FINAL DEMAND FOR PAYMENT AND NOTICE OF DISHONOR

This has reference to EastWest Tacloban Branch Check No. 0337545 dated 1 February 2009 amounting to ONE HUNDRED FIFTY THOUSAND PESOS (P150,000.00) which you issued to the order of JOSE BACSAL for a consideration. Unfortunately, when JOSE BACSAL deposited said check with PHILIPPINE NATIONAL BANK on 2 MARCH 2009, said check was dishonored for reason of ACCOUNT CLOSED. Soon thereafter Mr. Bacsal made several personal oral demands to you, informing you first about the dishonor of said check and then demanding from you the replacement of said check with its cash equivalent. Despite your repeated promises to pay him in a months time, you have failed and still refuse to comply with said oral demands up to the present, to the damage and prejudice of Mr. Bacsal and in violation of the provisions of Batas Pambansa Blg. 22. FINAL DEMAND is hereby made on you to redeem the aforesaid bounced check from us, within five(5) banking days from your receipt of this letter, otherwise we will be constrained to file the necessary criminal case of violation of BP 22 (bouncing checks law) against you in court. Please spare us the trouble of collecting the said amount thru the court of law.
