INTERPLEADER SUITS

The meaning of the term inter pleader suit is a suit in which


the real dispute is between the defendants only and the
defendants interplead
The defendant interplead means the defendant pleads with each
other rather than pleading against the plaintiff as in an ordinary
suit.
ACCORDING TO SECTION 88
If two or more persons claim a particular ;
A) Debt
B) Sum of money
C) Movable property
D) Immovable property belonging to them and the 3rd person
does not claim any interest in the property except for the charge
or cost and is ready to pay or deliver it to the rightful claimant,
Then such 3rd person may institute an inter pleader suit against
all the claimant
Such suit can be instituted for the purpose of
A) Obtaining the decision as the person to whom the payment or
delivery of the property shall be made
B) Obtaining indemnity for himself
CONDITION:
a) There must be a dispute respect of any debt, sum of money or
other property either movable or immovable
b) There must be a adverse claim of 2 or more person against
each other
c) The person from whom debt, sum of money or other property
either movable or immovable must not have any kind interest
d) No suit must be pending wherein the rights of all the claimants
can be properly determined
