PONESSA, 15, of 26 Knoth Road South, Wallkill, and a 13 year old Juvenile for burglary related charges following an investigation into a break-in at a deli on Wallkill Avenue in the Town of Shawangunk, Beginning at approximately 5:00 AM on 01/08/11 deputies and detectives responded to the deli fora reported burglary. Subsequent investigation yielded evidence and information identifying ‘Mr Ponessa and the juvenile as the suspects. Both were charged with the felonies of Burglary in the 3" Degree, and the misdemeanors of Criminal Mischief in the 4" Degree and Petit parceny. Mr. Ponessa was additionally charged with the felony of Conspiracy in the 4" Degree for being over 18 years old and agreeing to commit a felony (burglary) with a person under 16 The juvenile was additionally charged with the misdemeanor of Conspiracy in the 5! Degree, as he is alleged to have agreed with another person to commit felony (age differences Notwithstanding).
