On 07/28/2012, at approximately 2352 hours, I, Officer Jason Lopez, while on routine patrol in marked vehicle
#1845, was contacted by Brad Hogan (DOB - 10/12/79) at the southeast corner of Broadway Street and Walnut
Street, in the City and County of Boulder, State of Colorado. Hogan indicated a Hispanic male, later identified as
Timothy Paez (DOB - 08/10/88), crossing Broadway Street, and stated Paez had just urinated on a patron at
Shooters Bar, located at 1801 13th Street, #190, in the City and County of Boulder, State of Colorado.
Based on Hogan's statement, I contacted Paez in front of 1877 Broadway Street. Upon initial contact with Paez, I
detected the strong and distinct odor of an alcoholic beverage on his breath, he presented bloodshot, watery eyes,

his speech was slurred and he was unable to answer simple questions such as how much alcohol he had
consumed, all of which, based on my training and experience, are indicia of alcohol intoxication. I asked Paez if
had urinated on anyone. In response, he answered affirmatively. However, he was unable to clearly articulate
who. At one point, Paez stated he had urinated on his former male partner, which he identified as
. He later re-canted that statement. The remainder of Paez's statements were
unintelligible, presumably due to his level of intoxication.
Officers Ryan Bemis and James Klute responded to Shooters Bar and contacted Hogan and
the patron whom Paez had urinated on.
stated the following to Ofc. R. Bemis:
At approximately 2345 hours she was standing at the bar inside Shooters Bar, with her right side against the bar
facing an associate. A Hispanic male, later identified as Paez, approached from behind and placed his
right arm around her back. In response, looked at Paez and queried, "Um really?" Paez then backed
away. Approximately 3-5 seconds later, felt liquid on her right leg. She initially thought the liquid was
Paez's beer spilling. However, when looked to the right, she observed Paez with his penis exposed and
urinating on the lower front wall of the bar and on her leg. yelled, "Oh my God! He's peeing!" In an effort
to remove herself from the path of travel of Paez's urine stream, she leaned to the left as far as she could. Hogan
proceeded to come around the bar to escort Paez outside.

agreed to attempt a field identification of a Hispanic male who Ofc. R. Bemis advised may, or may not be a
suspect. Paez was seated on a retaining wall adjacent to the west sidewalk of Broadway Street and was not in
custody. Ofc. R. Bemis transported to the vicinity of my location (directly across Broadway Street form
me). At this location, Ofc. R. Bemis asked if she recognized the male party I was in contact with.
positively identified Paez as the Hispanic male who had urinated on her in Shooters Bar. She quantified her
identification as 100%.
Ofc. J. Klute contacted Hogan who stated the following:
He observed a Hispanic male (identified as Paez) wearing a light colored shirt and a hat in the immediate vicinity
of Hogan observed Paez with his penis exposed and urinating on yelled at Paez.
However, he did not stop. Security personnel escorted Paez out of the bar.
On 07/29/2012, at approximately 0015 hours, based on and Hogan's statements, I placed Paez into
custody on suspicion of the following violations:
- Harassment.
- Public Indecency.
I transported Paez to the Boulder County Jail, where he was subsequently booked and lodged.
This case is cleared by an adult arrest.
