Defendants hereby respectfully request that the Court grant this Ex Parte Application to enlarge the 25-page length limit set forth in Local Rule 11-6, to allow them to file an Opposition to Plaintiffs Motion for a Preliminary Injunction that is 28 pages in length. Defendants have made every effort to reduce the brief to minimize the need for additional pages, but have been unable to do so. Good cause exists for this request. Plaintiffs Motion for a Preliminary Injunction advances legal arguments involving complex constitutional issues of equal protection and substantive due process. In addition, the preliminary injunction touches on technical immigration issues, which cannot be adequately addressed in a cursory manner. On September 13, 2012, pursuant to Local Rule 7-3, Defendants Counsel Jesi Carlson conferred with Plaintiffs counsel, Peter Schey, as well as Intervenors Counsel, William Pittard, by e-mail regarding this issue. Mr. Schey indicated that he took no position on Defendants request to exceed the page limit. Mr. Pittard indicated that he did not object to Defendants request.
