Along with the background checks, we check against key Central Legislation pertaining to real estate as follows: Transfer of Property Act, 1882 ("TPA"): Deals with the transfer of immovable property by act of the parties. Registration Act, 1908 ("RA"): Deals with the registration of instruments relating to the transfer of an interest in immovable property. Indian Stamp Act: Deals with the amount of duty to be paid on the prescribed instruments including instruments transferring interest in any immovable property. Indian Easements Act, 1882: Deals with the easementary rights of parties, such as right to access etc. Indian Contract Act, 1872 ("ICA"): Deals with the contractual rights and obligations of the parties.
Included in the research and analysis are the local laws related to a selected concerned property, some of which are listed below: Title of the property: this is the most critical aspect, particularly since there are likely to be heir-based claims on the property. Legal due diligence: particularly from the perspective of the body that has jurisdiction over these properties (such as the Wakf Board) and ascertaining any historical disputes would be essential. These bodies will assist in clarifying the ownership of the property.
