JOINT REPLY COMMENT OF THE MINNESOTA LARGE INDUSTRIAL GROUP AND MINNESOTA CHAMBER OF COMMERCE
The Minnesota Large Industrial Group (MLIG)1 and Minnesota Chamber of Commerce (Chamber)2 (collectively, Joint Business Intervenors, or JBI), submit the following brief comment. I.
INTRODUCTION
On October 25, 2011, utilities submitted reports in compliance with section 216B.1691 subd. 2e of the Minnesota Statutes.3 The Minnesota Public Utilities Commission (the
Commission) never formally established a comment period for interested stakeholders to offer input on the utilities reports. In any event, JBI submitted a comment on October 1, 2012, requesting additional analysis be undertaken to fully comply with Minnesota law.
MLIG is a consortium of large industrial customers in the State of Minnesota spanning several utilities and consuming more than 5 billion kWh of electricity each year. 2 The Chamber represents over 2,400 business locations throughout the state of Minnesota. As the voice of Minnesota businesses on statewide policy issues, the Chambers main goal is to make Minnesotas business environment competitive relative to other states and nations. Energy is a critical component to a successful business environment. Therefore, a focal point of the Chambers policy is ensuring Minnesota has reliable and competitively priced energy rates. 3 See In the Matter of Utility Renewable Energy Cost Impact Reports Required by Minnesota Statutes Section 216B.1691, Subd. 2e, Commission Docket No. E-999/CI-11-852 (RES Impact Analysis Docket).

Commission has yet to hold a hearing to address JBIs request. On January 24, 2013, the Commission issued a notice of comment on the biennial renewable compliance reporting process.4 One of the topics open for comment is the biennial renewable compliance process. JBI submits the following reply comment to propose using that process to address the cost utilities have incurred in meeting the renewable energy standard (RES). II. Minnesota law requires: Each electric utility must submit to the commission and the legislative committees with primary jurisdiction over energy policy a report containing an estimation of the rate impact of activities of the electric utility necessary to comply with [RES]. The rate impact estimate must be for wholesale rates and, if the electric utility makes retail sales, the estimate shall also be for the impact on the electric utility's retail rates. Those activities include, without limitation, energy purchases, generation facility acquisition and construction, and transmission improvements. An initial report must be submitted within 150 days of May 28, 2011. After the initial report, a report must be updated and submitted as part of each integrated resource plan or plan modification filed by the electric utility under section 216B.2422.5 The very next section requires each electric utility to report on its plans, activities, and progress with regard to the objectives and standards of this section in its filings under 216B.2422 or in a separate report submitted to the commission every two years, whichever is more frequent, demonstrating to the commission the utilitys effort to comply with this section.6 JBI believes these two subdivisions, read in conjunction with the remainder of the RES statute, provide the Commission with the flexibility to incorporate the RES cost impact analysis in the REO/RES Docket.

In its October 1, 2012, comment, JBI respectfully requested the utilities to structure the statutorily required RES impact analysis as follows:7 Increasing amounts of wind resources in a utilitys generation portfolio has the inevitable impact of introducing more volatility and risk, which needs to be discussed and monetized in the utilities reply comments to more realistically estimate the impact of activities to meet RES; With respect to the historical analysis, utilities should calculate actual costs by comparing the savings from the wholesale market (derived by summing the product of hourly output and hourly market prices) against amounts recovered for activities to comply with RES (e.g., amounts are recovered in the RES rider and transmission cost recovery rider, as well as cycling costs included in O&M for existing resources); With respect to the future analysis, utilities should address the limitations of the current modeling software via the following analyses: o Use alternative models that include power flow as a supplement to address the issue of curtailment and capture costs of additional transmission infrastructure; o Use chronological models to accommodate wind variability more accurately and conduct sensitivity analysis to identify the variance of wind generation; o Exclude unrealistic assumptions, such as a non-existent carbon price adder, from any model; and o Monetize fuel price variability risk. We believe these suggestions would introduce transparency and consistency in the utilities reports, both of which are presently lacking. Absent Commission review and utility action on

JBIs requests, the utilities analysis will remain insufficient and fail to inform ratepayers, the Commission, and the Minnesota legislature of the total cost utilities have incurred to meet RES. It bears emphasis that JBIs analysis demonstrated that ratepayers of one utility have paid an annual premium of more than $5.7 million for just one renewable resource. If the Commission believes it would be more appropriate to address this critical issue in the REO/RES Docket, it could make that clarification now for inclusion in the utilities filings due June 1, 2013.8 Alternatively, the Commission could resolve the issue in the RES Impact analysis docket in the near future and direct updates in the biennial reports due June 1, 2014. Doing so would be consistent with the general intent of subdivision 3 of section 216B.1691 of the Minnesota Statutes. There, utilities are required to include in their reports a discussion of any obstacles encountered or anticipated in meeting RES.9 Cost could be such an obstacle, which is the focus of the RES Impact Analysis Docket and is listed as the first justification for modifying or delaying RES in another part of the RES statute.10 Other obstacles may include some of those listed above by JBI wind variability, price variability, etc. In either case, combining review could streamline the reporting process on two very related issues compliance with RES and the cost of complying with RES. So although the RES impact analysis is technically limited to occur during resource planning, JBI believes it would be reasonable (and probably more efficient from an administrative perspective) for the Commission to read the RES statute as a whole to allow the RES impact analysis to be addressed in the REO/RES Docket. Should the Commission disagree, JBI respectfully requests the Commission address the concerns raised by JBI in its
