Thank you for your November 25, 2015 letter concerning assignments of deeds of
trusts. In your letter, you request an opinion about which defects in an assignment
might trigger a Deed of Trust Act violation. As you know, the Attorney General
cannot provide legal advice to municipal governments or issue Attorney General
Opinions at the request of city officials. As a result, I cannot provide you with the
legal determination you are requesting. Your questions are best directed to the City
Attorney.
I do, however, share your concern about Washington homeowners. Employing
targeted enforcement actions against servicers and trustees, and facilitating
homeowners' access to support services and accurate information, have been and
continue to be an effective use of the resources of the Attorney General's Office in
preventing avoidable foreclosures in Washington. Our work in this area is ongoing
and active.
