swenomenr verve) EL DECLARATION OF Dooi: 0604018064 Fee: $42.50 COVENANTS AND Geek county ews Dens RESTRICTIONS FOR ALPINE Date: 02/022008 1202 PM Pee 1 of 10 HEIGHTS HOMEOWNERS ASSOCIATION For Recorders Use Only This document is recorded for the purpose of amending the Declaration, (hereinafter the “*Declaration"), for the ALPINE HEIGHTS HOMEOWNERS ASSOCIATION, (hereinafter the ‘Association"), which Declaration was originally recorded in the office of the Recorder of Deeds of Cook County, Illinois as document number 90599618 and amended as document number 91226110, and covers the property (hereinafter the “Property") legally described in Exhibit A, which is attached hereto and made a part hereof. WHEREAS, pursuant to the Declaration, the Board of Directors of the Association is responsible for the overall administration and operation of the Association; and WHEREAS, the Declaration was intended to be recorded against all of the lots within the Alpine Heights Subdivision as legally described in Exhibit A to the Declaration; and WHEREAS, it has come to the Board's attention that the Declarant made errors in listing the parcels and PINS against which the Declaration was to the recorded; and This instrument prepared by and after recording return to: WHEREAS, the Association is a common interest community pursuant to Section 18.5 of the Matthew L. Moodhe, Esq Kovitz Shin Nesbit 750 Lake Cook Road, Suite 350 Buffalo Grove, ints 60089 Phone: (847) 837-0500 33965511 llinois Condominium Property Act (hereinafter the “Act"); and WHEREAS, Section 18.58(h) of the Act authorizes the Association to correct any errors or omissions by amending the Deciaration or other instrument upon the vote of two-thirds (2/3rds) of the Board of Directors; and WHEREAS, an Affidavit signed by an officer of the Association is attached hereto as Exhibit B certifying that the Amendment has been approved by the affirmative vote of at least two-thirds (2/3rds) of the Board of Directors, as evidenced by the Affidavit and attached hereto NOW, THEREFORE, the Association hereby records the Second Amendment to the Covenants and Restrictions for the ALPINE HEIGHTS HOMEOWNERS ASSOCIATION against all of the lots included within the Alpine Heights Subdivision and as legally described in the original Declaration and as listed in the attached Exhibit A This Amendment shall become effective upon recording in the Office of the Recorder of Deeds of Cook County, Illinois.
