As you have not responded to either communication, you leave us no choice but to proceed in this fashion, Your repeated claims that our Board now conducts business with greater openness, inclusivity, and transparency ring hollow because you regularly operate ina disturbingly secretive and non-inclusive manner, Now we learn that settlement terms in the McCord/Corman/NCAA litigation have been proposed by Penn State to the NCAA. Given your apparent unwillingness to respond to Trustee Lubrano, we must presume that you and quite possibly other November 2011 trustees and certain handpicked successors are aware of this proposal However, much like your decision (along with then Chair Peetz) to exclude the full board from the discussion of the terms of the Consent Decree prior to its execution, you appear to have once again decided to exclude the full board, Therefore, we ask you to share the terms of that proposal with the entire board of trustees--immediately. We do not know its terms but are naturally skeptical of a proposal designed by only those trustees complicit in the travesties of 2011, 2012 and 2013. As Chair and Vice Chair during tiese periods, you should be particularly mindful of the real 1 and perceived conflict potential your leadership decisions have. Though we ‘empathize with the challenges Jerry Sandusky's actions posed to you and other University leaders three years ago, the poor decisions made during those difficult times do not excuse today's behavior. Keith, you have led your unelected majority to put the University into an adversarial position wich the Commonwealth of Pennsvivanta and with the Paterno family. How much farther down this ill-advised road will you go? ‘Again, in keeping with your (and former Chair Peetz) promise of openness and transparency, please share the terms of the proposal that have been submitted to the negotiating parties Respectfully Submitted, fim Litid Albert.
