GENERAL INFORMATION AND INSTRUCTIONS: Minnesota Statute 122A.25 permits the Board of Teaching to allow
school districts and charter schools to hire nonlicensed community experts to teach on a limited basis . THIS REQUEST
MUST BE APPROVED BY THE BOARD OF TEACHING PRIOR TO THE INDIVIDUAL BEGINS TO TEACH. By issuing
this, the Board takes no position on whether this individual meets the states definition of highly qualified. Meeting the
requirement for highly qualified is a separate issue and must be determined according to MDE guidelines. Also, the
permission is only valid in the school district that requested the Nonlicensed Community Expert.

applications will not be processed and will not go to the Board.

The Board of Teaching is authorized to grant Nonlicensed Community Expert permissions under MS 122A.25. In the interest of
maintaining the integrity of the statute, applications that meet one or more of the following criteria will receive increased scrutiny from the
Board of Teaching:
Renewal applications
Applications for core content areas, special education, or elementary positions
Applications for full-time positions
Applications indicating the individual is not working towards licensure (unless no correlating licensure field exists)

A NONLICENSED COMMUNITY EXPERT GUIDELINES
Minnesota Laws permit the Board of Teaching to allow school districts and charter schools to hire non-licensed community experts to
teach on a limited basis. THIS REQUEST MUST BE APPROVED BY THE BOARD OF TEACHING PRIOR TO THE
INDIVIDUALS BEGINNING TO TEACH. The form may be mailed, e-mailed, or faxed to the Minnesota Board of Teaching.
122A.25 Nonlicensed community experts; variance.
Subd. 2. Applications; criteria. The school district or charter school shall apply to the board of
teaching for approval to hire non-licensed teaching personnel from the community. In
approving or disapproving the application for each community expert, the board shall
consider:
(1) the qualifications of the community person whom the district or charter school proposes to
employ;
(2) the reasons for the need for a variance from the teacher licensure requirements;
(3) the district's efforts to obtain licensed teachers, who are acceptable to the school board, for the
particular course or subject area or the charter school's efforts to obtain licensed teachers for the
particular course or subject area;
(4) the amount of teaching time for which the community expert would be hired;
(5) the extent to which the district or charter school is utilizing other non-licensed community
experts under this section;
(6) the nature of the community expert's proposed teaching responsibility; and
(7) the proposed level of compensation to the community expert.

Attach a resum of the individual the district or charter school proposes to hire as a non-licensed community expert. Include
transcripts and recommendations that attest to the individual's expertise.

2.

Attach a detailed explanation of the professional duties the non-licensed community expert is proposed
to assume, including, when available, a position description.

3.

Attach a description of the school's efforts to obtain a fully licensed teacher for this position. Include:
What reasonable efforts been made to assign an existing licensed teacher to fill the position
The exact dates you advertised and where the advertisement appeared. If websites were used, please use at least one of
the following at a minimum: MASA, EdPost, Teacher-Teacher.com, MN Teacher Recruitment Center

4.

Attach a letter of explanation, signed by the school's hiring authority, of why the district or charter school believes this individual
to be highly qualified to fill this position.

Attach an explanation of the support, staff development, mentoring, and/or supervision to be provided to assist the non-licensed
community expert's successful fulfillment of the proposed professional duties.

6.

If, for any reason, this individual is needed to begin this assignment before the next regularly scheduled Board of Teaching
meeting, attach an explanation of the situation.
