporting his platform regardless of their motives or beliefs, you are hearing a reflection of his libertarianism, not his bigotry. He will accept support from any quarter and compared with the corporate money flowing into the other candidates coffers, he is about as independent as a presidential candidate can be. Because he is a radical individualist, he doesnt even understand why he should somehow explain the belief of others, or justify their support. You should ask them, not him. This kind of gotcha-association game is particularly easy because libertarians favor liberty above all, and that will necessarily mean liberty for bigots as well as others. A principled belief in states rights will doubtless lead to more racist and homophobic policies in many states but also, of course, more enlightened and successful inclusive states like Oregon or New York or Massachusetts or California. A rejection of statism might lead to more discrimination in the private sector. But it doesnt mandate it. And it need not encourage it. A noninterventionist foreign policy will allow evil to triumph elsewhere in

the world, because it believes its none of our business or too riddled with unintended consequences to try extirpating. That may be right or wrong, but it is not an approval of the evil of Assad or Ahmedinejad or the North Korean junta. And again, it is actually much deeper an American tradition than permanent warfare. But if you can trot out David Duke or Ayatollah Khamenei as potential Paul supporters, you have a very easy, cheap and essentially McCarthyite target. It saddens me that this kind of tactic works. I still believe that the newsletters, because they were in Pauls name, require a clearer explanation from Paul than the muddled ones he has given. He should not be left off the hook. And his proposals deserve a thorough vetting and discussion. But there is something awry when a candidate is assessed not on his arguments and proposals but on the shadiness and ugliness of some of his fringe supporters. Ron Pauls supporters ask that their candidate not be judged by his associates. Or by the people he chose to employ. Or by the newsletters he published. Or by the book he wrote. Or by the way he earned the largest part of his living when out of office in the 1990s. Or by his purchase of the mailing list of the Holocaust-

denying Liberty Lobby. Or by the radio shows he chooses to appear on. Or by his strategic decision to reach out to racist voters. Or by the conspiracy theories to which he lends credence, from government creation of AIDS to Israeli culpability for the 1993 bombing to a putative 9/11 coverup. And here I thought that libertarianism was a doctrine of personal responsibility? May Ron Paul at least be judged by the words he has spoken with his own mouth within the current campaign? The supporters say no again. When Ron Paul tells an interviewer that the Civil Rights Act of 1964 made race relations worse, were not supposed to consider what he might mean by better. When Ron Paul warns that a border fence would be used to prevent fleeing American citizens from exiting the country, were not supposed to conclude that hes a paranoid crank. Andrew deploys what might be called the ontological defense of Ron Paul, as follows: 1) Ron Paul is a libertarian. 2) Libertarians espouse individualism. 3) Racism is a form of antiindividualism. 4) Therefore Ron Paul cannot be a racist. That is a demonstration of what

might be called the deductive method of reasoning. But theres another way to study reality: induction. Like this: 1) Ron Paul has again and again exploited bigotry, paranoia, and hate as fundraising devices. 2) Ron Paul is a libertarian. 3) So yes, I guess it is possible for a libertarian to do that. Heres my question for Ron Paul supporters: why the denial of the undeniable? Perhaps you like Pauls message of legalized marijuana? Why not just say so? You dont think its important to stop Iran from gaining nuclear weapons? Argue it forthrightly. If you regard Social Security and Medicare as literally the moral equivalents of slavery, go ahead, make your case. But all this excuse-making, special pleading and jiggering of the rules of evidence so as to exculpate Ron Paul from the record of his whole political life? For what? Energy Dept. Spends $10 Million on Water Turbine to Power 25 Houses

The Ocean Renewable Power Company Maines Cobscook Bay Tidal Energy Pilot Project received the Energy Department money to build, install, and operate the hydrokinetic energy conversion devices situated at the easternmost tip of the state. The turbine, with a rated capacity of 180 kW, is expected to generate enough power for 25 to 30 homes. The electricity produced by the tidal generation will be sold by Ocean Renewable Power Company to Maines utilities under a 20-year power purchase agreement, according to Boston.com. The initial price of 21.5 cents per kilowatt hour is almost double the current average price of 11.21 cents per kilowatt hour for electricity in Maine. Heritages Nick Loris, a critic of government subsidies for energy sources, said Washington should stop propping up industries that happen to have good connections

in Washington. Taxpayer-funded programs do not create jobs; they shift them from one sector of the economy to another, Loris recently wrote. The opportunity cost of government spending is the lost labor and capital extracted from other sectors of the economy

to artificially support the politically preferred ones. If underwater turbines are a good investment, companies shouldnt need subsidies to build them. The power company plans to construct a network of as many as 20 of the seafloor-mounted

Justice Department Used Enemies List to Attack Critics Like Me

Its an odd feeling to see your name on the list of individuals targeted by the Justice Department. Especially when you used to work there. The DOJs Office of Public Affairs appears to have enlisted Media Matters to serve as its unofficial PR wing the one responsible for running smear campaigns too dirty for the department to risk leaving fingerprints. Media Matters is, of course, a far -left advocacy group that masquerades as a nonpartisan truth-teller and media watchdog. I am not sure whether to feel honored that my critical reporting on the Justice Departments misdeeds and rank politicalization attracted such attention, or upset that my taxpayer dollars have been used to attack me personally and professionally. But there is no question that taxpayers and Congress should be upset over unethical conduct by Justice Department employees who use government resources to abuse private citizens and journalists guilty only of reporting on the departments malfeasance. Matthew Boyle of The Daily

Caller discovered the smoking gun through a Freedom of Information Act request for DOJ emails. The department, of course, dragged its feet, taking nine months to respond to the request, even though the law requires a response within 20 days. But it was worth the wait.

The recovered e-mails document communications between Tracy Schmaler, the director of the DOJ Office of Public Affairs, and reporters at Media Matters. In dozens of emails, Schmaler enlists Media Matters and provides information to attack reporters covering DOJ scandals, in

Boyles words. In addition to me, Schmaler solicited attacks on other former Justice Department lawyers such as J. Christian Adams, National Review Online contributor Andy McCarthy, and Christopher Coates; bloggers and journalists such as Mike Vanderboegh and William

According to Energy Department estimates released in the projects impact statement, 53 new jobs are expected to be created over the course of the eight-year pilot period. Generating energy from tidal forces is more predictable and reliable than other forms of renewable energy, especially wind turbines. system, he said. To know how much power they can expect to get from a system over time is valuable. The Electric Power Research Institute is a recipient of approximately$1.5 million in Energy Department funding for a variety of ocean energy assessments, including ocean wave energy resource recoverability, fish injury and mortality, and available hydrokinetic energy from U.S. rivers. The Energy Department believes the project represents the first step in promoting the development of tidal energy in the United States. Based on its own estimates from early 2012, the Energy Department projects that as much as 15 percent of the nations electricity could come from waves and tidal currents and up to onethird of the nations electricity demand could be generated along the coast, though it did not provide a specific plan on expanding the energy portfolio in the announcement.

The Energy Department has funded more than $87 million in marine and hydrokinetic projects since fiscal 2008, with more than 45 percent going to three statesMaine, Oregon, and Washington. All of this conduct is reprehensible. But the attacks that Schmaler engineered on Christopher Coates were particularly unethical and unprofessional. At the time, Coates was a DOJ employee, detailed to the U.S. Attorneys Office in South Carolina to prosecute criminal cases. Coates was a career lawyer, the former chief of the voting section and an experienced civil-rights attorney. But Coates had upset DOJs political hacks when he complied with a lawfully issued subpoena for his testimony from the U.S. Commission on Civil Rights. Political appointees at DOJ had instructed him to defy the law and not comply with the subpoena. His testimony before the commission was crucial to explaining DOJs unjustified dismissal of the New Black Panther Party voter-intimidation case and the Obama Administrations implementation of a policy against race-neutral enforcement of the law. Coates testified that he was told that the law would not be enforced against minority defendants, no matter how egregious their conduct. Thus, the e-mails reveal that the DOJ Office of Public Affairs was directing attacks by an outside group on one of its own employees. Schmaler was clandestinely providing false information to her chosen media source to attack him while he was prosecuting cases for DOJ. This is

the kind of behavior one expects from dictatorships and banana republics, not from the chief lawenforcement agency of the U.S. government. Schmaler was also potentially violating the federal law that bars retaliation against whistleblowers like Adams and Coates. She should resign, and the inspector general should investigate her flagrant misbehavior. If she does not resign or is not terminated, it will be a sign that Attorney General Eric Holder approves of such abuses and sees nothing wrong with using government resources to attack his own employees as well as reporters, ordinary citizens, and others doing their jobs or exercising their right to report or criticize the conduct (and misconduct) of the Justice Department. During the Qaddafi era, it was the hotbed of a deadly Islamist insurgency against his regime. A significant number of the Libyan jihadists who travelled to Afghanistan and Iraq during recent wars came from Darna. During the revolt against him last year, Qaddafi's regime warned that Darna would declare itself an Islamic Emirate and ally itself with Al Qaeda. But now, the residents are lashing out against Ansar Al-Shariah, the main Islamic extremist group in the city.

"The killing of the ambassador blew up the situation. It was disastrous," said Ayoub alShedwi, a young bearded Muslim preacher in Darna who says he has received multiple death threats because has spoken out against militias on a radio show he hosts. "We felt that the revolution is going in vain." Leaders of tribes, which are the strongest social force in eastern Libya, have come forward to demand that the militias disband. Tribal leaders in Benghazi and Darna announced this week that members of their tribes who are militiamen will no longer have their protection in the face of antimilitia protests. That means the tribe will not avenge them if they are killed. Activists and residents have held a sit-in for the past eight days outside Darna's Sahaba Mosque, calling on tribes to put an end to the "state of terrorism" created by the militias. Militiamen have been blamed for a range of violence in Darna. On the same day Stevens killed in Benghazi, a number of elderly Catholic nuns and a priest who have lived in Darna for decades providing free medical services, were attacked, reportedly beaten or stabbed. New finding hints that Jesus had a wife Did Jesus have a wife? Pastors around the nation are bracing for questions from curious congregants, after a Harvard professor claimed a fragment of text from the fourth century suggests Jesus may have been married. Karen King, a professor of early Christianity at Harvard Divinity School, announced Tuesday that the tiny scrap of papyrus contains dialogue that includes the words "Jesus said to them, 'My wife..'" The text, written in Coptic and likely translated from a secondcentury Greek text, was produced by an unknown author roughly 300 years after Jesus' death. Several scholars claim the writing could very well be authentic but say they give no credence to the claim that Jesus was married. "The writing is probably authentic," author and religious historian Richard Sorensen said. "However, the idea that Jesus had a wife is a specious claim." "There is no word of this whatsoever" from "everybody that knew Jesus and spent any time with him," Sorensen said. "It's totally in disagreement with the people who lived during his time. "I think that the author of it [the papyrus] had an agenda - a philosophical agenda - and it's not Christian," he continued. "I see this simply as one more ancient revisiting of the gospel. ...
