Monroviaiberia is known for politicians who show high level of


inconsistency, forming one political party and pushing
its platform at one time and quickly deflecting when the
party becomes unpopular with the Liberian people.
When it was the Grand True Whig Party, Liberian politicians
joined the longest ruling single party with no other political party
nearing the strength of the TWP. Later, the variable changed to
the National Democratic Party (NDPL) when former President
Samuel K. Doe was in power, the NDPL was the only vibrant
political party but again these same group of politicians who were
members of the NDPL quickly ran to the National Patriotic Party
of Liberia when it was Charles Taylors term.
By 2005, when President Ellen Johnson Sirleaf won the first post
war democratic election, the Unity Party was seen as the best with
the most comprehensive platform to solve the over one hundred
years problems facing Liberia.
Before the 2011 elections, the number of politicians that joined
the Unity Party increased to the extent of forming merger with
two other political parties the Liberia Action Party (LAP) and the
Liberia Unification Party (LUP).
The numerous politicians that crossed over the UP helped the
party to perform better than it did in the previous election,
defeating the opposition Congress for Democratic Change (CDC)
in the first round of polling before going on to win a boycotted
runoff.
After ten years in power with critics saying the Unity Party has
failed to deliver on major campaign promises including fighting
corruption, restoring a vibrant health sector, ensuring quality
education, providing electricity and other essential necessities
and improving basic infrastructure, some individuals making up
the same breed of politicians have now turned against the ruling
party and are forming new political allies.
The ruling Unity Party continues to see resignations with two
senior and influential party officials deflecting in a space of three
days.
TYLERS RAID?

Speaker Alex J. Tyler resigned from the party late last week with
reasons for his resignation yet to be made public but another
lawmaker Moses Y. Kollie of Lofa County followed the footstep of
the Speaker Monday but instead making his letter public.
Kollie is a key ally of Speaker Tyler as he was appointed by the
Speaker to serve the lucrative position of Ways, Means and
Finance of the House of Representatives recently during a
leadership reshuffle at the Legislature. The committee oversees
the allotments of money to various functionaries of government.
The Lofa lawmaker who is serving a second six years after winning
the first term in 2005 and again getting re-elected in 2011 is citing
lack of consultation for his decision to leave the ruling party.

In his letter of resignation dated Monday, October 12, lawmaker


Kollie cited the lack of consultation and collaboration within the
party.
I have come to realize that there exists a complete lack of
consultation and coordination on the part of the National
Leadership of the Unity party. Though so many concerns have
been raised by partisans of the Unity Party over a long period
of time since 2012, ranging from a complete total disregard to
the intent of the merger and continual violations of the partys
By-laws and constitution without any regard for partisans of the
Unity Party which have continued stated lawmaker Kollie.
PARTY LACKS FOCUS

Lawmaker Kollie claimed in his letter that the unresolved issues


in the Unity Party show that the party lacks focus and disregard
for its members.
It shows that the party lacks focus, considering the unresolved
lapses on the part of the National Leadership and observing
that there are no attempts to address the issue of concerns as
mentioned supra, appears to me that there is total disregard
for partisans and National Executive Committee members,
Representative Kollie continued in his letter of resignation.
The lawmaker who became a member of the Unity Party following
a merger between the ruling party and two other political parties
declared that he could not continue to be a member of the Unity
Party without forming part of the decision making body.
Stated the lawmaker Therefore, as a National Executive
Committee member of the Unity Party coming from one of the
three (3) merged constituent political parties (the Liberia Action
Party), I cannot and will not continue to be only a due paying
member without me being a part of the decision making of the
institution, As such, this communication constitutes my official
resignation from the unity Party.
The resignations of both Speaker Tyler and Representative Kollie
brings to four the number of lawmakers that have left the ruling
party.
In September, Senator Oscar Cooper of Margibi County slammed
what he termed the division within the party, describing the party
as supporting legislations and policies that are not in the interest
of the Liberian people.
Senator Cooper declared in the letter of resignation that the Unity
Party has on numerous occasions failed to protect the interest of
its partisans.
Stated Senator Cooper The leadership of the Unity Party has,
on occasions too numerous to list here, failed to further the
interest of the party specifically and its supporters generally. A
most blatant example of this would be recently when the party
leadership openly and actively campaigned for a member of
an opposition party to become President Pro tempore of the
Liberian Senate instead of supporting one of its own. We also

back an independent Senator in 2012 for President Pro-Tempore.


Senator Cooper claimed that the ruling party was engaging in
perpetuation of ignorance.
The preservation of power through the perpetuation of ignorance
cannot be and will not be allowed to prevail; I was elected and took
an oath to serve my people. That service requires my constant
interaction with an enlightened and informed public; I strongly
abhor efforts by colleagues and fellow partisans to muzzle my
attempts to accomplish my mandate - Senator Oscar Cooper,
Margibi County.
Before Senator Cooper, Representative Wesseh Blamo another
unity Party lawmaker resigned from the party citing poor
relationship between the party and its standard bearer, President
Sirleaf.
Representative Blamo before his resignation was a major
ally of President Sirleaf serving as Chairman of the House of
Representatives Standing on Executive where he served as a
direct contact person between the House of Representatives and
the Executive Mansion.
Other party officials including Emmanuel Nuquay of Margibi
County have been visible in their relationship with other political
parties.
Representative Nuquay is a founding member of the People
Unification Party (PUP) one of the newest political parties to hit
the political landscape has not hidden his affiliation with the PUP.
UNITY PARTY TILL DEATH

President Sirleaf will not be eligible in 2017 and in the wake of all
the movements and resignations from the Unity Party one man
who has a lot at stake is Vice President Joseph Boakai, who is
likely to serve as the standard bearer of the party in 2017.
Vice President Boakai told FrontPageAfrica in a recent interview
that he has been helping to quell tension in the party mainly
differences between President Sirleaf and party Chairman,
Senator Varney Sherman.
Now, with the party fast disintegrating and news that the Vice
President Boakai is seeking options to contest on another party
other than the Unity Party, he told FrontPageAfrica Monday that
he will remain in the Unity Party until death.
I dont know where that rumor is coming from but I remain a
Partisan of the Unity Party until death. I have no plan to go to
other political institution, said Vice President Boakai.
With political season fast approaching and the Unity Party going
down the drain, as senior party officials continue to deflect,
political observers believe the party is suffering the old trend of
betrayal politics where politicians deflect after helping a party to
fail its promises to the Liberian people.
The upcoming years will prove a defining moment for the ruling
party as it pushes to maintain hold on power in the wake of the
resignations rocking the party.

Abuse, Neglect & Trafficking
THE UNITED NATIONS GENERAL ASSEMBLY on December 19,
2011 adopted Resolution 66/170, declaring October 11 each year
as the International Day of the Girl Child, to recognize girls rights
and the unique challenges girls face around the world.
IN LIBERIA LAST WEEK, a highlighted incident suggest that the
post-war nation is still lagging behind when it comes to putting
in place the right mechanisms to curb violent trends and issues of
neglect toward girls.
A SIXTEEN YEAR-OLD school girl was allegedly raped in a house in
the Old Road Community, which neighbors say belongs to Nigerian
businessman, Austin Okafor, head of the International Insurance
Company.
FRONTPAGEAFRICA REPORTED last Friday that a medical report
from Hope for Women Clinic on AB Tolbert Road in Paynesville
showed that the child was tempered with. The girl was on her
way from school on last Monday when she encountered the
driver. The young girl, in a hurry to get home and complete her
days assignment and seeing other school children in the vehicle,
said she had no fear that something terrible would happen to her.
Interestingly, the taxicab, was marked Dwadifo Adanfo, with tinted
glasses and windshields.
DWADIFO ADANFO is a Ghanaian microfinance company that is
involved with loaning cars and other businesses. Their vehicles are
brand new and in good working conditions, thereby enabling the
taxi driver, only identified so far as Prince, to lock the young girl in
the vehicle when all the other school kids had been dropped off.
THE SUSPECT denied the young girls request to open the car door
so that she could leave. Instead, he turned around from the front
seat, pretended that he was opening the door for her but he did
not. Instead he covered her face with a white handkerchief before
she knew it she was tied to a bed in one room in Dr. Okafors
compound, with her legs and hands apart and he was wearing his
clothes, according to Comfort David, the girls mother. She was so
weak when he dropped her off. She could hardly walk. She called
her sister to go and get her. They called me and said there was a
family emergency. Only to go see my baby couldnt even walk.
LIKE MOST CASES of such nature in Liberia these days, authorities
appear either ill-prepared or unwilling to deal with the issue and
continue to drag their feet when those responsible should be
brought to justice for inflicting life-long pain to our young girls.
SEXUAL VIOLENCE WAS widespread during Liberias long years
of war. Sex was used as a weapon to create fear in both civilian
population and enemies. By the time the war ended 75% of women
had experience some kind of sexual abuse, according to the United
Nations. Doctors Without Borders (DWB) reported in 2011 that
92% of females treated for rape in its Liberia facilities were under
18. A DWB study published in November said that of about 1,500
females treated in Monrovia clinics in 2008 and 2009 after rape,
four out of 10 were younger than 12. One in 10 was younger than
5. Half of the survivors were children aged 13 years or younger
and included infants and toddlers, according to the report.
IRONICALLLY, THIS years theme is The Power of the Adolescent
Girl: Vision for 2030. But as every incident, like the one involving
this little girl unfolds, it becomes increasingly clear that achieving
this 2030 goal may be impossible.
ACCORDING TO THE UNITED NATIONS, Adolescent girls have the
right to a safe, educated, and healthy life, not only during these
critical formative years, but also as they mature into women.
IN LIBERIA, girls have experienced numerous difficulties and
are up against a system that has so far failed to give them the
protection they need from sexual predators, thereby denying them
the opportunity of fulfilling their potential to change the world
both as the empowered girls of today and as tomorrows workers,
mothers, entrepreneurs, mentors, household heads, and political
leaders.
THE UNITED NATIONS has called on Member States, civil society
organizations, and private sector stakeholders, to commit to
putting adolescent girls at the centre of sustainable development
efforts by invest in high quality education, skills, training, access
to technology and other learning initiatives that prepare girls
for life, jobs, and leadership; investing in health and nutrition
suitable to the adolescent years, including puberty education,
menstrual hygiene management, and sexual and reproductive
health education and services; Promoting zero tolerance against
physical, mental, and sexual violence; Enacting and consistently
implementing social, economic, and policy mechanisms to combat
early marriage and female genital mutilation;
Investing in the creation and maintenance of social and public
spaces for civic and political engagement, creativity and talent
enhancement and promoting gender-responsive legislation and
policies across all areas especially for adolescent girls who are
disabled, vulnerable and marginalized, and victims of trafficking
and sexual exploitation.

history, Karl Marx unequivocally intimated in many of his
brilliant and imposing writings that deception and betrayal
are the worst crimes in the game of politics.
Marx asserted that the survivability of any political institution is
squarely guaranteed by the courageous and unwavering loyalty of its
leaders and membership, and not the stature and prominence of its
officials. The expository writer stated that the greatness of any political
institution is the strength it possessesand that strength rests on the
valor, commitment, courage, will rectitude and unrelenting defiance of its
general membership.
This means people must firstly obtain membership in political institutions
because they believe in its ideas and philosophy, for Marx argues that
when people are converted on the basis of believabilitythey are bound
to be committed, loyal and uncompromising to the growth and survival of
their political institutions.
I too, shear this thought, but here in Liberia it appears that most people
join these institutions with the view of what they can benefit from them
and not what they can give back which is why previous ruling political
parties are today submerged in utter ruins. Considering the mass exodus
or if you may, resignations of ranking members from the Unity Party, the
Party could follow similar path if the few standing committed leaders do
not put their long running bickering and clashes behind them now and act
appropriately and expeditiously.
Most revered African freedom Fighter, Comrade Nelson Mandela of the
vanguard revolutionary African National Congress (ANC) wrote from his
Soweto Prison Cell to the world, the ANC is even strengthened by the
unwarranted, devilish and unlawful imprisonment of its leaders but most
of all, the loyalty of the South African people to this party and our struggle
to end the scourge of racial discrimination and tyranny on black South
Africans remained incredibly defiant and heroicso no matter how long,
the ANC will win and the South African people will prevail.
Comrade Mandela, the indomitable, fearless, selfless and unyielding
freedom fighter was quite correct as the ANC won and remains Africas
most powerful political institution even in the absence of its founding
fathers simply because the members commit their lives to the survival of
the ANC. It is loyalty that makes the ANC great and heroic, not self-seeking
exploratory membership as we see around here with political parties and
their individual membership.
Here in Liberia, the case is a stark reverseconsidering the unfortunate
story of most of our political parties especially those that were opportune
to grab state power to include; the century old Grand True Whig Party,
National Democratic Party of Liberia (NPFL) and the all-powerful National
Patriotic Party (NPP) and now the ruling Unity Party that is badly plagued
by internal wrangling but worse of all, experiencing a dramatic exodus of
most of its ranking members.
To date, Senator Oscar Cooper, Rep. Wisseh Blamo, Rep. Moses Kollie,
Rep. Emmanuel Nuquay, Speaker Alex Tyler all of whom acquired these
enviable and lucrative positions on the back of the Unity Party they
contested these positions on the tickets of the UP but have betrayed the
confidence of the partytendering in their resignations with rather
feeble and bizarre justifications for their departure.
A political Science professor told me recently the UP must brace for the
worseas more and more resignations will come in the next few days,
adding, these deflectors have to clear the way to seek membership in
newly established political parties. How do we then build our fledgling
democracy amid weakening political institutions?
There are others who maintain membership in the party but have shifted
support and loyalty to other political partiesall in the name of politically
repositioning themselves as the UP popularity diminishes with the
Liberian people. These people include Rep. Boima Fanbulleh, Rep. Edwin
Snowe, Rep. Bill Tweahway Businessman Musa Bility including many
others who have not gone public yet.
I am not shocked by these accounts simply because they represent the
true character of the regular Liberian politicians most of whom lack the
intestinal fortitude and rectitude to face the tough challenges that come
with the existence of political institutions, and to add, mere gravy-seekers
who careless about the survival of the party and care more about what
they can generate on the backs of the parties.
Many of them are rather accustomed to leaching on political parties
and later matriculate to another political party in search of political
convenience and cushioning. This is why political parties in past and now
have failed to grow and glow. Ranking members are not committed to the
going concern of their institutions but rather concerned about what they
can benefit from the party as in the case of these deflected officials of the
Unity Party.
Most of them accused President Ellen Johnson Sirleaf of destabilizing the
Unity Party and not working in concert with the party as in the words of

community to realizing the potential of adolescent girls will directly


translate into the girls as powerful and positive change agents for
their own empowerment, for advancing gender equality and for the
sustainable advancement of their nations.
LIBERIA CAN take a big step toward fulfilling its part of the bargain
by ensuring that predators against young girls are prosecuted
swiftly, that our girls are protected against trafficking, that our girls
can begin to feel safe going and returning from school and that the
justice system is swift in disseminating justice and careful in how
it allows those who abuse our young girls to escape the claws of
justice.
WE MUST not allow a failed justice system to tarnish the memories
of several young girls whose lives were snatched away before their
reached the age of adolescence. Girls like young rape survivor Olivia
Zinnah who later died in December 2012 after suffering years of
pain and surgeries following a rape.

Senator Cooper and Rep. Wisseh Blamo, but I disagree on account that the
President wrongs as claimed by these men must not in any way warrant
leaders of the Party to deflect and seek membership in other political
parties.
As a matter of fact, President Sirleaf is one person and not the Unity Party
and the upholding of the values of the UP do not only rest with her in spite
of the fact that she is the Standard Bearer. I also believe that President
Sirleaf is not above the laws of the Party; hence, if she faltered as these
men claimed, why didnt the party take disciplinary actions against her.
In other countries or domiciles, when the Standard Bearer violates the
standing principles of the party, they dismember him/her or take other
tougher punitive actions. But the remedy will not and must not be mass
departure from the party as we are seeing now. The action and inaction of
Tyler and others is reprehensible, disingenuous, counterproductive and
deceitful.
It is my belief that these people sought membership in the UP on account
of the party values and philosophy and not on account of Johnson Sirleaf
membershipespecially these ranking officials I chronicled above. If
this is the case, why dismember yourself from the party on account of
Sirleafs poor conduct? I think you should rather disagree with Sirleaf,
leave her to public judgment and remain loyal to the UP.
There were infightings in the ANC but the party never disintegrated and
the members remain loyal to date. The ZANU P.F. of Zimbabwe remains
one of the greatest political institutions on the face of Africa because its
officials remain committed despite myriad of political differences with
President Robert Mugabe over the years.
I like to admonish fellow Liberians to shine their eyes on these shameless
political deflectors and political gate-crashers. Dont allow them to
infiltrate your party with the influence of their stolen dollars for they
only want to use your party as a platform to reposition themselves on the
political stage as the country fast ushers into the much heralded 2017
elections.
They will leash on your party and later drop you on the way side like they
have treated the ruling UP. These political bamboozlers have no desire
whatsoever to build any institution for the long haulthey are rather
concerned about salvaging their selfish political interest at the expense
of these new parties they are co-establishing. I must be at the table of
negotiation comes 2017, thats the major concern for them.
Holding their lazy argument against President Sirleaf constant, I challenge
them to tell the Liberian people what they have done individually and
collectively to stabilize and unite the UP amid all the internal squabbles
dogging the institution.
If these folks are truly men of good will and substance they would rather be
the ones holding the UP together considering that they have the economic
power and the political influence to do so but they have sadly chosen to
deflect from the institution on whose back they rose to prominence. Is this
not a mark of sheer disloyalty and laziness?
Perhaps President Sirleaf has found out that these folks are mere political
hustlers and jokers this is why she doesnt listen to them and accord
them any respect in the conduct of the affairs of the State. In fact, Speaker
Tyler and some of the Representatives mentioned in this piece also do
not represent the values and ideas of the Unity Party judging from their
despicable and greedy conduct in the legislaturethis is why the House of
Representative has fallen unpopular with the Liberian people under the
watch of Tyler. Liberians no longer show any respect for their lawmakers
because they are frustrated about the appalling manner these Lawmakers
are conducting the affairs of the Stateeverybody concerned about how
they can grease their pockets while the Liberian people endlessly struggle
with unbearable economic conditions.
I recall one of them decried the Sirleafs for denying him the opportunity
of owning a jet he would have benefitted from a Russian oil Company
and shamelessly told the Liberian people that the President and her Son
Robert Sirleaf left him under their palaver-hut and held discussions with
an Executive of this oil company in the house of the Presidentclaiming
he brought the investor in the county. So for them, it is about what I can
grab for me and my family while the Liberian people go to Hell or rot in
abject poverty.
When a political leader presents himself in such disdainful, greedy,
shameful and demeaning manner, the President and her family will
certainly look down on you and issue you disrespect and that was exactly
what they did to the lawmakerand quite frankly, the lawmaker brought
on himself such brazen disgrace.
Finally, I entreat fellow citizens to shine their eyes and fiercely resist these
spineless, greedy and unprincipled political migrants who are exiting
the UP in search of new political sanctuary, hope and opportunities, for
they do not mean well for the political and democratic governance of our
country. Let their conduct over the years be the judge. A hint to the wise
is quite enough!

Just last year, a 12-year-old girl was raped by an intoxicated man in


the Brewervillle community. He, like many others, had done similar
acts during the civil war as a rebel for one of the warring factions.
THE GIRL, like many before her, was denied admission to two
nearby health centers because she was bleeding profusely and local
staff feared she had Ebola. Her family then tried to drive her to
the capital to JFK Memorial Hospital, but was stopped at a police
checkpoint because it was after curfew. They were detained for
several hours. The child died there, roadside, in a red pickup truck.
ALL THIS IN A NATION which not so long ago celebrated the election
of its first female head of state, a nation, which more than a century
ago, celebrated becoming the first independent African nation and
a nation which so much promise but very little to show in terms
of protecting the rights of women, particularly our young women
who remain vulnerable to hardships and neglect in a recurring
nightmare of repeated sexual attacks.

Here is why we have the current situation in Liberia. When the 5th
President of the United States James Monroe saw repatriating the
former slaves to Africa as a way to end slave trade in the U.S. and to
avoid an uprising in the U.S.
Several of the colonies joined together to form the Commonwealth of
Liberia in 1838 and Liberia declared its independence in 1847. The
name Liberia originated from the word Liberty or freedom, and the
capital city of Monrovia was named for President Monroe. This new
country was created with the objective of providing freedom, prosperity
and justice for all. Because of this objective, the wording on the official
seal of Liberia is The Love of Liberty Brought Us Here. It is now 168
years, but the vast population of Liberia has not experienced true
freedom because the appropriate mechanisms for creating awareness
empowerment structures for equal opportunities for all Liberians
have not been put in place. The founding of Liberia was meant to end
enslavement and was intended to appease the segment of Africans who
were victims of the slave trade. The second aspect was the creation of a
new country based on rule of laws and strong institutions but Liberian
leaders main concerns for the 168 years have been personal gains
for themselves, families and friends. Personalizing the resources of
the country when one is the position of power and control is the only

article did not say at which functions did the former Nigerian Minister
represented the President while the Foreign Minister was present .
Was this a world Bank function , United Nations functions ? If so , at

President , but was then co-chaired or represented by the former
Nigerian Minister while the Foreign Minister of Liberia was present ?
The author did not say whether the Nigerian Minister was still active
in her government or not . But one thing that is clear , is that the
President of Liberian belongs to so many organizations which she also
chaired with a co-chairperson or persons . And should the President be
unabled as in this case , her co-chairperson can represent her . The is
not like government to government signing agreements or one that is
representing the country Liberia . The author speaks of representing
the President Sirleaf at some unknown functions , but not in the
capacity of representing the Republic of Liberia at some functions .
The President just received an award , but anyone could represent the
President to receive that award on behalf of the President while the
Foreign Minister of Liberia is present . Especially , if it is coming from

preparing to leave a local
hospital in Monrovia where
she had been treated for stroke.
Comfort David struggles to

as she is finding it difficult
to believe that the Liberia
National Police has decided to
set free a man whose taxi cab
was used by a friend to commit
the alleged act.
Comfort sixteen year old
daughter while leaving school
last week was taken into a taxi
cab but later found herself in
a compound where she was
sexually abused as proven by
medical report from the Hope
for Women Clinic on A. B.
Tolbert Road which indicated
that the child was sexually
abused.
Before one of her daughters
was allegedly raped by a
Nigerian taxi driver life was
okay with her. And she could
walk without the help of family
and friends. Today she is barely
able to talk.
The doctors told us it will
take time before she is able
to overcome the shock. She
just could not believe that the
only person who was held
responsible for the rape of her
little daughter is now free. She
fell off as soon as the police

CRIME NOT TRANSFERABLE

According to the Police Henry

How can the police claim that
Okafor had been cooperating
with them? It was at his house
that the crime took place. It
was his car that was used to

sexual violence especially
rape is one that the women of
Liberia are yet to put up a good
fight to win.
Rape was a hallmark of the
more than a decade long

civil war in Liberia. The war


ended in 2003 with the exile
of President Charles Taylor,
who was convicted of war
crimes in Sierra Leone by the
International Criminal Court in
The Hague. Rape was a weapon
used to infuse terror and
humiliate whole communities.
It was also used to break the
spirit of boy soldiers who
were sometimes forced to rape
their own mothers, sisters and
grandmothers as part of their
initiation. According to the
United Nations more than 65
per cent of women in Liberia
had experience some form of
rape.
One of President Sirleafs first
pledges in 2006 when she took
office was to do something
about the scourge of rape
which had traumatized many
in her homeland. But ten years
on, rape continues to be rife.
According to the report The
Fallout of Rape as a Weapon
of War, rape remains a major
problem, and has left many
women with lasting physical,
psychological, economic and
social problems, including
HIV infections, post-traumatic
stress disorder and depression.

Serving as a keynote speaker at
the occasion which was held at
the Paynesville Town Hall, Ms.
Juah urged the godfathers to
focus on how they can explore
the minds of young girls by

Trevor Cockings. Three of the
containers contain seventeen
thousand, ten cases of
couscous.
The other three containers,

of tuna fish. The shipment
is valued at more than four
hundred thousand United
States dollars.
The donation to the schools
by VP Boakai is to help feed

around the country.

and teach them to dream and
believe in the power of their
dream, she said.
She also advised girls to be
willing to go extra miles in
acquiring education, and they

should try to be themselves


rather than someone else.
Patrice Juah said it is important
that the government works in
collaboration with parents to
stop those harmful traditional
practices which hinder girls
development by the day.
Anything that has to do with
educationI like and I will
continue to support. When
we are call to speak on these
kinds of occasions, we are not
just speaking for ourselves but
we are representing the dream
of thousands of young girls
around the globe, said Juah.
Juah said the international and
local themes illustrate that

the potential in the girl child


can only be develop through
quality education.
Providing statistical report,
Juah said, globally 30 percent
of girls are enrolled in school,
62 million adolescent are out
of school globally, and half of
that population is girls. One
in seven girls in developing
countries is married before age
15, she said.
She narrated that over the last
decade, more efforts have been
made globally and nationally
to create opportunity for girls
to access quality education.

first lady Michelle Obama

launched Lets Girls Learn


to further amplify the issue of
quality education for girls. In
addition, Liberia launched its
girls education policy in 2006
in which it called upon all of its
partners to work collectively
in achieving quality primary
education and have also
established a division of
adolescent girls at the Ministry
of Gender such efforts must me
applauded, she said.
Juah said despite of all
the initiative above, socioeconomic
and
political
barriers continue to jeopardize
the health of girls, including
sexual exploitation and abuse,
harmful cultural practices
gender inequality , teenage
pregnancy, financial constraint,
early marriage, peer pressure
and the lack of mentors to
motivate girls stay in school.

Minister of Gender Children,
and Social Protection, Julia
Duncan-Cassell
said
on
October 11 2011, a day was
set aside by United Nations
in recognition of the rights
and challenges face by girls
globally.
She said on this day, activist
groups come together under
the same goal to highlight and

cheap, accessible and affordable
electricity for all Liberians
has been a welcomed by many
Liberians but what remains as
doubt in the minds of many is
whether the money will be fairly
applied for the betterment of all.
Liberians,
especially
most
of those below the poverty
ladder, continue to have doubt
about their public
officials
on
how billions through
donations, loans and grants
received by Liberia from
friendly governments have been
misapplied by those entrusted
with the authority to do so,
as evidenced by the Japanese
grants.
Despite the good news the
Millennium Compact Challenge
bringing over US$257m to
Liberia, certain segments of
the agreement signed between
Liberia and the US government
suggest that the money, to
some extent, shows that the
benefactor, the United States
of America, intends to control
the government during the five
years period of implementation
of the grant.
Article five of section 5.7 of the
MCC agreement on termination
of the agreement quotes that
MCC may terminate the
agreement in whole or in part,
without cause by giving the
Government thirty (30) days
written notice.
The agreement also states that

the MCC may immediately


terminate the agreement, in
whole or in part, by written
notice to MCA-Liberia and the
Government, if MCC determines
that any event that would be
a crisis for termination or
suspension of the compact or
MCC funding under section
5.1 (b) of the compact has
occurred.
Unless terminated earlier
in
accordance
with
the
terms hereof, the Agreement
will cease to be in force
simultaneously
with
the
expiration of termination of the
compact; however, that if MCC
determines, consistent with
section 4.2(b) or (c).

on Ways, Means, Finance and
Development
Planning
on

public hearing to review the
terms and conditions of the
multi-million dollar agreement
between the Government of
Liberia and the United States
Government which was signed
on the 2nd of October in the
United States.
The Joint Committee will
evaluate the Act to Establish the
Millennium Challenge Account.
The Millennium Challenge
Compact Account is expected
to manage the administrative,
technical
and
financial
operations of the agreement
between the two countries.
Liberia qualified for eligibility
for the Compact after it
improved performance on its
scorecard in 2015.

Thus, the diversity visa
program has become the
primary vehicle for the
increased outflow of skilled
Africans to the United States.
A businessman, Isaac Peters
said, people are coming in their
numbers to his caf to play DV,
adding that at this time of the
year, the internet business is
profitable.
I make three to four thousand
Liberian dollars a day since
this DV started. The amount
paid to play DV is not much,
and why should people be
complaining on paying 200LD
for something that will change
their lives, Peters said.
Peters boasted that more than
fifteen persons have won the
DV lottery at his center adding
that it has made a lot of people
to rush to his center hoping to
win.

a student, Shaka Sherriff is


helping his colleagues with no
cost attached to play the DV.
Sherriff said his decision to
offer free service to play the DV
is meant to ease the difficulties
many students face financially.
Sherriff added that the DV is an
opportunity for every Liberian.
He added that it is important
for the University students to
take advantage of the process.
This [DV] is an opportunity for
every Liberian so that they can
find a mean to go to America,
Sherriff said.
Some of my colleagues do not
have money, so I have decided
to help them free.
Im doing it free to help my
colleagues, I encourage other
students to play DV to improve
their life, if you there and
improve your life you can come
back home, Sherriff added.

Francis Ndama said the lottery
is life transformational.

are here in Liberia and we are
seeing no improvement in our
lives,
Many people like Ndama hold
the same beliefs that by going
to America it is the end of their
suffering.
I believe that when I go to
America my life will improve
and my family life will improve.
I see this DV as an opportunity
to take me out of poverty,
so many people want to go
America it is not just Liberia.
America is a great country,
when I go there, poverty will
be far from me. I appreciate
my brother, I pray he continues
with the process, said Ndama.

considered a blessing from
God and is viewed as the end to
ones suffering.

While the trans-Atlantic slave


trade brought large numbers
of Africans to the United States
as forced migrants from the
16th to the 19th centuries,
significant voluntary migration
from Africa to the United States
did not begin in earnest until
the 1980s.
According to US Census
Bureau's From 1980 to 2009,
the African born population in
United States grew from just
under 200,000 to almost 1.5
million.
In 2009, almost two-thirds of
African immigrants were from
Eastern and Western Africa,
but no individually reported
country accounted for more
than 14.1 percent of the foreign
born from the Africa region.
African immigrants who gained
lawful permanent residence in
2010 were also diverse, with
48 percent having done so
through family relationships,
24 percent through the
diversity visa program, 22
percent as refugees and
asylum seekers, 5 percent
through employment, and the
rest through other means.
Compared to the foreign born
overall, African immigrants
reported higher levels of
English
proficiency
and
educational attainment in
2009, and were more likely
to be of working age and to
participate in the labor force.
Yet African immigrants were
also more likely to be recent
arrivals to the United States
and to live in households with
an annual income below the
poverty line. Overall, striking
differences are evident across
African origin countries, with
some refugee-origin countries
appearing as outliers in
certain measures of immigrant
integration.
The Diversity Visa is not the
only means Africans are using
to leave Africa in search of
Greener pastures.
Millions of people are also
on the move across Africa,
escaping
poverty
and
persecution.
The worlds attention is
focused on the hundreds of
thousands of refugees and
economic migrants arriving on
Europes shores. But that is just
a snapshot of a global crisis,
says Amnesty Internationals
Gauri van Gulik.
Europe is facing a crisis of how

its responding to refugees. Its


not facing a refugee crisis," she
said. "Globally there are 19.5
million refugees right now.
With so many people on the
move, the search for a solution
should focus on the source
of upheaval whether its
conflicts in the Middle East
or poverty and persecution in
Africa, says Michele Bombassei,
West Africa specialist at the
International Organization for
Migration.
What's happening right now
in the Mediterranean is just the
last step of a long, long process
that, in many cases started
here in West Africa," he said.
In very specific areas, the
presence of large, large
numbers
of
migrants,
sometimes
undocumented,
is a concern for many
governments,
especially
with the risk of infiltration of
terrorists or armed groups of
different kinds, said IOM's
Michele Bombassei.
European and African leaders
are due to attend a summit in
November aimed at dealing
with the migrant crisis.
Experts say any solution must
address the lack of economic
opportunities in many parts of
sub-Saharan Africa.
Greece and Italy, have also
served as the main points
of entry for migrants and
refugees due to their proximity
to the Mediterranean Basin.
Shifting migratory patterns
over the past year have
also exposed countries like
Hungary, situated on the EU's
eastern border, to a sharp
uptick in irregular migration.
The number of illegal bordercrossing detections in the EU
started to surge in 2011, as
thousands of Tunisians started
to arrive at the Italian island
of Lampedusa following the
onset of the Arab Spring. SubSaharan Africans who had
previously migrated to Libya
followed in 20112012, fleeing
unrest in the post-Qaddafi era.
The most recent surge in
detections along the EU's
maritime borders has been
attributed to the growing
numbers of Syrian, Afghan,
and Eritrean migrants and
refugees.
The IOM estimates that more
than 464,000 migrants have
crossed into Europe by sea for
the first nine months of 2015.

It is my pleasure as always, to welcome you to the opening ceremony of the Supreme Court.
After a short period of rest, we are happy to be back to sit, hear and decide cases in the
second term of this Court for this year. I welcome back to Liberia, those of my Colleagues who
travelled out of the country for their vacation.
We cannot stop thanking God for the many blessings He has continued to shower on us as
a people and as a nation. In times of challenges, trials and tribulations, He has firmly stood
by us, providing the strength and courage to see us through. We at the Supreme Court are
particularly grateful for His gift of wisdom in handling all cases that come before us, especially
cases of high profile nature with serious national and international implications. It behooves
us to show Him our gratitude by always striving to do His will.
I regret to inform you, at this time, that between the time we last met for the opening of the
March Term and now, we lost, at the cruel hands of death, a rather large number of judicial
workers. Twenty-five of our co-workers departed for the next world. Amongst them were
a serving circuit judge and a retired circuit judge. As far as I can recall, this is the largest

based on our recommendation the President of Liberia nominated Counsellor Yamie Quiqui
Gbeisay and Attorney Joseph S. Fayiah to the Liberian Senate to serve as Relieving Judge and
Judge of Criminal Court E respectively. They were confirmed by the Senate, appointed by
the President and subsequently commissioned by me on behalf of the President. Counsellor

Gbeisay comes to the post with a wealth of experience, having practiced for many years before
the lower courts and this Court. As for Attorney Fayiah, I consider him a success story in the
Judiciary. He joined the Judiciary as a Justice of the Peace. He was later appointed as Associate
Magistrate and then as Stipendiary Magistrate. While serving as Stipendiary Magistrate, he
enrolled at the University of Liberia and graduated with a first degree which propelled him to
matriculate at the Louis Arthur Grimes School of Law from whence he also graduated. He is a
classic example of a focused and determined person who desired to climb from pit to top. We
welcome Judge Gbeisay and Judge Fayiah into the ranks and files of the Judiciary.
On July 22, 2015, the court complex in Greenville, Sinoe County was dedicated by the President
of Liberia. The program formed part of the activities of the Independence Day Celebration in
that County. The complex houses the Third Judicial Circuit Court, the Debt Court, Revenue
Court, Traffic Court, and the Magistrate Court of Greenville, Sinoe County, with offices for key
judicial actors.
Three days thereafter, the Twelfth Judicial Circuit in Barclayville, Grand Kru County was also
dedicated. But unlike the court in Sinoe County, the one in Grand Kru only houses the Twelfth
Judicial Circuit and does not have rooms for
other courts and offices for judicial actors. As such, it is not a judicial complex. In accordance
with the current plan of the Judiciary, every judicial circuit should have a court complex that
houses all courts located in the capital of every county in the Republic. The plan includes the
construction of a fence around the complex and the construction of a living quarters for the
resident and assigned circuit judges. The scope and size of each facility depends on the case
load of the particular judicial circuit.
Ambitious, yes, but we have determined that this is the right thing to do. The benefits of
a judicial complex are enormous. In a judicial complex, the staff of the Judiciary and other
stakeholders work in an improved environment with better facilities; the availability of
many courts and offices in a single structure at a central location makes it easy for party
litigants to go to the court of their choice; and while in such close proximity, judicial actors
can better and more effectively coordinate activities for the speedy disposition of cases.
Perhaps most importantly, a judicial complex romotes judicial independence and minimizes
the embarrassments which the courts have on numerous occasions been subjected to by
local government officials. It is now time that the Judiciary, an independent branch of the
Government, be housed in its own facilities throughout the country. As I speak, many of
our courts, including circuit courts, are still operating from administrative buildings owned
either by the Executive Government, or from properties owned by private individuals who
are potential litigants before the courts. This practice has the propensity to compromise the
independence of the Judiciary in many respects.
So, we will construct an annex to the Grand Kru Court to house the remaining courts in
Barclayville and provide other facilities appropriate therein, so that Grand Kru County too
will have the full benefit of a judicial complex as we already have in some counties and as we
intend to have in the other counties.
The construction of the judicial complex in Tubmanburg, Bomi County is proceeding according
to plan, while the contract for the judicial complex in Nimba County has been concluded.
Construction work will commence as soon as the ground breaking ceremony takes place.
Under the bilateral agreement between the Peoples Republic of China and Liberia, three
personnel of the Judiciary were recipients of scholarship. They are: George D. Johnson,
Patience Dolo and Octavious Klah. They are currently in the Peoples Republic of China for
graduate studies in information technology and networking, public finance and financial
management respectively. We thank the Chinese Government for this goodwill gesture aimed
at empowering the Judiciary workforce.
The Swedish Government, through the Justice and Security Trust Fund, has provided funds
for the construction of four magistrate courts in the Omega Community, Montserrado County;
Botota, Kokoyah area, Bong County; Vahun, Lofa County; and Karnplay, Nimba County.
The estimated cost of the project is US$612,388.90. We express gratitude to the Swedish
Government through, the Justice and Security Trust Fund for this generous assistance. This
will go a long way in providing access to justice to a large segment of our population.
The United Nations Development Program (UNDP) has made contribution to the Judiciary of
assorted items, they are: wooden shelves, book shelves, thermometers, clorox, manual type
writers & ribbons, a canon copier, desktop computers & printers and some A4 & legal papers.
We thank UNDP for this generous contribution.
Based on an invitation extended by the Widener University Law School in the state of
Delaware, USA, and Potter Anderson & Corroon LLP, Madam Justice Jamesetta H. Wolokolie
and Mr. Justice Philip A.Z. Banks, III, attended the African Justice and Business Program from
August 24 27, 2015, while on vacation in the USA. The program afforded opportunity for
the Justices to interact and share experiences with members of the Delaware legislative and
judicial system and business community.
We have begun operationalizing the new jury law on a gradual basis. Counsellor George C.
Katapkah, former Stipendiary Magistrate and former Instructor at the James A. A. Pierre
Judicial Institute has been appointed National Jury Manager.
The rollout is now in Montserrado, Bomi and Margibi Counties. The program will subsequently
be extended to all judicial circuits in accordance with the Act Creating the National Jury Office.
We have employed six new public defenders and assigned them to various courts in
Montserrado County. Two of the public defenders are assigned to Criminal Court E to speed
up the trial of sexual offense cases, especially rape cases.
We note with serious concern that the crime of rape continues to be a menace to our society,
posing serious challenges to the dispensation of justice.
Conviction records show that girls as young as two years old have been assaulted and
brutally abused through this heinous and despicable act. While we recognize and will at
all times accord people accused of all crimes, including rape, the rights provided under the
law, especially the right of presumption of innocence until proven guilty, and the right to
be represented by counsel, no efforts will be spared in dealing with the situation. We have
therefore instructed that lapses in trial processes that impede speedy, fair and impartial trial
must be avoided. This is why we have assigned two public defenders at Criminal Court E
to expedite the trial of cases; and this is why we gracefully welcome the appointment of His
Honor Joseph S. Fayiah as the second judge at Criminal
Court C.
The Act establishing Criminal Court E provides for two judges to preside at that court,
but since its establishment, only one Judge has been appointed. The Act also establishes in
each county of the Republic of Liberia, a separate and special division of the circuit court to
be called Sexual Offences Division to handle sexual offence cases. However, due to lack of
infrastructural facility, only Criminal Court E in Montserrado County is currently operating
as a Sexual Offences Court. We are working in close partnership with the GOL/UN Joint

Program Initiative to Prevent and Respond to Sexual Gender Based Violence and Harmful
Traditional Practices to construct facilities in a number of judicial circuits to pave the way for
the appointment of judges to preside over sexual offence cases. Priority will be given to Bong,
Lofa, Nimba and Grand Bassa Counties from whence, according to records, large numbers
of sexual offence cases are reported. I should note at this juncture, that we are informed
that part of the problems hampering the speedy and effective prosecution of rape cases is
that some victims and their parents or relatives are compromising rape cases and refusing
to provide material evidence to establish the cause. Rape, being a crime, is committed
against the State and not against an individual, even though the individual is the victim of
the physical act. Only the State can decide whether or not to proceed with trial in a criminal
case. It is therefore utterly wrong for any victim or his/her parent or relative to compromise
the case. And refusing to provide essential evidence against the accused leaves room for the
wrongdoer to go with impunity.
The James A. A. Pierre Judicial Institute has concluded the recruitment of college graduates
for what is called the Professional Magistrate Training Program. Successful candidates will
undergo intense academic training for a period of twelve months followed by an on-thejob training for a period of one month during which the trainees will be assigned to sitting
Stipendiary Magistrates throughout the country to be tutored in magistrate court proceedings.
Sixty persons graduating under the program will serve as associate magistrates. The overall
target is to eventually train and deploy a total 300 associate magistrates throughout the
country as part of the reform process of the Judiciary. The Professional Magistrate Training
Program was first conducted in 2009, during which sixty associate magistrates were also
trained.
The program has been a huge success. Prolonged detention without trial remains a serious
challenge within the justice sector. We have advised and encouraged, and continue to advise
and encourage judges and magistrates to take full advantage of provisions under the law for
alternatives to incarceration and the need to promptly attend to court cases. We established,
in conjunction with the Ministry of Justice, the magistrate sitting program at the Monrovia
Central Prison in an attempt to curb or in the very least, minimize this perennial problem of
prolonged detention. The program requires magistrates, prosecutors and public defenders
to meet at the Prison on a scheduled basis, and review cases of detainees for speedy action.
For some time, especially during the Ebola crisis, significant progress was made, as pretrial
detention rate not only in the Monrovia Central Prison, but throughout the country, was
reduced to bare minimum.
However, according to recent report, the population of the Monrovia Central Prison has
increased with 84% of inmates therein constituting pretrial detainees.
This is alarming. Our law provides for the speedy trial of cases with priority given to criminal
cases. Where there is no evidence to proceed to trial, there are adequate provisions of law for
the release of the detained persons. This is done without prejudice to the State that prayed
for the issuance of the criminal writ.
Keeping the accused persons behind bars over the period allowed by statue without trial,
amounts to travesty of justice.
Report of the surge in the number of pretrial detainees necessitated my visit to the Monrovia
Central Prison on September 8, 2015, where I was met on arrival by the Minister of Justice/
Attorney General, Counsellor Benedict F. Sannoh. In the coming months, we will take more
concrete steps in addressing the problem of pretrial detainees.
Members of the Bar, distinguished ladies and gentlemen, on assuming leadership we pledged
that the Supreme Court, as head of the Judiciary, will not relent in taking appropriate
measures, even if such measures require stern disciplinary actions against key members of
the Judiciary. This is necessary to restore public confidence in our court system. We have done
this in the past and we will continue to do this as the need arises. Quite recently, in an opinion
delivered during the adjournment of the last term of this Court, we took action suspending
His Honor J. Vinton Holder, Judge of the Monthly and Probate Court for Montserrado County,
for the period of one year. The litany of wrong acts amounting to violation of the judicial
canons for which the punitive action was taken against the Judge is contained in the case:
Mustapha Fallah v. The Intestate Estate of Velma Gibson-Ajavon.
We have noticed and also received further reports that some judges and magistrates are
becoming very slack on duty. They report late for work in the morning and leave early. Some
are said to be teaching at higher institutions of learning during primetime when their courts
should be in session. This is wrong and amounts to conflict of interest. Judges involved in
such unwholesome acts should desist now or they will face penalty.
Rule #1, Circuit Court Rules as revised, provides:
The Circuit Courts shall meet regularly according to law, and the judges assigned shall be
in prompt attendance, unless prevented by sickness or such other inability over which they
have no control
Rule #3 provides:
On the first day of the opening of the [circuit] court in regular session and on Saturdays,
the Court shall meet at 10:00 am and on all other days at 8:00 am. The recess and day to day
adjournment of the court shall always be at the discretion of the presiding judge, he having
due regard for expediting as much work as possible within the working day
Judicial Canon #15 requires a judge to be prompt in the performance of his judicial duties,
recognizing that the time of litigants and lawyers is of value and habitual lack of punctuality
by the judge in his administration of the business of the court should not be condoned.
These rules, notwithstanding, the frequent tardiness of some judges lend credence to the
wrong and unfounded notion that the time is what the judge says it is. When a judge is not
punctual, he loses moral authority to administer penalty to lawyers and support staff who
may themselves report late at his/her court. When a judge is not punctual, work is stalled
and the docket remains crowded.
Every judge was a practicing lawyer. So, we all know that a lawyers time is ighly budgeted.
There is a saying that a lawyers time is his money. In this jurisdiction, it is not unusual for
a lawyer, on a typical work day, to present an argument for 45 minutes before the Monthly
and Probate Court of Montserrado County in a contested will matter starting at 9:00am;
participate in a trial involving aggravated assault for two hours at Criminal Court A, and still
attend to an action for summary proceedings to recover possession of real property before
the Magistrate Court in Kakata, Margibi County on the same day. But this tight but workable
schedule could be seriously disrupted, if for example, the probate matter starts at 11:00am
instead of 9:00am as scheduled, or if Criminal Court A does not keep to the scheduled time
of 10:00am.
A lawyer who is unable to attend his clients case having due notice thereof is required to
present a tangible reason for his failure to attend upon the cause, otherwise, there may be
dire consequences; the court may render default judgment against the client. Just as the

lawyer is expected to inform the court of his inability to be present in court, the judge, too,
should inform the lawyers and/or parties why he cannot be in court on the scheduled date
of a case. A judge may fall sick, he may be bereaved or his vehicle may break down while on
his way to the court. Certainly, these are compelling reasons why a judge could be late or not
be present in court. A simple telephone call to his clerk or other court officers could convey
the message. In this way, the lawyer can proceed to attend to other matters on his itinerary
for the day.
Members of the Bar, ladies and gentlemen, before closing this opening address, it is important
that I say something about the budget of the Judiciary. Over the years, beginning long before
and after the civil war in this nation and until now, the budget of the Judiciary has remained
very low compared to the other branches of Government. A budget is the sum of money
allocated to an institution for a given period to cover the running cost of that institution. For
our purpose a budget is the allocation made by the Legislature to the Judiciary for each fiscal
year. That sum of money in our view, ought to be directly proportional to the running cost of
the Judiciary. But this is not the case with the Judiciary.
The question we ask is, is the running cost of the Judiciary significantly lower than the other
branches of Government as the National Budget seems to reflect? We do not think so.
The Judiciary is a co-equal branch of the Liberian Government comprising the Supreme Court
and subordinate courts. There is a judicial circuit in all 15 counties. The First Judicial Circuit,
Criminal Assizes A in Montserrado County is divided into 5 parts: Criminal Courts A, B,
C, D and E. There are specialized courts: The Probate Court, Debt Court, Labor Court, Tax
Court, Juvenile Court, Traffic Court and Magistrate Courts all operating under the Judiciary.
And then there is the relatively new Commercial Court. As we have noted, the Act Creating
Criminal Court E also establishes in each county of the Republic of Liberia, a separate and
special division of the circuit court to handle sexual offence cases. The Judiciary is therefore
present in all parts of the country, especially through the magistrate courts. There are several
magisterial districts in a county, and new ones are being created by law from time to time as
the need arises to provide access to justice. I have highlighted the operational structure of the
Judiciary to accentuate the point that the activities in this Branch of Government are quite
enormous and the need to reform so critical such that appropriate budgetary allocations are
required.
I should acknowledge that since the inauguration of the administration of President Ellen
Johnson Sirleaf, the budget of the Judiciary has steadily increased, even though not at the
same pace and level of the other branches of Government.
Last year, the budget of the Judiciary was 19,000,576.00. For fiscal year 2015/2016 we
presented a budget of 26,687,889.00.The accompanying budget notes clearly explained
reasons for the increment. We had meetings with some key members of the Legislature,
followed by the appearance of the Court Administrator before the Budget Committee of the
Legislature during which justifications were provided that additional funds were required
to implement the amendment in the jury law and the law expanding the jurisdiction
of magistrate courts throughout the country. These laws were passed by the National
Legislature, approved by the President, and printed into Hand Bills on May 22, 2013. When
laws are amended, the amended provisions cease to exist and the new ones take immediate
effect upon being printed into Hand Bills. The new jury law states on its face that The
Central Office of Jury Management is an entity of the Judiciary, while the law expanding the
jurisdiction of the magistrate courts throughout the country require concrete actions on
the part of the Judiciary to ensure that it is implemented to the letter. The predicament the
Judiciary now faces as the implementer and end user of the new laws is that no funds were
allocated for implementation. This is why we requested the additional funds.
We further requested additional funds to increase the salaries/benefits of circuit and
specialized court judges. Circuit court judges are on the same ranking with deputy ministers;
since the Government had increased the salaries /benefits of deputy ministers, it was only
proper that the judges be included under the scheme to reflect uniformity in the decision of
Government regarding remuneration. These requests, we believe, are not unreasonable.
But surprisingly, not only were our requests for additional funds for the good and
sufficient reasons stated above not considered, but the budget of the Judiciary was actually
reduced. From US$19,000,576,000.00 provided in 2014/2015 budget year, we received
US$18,618,722.00 for fiscal year 2015. We are currently engaging the relevant authorities,
both in the Legislative and Executive Branches of Government, in an attempt to address this
serious situation.
We believe that it was in recognition of the difficulties experienced by the Judiciary over
the years due to the low budgetary allocations, coupled with the bureaucracies involved in
accessing even the meager funds allocated that the Legislature passed, in 2006, what is now
called the Financial Autonomy Act.
Section 1of the Act provides:
1.Judiciary Budget: The Supreme Court shall submit to the Bureau of the Budget annual
estimates of the expenditure and appropriations, supplies and services including personnel,
as well as funds necessary for the maintenance and operation of the courts and such
supplemental an deficiency estimates as may be required from time to time for the same
purpose, according to law. All such estimates shall be included in the National Budget
estimates without revision, but subject to any recommendation of the Bureau of the Budget
which may be included with the transmittal of the National Budget estimates from the
President to the Legislature for action thereon. The clear language of the Act is that the
budget of the Judiciary, as prepared and presented by the Judiciary should not be altered by
the Bureau of the Budget; it should be submitted to the National Legislature as received from
the Judiciary, with recommendation, if any, from the Bureau of the Budget, through the office
of the President of Liberia. It is only the National Legislature that can act in respect of the
budget of the Judiciary. Henceforth, we shall not hesitate to ensure strict compliance with the
Financial Autonomy Act of the Judiciary.
Members of the Bar, ladies and gentlemen, the Judiciary, as we have said time and time again,
is the cornerstone and foundation of a nation. It is the anchor that firmly holds democracy in
place with all its attending attributes. The Judiciary should therefore be strong, if the nation
and its democratic tenets must remain strong. This means that the Judiciary should receive
full and adequate support, primarily from the national Government. For what it is and what it
stands for, and in order to preserve its dignity and independence, the Judiciary cannot afford
to rely much on external assistance. A weak judiciary is a threat to peace and democracy. We
therefore implore policy makers to hear us now and grant full support to the Judiciary.

1. This expression of interest follows the general procurement notice that


appeared in the local newspaper and the Ministry of Health website www.
mohsw.lr.gov and the market beginning 30th, July 2015.

2. The Government of Liberia (GOL) through the Ministry of Health & Social
Welfare has received grant from the Government and the people of the
United States of America through the United States agency for international
development (USAID) towards the improvement of the Health Care and Social
Welfare Delivery System in Liberia. The Ministry of Health & Social Welfare
intends to apply part of the proceeds of these grants to payments under a
contract for the provision of the health services: comprehensive delivery of
evidence-based Essential Package Of Health Services (EPHS), including activities
for the reduction of maternal and newborn mortality, supported by innovative
Performance-Based Financing schemes as a health systems approach in Bong,
Lofa and Nimba Counties beginning 1st, January 2016.
3. To implement these services, the Ministry of Health & Social Welfare
(MOHSW) now invites interested and qualified non-governmental, faith-based
and other civil society organizations with proven records and backgrounds
of providing Healthcare in post conflict Countries, especially those with
long-standing records of effective implementation of health care services in
Liberia for a performance-based contract to indicate their interest in support
of the Essential Package Of Health Services (EPHS) and the roadmap for the
acceleration of the reduction of maternal and newborn mortality rates.
4. The duration of the contract will be twelve (12) months with a possible
extension.

5. Qualification and short listing criteria: Firms will be listed based on core
business, experience in the services/assignment as required, experience working
in Liberia and countries of similar context as Liberia, --technical and managerial
organization of the firm, clearly articulated collaborative approach for working
with NGOs and CHT at county, and district level, as well as general qualifications
and number of key staff.
6. Selection for contract award shall be in accordance with Quality Cost Based
Selection (QCBS) procedures as spelled out in the 2010 Amended Restated
Public Procurement Act of the Republic of Liberia.

RADIO GBARPOLU OFF AIR DESPITE $70 K ALLOTMENT

a priority.
There was no existing medium
to communicate with locals
in Gbarpolu as the only radio
station has been off. Sensing
the urgency, the county allotted
over 70,000USD to revamp the
station.
Despite the need for creating
awareness and the money
allotted, the radio station
in Gbarpolu is yet to blare
the airwaves but the county
authority has argued that
money allotted has not been
squandered.
That money is still in the
Central Bank of Liberias
coffers and no one should think
that it was stolen or eaten by
anyone, Superintendent Sanor
said.
The station appears to be
abandoned with the grass
overgrown in its vicinity and
the premises engulfed with an
offensive odor.
The radio compound is
virtually being used for open
defecation by passersby.
The story of accountability
since the end of the Ebola crisis
by both the government and
local and international nongovernmental organizations is
now becoming the same.
Many of these institutions are
finding it difficult to account
for funds and supplies received
during the Ebola crisis.
The story about the radio
station in Gbarpolu is not
unique to the county alone.
Accounting
for
vehicles
received during the fight
against virus been a nightmare.

in the fight against the virus
cannot be located.
Ministries and Agencies are
unable to account for vehicles
given them for the fight against
Ebola, Director Broh said.
She said that there exist a
discrepancy between the
recorded number of vehicles by
GSA and the report submitted
by the Internal Audit Agency
based on findings from its
recent audit.
An audit of the expenditures of
Ebola funding by the General
Auditing
Commission
of
Liberia pointed out violations
of existing laws, regulations
and other procedures by the
management team of the
funds but President Ellen
Johnson Sirleaf defended her
officials when she declared
that the situation at hand
was emergency and therefore
decisions were made in the
context of protecting lives.
In August 20, 2014, authorities
of Gbarpolu County requested a
total amount of US$127,650.00
from the County Development
Fund (CDF). Out of this
amount, US$57,600 was to buy
an ambulance, while a radio
transmitter with accessories
was to cost US$70,050 for
Radio Gbarpolu.
The
Gbarpolu
County
Legislative caucus in their
resolution
noted
that
Gbarpolu County, as a political
subdivision, was no exception
to the fight against Ebola,
whereas the fight became a
global issue, and Liberia at the
time became an epic center.
But to date, there is no concrete
evidence of the equipment
being bought and installed and
the station coming back on air.
Investigation
conducted
during recent visit shows that
only an ambulance was paid
for and the radio transmitter is

yet to be procured.
It can be recalled that Radio
Gbarpolu was shut down
three years before the
Ebola outbreak, when some
unknown criminals reportedly
made away with the stations
transmitter and other studio
equipment.
The hopes of the locals
in that remote part of the
country were raised, when
officials
announced
that
over
US$70,000.00
was
appropriated for the only
public radio in Gbarpolu to
combat the deadly EVD, which
killed 4,800 people in Liberia
before the outbreak could end
earlier 2015.
However, the reopening of this
radio hangs in the balance,
as condition remains the
same, with citizens crying for
something urgent to be done.
So far lawmakers of Gbarpolu
County
have
remained
tightlipped about the fate of
the local radio, despite the
countys huge investment in it.
When contacted, Gbarpolu
County Superintendent Armah
M. Sarnor admitted that in
August 2014 the authorities
of Gbarpolu County requested
the amount of US$70,050
from the Gbarpolu County
Development Fund for the
purchase of a radio transmitter
with accessories for the county.
The resolution authorizing the
purchase was signed August
2014 by five lawmakers of the
county, which includes Sen.
Armah Jallah Pro-Tempore of
the Liberian Senate, Rep. Malai
Gbogar, Sen. J.S.B. Theodore
Momo Jr,
Rep. Alfred G.
Koiwood and Rep. Gertrude T.
Lamin.

is still being procured by
the Public Procurement and
Concessions
Commission
(PPCC).

procurement, we did it with
advertisement. Bidders sent
in their bids and that again
was turned down by the PPCC
on technical grounds, Sarnor
said.
Some citizens are not convinced
about such explanations and
they have spoken out against
the county authorities failure
to revamp the radio.
Responding to claims made
by some angry citizens that
the money allotted for the
radio station has been eaten
by the county authority, he
said, We want at the end of
the day, everybody involved in
the process hands should be
clean and we want to follow
the procurement process up
to the letter, the Gbapolu
Superintendent said.

The
Public
Procurement
Commission and Concession
(PPCC) head, Dorbor Jallah
confirmed that the PPCC was
in the process of reviewing
the procurement plan to
buy a radio transmitter and
accessories for the county.
If there are issues during the
review process, we will refer
the plan back to them for
approval. The reason why the
revision process has delayed
is that they submitted the
procurement plan without
proof of the availability of
funding. The county authority
needs to have proof that
the money is available to
purchase the transmitter and
radio accessories, the PPCC
Executive Director said.
Said Jallah: Sometimes these
entities take a very long time
to respond to our inquiry when
reviewing their procurement
plan. When we shall have
finished with it and submit
our decision to them, then
that decision becomes public.
Under the law, we are not
supposed to allow any entity
commit government into a
procurement contract unless
we see evidence that money is
available, Jallah added.
Officials have done little to
dampen the criticisms and
frustrations of locals over
the continuous silence of the
Gbapolu community radio.

I feel very bad seeing our
only radio station off the air
and we do not know what
has happened to the seventy
thousand and fifty US dollars,
Alifia said.
Since the county sitting,
nobody from the county
leadership one day inform
citizens that the equipment
for the radio station has been
procured or not, Alifia said.
He called on the countys
officials to try their best and
reopen the radio station.
Momo Madawa 45 said, the
prolonged closure of the radio
station is creating a gap in the
flow of information between
the locals and the county
authority.
Well, according to information
that I have, some unknown
criminal broke into the station
and may away with the
station transmitter and other
equipment from that time to
present the radio station had
being off.
This is creating a big
information gap for people
here because we no longer hear
from the County mouthpiece
anymore, Alifia added.

II. Background
The Environmental Protection Agency of Liberia (EPA) was established under the
Executive Branch of Government, an autonomous body by an Act of the National
Legislature in 2003; for monitoring, coordinating and supervisory authority for
the sustainable management of the environment in partnership with regulated
Ministries and organizations and in a close and responsive relationship with the
people of Liberia; and to provide high quality information and advice on the state
of the environment and for matters connected therewith.
The Agency shall be the principal authority in Liberia for the management of the
environment and shall co-ordinate, monitor, supervise and consult with relevant
stakeholders on all activities in the protection of the environment and sustainable
use of natural resources.
The Constitution of the Republic of Liberia provides for full public participation
of all citizens in the protection and management of the environment and natural
resources of Liberia, and the Constitution also guarantees every person in Liberia
the right to life, and by extension, the right to a clean and healthy environment that
supports that life. Liberia is committed to the pursuance of social and economic
development but without undermining the ecosystems renewal and re-supply
process that is the underpinning of such development.
III. Summary of Work
The main responsibility of the Deputy Executive Director is to assist the Executive
Director (ED) and Chief Executive Officer (CEO) of the Environmental Protection
Agency to run the day-to-day activities of the Agency. The DED shall provide technical
and administrative oversight to the EPA with focus on the administrative system;
accounting and internal financial control; budgeting; public awareness; provision
of access to environmental information and records; training; planning and
policy development. The DED will also investigating environmental degradation,
pollution, disruption; determination of compliance with environmental standards;
facilitating the development of state of the environment report; administration of
environmental and social impact assessment, monitoring and audit.
IV. Specific Duties and Responsibilities
Provide oversight and supervision for all departments within the EPA to
include: Compliance and Enforcement, Intersectoral Coordination, Planning
and Policy Multilateral Environmental Agreements, Administration, Finance and
Implementation of Projects;
Provide oversight and guidance in fiscal controls, administrative operations and
monitoring
Provide oversight and guidance to develop internal control systems on financial
transactions to ensure compliance with national and international finance,
budgeting, accounting and auditing rules and regulations;
Provide guidance for effective and sustained inter-sectoral collaboration
between EPA and stakeholder institutions;
Explore the potential for private sector and communities partnership and
participation in environmental management;
Provide oversight and guidance to develop strategies for the promotion of cross
sectoral collaboration including poverty reduction, governance, gender, and
capacity development;
Promote public understanding of Liberias priority environmental and natural
resources issues, and potential solutions;
Ensure provision of technical environmental information to sector institutions;
Provide oversight and guidance to develop programs and actions for rapid
response environmental disasters.
Provide oversight and guidance to design and develop appropriate methodologies
for scientific environmental data collection and analyses;
Provide oversight and guidance to the development of standards, criteria and
guidelines for environmental management;

Provide oversight and guidance to devise modalities for the effective


documentation of cases of compliance and non compliance to environmental
legislations, sanctions and standards;
Provide oversight and guidance to develop programs and plans for achieving a
broader conservation objective;
Provide oversight and guidance to coordinate project development on the
ground in collaboration with strategic partner(s), Contractors, and Safety
Officials to assure environmental protection agency standards are adhered to in
the areas of sustainable development, infrastructure development and positive
environmental impact. i.e., recycling, remediation, sample analysis, renewable
energy, pest control management, etc;

V. Educational Qualifications and Experience


Must have at least a Masters Degree Environmental Science, Environmental
management, Environmental Law, Climate Change, Natural Resources
Management, Development Planning, Public Policy and Regional Planning, among
others, an advanced degree in the above areas of study will be of an advantage, but
with consistent professional specialization in environmental management.
At least ten (10) years of working experience at the national or international level
providing organizational development, monitoring and evaluation of programs in
Environmental management;
Experience in change management, capacity development evaluation and
appraisal
Experience in conducting research, assessments, and analyses, with strong
abilities in quantitative and qualitative analysis;
Ability to work independently and take initiative; and
Ability to mobilize a team and oversee the quality and timeliness of task
completion; and Experience in working in a post-conflict environment.

has returned to Liberia on a 2-week assessment visit
and to provide Training in Development, Capacity
Building and Sustainability.
Mr. Tietze who was instrumental in the establishment of the
Lutheran Development Service (LDS) in Liberia before his
departure at the close of 2001 has described his return visit as
his continuous interest in Liberia and its people.
Speaking to the Press in Bong, as part of an Assessment visit
to Margibi and Bong Counties, the former LWS/WF Boss
challenged Liberians to join the Liberian government and
partners in development efforts.
Mr. Tietze called on Liberians to prioritize Sustainable
Development in the areas of agriculture, water and sanitation.
He said the essence of his visit is in one way to see things
he planted and to meet the Liberian people again, especially
seeing them as happy people living at the time where there is
peace and hope for the future.
Mr. Tietze said another part of his visit is to contribute with the
experience that he has in development work, with emphasis in
Sustainable Development, making sure that the land is used in
a sustainable way.
He spoke of the importance of sustainable soil management,
sustainable and integrated farming, and to continue improving
the fertility of the soil so that it can remain productive for
future generations.
According to him, Sustainable Development is only sustainable
if the land is used now and can still be useful in the future for
farming activities.
Mr. Tietze said he is impressed by what he has seen, because
according to him, the Lutheran Development Service (LDS) in
Liberia has grown beyond what he expected.
He however said he was not surprised because LDS also has
former staff of the Lutheran World Service/World Service who
have brought lots of drive and ownership of development with
professionalism and commitment.
He cautioned Liberians, especially rural dwellers to embark
on self-help initiatives to always sustain projects implemented
by government and development partners.
Also speaking, the Executive Director of the Lutheran
Development Service in Liberia, Joseph S. Binda said the
visit of Mr. Tietze is to help improve on the works of LDS to
continue serving Liberia in development activities.
Mr. Binda said the former LWS/WF Resident Representative
will begin a 4-Day Sustainability Workshop for the Lutheran
Development Service and the Lutheran Church in Liberia from
Monday to Thursday, October 12-15, 2015.
He said Mr. Tietze served Lutheran World Service/World
Federation in Liberia from 1997-2001, and was the forerunner
for the establishment of the Lutheran Development Service
in Liberia, an Organization that continues to make impart in
Liberia since 2002.
Mr. Binda said they are happy to have Mr. Tietze back in Liberia
after 14 years, and to share his expertise and experience with
LDS and the Lutheran Church in Liberia.
The LDS Boss has meanwhile reiterated his Organization's
commitment in fostering Liberia's post conflict growth and

fire incident that took place at its main yard in Bomi
County on September 20th.
SDPL has indicated that it values the input of the investigating

seriously consider recommendations from the investigating

It was established that the fire was caused by electrical sources

The company said out of the 10 workers and contractors who

acknowledged our efforts in providing workers, students
and residents in the vicinity with nose masks right after the
incident. In addition, SDPL had also provided clean water and
frozen fish for the local residents and purchased new rice
stock to replace the existing stock to eliminate any health risk
to the recipients.
The company continued To further assess the impact of the
incident and to make sure there was no harmful effect to the
residents, we have commissioned a third party environmental
consultant to undertake soil, water and air assessments of
the surrounding area. SDPL will also carry out a sensitization
program for workers and nearby residents to update them on
the situation.
The chemical store located in the Main Yard Complex of the
Bomi Estate caught fire at 10:20 AM on Sunday, September
20th. Thanks to the efforts of the dedicated staff and the
Liberian Fire Service Department, the fire was put out three
hours later at 13:30 PM.

TRAINING FOR 19 GIRLS

Monroviairls at young age, 15 and even below continue to get


pregnant with some without partner before reaching
the age of 18.
Social workers have blamed the rise in teenage
pregnancy in the country largely to lack of family planning.
In the wake of the increase in teenage pregnancy and in a bid
to discourage it a total of 19 girls some from various higher
institutions of learning in the country Saturday took part in a
training in family planning offered by the Gbowee Foundation
in collaboration with the SEGAL Family Foundation.
The training known as the 2nd Annual SEGAL Ambassadors
for family planning (SAFP) training workshop was held
Saturday at the Golden Gate Hotel on the edifice of the Samuel
Kanyon Doe Sports Stadium.

During the training the girls were taught basic topics including
feminism, bodily integrity, envisioning your future and
planning your campaign.
The girls who were placed in various groups during the
training were given the opportunity to make a presentation
through a group leader from a designated topic that was
covered during the training.
One of the presenters Sara Buchanan a social worker by
profession told the girls under the topics envisioning your
future to have passion for whatever work that have come in
their way in life be it small or big.
Girls you have to get passion for whatever job you have
chosen to do whether small or big and you should do it with
integrity said Madam Buchanan.
The Executive Board Chairman Cllr. Deweh Gray of the Gbowee
Foundation of Nobel Peace Laureate Leymah Gbowee stated
that the idea behind the training is to teach those girls safe sex
and also know their own value so that they cannot be abused.
Cllr. Deweh continued that the training of the girls is intended
to discourage teenage pregnancy.
We all need safe life, go out and be good ambassadors, we,
dont want any of you to fall by the way side said Cllr. Gray
when she presented certificates of participation to each of the
girls.
Patience T. Dobson, a leader of one of the groups of Health
Science at the Catholic run Stella Maris Polytechnic stated that
she was very delighted to have gone through the training that
taught her how to plan family.
Madam Dobson who lauded the Gbowee Foundation for the
training stated that during the training she was taught the
importance of safe sex and as a women what is needed to be
done to maintain your value.
I learned lots of good things on family planning which I am
going to spread the message to my school and community in
the time to come, she said.
Another girl who identified herself as Ma Hawa Ngina also
stated that the training taught her how to control sexual habit
as a child bearing mother.
This training taught me lots of good things toward safe sex
and as a woman how many children you want to bear said Ma
Hawa Ngina.
According to the organizer of the training the 19 girls will be
moving into the various communities soon to teach other girls
the importance of family planning.

the guards motivation, the nature of the injury sustained
by the prisoner, and whether the guards action constituted
cruelty aimed at the prisoner.

create a better learning environment for the exchange of good
ideas on the issue of peace and security in Liberia,

WALTER PALMER, SAYS ZIMBABWE

after killing a lion in Zimbabwe will not be prosecuted
because he had obtained the legal authority to hunt,
officials say.
Walter Palmer admitted to killing Cecil the lion in July but has
always denied that he acted illegally.
Zimbabwe's Environment Minister Oppah Muchinguri said he
could not be charged as all his "papers were in order".
Mrs Muchinguri said Zimbabwe would now review how it
issues hunting licences.
The environment minister had previously called for Mr Palmer
to be extradited and face prosecution. However, it appears that
Mr Palmer broke no laws when he killed the lion using a bow
and arrow.
"We approached the police and then the Prosecutor General,
and it turned out that [Walter] Palmer came to Zimbabwe
because all the papers were in order," Mrs Muchinguru said.
Meanwhile the trial against Mr Palmer's Zimbabwean guide,
Theo Bronkhurst, is due to continue on Thursday.
Mr Bronkhurst denies the charge of "failing to prevent an illegal
hunt".

Speaking publicly for the first time about the incident last
month, he told the Associated Press and Minneapolis Star
Tribune that if he had known who the animal was he would not
have killed it.
"If I had known this lion had a name and was important to
the country or a study obviously I wouldn't have taken it," Mr
Palmer said. "Nobody in our hunting party knew before or after
the name of this lion."
Mr Palmer also revealed that his wife and daughter had faced
intimidation.

GUINEA' CELLOU DIALLO DEMANDS


PRESIDENTIAL ELECTION RE-RUN

uinea's opposition is calling for a re-run of Sunday's


presidential election even before the votes have been
counted.
It alleged widespread fraud, including ballot boxes
being stuffed and some 400 polling stations staying closed.
This is the country's second democratic presidential election
since it gained independence from France in 1958.
Several people were killed in clashes during the election
campaign.
The main opposition leader, Cellou Dalein Diallo, said they will
not accept the results, they will not give in and that they will
protest.
He was speaking at a press conference attended by the six other
candidates challenging incumbent President Alpha Conde, who
was standing for a second term.
Mr Conde became president in 2010 in the country's first
democratic election after decades of fighting authoritarian
regimes, during which he was sent into exile and prison.
He defeated Mr Diallo in a run-off.
The electoral commission says the results won't be announced
until the end of this week.

rebels in Syria.

soon may be Russian troops

Ukraine.
Along with the airstrikes,

Russia is firing its most


sophisticated cruise missiles
from warships in the Caspian
Sea a thousand miles away
and targets not ISIS as it
claims, but the U.S.-backed
anti-Bashar al-Assad rebels
in Syria.
The analyst also reminds that
there have been reports from
Turkey, a NATO member,
about Russia starting to
violate Turkish airspace.

if Russias intervention in
Syria accomplished nothing
more than propping up the
murderous regime of Assad,
which has killed more than a
quarter-million Syrians and

bans while corruption claims
