AFFIDAVIT OF TIM Ri On this day, Tim Reeves appeared before me, the undersigned notary public, and after 1 administered an oath to him, upon his oath, he said: 1, My name is Tim Reeves. I am over the age of 18, I have never been convicted of a felony or any crime involving moral turpitude, | am not otherwise disqualified by law fiom making this Affidavit, and I have personal knowledge of the facts stated herein and swear that such facts are true and correct, Iam employed by The Election Group LLC (“Election Group”) as its Vice President and my personal knowledge of the facts stated herein was acquired through my employment with Election Group. 1am furnishing this Affidavit in connection with the Petition tor Writ of Mandamus filed herewith in the Fifth District Court of Appeals ~ Dallas, Texas. 3. Sometime shortly after May 20, 2010, Election Group was hired by counsel for Relator Marcus Wood to facilitate a name-by-name audit of the signatures appearing on a petition to legalize the sale of beer and wine for off-premise consumption in the City of Dallas. 1 ‘was principally involved in, and oversaw, the audit performed by Election Group. Approximately 108,837 signatures were reviewed and verified by Election Group. ‘The audit took three and a half weeks to complete, Election Group’s audit disclosed that the petition was at least 5,555 signatures short of the required number of signatures and that another 7,987 signatures should be statutorily-disqualified because of missing or incomplete voter information and illegibility. In sum, based on Election Group’s audit, we determined there were an insufficient number of valid signatures appearing on the face of the petition to warrant certification by the City Secretary for the City of Dallas.
