COMPLAINT
The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s). The complainant states that the following facts establish PROBABLE CAUSE:
Complainant, Det. Sara Metcalf, of the Minneapolis Police Department, has investigated the facts and circumstances of this offense and believes the following establishes probable cause: On October 24, 2011, at approximately 9:15 p.m., Minneapolis Police were conducting undercover narcotics investigations at East Franklin Avenue and Third Avenue South, Minneapolis in Hennepin County, Minnesota. The undercover officer (UC) was standing at a bus stop with an older male, later identified as DEFENDANT NORMAN JENE BREWER, DOB 7/8/1959, and asked DEFENDANT BREWER if he knew where the UC could get a twenty, which is slang for a small amount of crack cocaine. DEFENDANT BREWER stated he would have to go to Portland Avenue. UC walked over to Fourth Ave. S. and Franklin and sat down, where he was approached by DEFENDANT BREWER who told the UC he would have to cross over the Franklin Avenue Bridge, which the UC refused to do. DEFENDANT BREWER went over the bridge and a short time later returned with a group of four males. One of the males, later identified as DEFENDANT DEVON LAMONT HOLT, DOB 4/30/1990, approached the UC and told him to accompany him to the bus shelter. Within, the UC handed DEFENDANT a prerecorded twenty dollar bill, and in return received two bindles of suspected crack cocaine. The suspected crack cocaine subsequently field tested positive and weighed approximately .4 and .1 grams respectively. Police stopped the group of males and identified them. In a search of DEFENDANT, police found the prerecorded twenty dollar bill in his pants pocket.

Page DEFENDANT is not in custody. DEFENDANT has a prior fifth degree controlled substance conviction.
OFFENSE COUNT 1: CONTROLLED SUBSTANCE CRIME THIRD DEGREE-SALE (FELONY) MINN. STAT. 152.023, SUBD. 1(1), SUBD. 3(b); 609.101, SUBD. 3; 152.01, SUBD. 16a PENALTY: 2-30 YEARS AND/OR $75,000-$250,000 That on or about October 24, 2011, in Hennepin County, Minnesota, DEVON LAMONT HOLT unlawfully sold, gave away, bartered, delivered, exchanged, distributed, disposed of to another, offered to sell, agreed to sell, manufactured or possessed with intent to sell one or more mixtures containing a narcotic drug, to-wit: COCAINE, and DEFENDANT has a prior disposition for a felony-level offense under section 152.18, subd. 1, or felony conviction under chapter 152 or similar statute of another jurisdiction.
NOTICE: You must appear for every court hearing on this charge. A failure to appear for court on this charge is a criminal offense and may be punished as provided in Minn. Stat. 609.49.
THEREFORE, Complainant requests that said Defendant, subject to bail or conditions of release be: (1) arrested or that other lawful steps be taken to obtain defendants appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
