Affidavit
I, Jose Tupas , Filipino citizen, of legal age, single/married to Antonia Tadique, and a resident
of 69 Paeng Ave., Jularbal City, NCR , after having been duly sworn in accordance with law,
hereby depose and say:
1. That I am the Register of Deeds of Makati City and have held the same position from
May 2, 1989 to the current date.
2. That as per records, Plaintiff Arthur Garcia is the registered owner of a parcel of land
located at 20 Rockwell Drive, Center Makati City, evidenced by TCT 11873645

3. That Plaintiff acquired the same by virtue of succession from his Father in 2001 who
passed away in that same year.
4. That on June 12, 2005, a gas leak razed a large part of the Register of Deeds to the
ground; however, documents consisting of TCTs and OCTs stored in a steel vault at
the back of the building remained unscathed.
5. That Plaintiffs TCTs were among those partially damaged but remained legible as to
provide convincing proof of ownership.
