Re: Proposed Compliance Agreement between York Haven Power Company, LLC and Londonderry Township
Dear Board of Supervisors,
We are writing on behalf of the newly formed Lake Frederick Home Owners Association (the "Association"). The
Association is comprised of a majority of the Lake Frederick Lot Licensees and Property Owners, who are deeply concerned
about the proposed Compliance Agreement between the Township and York Haven Power Company. Members of the
Association first learned that there was a proposed Agreement late last week and only had the opportunity to review for
the first time a draft of the Agreement when it was posted on the Township's website late last Friday afternoon. Upon
initial review of the proposed Agreement, it is clear that the persons who will be directly harmed if the Township enters
into the Agreement with the Power Company are the homeowners on Shelly and Beshore Islands, and others, many of
whom have had their homes on the Islands for generations.
The proposed Agreement is complex and the Members of the Association have not had a reasonable opportunity to
review the Agreement, or have it reviewed by legal counsel, to fully determine the impact on them and any rights they may
have. Members of the Association were not asked, and did not participate in any of the discussions between the Township
and the Power Company about the proposed Agreement.
Under the proposed Agreement, the Island homeowners would be required to vacate their lots and demolish their
homes, at the homeowners' expense, no later than November, 2017. Were this to happen, not only would the Island
homeowners suffer harm and substantial financial losses, they would also lose the close, family oriented community that
has developed on the Islands over decades. Members of the Association are also tax payers in Londonderry Township, as
well as the Lower Dauphin School District. If they are required to vacate their properties, the Township and the School
District will lose much needed tax revenues. There are also several local businesses and families that rely upon the residents
of the Islands for their livelihood who will be hurt.
If the Supervisors are planning on voting on the proposed Agreement at tonight's Board meeting, we respectfully request
that the Supervisors delay or table any vote to afford the Members of the Association time to thoroughly review and
understand the implications for them if the Township intends to proceed with the Agreement.
