RICO lawsuit pending before this Court, Plaintiff YANA HENRIKS, by and through \up0

claims she has asserted in several state court \up0 \expndtw-2\charscalex100
actions. Moving Party LOUISA MORITZ, an attorney, did nothing\u8212?and is alleged
to have done \up0 \expndtw-2\charscalex100 nothing\u8212?but represent some of the
parties to some of those actions for several months. Based solely \up0 \expndtw-
2\charscalex100 on actions taken in the context of the state court cases, the
litigious YANA HENRIKS has now \line \up0 \expndtw-2\charscalex100 attempted to
spin her previously-asserted state court claims into alleged violations of the
Racketeer \up0 \expndtw-2\charscalex100 Influenced Corrupt Organizations Act
(RICO), 18 U.S.C. 1961, et seq. Plaintiff\u8217?s RICO claim is \up0 \expndtw-
2\charscalex100 merely a regurgitation of the same allegations she has already
presented on several separate \line \up0 \expndtw-2\charscalex100
occasions.\ul0\super\cf11\f12\fs24 1\ul0\nosupersub\cf8\f9\fs24 The activity
plaintiff finds objectionable is defendant MORTIZ\u8217?s zealous\u8212?albeit
\line \up0 \expndtw-2\charscalex100 brief\u8212?representation of some of
HENRICK\u8217?s adversaries in state court actions seeking to control a \up0
\expndtw-2\charscalex100 family trust. The demonstrated lack of merit to
plaintiff\u8217?s allegations indicates that this suit has been \up0 \expndtw-
2\charscalex100 brought solely to quell defendant MORITZ\u8217?s exercise of her
constitutional rights to utilize the state \up0 \expndtw-2\charscalex100 court
legal system, to petition and speech, not to vindicate any valid claim.\par\pard\ql
\li20\ri559\sb1\sl-472\slmult0\fi719 \up0 \expndtw-2\charscalex100 Plaintiff\u8217?
s action is a SLAPP (Strategic Lawsuit Against Public Participation) aimed at
\up0 \expndtw-2\charscalex100 interfering with defendants\u8217? legitimate
exercise of their First Amendment and statutory rights. This \up0 \expndtw-
2\charscalex100 Court must follow the mandate of 42 U.S.C. 1988(a) and apply the
California anti-SLAPP statute \up0 \expndtw-2\charscalex100 (C.C.P. � 425.16) in
this action, to protect defendant\u8217?s fundamental constitutional rights of
petition \up0 \expndtw-2\charscalex100 and speech. F.R.C.P. 12(b)(6),
alternatively, would also mandate dismissal of this action.\par\pard\ql

below, SLAPP lawsuits frequently mask themselves as ordinary lawsuits. \line
\up0 \expndtw-2\charscalex100 Plaintiffs win political battles by dragging
defendants into court and enmeshing them in protracted \line \up0 \expndtw-
2\charscalex100 litigation. (See \ul0\nosupersub\cf9\f10\fs24 Wilcox v. Superior

Yana Henriks; Ms. Moritz never represented Ms. Henriks. Ms. Moritz briefly (from
approximately \up0 \expndtw-2\charscalex100 April, 2006 to September, 2006)
represented members of the Noval family, having ceased \line \up0 \expndtw-
2\charscalex100 representing anyone in the Noval family in September, 2006, when

complaint against Ms. Moritz, is the former live-in \line \up0 \expndtw-

client, Tania Noval. Ms. Henriks (also known \line \up0 \expndtw-2\charscalex100
as Gayane Khachatryan), on April 23, 2004, replaced Tania Noval as Trustee of one

(Brothers\u8217? Irrevocable Trust), and it was her role as Trustee that led to

Brothers\u8217? Irrevocable Trust. Tania Noval, therefore is the aunt of \up0
\expndtw-2\charscalex100 Victor Noval\u8217?s children, who, with her own son, are
the beneficiaries of the Brothers\u8217? Irrevocable \up0 \expndtw-2\charscalex100
Trust. In 2003, during illness of Tania Noval, and while Yana Henriks was
romantically involved \up0 \expndtw-2\charscalex100 with Victor Noval, Yana Henriks
assumed the role of Trustee of the Brothers\u8217? Irrevocable
Trust.\ul0\super\cf11\f12\fs24 4 \line \up0 \expndtw-2\charscalex100
\ul0\nosupersub\cf8\f9\fs24 The relationship between Victor Noval and Yana Henriks
later ended (bitterly), and the Noval family \up0 \expndtw-2\charscalex100 (Victor,
Tania, Tania\u8217?s son, and Victor\u8217?s children\u8212?the beneficiaries) have
sought to replace Ms. \line \up0 \expndtw-2\charscalex100 Henriks as the Trustee of
the family trust. Ms. Henriks has refused, rather engaging in litigation \line
\up0 \expndtw-3\charscalex100 against the Novals in several courts.\par\pard\ql

indicated above, Victor Noval is the brother of Tania Noval, the original Trustee
of the \up0 \expndtw-2\charscalex100 Brothers\u8217? Irrevocable Trust. He is also
the father of Victor Franco, Jon Hunter, Jake Harrison, and \up0 \expndtw-
2\charscalex100 Victor Peter Noval, beneficiaries of the Brothers\u8217?
Irrevocable Trust, and the uncle of Bijan\par\pard\qj \li20\ri872\sb1\sl-
472\slmult0 \up0 \expndtw-2\charscalex100 Nasehipour, the other beneficiary (and
Tania Noval\u8217?s son). Victor Noval was once romantically \up0 \expndtw-
2\charscalex100 involved with Yana Henriks. He was also, several years ago,
indicted and later incarcerated in \up0 \expndtw-2\charscalex100 connection with a
criminal matter concerning his business (unrelated to and long before
the\par\pard\ql \li20\ri472\sb4\sl-472\slmult0 \up0 \expndtw-2\charscalex100
representation by Ms. Moritz). When Mr. Noval was defending himself in the
criminal action, he \line \up0 \expndtw-2\charscalex100 had Ms. Henriks\u8212?then
his girlfriend\u8212?assume the role of Trustee of the Trust, of which his children
\line \up0 \expndtw-2\charscalex100 and nephew were beneficiaries. Mr.
Noval\u8217?s romantic relationship with Yana Henriks subsequently\par\pard\ql

severe rheumatoid arthritis and was be unable to take care of the Trust\u8217?s

and she assured me that she would be the person most \up0 \expndtw-2\charscalex100
qualified to be successor trustee during my illness. She informed me of her
educational background \up0 \expndtw-2\charscalex100 and her high position with her
employer, Met Life. As a girlfriend of my brother, she was also \up0 \expndtw-
2\charscalex100 believed to be the future stepmother to my nephews, which I stated

In effect, KHACHATRYAN acquired a multi-\par\pard\ql \li740\sb1\sl-275\slmult0 \up0
\expndtw-3\charscalex100 million dollar asset for $100.00.\par\pard\ql
\li1460\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100 \u8220?13. Attorney
PHILIP DAPEER explained to Cross-Complainant that the \u8220?
transfer\u8221?,\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-
2\charscalex100 which TANIA NOVAL did not sign, was solely to complete the
litigation, which was for the\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-
3\charscalex100 benefit of BLUE WATER SUNSET, L.L.C. and that Cross-Defendant
GAYANE\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100
KHACHATRYAN and himself were the persons best qualified to perform this legal

GAYANE KHACHATRYAN was in her own words \u8220?a great litigator\u8221? and she

immediately return the ownership of the properties involved to Cross-Complainant

The beneficiaries of BROTHERS IRREVOCABLE TRUST were the children of\par\pard\ql
\li740\sb1\sl-276\slmult0 \up0 \expndtw-3\charscalex100 TANIA NOVAL and her brother
VICTOR.\u8221? [Victor Noval cross-complaint, Exhibit E, �s\par\pard\ql

declaration filed in this action, Tania Noval stated, among other things that

\u8220?wasted and misappropriated valuable Trust assets.\u8221? [A copy \up0
\expndtw-2\charscalex100 of her Declaration is attached as Exhibit A.] To properly
understand the claims of the Noval family \up0 \expndtw-2\charscalex100 (advanced
through the representation of Ms. Moritz), the substantive assertions of Ms. Tania
Noval \up0 \expndtw-3\charscalex100 (in her May 10, 2006 declaration) are set forth

2\charscalex100 \u8220?2. My name is Tania Noval. I am the Settlor, Trustor and
original trustee to the\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-
2\charscalex100 Brothers Irrevocable Trust (hereafter the \u8220?Trust\u8221?).
This trust was set up for the benefit of my\par\pard\ql \li740\sb0\sl-
276\slmult0 \up0 \expndtw-2\charscalex100 son and nephews, who are the only
beneficiaries of the Trust. This declaration is submitted\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 in support of the Petition
to remove Yana Henriks as Trustee of the Trust, and for related\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-3\charscalex100 relief.\par\pard\ql
\li1460\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 \u8220?3. In late 2003, I
started to have severe rheumatoid arthritis and was unable to take\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 care of the Trust\u8217?s
business. I explained my problem to Yana Henriks, and she assured
me\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 that she
would be the person most qualified to be successor trustee during my illness.
She\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 informed me
of her educational background and her high position with her employer,
Met\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100 Life. As a
girlfriend of my brother, she was also believed to be the future stepmother to
my\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 nephews,
which I stated above, are the beneficiaries of the Trust. Given her
excellent\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100
personal history I believed that she indeed would be a trustworthy individual to
handle the\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-3\charscalex100
future well being of my son and nephews.\par\pard\ql \li1460\sb1\sl-275\slmult0
\up0 \expndtw-2\charscalex100 \u8220?4. I was wrong about Ms. Henriks. She is
claiming that Blue Water Sunset L.L.C. is\par\pard\ql \li740\sb1\sl-276\slmult0
\up0 \expndtw-2\charscalex100 her property. This is false. This L.L.C. was formed
for the benefit of the beneficiaries, and it\par\pard\ql \li1872\sb0\sl-115\slmult0

trust.\par\pard\ql \li1460\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 \u8220?
5. Yana Henriks has ignored numerous requests made by the beneficiaries
regarding\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100
accounting and the sale of a Mustang belonging to beneficiary Victor Franco
Noval.\par\pard\ql \li1460\sb0\sl-276\slmult0 \up0 \expndtw-2\charscalex100 \u8220?
6. Ms. Henriks has been asked (by me, as Settlor, and by all of the
beneficiaries,\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100
whose declarations are attached to this Petition) to step down and turn over her
position as\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100
Trustee. She has not only completely ignored this but also wrote a letter to my
attorney\par\pard\ql \li740\sb0\sl-276\slmult0 \up0 \expndtw-2\charscalex100 Louisa
Moritz (attached to the Petition) insulting her practice and making false
statements.\par\pard\ql \li1460\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100
\u8220?7. Henriks wrote letters to my brother telling him that his children
(beneficiaries)\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-3\charscalex100
don\u8217?t care about him and that they do not deserve anything.\par\pard\ql
\li1460\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 \u8220?8. Henriks is in
the bad habit of threatening people and is well known for\par\pard\ql
\li740\sb1\sl-276\slmult0 \up0 \expndtw-3\charscalex100 threatening attorneys with
reporting them to the bar.\par\pard\ql \li1460\sb1\sl-276\slmult0 \up0 \expndtw-
2\charscalex100 \u8220?9. I have personally heard a cassette tape where Henriks
threatens my brother. Yana\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-
2\charscalex100 Henriks has also called our friend Heather Mercado and threatened
her life.\par\pard\ql \li1460\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100
\u8220?10. Henriks falsely claims that my brother abused her. My brother was
married\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 twice
about 10 years each and has never abused mentally or physically his wives or
anyone\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-3\charscalex100
else.\par\pard\ql \li1460\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100 \u8220?
11. Henriks has sent me letters via fax insulting me and telling me to \u8220?
Fasten your\par\pard\ql \li740\sb0\sl-276\slmult0 \up0 \expndtw-3\charscalex100
seatbelt\u8221?.\par\pard\ql \li1460\sb1\sl-275\slmult0 \up0 \expndtw-
2\charscalex100 \u8220?12. Henriks wrote letters to my brother in which she says
she is an attorney. (See\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-
3\charscalex100 attached copy of envelope.)\par\pard\ql \li1460\sb1\sl-
276\slmult0 \up0 \expndtw-2\charscalex100 \u8220?13. My brother told me that,
after learning of Henriks\u8217? misdeeds, he decided not to\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 marry her. This resulted
in enormous animosity, causing significant harm to the Trust, me,\par\pard\ql
\li740\sb1\sl-276\slmult0 \up0 \expndtw-3\charscalex100 and the
beneficiaries.\par\pard\ql \li1460\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100
\u8220?14. My brother applied for a restraining order against Henriks. Upon being
notified\par\pard\ql \li740\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100 of the
order, Henriks immediately rushed to the court and sought a restraining order
against\par\pard\ql \li740\sb1\sl-275\slmult0 \up0 \expndtw-3\charscalex100 my
brother who is the father to four of the beneficiaries.\par\pard\ql \li1460\sb1\sl-
275\slmult0 \up0 \expndtw-2\charscalex100 \u8220?15. In addition to the foregoing,
I am aware of the following acts of Ms. Henriks, to\par\pard\ql \li740\sb1\sl-
276\slmult0 \up0 \expndtw-3\charscalex100 the detriment of the
Trust:\par\pard\ql \li2180\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 -- She
had not made any distributions to the beneficiaries, and has not\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-3\charscalex100 communicated with the
beneficiaries;\par\pard\ql \li2180\sb1\sl-275\slmult0 \up0 \expndtw-3\charscalex100
-- She has never provided an accounting relative to the Trust;\par\pard\ql
\li2180\sb1\sl-275\slmult0 \up0 \expndtw-3\charscalex100 -- She has wasted and
misappropriated valuable Trust assets;\par\pard\ql \li2180\sb1\sl-275\slmult0
\up0 \expndtw-2\charscalex100 -- She has initiated litigation against me, as well
as against the father of the\par\pard\ql \li740\sb2\sl-276\slmult0 \up0 \expndtw-

275\slmult0 \up0 \expndtw-2\charscalex100 -- She claims to have personally acquired

She has engaged in self-dealing, to the detriment of the Trust and

-- She has filed a restraining order application against the father of some of

2\charscalex100 At the hearing of May 19, 2006, an issue was whether the

value of certain property. The Trust was a party to that action, \up0 \expndtw-

trust had withdrawn because of a conflict of interest, related to the conflicting
claims \up0 \expndtw-2\charscalex100 concerning the trust of Yana Henriks and Tania
Noval). At that hearing, the Court said to Ms.\par\pard\ql \li20\ri440\sb1\sl-
472\slmult0 \up0 \expndtw-2\charscalex100 Henriks: \u8220?Ms. Hendriks
[\ul0\nosupersub\cf9\f10\fs24 sic\ul0\nosupersub\cf8\f9\fs24 ], we\u8217?re going
to have [\ul0\nosupersub\cf9\f10\fs24 sic\ul0\nosupersub\cf8\f9\fs24 ] direct you
to retain counsel. You can\u8217?t \up0 \expndtw-3\charscalex100 represent
yourself. You can\u8217?t appear pro se under the rules of the court.\u8221?

Ms. Moritz, upon the request of her client Tania Noval (who, as noted above,

Irrevocable Trust), also appeared at the Federal Court hearing to advise \up0
\expndtw-2\charscalex100 the Court of the position of the Trust (which, because of
the withdrawal of the Trust\u8217?s forfeiture\par\pard\ql \li20\ri426\sb1\sl-
472\slmult0 \up0 \expndtw-2\charscalex100 attorney, was unrepresented by
counsel).\ul0\super\cf11\f12\fs24 8\ul0\nosupersub\cf8\f9\fs24 Ms. Moritz
introduced herself as follows, according to the \up0 \expndtw-2\charscalex100
transcript: \u8220?Your honor, my [name] is Louisa Maritz
[\ul0\nosupersub\cf9\f10\fs24 sic\ul0\nosupersub\cf8\f9\fs24 ] and I am
representing the trustee of the \up0 \expndtw-3\charscalex100 brothers irrevocable
trust.\u8221? \up0 \expndtw-2\charscalex100 [page 12, lines 2-4.] She then advised
the Court of her role: \u8220?I am only\par\pard\qj \li20\ri395\sb0\sl-
474\slmult0 \up0 \expndtw-2\charscalex100 here to request a continuance because
there is a question about the brothers irrevocable trust and the \up0 \expndtw-
2\charscalex100 attorney has resigned and withdrawn and I understand that Your
Honor has allowed it and so they are \up0 \expndtw-4\charscalex100 without an
attorney.\u8221? [Exhibit H, page 12, lines 16-20.]\par\pard\qj

not make a misrepresentation to the Court as claimed by Ms. Henriks. In the

petition to remove Ms. Henriks. The transcript \up0 \expndtw-2\charscalex100
states: \u8220?Okay. Your Honor we do have an order\ul0\super\cf11\f12\fs24
9\ul0\nosupersub\cf8\f9\fs24 from the court and we have made\u8212?I am

\expndtw-2\charscalex100 actual trustee was unresolved, and pending in the state
court. Specifically, the Court responded: \line \up0 \expndtw-2\charscalex100

the issue as to the appropriate trustee has never again been raised in that court.

information\u8230? and she has completely ignored our request. We also \up0
\expndtw-3\charscalex100 asked her to remove herself as trustee and she has ignored

detrimental to all the beneficiaries well being. \up0 \expndtw-2\charscalex100 I
would like my mother, Tania Noval to resume her position as trustee.\u8221?

handwritten letter produced by Victor Noval, \up0 \expndtw-2\charscalex100
purporting to bear the signature of Yana Henriks. This letter concludes with a
statement that \u8220?I,\par\pard\ql \li20\ri402\sb1\sl-472\slmult0 \up0 \expndtw-
2\charscalex100 Yana Henriks, will transfer BWS [presumably Blue Water Sunset, an

Moritz\u8217?s client maintained. Ms. Henriks, in this litigation, \up0 \expndtw-
3\charscalex100 denied that this was her signature. [A copy of the disputed
letter is attached hereto as Exhibit J, and \up0 \expndtw-3\charscalex100 to
Plaintiff\u8217?s RICO Case Statement, Exhibit I, page 171.]\par\pard\ql

vehemently denies that she ever knowingly presented a forged or altered exhibit,

others have committed criminal and tortuous acts, the validity of the handwritten

documents, and I am therefore clearly convinced that in fact, Yana Hendricks is the
author of the \line \up0 \expndtw-3\charscalex100 signature on the questioned
handwritten letter.\u8221? [Exhibit K, � 6.] Dr. Alexander also declared:

signature on the questioned document shows the effects of medication \line \up0

She states that Moritz presented documents \u8220?to the Los Angeles Superior

2, line 27.] Elsewhere, she asserts that Moritz\u8217?s arguments were \line

TAILORED TO CURBING THEIR HARMFUL EFFECTS ON FIRST AMENDMENT \up0 \expndtw-
3\charscalex100 RIGHTS.\par\pard\qj \li20\ri462\sb0\sl-472\slmult0\fi719 \up0
\expndtw-2\charscalex100 \ul0\nosupersub\cf8\f9\fs24 SLAPPs are lawsuits aimed at
silencing a plaintiff\u8217?s opponents. The purpose of a SLAPP is \up0 \expndtw-
2\charscalex100 not to win, but to intimidate the SLAPP defendant and to chill
petition and/or free speech rights. The \up0 \expndtw-2\charscalex100 court in
\ul0\nosupersub\cf9\f10\fs24 Wilcox v. Superior Court\ul0\nosupersub\cf8\f9\fs24 ,
27 Cal.App.4th 809, 816, 33 Cal.Rptr.2d 446 (1994), explained \up0 \expndtw-
3\charscalex100 the characteristics of SLAPP suits as follows:\par\pard\ql
\li740\sb98\sl-276\slmult0 \up0 \expndtw-2\charscalex100 SLAPP suits are brought to
obtain an economic advantage over the defendant, not to\par\pard\ql \li740\sb0\sl-
276\slmult0 \up0 \expndtw-2\charscalex100 vindicate a legally cognizable right of
the plaintiff. Indeed, one of the common characteristics\par\pard\ql \li740\sb1\sl-
276\slmult0 \up0 \expndtw-2\charscalex100 of a SLAPP suit is its lack of merit. But
lack of merit is not of concern to the plaintiff\par\pard\ql \li740\sb0\sl-
276\slmult0 \up0 \expndtw-2\charscalex100 because the plaintiff does not expect to
succeed in the lawsuit; only to tie up the defendants\u8217?\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 resources for a sufficient
length of time to accomplish plaintiff\u8217?s underlying objective. As\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-2\charscalex100 long as the defendant is
forced to devote its time, energy and financial resources to\par\pard\ql
\li740\sb1\sl-276\slmult0 \up0 \expndtw-2\charscalex100 combating the lawsuit, its
ability to combat the plaintiff in the political arena is substantially\par\pard\ql
\li740\sb1\sl-275\slmult0 \up0 \expndtw-3\charscalex100 diminished. [Citations
omitted]\par\pard\qj \li20\ri413\sb124\sl-472\slmult0\fi719 \up0 \expndtw-
2\charscalex100 Thus, while SLAPP suits \u8220?masquerade as ordinary
lawsuits,\u8221? the conceptual features which \up0 \expndtw-2\charscalex100 reveal
them as SLAPPs are that they are generally meritless suits brought by large private
interests to \up0 \expndtw-2\charscalex100 deter common citizens from exercising
their political or legal rights or to punish them for doing so. \up0 \expndtw-
3\charscalex100 [Citations omitted]\par\pard\qj \li20\ri705\sb1\sl-
472\slmult0\fi719 \up0 \expndtw-2\charscalex100 Therefore, since plaintiffs who
bring SLAPPs can \u8220?win\u8221? simply by dragging victims into \up0 \expndtw-
2\charscalex100 court and draining their (and the courts\u8217?) resources, these
suits must be identified and dismissed at \up0 \expndtw-3\charscalex100 the
earliest possible moment.\par\pard\qj \li20\ri417\sb0\sl-474\slmult0\fi719 \up0

to strike are ineffective in dealing with SLAPPs because a \up0 \expndtw-
2\charscalex100 plaintiff may satisfy basic pleading requirements by making
constitutionally protected behavior\par\pard\ql \li20\ri487\sb1\sl-472\slmult0 \up0
\expndtw-2\charscalex100 appear as defamation, interference with business
relations, or restraint of trade. Therefore, the \up0 \expndtw-2\charscalex100
Legislature provided that in the special anti-SLAPP motion to strike, the court is

and filings, and even communications between counsel that is related to the
litigation, even if the \up0 \expndtw-2\charscalex100 communications do not address

supra.]\ul0\nosupersub\cf3\f4\fs24 \ul0\nosupersub\cf8\f9\fs24 In this case,
Henriks cannot overcome the defendant\u8217?s litigation \up0 \expndtw-
3\charscalex100 privilege defense, and\ul0\nosupersub\cf3\f4\fs24
\ul0\nosupersub\cf8\f9\fs24 thus will be unable to establish that she is likely to
prevail on her claim. The \up0 \expndtw-3\charscalex100 filings
she\ul0\nosupersub\cf3\f4\fs24 \ul0\nosupersub\cf8\f9\fs24 alleges were
actionable were allegedly made by Defendant Moritz in connection with \up0
\expndtw-3\charscalex100 pending litigation, and were all subject to the litigation
privilege. Henriks will\ul0\nosupersub\cf3\f4\fs24 \ul0\nosupersub\cf8\f9\fs24
be unable to \line \up0 \expndtw-2\charscalex100 establish any probability of
prevailing on the merits of her RICO action against Moritz, since the \up0
\expndtw-2\charscalex100 litigation privilege will completely bar her action as it
is based entirely on filings and arguments in \up0 \expndtw-3\charscalex100
litigation in which Henriks was involved.\par\pard\qj \li20\ri1038\sb0\sl-
552\slmult0\fi719 \up0 \expndtw-2\charscalex100 In sum, plaintiff cannot show a
probability of success on her claims because she has no \up0 \expndtw-
2\charscalex100 admissible evidence of anything other than lawful petitioning
activity, protected by the First \up0 \expndtw-3\charscalex100 Amendment and
statutory privileges.\par\pard\ql \li380\sb242\sl-276\slmult0 \up0
\expndtw0\charscalex100 \ul0\nosupersub\cf4\f5\fs24 V.\ul0\nosupersub\cf10\f11\fs24
\ul0\nosupersub\cf4\f5\fs24 CONCLUSION\par\pard\ql \li20\ri390\sb30\sl-

Both prongs of the Anti-SLAPP Statute analysis are satisfied here. Under the Anti-
SLAPP \line \up0 \expndtw-2\charscalex100 statute, this Court should strike the
plaintiff\u8217?s claim. The plaintiff\u8217?s claim arises from the exercise of
\line \up0 \expndtw-2\charscalex100 Defendant Moritz\u8217?s right to petition and
free expression, putting it well within the statutory \line \up0 \expndtw-
2\charscalex100 definition. In addition, plaintiff cannot establish a likelihood
of prevailing on the merits of her claim, \line \up0 \expndtw-2\charscalex100
because the defendant may employ the complete defense of the litigation privilege
of \ul0\nosupersub\cf9\f10\fs24 Civil Code \line \up0 \expndtw-2\charscalex100
\ul0\nosupersub\cf8\f9\fs24 section 47. Given that the alleged conduct is
constitutionally protected, and any claim based upon \line \up0 \expndtw-
2\charscalex100 the alleged conduct will be barred by the litigation privilege,
both prongs of the Anti-SLAPP \line \up0 \expndtw-2\charscalex100 analysis are
satisfied. This Defendant therefore respectfully requests this Court to strike the
\line \up0 \expndtw-2\charscalex100 plaintiff\u8217?s claim that is based upon
constitutionally protected and privileged conduct, in its entirety. \line\tab
