AMENDED COMPLAINT
The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s). The complainant states that the following facts establish PROBABLE CAUSE:

The offense portion is amended as follows: Your Complainant, Geoffrey Toscano, is an Officer with the Minneapolis Police Department, and in that capacity has investigated the facts and circumstances of the offense alleged herein, including reviewing the reports of other officers. Your Complainant has learned the following: On December 9, 2010, officers were conducting routine patrol in the area of Lake Street and Park Avenue in Minneapolis, Hennepin County, Minnesota, when they observed Defendant EMMANUEL GORDON ANIM standing in front of a store located at this intersection. Officers observed several individuals approaching Defendant. When they would approach, Defendant would cup his hand to his mouth, take something from his mouth and hand it to the individual in exchange for money. Officers believed that Defendant was selling narcotics to these individuals, as it is common for narcotics dealers to keep small amounts of narcotics in their mouths when engaged in narcotics transactions. Defendant then met up with two other individuals and walked north into an alleyway. Officers approached the group and observed Defendant conducting a narcotics transaction with the two individuals. When Defendant saw the officers, he threw his hand up to his mouth. Officers observed something fall from Defendants mouth on to the ground. Defendant then rolled over on to the item. Officers recovered the item, suspected crack cocaine, from underneath Defendant. The suspected crack cocaine field-tested positive, weighing approximately .2 grams without packaging.

STAT. 152.025, SUBD. 2(b)(1); 609.101, SUBD. 3; 152.01, SUBD. 16a PENALTY: 6 MONTHS-10 YEARS AND/OR $6,000-$20,000 That on or about December 9, 2010, in Hennepin County, Minnesota, EMMANUEL GORDON ANIM unlawfully possessed one or more mixtures containing a Schedule I, II, III, or IV controlled substance, to-wit: Crack-cocaine, and the DEFENDANT has a prior disposition for a felony-level offense under section 152.18, subd. 1, or felony conviction under chapter 152 or similar statute of another jurisdiction. COUNT 2: CONTROLLED SUBSTANCE CRIME THIRD DEGREE-SALE (FELONY) MINN. STAT. 152.023, SUBD. 1(1), SUBD. 3(b); 609.101, SUBD. 3; 152.01, SUBD. 16a PENALTY: 2-30 YEARS AND/OR $75,000-$250,000 That on or about December 9, 2010, in Hennepin County, Minnesota, EMMANUEL GORDON ANIM unlawfully sold, gave away, bartered, delivered, exchanged, distributed, disposed of to another, offered to sell, agreed to sell, manufactured or possessed with intent to sell one or more mixtures containing a narcotic drug, to-wit: cocaine, and DEFENDANT has a prior disposition for a felony-level offense under section 152.18, subd. 1, or felony conviction under chapter 152 or similar statute of another jurisdiction. NOTICE: You must appear for every court hearing on this charge. A failure to appear for court on this charge is a criminal offense and may be punished as provided in Minn. Stat. 609.49.

THEREFORE, Complainant requests that said Defendant, subject to bail or conditions of release be: (1) arrested or that other lawful steps be taken to obtain defendants appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
