BALLOT TITLE AND SUMMARY ORDINANCE CREATING THE MILPITAS COMMERCIAL SPECIFIC PLAN AREA “This proposed ordinance arvends the Milpitas Zoning Code by creating the Milpitas Commercial Specific Plan Area in an approximately 14.56-acre site located near the ‘comer of North McCarthy Boulevard and Ranch Drive in Milpitas, California, “The stated purpose of the Milpitas Commercial Specific Plan is to assist in the development of site for the benefit of local shoppers, the general public, and the City of Milpitas, The Specific Plan sets forth development standards, conditions and ‘guitement for te constuction of new structures and uses and the movification of ‘Suoting ones in tbe Milpitas Commercial Specife Plan Area. The ongoing operation and fDaintenance of existing uses or structures would not be affected, “The standards, conditions and requirements in the Milpitas Commercial Specific Plan are Yaied. The Milpitas Commercial Specific Plan provides development standards such 25 Jaximum floor area ratios, general building design concepts and limitations, and requirements for alcoholic beverage sales, food preparation and sales, landscaping, parking, on-site creulation, signage, noise, lighting, and site infrastructure, Under the Milpitas Commercial Specific Plan, development within the specific plan area that is consistent with the listed development standards, conditions and requirements ‘would be processed through building permit and/or construction plan review and would Mocrequire any additonal approvals or permits. Such review shall be non-disretionary, final actions that cannot be appealed. ‘Development that is not consistent withthe Specific Plan's development standards would ‘her require a substantial conformance determination or an approval under the provisions and requements of the Milpitas Zoning Code for development inthe C2 Gone. In the event of « substantial conformance determination, such decisions would be Aaade administratively by the Planning Director or designee without a public hearing. “The Milpitas Commercial Specific Plan also states that it provides environmental performance standards to ensure that development proceeds with appropriate peironmental sensitivity. The Specific Plan states that such environmental performance ‘Standards were developed from eavironmental studies previously conducted for a ‘proposed expansion ofan exiting retail fciity in the Milpitas Commercial Specific Plan Aiea, The covironmental stdies related to such things as aesthetics, light and glare, heath risks, air quality, biological reources, geology, soils, publi services and wilites, and urban decay. INITIATIVE MEASURE TO BE SUBMITTED DIRECTLY TO VOTERS To the City Council ofthe City of Milpitas: We the undersigned, registered, qualified voters of Milpitas, California, hereby propose amendments to the Municipal Code and adoption of a specific plan concering a proposed commercial development in Milpitas. and petition the City Council to submit the same to the voters of Milpitas for their adoption or reection atthe next succeeding municipal eletion, or special election for which this measure may qualify, or adopt the measure without alteration, as provided for in the Elections Code. ‘THE PEOPLE OF THE CITY OF MILPITAS DO ORDAIN AS FOLLOWS: SECTION 1. FINDINGS AND DECLARATION OF PURPOSE Lf A. The people of Milpitas want expanded retail shopping opportunites developed on the [property atthe northernmost southeast comer of North McCarthy Boulevard and Ranch Drive. BB. The proposed project will provide many new jobs in the community, broaden the City’s sales tax base, and provide new and modern retail shopping options forthe citizens ~ of Milpitas. CC. The people of Milpitas want this expanded retail shopping center, the new jobs created, and the other public benefits associated with the project as quickly as possible. 1D. However, any development of the property must also be consistent with the City's General Pan, must pay for adequate infrastracture and public amenities, and mitigate ‘against anticipated environmental impacts [E, The City prepared an Envizonmental impact Report in accordance with the California Environmental Quality Act that analyzed the potential environmental impacts of sn ‘expansion of the exiting retail facility onthe property. F. Therefore, the people of the City of Milpitas hereby propose this Initiative Measure to: 1) Enact a Specific Plan that is consistent with and in furtherance ofthe existing General Plan ofthe City; and 2) Require any amendment of this Initiative Measure to be approved by the ‘voters except to further the purposes ofthis Initiative Measure SECTION 2, ADOPTION OF SPECIFIC PLAN A. Singletary aidences are loesied east of £880 and are protected by a sud wal long the 880 fale. 2 PURPOSE OF THE SPECIFIC PLAN A specific plan is a combination policy statement and implementation tol that can be used to address the unique needs of a particular area of a city or county. As a result, emphasis is on ‘concrete standards and development criteria for use in the submission and review of subsequent ‘development plans and permits. The California Government Code permits the use of specific plans to regulate site development, including permitted uses such as density, building size, and placement. Specific plans also govern the landscaping and roedways, as weil asthe provision of infrastructure and uilities. Since the development guidelines established ina specific plan focus con the unique needs of a specific area, specific plans allow for greater flexibility than is possible with conventional zoning, “The purpose ofthe Milpitas Commercial Specific Plan i to assist i the development of the site i manner that will benefit local shoppers, the genera public, and the City of Milpitas. The Specific Plan accomplishes these purposes by providing for the efficient use of land, ensuring compatibility between existing and proposed land uses, and establishing environmental and development standards and procedures to be met in development of the Specific Plan area. The customized development regulations contained in the Specific Plan address the unique charecteriatcs of the site and surrounding properties, as wel a the needs ofthe commercial land ‘ses proposed forthe ste. These efforts ae intended to foster greater economic development ‘nd design opportunities than could be achieved through the use of conventional zoning and evelopment standards. ‘As used herein, the term “developer” shall mean the fe tite holder of the Milpitas Commercial Specific Plan area. 3. PROJECT OBJECTIVES ‘The objectives of the Milpitas Commercial Specific Plan are as follows: + Promote economic growth and development thet is consistent withthe policies ofthe City of Milpitas General Plan. + Provide development that maximizes the Specific Plan area's use potential in a manner ‘consistent withthe City of Milpitas General Plan + Ensure development within the Specific Plan area complies with appropriate conditions ‘and environmental mitigations for the benefit ofthe City, its residents and taxpayers. Page 1-2 ‘= Generate sales tax and propesty tax revenues to accrue to the various agencies within the ‘Specific Plan area, ‘+ Enhance the commercial ceil opportunities inthe City of Milpitas and surrounding. ‘+ Create additional employment opportunities for local area residents. + Expand and upgrade an existing retail facility to provide the City of Milpitas and surrounding communities with a modem and energy efficient facility that provides daytime and nighttime shopping opportunities ina safe and secure environment. ‘= Minimize travel lengths and utilize existing infrastructure to the maximum extent possible J by expanding and revitalizing an existing retail store. 4 AUTHORITY ‘The Milpitas Commercial Specific Plan has been prepared in accordance with Government Code Sections 65450 et seq. and 66450 seq. and will constitute the zoning forthe Specific Plan ares. [Land use standards and regulations contained within this document shall govern future development within the Boundaries of this Specific Pan. ‘The Milpitas Commercial Specific Plan provides a framework for development of the Specific Plan area. The Specific Plan provides guidance for th review of specific development proposals and isthe City’s reference document for determining permitted uses, intensity of use, and ‘development standards and requirements. The Specific Plan defines objectives, as wel as regulations and requirements for development ofthe Milpitas Commercial Specific Pan are. 5. GENERAL REQUIREMENTS General Plan Consistency Implementation of the Milpitas Commercial Specific Plan is intended to carry out the goals and Policies contained inthe City of Mupitas General Plan, at amended, in an orderly and attrective fashion, Development within the Milpitas Commercial Specific Plan area shall, therefore, be consistent withthe provisions of the City of Milpitas General Plan ‘The Milpitas Commercial Specific Plan implements the General Plan by: ‘Encouraging development within the incorporated limit ofl in the urban fabric rather ‘thin providing cosy expansion of urban services into outlying areas. ‘+ Encouraging economic pursuits to suengihen and promote development: provide {conotnic opportunites for all Milpitas residents within exiting environmental, social, fiscal, and land se constrains; and maintain a balanced economic base that can resist downturns in any one economic sector. ‘+ Providing opportunites to expand employment, participate in partnerships with local business to facilitate communication, and promote business retention, ‘+ Fostering community pride and growth through beautification of existing and fare evelopment, ‘© Utilizing the City’s adopted Level of Service standards in evaluating development proposals and capital improvements. ‘+ Paying its share of siret and other traffic improvements based on its impacts. + Promoting measures thet increase transit use, walking, and bicycling and that lead to improved utilization of the existing transportation system. # Providing adequate circulation and off-street parking and loading facilites for trucks and esrictng trucks to designated truck routes. Minimizing unnecessary, annoying, or injurious noise. Furthering the Land Use Guiding Principles by promoting a compact urban form and encouraging focused growth through infill opportunities in the incorporated City limits rather than in outlying areas. Improving the viability of transit, pedestrian and bicycle systems by promoting measures ‘that increases use of those systems. ‘Maintaining the architectural and landscape elements that contribute tothe identity and history of the City by requiring new developments to be harmooious with older structures. Ensuring the conservation, development and use of natural resources by providing "smart ‘grow1h” through infill development and promoting conservation and efficiency in energy ‘and water use and reducing waste generation through increased recycling and less waste production. Relationship Between Specific Plan Development Standards/Criteria and the City of Milpitas Municipal Code ‘The provisions ofthe Milpitas Commercial Specific Plan shall govern all development on the lands within the Specific Plan area. Any regulations or requirements not specifically covered herein shall be subject tothe regulations and requirement ofthe Cty of Milpitas Municipal Code, design guidelines and engineering standards and other applicable reguations, in addition tall appicable local, state and federal ordinances, laws or regulations, Any operations on the ‘Specific Plan area shalt also be required to operate in accordance with all local, state and federal {egulations. If any provision of this document conflicts with the regulations or requirements of the City of Milpitas Municipal Code, the provisions of this document shall gover. “The process for approving development under the Milpitas Commercial Specific Plan shall be set forth in Section 11.07). Page 14 & Conformance with Uniform Building and Fire Codes All construction within the Milpitas Commercial Specific Plan shall be in compliance with Title “Building Regulations" and Title V-300 “Fire Code" ofthe Milpitas Municipal Code. 4, Provision of lafrastructure Unless otherwise specifically approved as part ofthis Specific Pian ali off-site improvements under the control ofthe City shall be subject to the City of Milpitas regulations and requirements ineffect atthe time improvement plans are submited. Other improvements not under the control of the City (eg. electricity, natural gas, telephone) shall be subject tothe regulations and reqyfterents ofthe responsible agency. Specific requirements for infrastructure improvements are set forth in Table 11.07-6, To ensure the cost-effective availablity of curent and adequate infrastructure and services during the development of the Specific Plan area, infrastructure plans may be modified upon approval of the City of Milpitas Chief Building Official, which pursuaot to Section 11.07 shall be ‘ministerial final and not subject 10 appeal and without the need to amend this Specific Plan. Severability {f any tem, provision, condition, requirement, ot portion thereof of this Specific Plan is for any reason held invalid unenforceabie, or unconstitutional, the remainder of this Specific Plan or the application of such tem, provision, condition, requirement, or portion thereof to circumstances ‘other than those in which iti held to be invalid, unenforceable, or unconstitutional, sball not be affeced thereby; and each other term, provision, condition, requirement, or portion thereof shall bbe held valid and enforceable tothe fullest extent permited by law. Conte ‘The developer shall pay the costs of any code enforcement activities, including attorney's fees, resulting in the violation of any provisions of the Milpitas Municipal Code, ineuding the Milpitas Commercial Specific Plan. ‘The developer shall be responsible forthe entie cost to implement the environmental performance standards in accordance with Section 11.07(F) ofthis Specific Plan. & Consent to Hold Harmless ‘The developer shall as a requirement of any development within the Milpitas Commercial Specific Plan area, agree to indemnify, protect, defend (with counsel selected by the City) and hold harmless the City, and any agency or instrumentality thereof, and any officers, officials, employees, or ageots thereof, from any and all claims, actions, suit, proceedings, or judgments against the City or any agency or instrumentality thereof, and any officers, officials, employees, of agents thereof to attack, set aside, void or annul, any acti by the City, or any agency or instrumentality thereof, advisory agency, appeal board, or legislative body related to, in furtherance ofthis Specific Plan. Furthermore, developer shall indemnify, protect, defend (with counsel selected by the City), and ‘hold haraless the City, and any agency or instrumentality thereof, against any and all claims, actions. suits, proceedings, or judgments against any governmental entity in which developer is ‘subject to that other govertunental entity's approval and a condition of such approval is that city indemnify and defend such governmental entity. IMPLEMENTATION All other ordinances, rules and regulations tha constitute legislative acts shall be amended as ‘necessary to accommodate the implementation of he Specific Plan in accordance with this Initiative Measure. ‘The City Council, the Cty Planning Agency, the Planning Commission, the Director of Planning and Redevelopment, and other City officials and employees so designated herein and in the (City's Municipal Code ae further hereby authorized and directed to make such discretionary approvals and in accordance with the policies, direction and ustrative examples set forth in the Specific Plan, and such discretionary authority shall be retained and exercised by the City in ‘accordance with thi Initiative Measure and the Specific Plan.
