Windsor v. United States, Nos. 12-2335, 12-2435 Dear Ms. O'Hagan Wolfe: We write to advise the Court of a very recent development that may be relevant to the Court's consideration of the motion to suspend oral argument in the above-captioned appeal filed by the Bipartisan Legal Advisory Group of the House of Representatives ("BLAG"). More specifically, yesterday, plaintiffs in the case of Pedersen v. Office of Personnel Management, No. 3:10-cv-1750 (VLB) (D. Conn.), filed a petition of certiorari before judgment with the United States Supreme Court. (No. 12-3273.) Responses to that petition are currently due on September 21, 2012. In its reply brief of yesterday on the motion for a stay, BLAG argued that this Court should suspend the September 27 oral argument because the Supreme Court is likely to conference the DOMA cases on October 6. (BLAG Reply to Opp. To Mot. to Suspend Oral Arg., ECF No. 207, at 2, 4.) However, given the filing of the Pedersen petition, this may no longer be the case. Catherine O'Hagan Wolfe along with the other DOMA cases, the DOMA cases (including Windsor) likely will not be considered by the Supreme Court until the end of October at the earliest (assuming no extensions are granted), or at the conference on October 26, 2012.
