Respondents (drivers, conductors, mechanics) charged petitioners with illegal

dismissal, unfair labor practice, and illegal deductions. Respondents alleged that
their commissions were reduced from 8-10% to 7-9%, so they held a series of
meetings, prompting petitioner to suspect that they were about to form a union. To
block the continued formation of the union, petitioner cause the transfer of all union
members and sympathizers to one of its sub-companies. (Lubas) Despite the
transfer, their schedule, IDs, DTR, etc were issued by petitioner. Lubans business
deteriorated due to petitioners refusal to maintain and repair Lubans units. This
resulted in the virtual stoppage of its operations and respondents loss of
employment.
