I!have!been!emailed!today!a!copy!of!the!Governments!Motion!for!Protective!Order!which!apparently!the!Government! filed!10!days!ago!but!did!not!serve!on!defense!counsel!contrary!to!the!certificate!of!service!attached!to!the!motion.! ! I!request!that!the!a!corrected!certificate!of!service!be!filed.!! ! In!the!motion!unnamed!defense!counsel!are!alleged!to!have!breached!the!U.S.!Attorneys!discovery!policy!by!giving! clients!copies!of!materials!of!Government!discovery!materials.!Before!responding!to!these!accusations,!I!request!that! you!provide!details!of!the!evidence!that!supports!this!accusation.!I!trust!that!the!Government!did!not!based!this! allegation!on!rumor!or!other!inadequate!information.!! ! Please!identify!the!materials!that!the!Government!claims!were!improperly!distributed.!As!you!know!a!lot!of!the! materials!in!the!discovery!are!public!records!that!are!also!available!independently.!!I!assume!the!Government!is!not! claiming!that!defense!counsel!cannot!give!their!clients!copies!of!materials!that!were!obtained!from!other!sources!in!the! public!domain!merely!because!the!Government!has!also!included!them!in!their!discovery!materials.! ! In!addition,!so!far!as!I!am!aware!none!of!the!discovery!materials!that!the!Government!has!disclosed!to!date!contained! information!that!any!documentation!of!threats!being!made!by!defendants!against!witnesses!since!the!return!of!the! indictment.!Please!correct!me!if!I!am!wrong.! ! As!you!are!aware!there!is!significant!public!support!that!has!been!on!display!since!the!indictment!that!remains!critical!of! the!prosecution!efforts!in!this!case.!I!assume!that!you!are!not!alluding!to!the!expressions!protected!under!the!First!
