WORK EMPLOMENT TYPES IN US


In US, there are following 2 types of employments: W2 Corp-to-Corp W2: In this type of employment. The person is on the payroll of the company I.e. regular full time permanent employee of the company. Following are the 2 types of W2 employment in US: W2 Salaried (with benefits). W2 Hourly (without Benefits) W2 SALARIED: In this type of employment, the person is no the payroll of the company and is also being paid on salaried basis. This is always with benefits like medical insurance, paid leaves, education reimbursement etc. For this type of employment the recruiter (we) should always ask for the salary expectation I terms of annual/monthly salary.

W2 HOURLY: In this type of employment, the person in on the payroll of the company but is being paid on hourly basis. This is without the benefits like medical insurance, paid leaves, education reimbursement Etc. however, employee can purchase two benefits like medical insurance and retirement benefits from the company. For this type of employment the recruiter (we) should always ask for the hourly rate expectation. POINTS TO REMEMBER Payments in US is on a bimonthly basis irrespective of the type of W2 employment. If the project duration is of 6 months or more. Then candidate can choose for any of the w2 types of employment , whereas of the project duration is less than 6 months, the candidate can work on only w2 hourly. W2 salaried is more beneficial for a company as the saving In more and the company had better hold over the candidate. Hence, we should suggest w2 salaried to the candidate. CORP TO CORP: Corp-to-Corp type of employment is also called a corporation to corporation or corporate to corporate type of employment where a legal contract is signed between two companies, before the candidate starts on a project. Following are the 2 types of Corp-to-Corp employment in US: Subcontracting. Incorporation. SUBCONTRACTING: In this type of employment, a legal contract is signed between 2 companies before the person starts on the project. Eg: IBM Artech XYZ Company INCORPORATION: In this type of employment, a legal contract is signed between 2 companies before the person starts on the project, but the company with which the contract is signed is a very small company named as XYZ Inc. Is also called 1099 in US. However, this term is technically incorrect. PAYROLL TAX:

Is a tax which is paid to IRS (income revenue services-a department of taxation in US) for all the employees who are on the w2 of the company. Tax rate is 12.3% of the salary paid to the employee. It is not deducted from the employees salary but is over and above the employees salary (unlike income tax which is deducted from the employees salary). ***************************************************************************************************

-For H1 employees we cannot do a w2 hourly salary less than $30 or per annum with benefits less than %45k. -With GC and citizens any amount of per annum / pr hr salary can be negotiated. -W2 salary makes sense only if project is for at least 6 months or more. Other Benefits 1 Green card (on w2- salary) -Artech shall bear the cost as long as you are able to add 30% to the per annum salary -RIR category FAST labor clearance 2. Per diem (on w2 hourly) -If relocating -If staying more than 55 miles away -Benefit is per diem amt is tax-free. -The state laws determine per diem component. 3. RATE SALARY MARGIN CALCULATION


Cost to company Candidates cost to Artech for w2 hourly = pay rate + 12.3% of pay rate. MSP has an agreement with the vendors that whenever a bill is sent to client (Eg: Hp), some percentage of it is to be paid to MSP (Eg: Chimes), called MSP Commission. Whenever MSP is involved, we need to calculate the New Bill Rate (NBR).

Eg: if MSP commission is 4%, then NBR = BR 4% of BR Few tips

Minimum net margin to be maintained: at least 25% if the bill rate please consult your team leader to get the exact figure as the same might vary. Before talking to a candidate for a position, calculate the maximum pay rate, which can be offered, to him by keeping our required margin. While calculating the margin do not miss the MSP commission (if applicable) Try to judge the candidates level (by his resume, his knowledge and professional experience) before offering him/her any rate/ salary,it would be helpful in maintaining a better margin. Try to avoid discussing about the margins with the candidate.

TYPES OF US VISAs
A visa is either a multicolored stamp or computerized document affixed to a page in the passport by a US consular office abroad. It allows international visitors to travel to the US as long as the visa has not expired. Two basic types of US visas: Immigration visas: for those intending to reside permanently in the united states. (Whether or not they intend to work) Nonimmigrant visas: visa for visiting United States temporarily. tourist or medical treatment, business purpose, students, participants in exchange programs, temporary workers, performing artists, professional journalists, and government representatives, etc. Following are the various categories of visas: Temporary workers visas. - H1B - H4 - L1 - L2

Student visas. - F1 - F2 Visitors visas. - B1 - B2 Student visas There are two nonimmigrant visa categories for persons wishing to there in the united states. The F1 visa for academic studies, and the M visa is for nonacademic or vocational studies. **F2: Dependent of F1. A spouse, and unmarried, minor children may also receive nonimmigrant visas to accompany or follow the student. **Students on F1 visa cant take a full time job in US but can work for part time for not more than 20 hours per week. Visitors visas Visitors visas are nonimmigrant visas, for persons desiring to enter the united states temporarily for business (B-1), or for pleasure/medical treatment (B-2). These visas are for a specifically limited period. **There is no fixed validity period for B1 visas. . Business Express Program: Companies with good reputation and good background become a part of the program and these companies can get the B1 visas within a shorter span of time. Eg: 2 weeks instead of one month.

H4 Visa This is a dependent visa (of H-1B), it can only be issued to a dependent of the person who is no working visa e.g. spouse, children etc. **This visa doesnt permit you to work anywhere in US. **If the dependent wants to work in US, he/she has to apply for new/fresh H1 visa and can work only after he/she gets the same.

H1-B Visa
Is a work permit visa of nonimmigrant classification used by a person who will be employed temporarily in US in a specialty occupation. **A specialty occupation requires theoretical and practical application of a body of specialized knowledge along with at least a bachelors degree or its equivalent. How long can a person be in H-1B status? Under current law, a person can be in H-1B status for a maximum period of six years (initially 3 years) at a time. After that time a person must remain outside the United States for one year before another H-1B petition can be approved. H1 visa transfer

A person working with a company in US on H1 visa can work for another company of the other company is ready to transfer his/her visa in their name. **The candidate can work with a new company the moment one applied for the H1 visa transfer. Process of getting H1-B visas: 1. Company (Eg: Artech) sends the documents of the candidate to US. 2. US agencies do Education Evaluation and provide a certificate/approval after the same. 3. Artech in US has to apply in the labor department. 4. The labor department issues a form called LCA (Labor Condition Application). 5. LCA (Labor Condition Application) is an application is an application filled by a company that wants to hire a foreign national to fill a position within the United States. This form must be filed by the company and approved by the department of labor before an H-1B visa petition may be filed with the INS. 6. INS stands for Immigration and naturalization services in US (it issues visas). 7. An application is submitted by the company and approved by the INS. 8. The application, which is submitted by the human resources administrator, includes a petition form, an endorsement letter from the institution, original documents indicating the visitors highest degree, curriculum vitae, and a filing fee payable to the institutions Immigration Attorney. (Since there are delays in processing these applications, allow at least three to four months before the individual intends to arrive in the United States). 9. When the petition has been approved, INS sends notice to go to US consulate or embassy. They issue an 1797 form (approval notice from US immigration office) after verification is done. 10. After all the above mentioned steps, the candidate needs to go to US consulate or embassy and submit all documents and fees to apply for the visa. Other Terms related to Work Employment TN visa is meant for Canadian citizens. OPT (Optional Practical Training)- is the opportunity to apply knowledge gained in classroom to a practical work experience off campus I.e. people doing some course and working as a part of that course. Eg: medical training EAD#(Employment Authorization Document Number) when we get EAD#, it signifies that the green card is about to come. EAD is a document (I-688,I-688A/B,I-766 or any other successor document issued by USCIS) that proves as evidence that the holder is authorized to work in US. US Citizen: is a person who is a permanent resident in US and has all the rights including the right to vote. Green card holder: A green card (GC) holder is a person who is a permanent resident of US and has all the rights except the right to vote. Company applies/sponsors for green card of the employee, but who has to pay the green card processing fee is to be negotiated between candidate and company during the interview. *************************************************************************************************** Regarding Compensation 1) What is your current CTC? Is there anything that would prevent you from relocating the assignment?
