The Department of Land Management worked with the Office of the Attorney
General to correct recording errors with regard to the properties relating to the
Redemptoris Mater Seminary in Yona.
On March 15, 2016, the Department of Land Management and the legal counsel for
the Archbishop of Agana concluded the cancellation of the four respective
certificates of title issued on October 30, 2015, and issued four certificates of title to
include Instrument No. 829322, Declaration of Deed Restriction, in favor of the
entities identified in the deed.
This process was conducted in accordance with the direction provided by the Office
of the Attorney General in response to the Department of Land Managements
request for guidance on the matter.
I understand that the property owner is willing to present the owners duplicate
certificates for each of the effected lots to the Department of Land Management for
the issue of a new Certificate of Title with the correct memorial, Assistant Attorney
General Kristan Finney wrote to Land Management.
The presentation of the owners duplicates would bring this matter within the
Departments authority to issue a new certificate as provided by 21 GCA subsection
29160, and no additional action would be necessary.
The Department of Land Management is the recorder for a variety of documents
related to land properties, from ownership documents to encumbrances. Every
recorded document, including certificates of titles, are public documents available
for public review.
Director Mike Borja said the agency always strives to ensure the land recordation
process is maintained with the highest integrity.
