ASILO of legal age, a widower and resident of South San Juan Village, Barangay Centro Agdao, Davao City after having sworn in accordance with law, do hereby depose and state THAT: 1. I am not aware of the alleged contract between ROGELIO VELEZ and my deceased spouse DONATILA S. ASILO for the alleged sale of our lot located at Block 1 Lot 8 South San Juan Village, Brgy. Centro, Agdao Davao City; I am not aware of the demolition of my building and the construction of the new one; I just read and discovered the alleged deed of sale (attached herein as annex A) when the same was exhibited by ROGELIO VELEZ, MARY GRACE BANDONEL and FE LOURDES BANDONEL during the barangay conciliation process last February 23, 2013 ; I found the said document as simulated, contrary to law and executed with fraud; During the conciliation process, ROGELIO VELEZ stated that the alleged agreement was temporarily made only between him and my deceased spouse (evidenced by a transcript of conciliation process with the punong barangay attached herein as ANNEX B); I had executed a waiver of my legitime and conjugal rights of the above mentioned real property with a special power of attorney (attached herein as ANNEX C) to my daughter, ANABELLE S. ASILO-DELUTE;
